सा.का.नि. 13 ( अ) .- बौद्धिक संपदा अपील बोर्ड ( अध्यक्ष , उपाध्यक्ष और अन्य सदस्यों को संदेय वेतन और भत्ते तथा सेवा के अन्य निबंधन और शर्ते) नियम , 2003 का संशोधन करने से संबंधित निम्नलिखित प्रारूप , जिसे केन्द्रीय सरकार , साधारण खंड अधिनियम , 1897 (1897 का 10 ) की धारा 22 के साथ पठित , व्यापार चिह्न अधिनियम , 1999 ( 1999 का 47 ) की धारा 157 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , बनाना चाहती है , उक्त अधिनियम की धारा 157 की उपधारा ( 1 ) की अपेक्षानुसार उन सभी व्यक्तियों की, जिनके उससे प्रभावित होने की संभावना है , जानकारी के लिए प्रकाशित किया जाता है और यह सूचना दी जाती है कि उक्त प्रारूप नियमों पर , उस तारीख से , जिसको उस राजपत्र की प्रतियां , जिसमें यह अधिसूचना प्रकाशित की जाती है , जनता को उपलब्ध करा दी जाती है , पैंतालीस दिन की अवधि की समाप्ति के पश्चात विचार किया जाएगा;
ऐसे किन्हीं आक्षेपों या सुझावों पर जो ऊपर विनिर्दिष्ट अवधि की समाप्ति के भीतर उक्त प्रारूप नियमों की बाबत किसी व्यक्ति से प्राप्त हो सकेंगे; केन्द्रीय सरकार द्वारा विचार किया जाएगा ।
आक्षेप या सुझाव , यदि कोई है , सचिव , भारत सरकार , वाणिज्य और उद्योग मंत्रालय (औद्योगिक नीति और संवर्धन विभाग ) उद्योग भवन , नई दिल्ली-110011 को भेजे जा सकेंगे ;
प्रारूप नियम
1. ( 1 ) संक्षिप्त नाम और प्रारंभ:- ( 1 ) इन नियमों का संक्षिप्त नाम बौद्धिक संपदा अपील बोर्ड ( अध्यक्ष , उपाध्यक्ष और सदस्यों को संदेय वेतन और भत्ते तथा सेवा के अन्य निबंधन और शर्तें) संशोधन नियम , 2005 है ।

[PART II-SEC. 3 ( i ) ] (2 ) ये 15 सितम्बर , 2003 को प्रवृत्त समझे जाएंगे ।
2. बौद्धिक संपदा अपील बोर्ड ( अध्यक्ष , उपाध्यक्ष और सदस्यों को संदेय वेतन और भत्ते तथा सेवा की अन्य निबंधन और शर्तें ( नियम , 2003 ) जिसे इसमें इसके पश्चात् मूल नियम कहा गया है) में, -
(i) नियम 5. के स्थान पर निम्नलिखित नियम रखा जाएगा , अर्थात् 5. "छुट्टी - (1 ) अपील बोर्ड में अध्यक्ष , उपाध्यक्ष या अन्य सदस्य के रूप में नियुक्ति पर कोई व्यक्ति , निम्नलिखित रूप में छुट्टी प्राप्त करने का हकदार होगा": -
(i) सेवा के प्रत्येक पूरे कलेण्डर वर्ष या उसके किसी भाग के लिए पन्द्रह दिन की दर पर उपार्जित छुट्टीः
( ii) सेवा के प्रत्येक पूरे वर्ष की बाबत बीस दिन की दर पर चिकित्सा प्रमाणपत्र या निजी काम के आधार पर अर्ध वेतन छुट्टी और अर्ध वेतन छुट्टी के लिए छुट्टी, सम्बलम उपार्जित छुट्टी के दौरान अनुज्ञेय छुट्टी संबलम के आधा के समतुल्य होगा:
(iii) अध्यक्ष , उपाध्यक्ष , या सदस्य के विवेकानुसार अर्ध वेतन पर छुट्टी की पूर्ण वेतन छुट्टी में परिवर्तित किया जा सकता है परन्तु यह तब जब वह चिकित्सीय आधारों पर ली गई हो और सक्षम चिकित्सा प्राधिकारी के चिकित्सा प्रमाणपत्र द्वारा समर्थित की गई हो;
