नई दिल्ली, 12 फरवरी , 2002
का.आ. 194( अ ).-केंद्रीय सरकार , राष्ट्रीय राजमार्ग अधिनियम, 1956 ( 1956 का 48) (जिसे इसमें इसके पश्चात् उक्त्त अधिनियम कहा गया है) की धारा उक की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, यह समाधान हो जाने के पश्चात् कि उड़ीसा राज्य मे खुर्दा जिले में लोक प्रयोजभ के लिए राष्ट्रीय राजमार्ग सं० 5 के 387/700 कि.गी से 419/200 कि.मी. (विशाखापटनम-भुवनेश्वर सेक्शन) तक खंड को चौड़ा करने के लिए वह भूमि अपेक्षित है जिसका संक्षिप्त वर्णन नीचे उपाबद्ध अनुसूची में दिया गया है, पूर्वोक्त प्रयोजन के लिए ऐसी भूमि को अर्जित करने के अपने आशय की घोषणा करती है;
इस भूमि में हितबद्ध कोई व्यक्ति राजपत्र में इस अधिसूचना की प्रकाशन की तारीख से 21 दिन के भीतर उक्त अधिनियम की धारा उग की उपधारा (1) के अधीन पूर्वोक्त प्रयोजन के लिए ऐसी भूमि के उपयोग पर आक्षेप कर सकेगा;
ऐसा प्रत्येक आक्षेप, सक्षम प्राधिकारी, भूमि अधिग्रहण अधिकारी, मुख्य भूमि अधिग्रहण खण्ड, जिला खुर्दा, एन-2/35, आई.आर.सी. गाँव, नयापल्ली, भुवनेश्वर-15, उड़ीसा को लिखित रूप में किया जाएगा और उसमें उसके आधार अधिकथित किए जाएंगे और सक्षम प्राधिकारी आक्षेपकर्ता को व्यक्तिगत रूप में या किसी विधि व्यवसायी द्वारा सुने जाने का अवसर देगा और. ऐसे आक्षेपों की सुनवाई के पश्चात् तथा ऐसी और जाँच करने के पश्चात् यदि कोई है जिसे सक्षम प्राधिकारी आवश्यक समझे, आदेश द्वारा या तो आक्षेप को अमुझात या अभमुझात करेगा;
उक्त अधिनियम की धारा उग की उपधारा 2क के अधीन सक्षम प्राधिकारी द्वारा किया गया कोई आदेश अन्तिम होगा; और
इस अधिसूचना के अधीन आने वाली भूमि के रेखांक और अम्य ब्यौरे उपलब्ध है और सक्षम प्राधिकारी के पूर्वोक्त कार्यालय में हितबद्ध व्यक्ति द्वारा मिरीक्षण किया जा सकता है ।

NOTIFICATION
New Delhi , the 12th February, 2002
S.O. 194 (E) . In exercise of the powers conferred by sub - section ( 1 ) of section 3A of the National Highways Act, 1956 (48 of 1956 ) ( hereinafter referred to be the said Act) , the Central Government , after being satisfied, that the larıds description of which are given in the Schedule below are required for the public purpose widening of National Highway No.5 in the stretch from Km. 387/700 to Km. 419/200 (Visakhapatnam - Bhubaneswar Section ) in the District Khurda , in the State of Orissa , hereby declares its intention to acquire such lands for the aforesaid purpose;
Any person interested in the land may , within twenty - one days from the date of publication of this notification in the Official Gazette , object to the use of the such lands for the aforesaid purpose ;
Every such objection shall be made to the competent authority , I and Acquisition Officer , Special Land Acquisition Cell , District Khurda , a N - 2 / 35 , IRC Village , Nayapalli , Bhubaneswar - 15 , Orissa in the Official G. zette in writing and shall set out the grounds thereof and the co petent authority shall give the objector an opportunity of being heard , either in person or by a legal practitioner and may , after hearing of such objections and after making such further inquiry , if any , as the competent authority thinks necessary , by order either allow or disallow the objection ;

Any order made by the competent authority under sub - section (2) of the section 3C of the said Act shall be final ; and
The land plans and other details of lands covered under this notification are available and can be inspected by the interested at the aforesaid office of the competent authority.

(भुवमेश्वर-कोलकत्ता सेक्शन) तक खड को चौड़ा करने के लिए वह भूमि अपेक्षित है जिसका संक्षिप्त वर्णन नीचे उपाबद्ध अनुसूची में दिया गया है, पूर्वोक्त प्रयोजन के लिए ऐसी भूमि को अर्जित करने के अपने आशय की घोषणा करती है;
इस भूमि में हितबद्ध कोई व्यक्ति राजपत्र में इस अधिसूचना की प्रकाशम की तारीख से 21 दिन के भीतर उक्त अधिनियम की धारा उग की उपधारा (1 ) के अधीन पूर्वोक्त प्रयोजन के लिए ऐसी भूमि के उपयोग पर आक्षेप कर सकेगा;
ऐसा प्रत्येक आक्षेप, सक्षम प्राधिकारी , को लिखित रूप में किया जाएगा और उसमें उसके आधार अधिकथित किए जाएंगे और सक्षम प्राधिकारी आक्षेपकर्ता को व्यक्तिगत रूप में या किसी विधि व्यवसायी द्वारा सुने जाने का अवसर देगा और ऐसे आक्षेपों की सुनवाई के पश्चात् तथा ऐसी और जाँच करने के पश्चात् यदि कोई है जिसे सक्षम प्राधिकारी आवश्यक समझे, आदेश द्वारा या तो आक्षेप को अनुज्ञात या अनमुज्ञात करेगा;
उक्त अधिनियम की धारा ३ग की उपधारा 2क के अधीन सक्षम प्राधिकारी द्वारा किया गया कोई आदेश अन्तिम होगा; और
इस अधिसूचना के अधीन आने वाली भूमि के रेखांक और अन्य ब्यौरे उपलब्ध है और सक्षम प्राधिकारी अर्थात् भूमि अधिग्रहण अधिकारी , राष्ट्रीय राजमार्ग परियोजना, जिला-बालासोर, उड़ीसा , के पूर्वोक्त कार्यालय में हितबद्ध व्यक्ति द्वारा निरीक्षण किया जा सकता है । [PART II SEC. 3 (ii)]

NOTIFICATION
