सा.का.नि. 22( अ)-महापत्तन न्यास अधिनियम , 1963 ( 1963 का 38 ) की धारा 124 की उपधारा ( 1 ) के साथ पठित उपधारा 132 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्र सरकार एतद्वारा पोर्ट न्यासी मडल द्वारा बनाए गए और इस अधिसूचना के साथ संलग्न अनुसूची मे कोचिन पत्तन न्यास कर्मचारी ( सेवा निवृत्ति ) ( संशोधन ) विनियम, 2001 का अनुमोदन करती है ।
2 उक्त विनियम 31-03-2001 को प्रवृत्त होंगे ।

कोचिन पोर्ट कर्मचारी ( सेवा निवृत्ति ) संशोधन विनियम, 2001
महापत्तन न्यास अधिनियम, 1963 ( 1963 का 38 ) की धारा 28 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, कोचिन पोर्ट एतद्वारा निम्नलिखित विनियम कोचिन पोर्ट कर्मचारी ( सेवा निवृत्ति ) विनियम , 1977 में संशोधन लाने के लिए केन्द्र सरकार के अनुमोदन के शर्त पर बनाती है तथा उसको उक्त अधिनियम की धारा 124 के अधीन आवश्यकतानुसार प्रकाशित करती है ।
1 इन विनियमों का नाम क्रोचिन पोर्ट ट्रस्ट कर्मचारी सेवा निवृति ( मशोधन ) विनियम, 2001 है ।
2 ये 31-03-2001 से प्रवृत्त होंगे ।
3 कोत्रिन पोर्ट कर्मचारी ( मेवा निवृत्ति ) विनियम , 1977 , इसके आगे उक्त विनियम से अभिहित है, विनियम 1 ( ग ) निम्न प्रकार प्रतिस्थापित किया जाए, अर्थात्: -
1 ( ग ) ये विनियम बोर्ड के सभी कर्मचारियों के लिए लागू हैं ।

[PART 11-SEC 3 (1 ) 4. उक्त विनियम में, विनियम 3 को निम्नलिखित प्रकार प्रतिस्थापित किया जाए, अर्थात्:-
3 मेवा निवृत्ति की आयु
(क) इन विनियमों में किसी अन्य व्यवस्था को छोड़कर हर एक कर्मचारी खण्ड ( ख ) में संदर्भित प्रकार सेवा से 58 वर्ष की आयु होने के महीने के अंतिम दिन के अपराह्न से सेवा निवृत्ति हो जाएगा ।
(ख) एक कामगार/ श्रेणी IV के कर्मचारी या ओ की सेवा में 21-07-1972 के पहले जो सेवा में प्रवेश किया हो, सेवा से 60 वर्ष की आयु होने के महीने के अंतिम दिन के अपराहन , मेवा निवृत्त हो जाएगा ।
नोट: (i ) इस खण्ड में ' कामगार' का तात्पर्य अति कुशल , कुशल , अर्ध कुशल या अकुशल कारीगर जो औद्योगिक स्थापना में मासिक दर के वेतन पर काम किया हो ।
नोट : ( ii ) एक कर्मचारी जिसकी जन्म तारीख महीने के प्रथम दिन में हो वे सेवा से 58 वर्ष या 60 वर्ष जो मामला के अनुसार हो, पूर्व महीने के अंतिम दिन सेवा निवृत्त हो जाएगा ।
5. उक्त विनियम में विनियम 4 निम्न प्रकार प्रतिस्थापित किया जाएगा ।
4. सेवा निवृत्ति के बाद सेवा का विस्तार/पुन रोजगार
सेवा निवृत्ति की आयु के परे किसी भी कर्मचारी को सेवा में बढ़ावा नहीं दी जाएगी ।
बशर्ते कि चिकित्सा या तकनीकी क्षेत्र में एक विशेषज्ञ को, बोर्ड के हितानुसार 60 वर्ष की आयु तक अध्यक्ष द्वारा सेवा को बढ़ाया, जो सार्वजनिक हितानुसार है तो, दी जाए और ऐसी बढ़ावा का कारण भी रिकार्ड किया जाए ।
आगे बशर्ते कि एक स्थायी या अर्थ स्थायी कर्मचारी को कम से कम तीन महीने के पहले एक सूचना देकर या एक स्थायी कर्मचारी को एक महीने पहले , या ऐसी सूचना के बदले वेतन या भत्ता देकर सेवा की अर्वाध को बढ़ाषा समाप्त करने के लिए ऐसी बढ़ावा की समाप्ति के पहले समुचित प्राधिकारी को अधिकार होगा ।

