का.आ. 4( अ).-दिनांक 24 जनवरी, 2002 को भारत के राजपत्र, भाग -11 , खण्ड 3 , उप- खण्ड ( ii ) में प्रकाशित इस विभाग की अधिसूचना सं . 100 ( अ ) का आंशिक संशोधन करते हुए केन्द्र सरकार निम्नलिखित संशोधन करती है ।
अनुमोदन की प्रक्रिया से संबंधित पैरा-3 में उक्त अधिसूचना में पैराग्राफ 3.3 और 3.5 के स्थान पर निम्नलिखित पैराग्राफ्फ प्रतिस्थापित किए जाएंगे , अर्थात्:-
3.3 सरकार विशेष आर्थिक क्षेत्रों की स्थापना के प्रस्तावों को सिद्धांत रूप में अनुमोदन प्रदान कर सकती है । यह सैद्धान्तिक अनुमोदन 1 वर्ष की अवधि के लिए वैध होगा । वैध अवधि को वाणिज्य विभाग द्वारा अलग- अलग मामलों के आधार पर बढ़ाया जा सकता है ।
3.5 बीओए द्वारा प्रस्ताव स्वीकृत कर लिए जाने के बाद वाणिज्य विभाग आवेदक, जिसे इसके बाद " विकासकर्ता " कहा गया है, को एक अनुमति पत्र जारी करेगा । यह अनुमोदन तीन वर्ष की अवधि के लिए वैध होगा, जिस समय के भीतर विकासकर्ता द्वारा परियोजना के कार्यान्वयन के लिए प्रभात्री कदम उठाए जाएंगे । वाणिज्य विभाग द्वारा वैधता की अवधि को अलग-अलग मामलों के आधार पर बढ़ाया जा सकता है । बशतें , वाणिज्यिक, आवासीय और मनोरंजन सुविधाओं का अनुमोदन केवल तभी किया जाएगा जब आवेदक का ऐसी सत्ताओं की इक्विटी में न्यूनतम 26% हिस्सा होगा ।

NOTIFICATION
New Delhi , the 3rd January , 2003
S.O. 4 ( E) . In partial modification to this Department's notification bearing S.O. 100 ( E ) published in the Gazette of india . Part - 11 . Section 3. Sub - section ( ii ) on 24th January , 2002, the Central Government make the following amendment .
In the said Notification in para 3 relating to procedure for approval , for sub - paragraphs 3.3 and 3.5 the following stub-paragraphs shall be substituted, namely
3.3 The Goverunent may grant of in - principle approval to proposals for setting up of SEZs. The in - principle shall be valid for aperiod of 1 year . The validly period may be extended by the Department of Commerce on a case to case basis .
3.5 On acceptance of the proposal by the BOA , the Department of Commerce will issue a Letter of Permission to the applicam, hereafter referred to as " developer " . The approval shall be valid for a period of 3 years within which time effective steps shall be taken by the developer to implement the project . The validly period may be extended by the Department of Commerce on a case to case basis . Provided that commercial , residential and recreational facilities shall be approved only if the applicant has at least 26% equity in such entities . :
