सं. एचआरडीडी/आईआर/बीएस-25( पी ). बैंककारी, कंपनी ( उपक्रमों का अर्जन और अंतरण ) अधिनियम 1970 ( 1970 का 5 ) की धारा 12 की उप - धारा ( 2 ) के साथ पठित धारा 19 द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए, पंजाब नैशनल बैंक का निदेशक मंडल, भारतीय रिजर्व बैंक से परामर्श करके तथा केन्द्र सरकार की पूर्व अनुमति से , पंजाब नैशनल बैंक ( कर्मचारी ) पैंशन विनियमन, 1995 में और संशोधन करके निम्नलिखित विनियमन बनाता है, अर्थात्: -

1. ( 1 ) ये विनियमन पंजाब नैशनल बैंक ( कर्मचारी ) पैंशन ( संशोधन ) विनियमन, 2002 कहलाएंगे ।

(2) ये सरकारी राजपत्र में अपने प्रकाशन की तारीख से प्रभावी होंगे ।

(2) पंजाब नैशनल बैंक ( कर्मचारी ) विनियमन, 1995 में, विनियमन 28 के लिए निम्नलिखित विनियम प्रतिस्थापित किया जाएगा , अर्थात्:-

" 28. अधिवर्षिता पैंशन:

अधिवर्षिता पैंशन उस कर्मचारी को मंजूर की जाएगी जो सेवा विनियमों या समझौतों में उल्लिखित अधिवर्षिता आयु पर पहुंचने के पूर्व सेवानिवृत्त हो गया है ।

फिर भी , 1 सितम्बर, 2000 से पैंशन ऐसे कर्मचारी को भी मंजूर की जाएगी जो अधिवर्षिता आयु पर पहुंचने के पूर्व सेवानिवृत्ति होने का विकल्प चुनता है , लेकिन यह सरकार के अनुमोदन से बोर्ड द्वारा इस प्रयोजन हेतु बनाई गई किसी योजना के अनुसार न्यूनतम 15 वर्ष की सेवा करने के पश्चात्ही होगा ।

व्याख्यात्मक ज्ञापन

1 भारतीय बैंक सघ ने, भारत सरकार से अभापत्ति प्राप्त करने के पश्चात्, 31-08-2000 को सभी सरकारी क्षेत्र के बैंकों को मॉडल स्वैच्छिक सेवानिवृत्ति योजना ( वीआरएस ) परिचालित की थी । योजना में, अन्य बातों के साथ- साथ यह व्यवस्था थी कि जिस कर्मचारी ने 15 वर्ष की सेवा पूरी की है , वे योजना के लिए पात्र हैं । पैंशन विनियमन में मौजूद उपबंधों के अनुसार, केवल वे कर्मचारी , जिन्होने 20 वर्ष की अर्हता सेवा के पश्चात् स्वैच्छिक सेवानिवृत्ति का विकल्प चुना है और प्राधिकारी नियुक्त करने हेतु लिखित रूप में न्यूनतम 3 महीने का नोटिस दिया है , पैंशन लाभ के लिए पात्र हैं । पेंशन विनियमन के उपर्युक्त प्रावधानों के पात्रता मानदंड तथा लाभ, 31-08-2000 को परिचालित स्वैच्छिक सेवानिवृत्ति योजना के अधीन किए गए विचार से भिन्त्र व अलग हैं । लेकिन , पैंशन विनियमन मे उस सदस्य कर्मचारी को पैंशन लाभ प्रदान करने हेतु कोई प्रावधान नहीं है जो ऐसी विशिष्ट योजना के अधीन अधिवर्षिता आयु पर पहुंचने के पूर्व सेवानिवृत्त हो जाता है । अतः यह निर्णय लिया गया है कि विशिष्ट योजना ( ओं ) के अधीन स्वैच्छिक सेवानिवृत्ति का विकल्प चुनने वाले पैंशन निधि के सदस्यों को यथानुपात पैंशन लाभ उपलब्ध कराया जाए । 2. अतः यह आवश्यक है कि संशोधन 1 सितम्बर, 2000 से प्रभावी बनाया जाए ताकि पैंशन निधि के सदस्य तथा 15 वर्षों की सेवा पूरी करने के पश्चात् स्वैच्छिक सेवानिवृत्ति लेने वाले सभी कर्मचारी पैंशन का लाभ प्राप्त कर सकें ।

3 यह प्रमाणित किया जाता है कि पूर्वव्यापी प्रभाव देने पर पंजाब नैशनल बैंक का कोई भी कर्मचारी/ अधिकारी, अधिसूचना द्वारा प्रतिकूल रूप से प्रभावित नहीं होगा।"

No. HRDD/IR/BS- 25 (P) .-- In exercise of the powers conferred by Section 19 read with sub - section (2) of section 12 of the Banking Companies ( Acquisition and Transfer of Undertakings ) Act, 1970 (5 of 1970 ), the Board ofDirectors of Punjab National Bank in consultation with the Reserve Bank of India and with the previous sanction of the Central ' Government, hereby make the following regulations further to amend the Punjab National Bank ( Employees ' ) Pension Regulations , 1995 namely

2002 1 ( 1 ) These Regulations may be called Punjab National Bank (Employees ' ) Pension (Amendment ) regulations , (2) They shall come into force on the date of their publication in the Official Gazette

2 In the Punjab National Bank (Employees' ) Pension Regulations, 1995 , for regulation 28 , the following regula- tion shall be substituted, namely

"28 Superannuation Pension :

Superannuation Pension shall be granted to an employee who has retired on his attaining the age of superan- nuation specified in the Service Regulations or Settlements

Provided that, with effect from 1st Sept 2000 pension shall also be granted to an employee who opts to retire before attaining the age of superannuation, but after rendering service for a minimum period of 15 years in terms of any Scheme that may be framed for such purpose by the Board with the approval of the Government

VoluntaryRetirement Scheme ( VRS ) to all the Public Sector banks on 31-8-2000 . The Scheme . inter alia, provided that employeeswho have rendered 15 years ' service are eligible for the Scheme. According to the existing provisions in the pension regulations, it is only employees who opt for voluntary retirement after completing 20 years' of qualifying service and after giving notice of not less than 3 months in writingto the appointing authority, are eligible for pensionary benefits . The eligibility criteria and the benefits flowing out of the above provisions in the Pension regulations are distinct and separate from that envisaged under VRS circulated on 31-8-2000 . There are no provisions available in the Pension Regulation for extending pensionary benefits to a member employee who retires before attaining the age of superannuation under such specific schemes . It has been , therefore , decided to provide the benefit of pro- rata pensionary benefits to members of Pension Fund who opt for voluntary retirement under specified scheme(s) .

2. Itis , therefore, necessary that the amendment may be made effective from 1st Sept. 2000 so that all employees who are members ofthe Pension Fund and have taken voluntary retirement under the Scheme after completion of 15 years of service can draw the benefit ofpension

3. It is certified that no employee/officer of the Punjab National Bank is likely to be affected adversely by the Notification being given retrospective effect . "