के. वी. राव, संयुक्त सचिव पाद टिप्पणी:- दि. 10-6-1978 के सा.का.नि. सं. 750 द्वारा मुख्य विनियम भारतीय राजपत्र में प्रकाशित किये थे । और दि. 29-5-1998 के सा.का.नि. सं. 281 ( ई ) द्वारा अंतिम रूप से संशोधित किया था ।
MINISTRY OF SHIPPING (PORTS WING) NOTIFICATION New Delhi , the 12th January , 2001
G.S.R. 22 ( E) .-In exercise of the powers conferred by Sub - section ( i ) of Section 124 , read with Sub-section ( i ) of Section 132 of the Major Ports Trusts Act , 1963 ( 38 of 1963 ) , the Central Government hereby approves the Cochin Port Trust Employecs (Recruitment ) Amendment Regulation, 2001 made by the Board of Trustees for the Port of Cochin Port Trust and set out in the schedule annexed to this notification
2 The said regulations shall come into force on 31-3-2001
SCHEDULE
The Cochin Port Employees (Retirement ) (Amendment ) Regulations , 2001 In exercise of the powers conferred by section 28 of the Major Port Trusts Act , 1963 ( 38 of 1963 ) the Cochin Port Trust hereby makes the following Regulations to amend the Cochin Port Employees (Retirement ) Regulations , 1977, subject to the approval of the Central Govt and the same is published herein as required under section 124 of saidAct.
1. These Regulations may be called the Cochin Port Trust Employees (Retirement ) ( Amendment ) Regulations . 2001 .
2 They shall come into effect on 31-3-2001 भारत व जपत्र अन

3 In the Cochin Regulation 1 ( C) shall be Employees (Rett ent) Regulations 977 , hereinafter called the said Regulations , stituted by the following namely.
1 ( C ) These kulations shall apply to all employees of the Board
4. In the said Regulations , Regulation 3 shall be substituted by the following namely :
3 Age of Retirement :-
a. Except as other 'ise provided in these Regulations , every employee other than those referred to in Clause (b) shall retire from service on the afternoon of the last day of the month in which he attains the age of 58 years.
b Aworkman/ an employee in Class IV service or post who entered Board's Service before 21-7-1972 shall retire from service on the afternoon of the last day of the month in which he attains the age of 60 years .
Note( 1 ) In this Clause " a workman " means a highly skilled , skilled . semi - skilled or un - skilled artisan, employed on a monthly rate of pay in the industrial stablishment.
Note (2) An employee whose date of birth is the first a month shali retire from service on the afternoon of the last day of the preceding month on attaining the age of 58 years or 60 years as the case may be .
5. In the said Regulations , Regulation 4 shall be substituted by the following namely,
4. Extension of service/re - employment after retirement .
No employee shall be granted extension in service beyond the age of superannuation.
Provided that a specialist in Medical or Scientific fields , may , in the interests of the Board , be granted extension of service by the Chairman upto the age of 60 years if such extension is in public interest and the grounds for such cxtension are recorded in writing.
Provided further that the appropriate authority shall have the right to terminate the extension of service before the expiry of such extension by giving a notice in writing of not less than 3 months in the case of a permanent or a quasi- permanent employee , or of one month in the case of a temporary employee , or pay and allowances in lieu of such notice.
