का.आ. 46( अ) .-केन्द्रीय प्रत्यक्ष कर बोर्ड, आय-कर अधिनियम, 1961 ( 1961 का 43 ) की धारा 17 की उपधारा ( 2 ) के खंड (vi ) के साथ पठित उस अधिनियम की धारा 295 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, आय- कर नियम, 1962 में और संशोधन करने के लिए निम्नलिखित नियम बनाता है, अर्थात्: -
1. (1 ) इन नियमों का संक्षिप्त नाम आय- कर ( पहला संशोधन ) नियम, 2004 है ।
(2) ये 1 अप्रैल, 2004 को प्रवृत्त होंगे ।
2. आय - कर नियम, 1962 के नियम 3 के उपनियम (7 ) के खंड ( i ) में " नियोजक या उसकी ओर से " शब्दों से प्रारम्भ होने वाले और " साधारण ब्याज के बराबर राशि के रूप में अवधारित किया जाएगा " शब्दों पर समाप्त होने वाले भाग के स्थान पर " नियोजक या उसकी ओर से किसी व्यक्तिद्वारा सुसंगत पूर्व वर्ष के दौरान कर्मचारी या उसके घर के किसी सदस्य को उपलब्ध कराए गए किसी प्रयोजन के लिए ब्याज रहित या रियायती उधार की व्यवस्था के परिणामस्वरूप निधारिती को होने वाले फायदे का मूल्य, उसी प्रयोजन के लिए उसके द्वारा दिए गए उधार के संबंध में सुसंगत पूर्व वर्ष की पहली तारीख को भारतीय स्टेट बैंक अधिनियम, 1955 ( 1955 का 23 ) के अधीन गठित भारतीय स्टेट बैंक द्वारा प्रति वर्ष प्रभारित दर से संगणित ब्याज के बराबर राशि के रूप में अवधारित किया जाएगा " शब्द, अंक , कोष्ठक और अक्षर रखे जाएंगे ।

S.O. 46 (E ) . In exercise of powers conferred by Sub -section (1 ) of Section 295 read with clause (vi ) of Sub- section (2 ) of Section 17 of the Income -tax Act, 1961 (43 of 1961 ) , the Central Board of Direct taxes hereby makes the following rules further to amend the Income-tax Rules , 1962 , namely:-
1.(1) These rules may be called the Income-tax (First Amendment) Rules, 2004.
(2) They shall come into force on the 1st day of April, 2004.
2. In the Income-tax Rules , 1962 , in Rule 3 , in Sub -rule (7) , in clause ( i) , for the portion beginning with the words "concessional loan made available " and ending with the words and figures " rate of 13% per annum for other loans " , the words , figures , brackets and letters " concessional loan for any purpose made available to the employee or any member of his household during the relevant previous year by the employer or any person on his behalf shall be determined as the sum equal to the interest computed at the rate charged per annum by the State Bank of India , constituted under the State Bank of India Act, 1955 (23 of 1955) , as on the 1st day of the relevant previous year in respect of loans for the same purpose advanced by it " , shall be substituted .
