/ —चूँकि राज्य सरकार की राय है कि जाँच अधिनियम, 1952 (सं0-60, 1952) की धारा 3(1) द्वारा प्रदत्त शक्तियों के आलोक में दिनांक-17 जून, 2026 को भोजपुर जिला के शाहपुर थानान्तर्गत बिलौटी ग्राम में हुई पुलिस कार्रवाई की घटना की जाँच के लिए एक न्यायिक जाँच आयोग का गठन आवश्यक है;

अतः बिहार के राज्यपाल एकल सदस्यीय न्यायिक जाँच आयोग का गठन करते हैं, जिसके अध्यक्ष माननीय न्यायमूर्ति श्री विनोद कुमार सिन्हा, सेवानिवृत्त न्यायाधीश, पटना उच्च न्यायालय होंगे।

आयोग के विचारणीय बिन्दु निम्नलिखित होंगे :-

I. घटना की पृष्ठभूमि, घटनाक्रम और उन प्रत्यक्ष एवं परोक्ष परिस्थितियों की जाँच करना जिसके कारण उक्त घटना हुई;

II. दिनांक-17.06.2026 को भोजपुर जिला के शाहपुर थाना अंतर्गत बिलौटी ग्राम में हुए पुलिसकार्रवाई की औचित्य की जाँच और आवश्यकतानुसार उत्तरदायित्व का निर्धारण। उक्त अधिनियम की धारा 5 (1) द्वारा प्रदत्त श्क्तियों का प्रयोग करते हुए बिहार राज्यपाल यह भी निदेश देते हैं कि उक्त अधिनियम की धारा-5 की उप धारा (2), (3), (4) और (5) के सभी उपबंध आयोग पर लागू होंगे। आयोग द्वारा जाँच कर अधिसूचना निर्गत की तिथि से 06 माह के अन्दर प्रतिवेदन सरकार को समर्पित किया जायेगा।

/ का अंगे्रजी में निम्नलिखित अनुवाद बिहार राज्यपाल के प्राधिकार से इसके द्वारा प्रकाशित किया जाता है, जो भारतीय संविधान के अनुच्छेद 340 के खंड (3) के अंतर्गत अंग्रेजी भाषा में इसका प्राधिकृत पाठ समझा जायेगा।

/ —Whereas, in exercise of powers conferred under Section 3 (1) of the Commissions of Inquiry Act, 1952 (No. 60, 1952), the Government of Bihar is of the opinion that it is necessary to appoint a Commission of Inquiry for the purpose of inquiring into the incident of police action which took place on 17th June, 2026 at Belauthi village under the police station Shahpur in Bhojpur district; Now, therefore, the Governor of Bihar is pleased to constitute a single member Commission of Inquiry comprising of Hon'ble Mr. Justice Vinod Kumar Sinha, Retired Justice of Patna High Court as its chairman.

2. The Commission will have the following terms of reference :-

I. To inquire into the background of incident, sequence of events and those direct and indirect circumstances, which resulted into occurrence of those incidents.

II. To inquire into the justification of police action at Belauthi village under the police station Shahpur in Bhojpur district on 17.06.2026 and fix the responsibility there for, if necessary.

3. The Governor of Bihar is further pleased to exercise powers conferred by sub- section (1) of Section 5 of the said Act to direct that all the provisions of sub-section (2) (3) (4) and (5) of the said section shall apply to this Commission.

4. The Commission shall submit its report within 06 months from issue of this notification.