(iv) पद की अवधि में एक सौ अस्सी दिनों की अधिकतम कालावधि तक वेतन और भत्तों के बिना असाधारण छुट्टी ।
(2) अपील बोर्ड में अपनी पदावधि की समाप्ति पर अध्यक्ष , उपाध्यक्ष या अन्य सदस्य अपने खाते में जमा उपार्जित छुट्टी के संबंध में छुट्टी सम्बलम के समतुल्य नकद प्राप्त करने का इस शर्त के अध्यधीन हकदार होगा कि इस नियम के अधीन, यथास्थिति , अधिकतम छुट्टी की मात्रा जिसकी नकद रकम प्राप्त की गई है और पिछली सेवा से सेवानिवृत्ति के समय एक साथ मिलाकर किसी भी दशा में 300 दिन से अधिक नहीं होगी;
( ii) मूल नियमों के नियम 6 के पश्चात निम्नलिखित नियम अन्तःस्थापित किया जाएगा , अर्थातः-
" पेंशन : 6 क ( 1 ) अध्यक्ष , उपाध्यक्ष या अन्य सदस्य के रूप में अपील बोर्ड में नियुक्त प्रत्येक व्यक्ति पेंशन का हकदार होगा , परन्तु ऐसे व्यक्ति को पेंशन देय नहीं होगी यदि उसे अधिनियम की धारा 89 की उपधारा (2 ) के अधीन पद से हटा दिया गया है" । (2) " उपनियम ( 1 ) के अधीन पेंशन की संगणना सेवा के प्रत्येक पूरे छह माह की अवधि के लिए दो हजार तीन सौ अठ्ठावन रुपए प्रतिवर्ष की दर पर की जाएगी" ;

परन्तु इस नियम के अधीन देय पेंशन की कुल रकम , जिसके साथ पेंशन के सारांशित भाग , यदि कोई हो , सहित पेंशन की ऐसी रकम भी है जो अपील बोर्ड में पद धारण करते समय प्राप्त की गई है , या जिसके प्राप्त करने का वह हकदार है , उच्च न्यायालय के न्यायाधीश के लिए विहित पेंशन की अधिकतम रकम से अधिक नहीं होगी ।
परन्तु यह और कि अध्यक्ष , उपाध्यक्ष या कोई अन्य सदस्य अपनी नियुक्ति की तारीख से तीन मास की अवधि के भीतर या बौद्धिक संपदा अपील बोर्ड ( अध्यक्ष , उपाध्यक्ष और अन्य सदस्यों को संदेय वेतन और भत्ते तथा सेवा के अन्य निबंधन और शर्ते) संशोधन नियम , 2005 के प्रवृत्त होने के एक मास के भीतर जो भी पश्चातवर्ती हो, इन नियमों के अधीन अपने पेंशन के अधिकार को छोड़ देने का चयन कर सकेगा जिस पर वह अभिदायी भविष्य निधि में अभिदाय करने का पात्र होगा ।
परन्तु यह भी कि अध्यक्ष , उपाध्यक्ष या कोई अन्य सदस्य जो 1 जनवरी , 2004 को या बाद में उसके पश्चात् पद ग्रहण करता है अभिदायी निधि में अभिदाय के लिए पात्र होंगे और पेंशन के लिए नहीं ।
(iii) मूल नियमों के नियम 10 में उपनियम (2 ) के स्थान पर निम्नलिखित नियम रखा जाएगा , अर्थात्: -
" (2 ) जब अध्यक्ष , उपाध्यक्ष या किसी अन्य सदस्य को उपनियम ( 1 ) में निर्दिष्ट आवास सुविधा उपलब्ध नहीं कराई जाती है या वह उसका उपयोग नहीं करता है तो उसे समय- समय पर केन्द्रीय सरकार में समतुल्य वेतमान के अधिकारी को यथा अनुज्ञेय प्रतिमाह मकान किराया भत्ता संदेय होगा । "
( iv) नियम 12 के पश्चात निम्निलिखित अन्तःस्थापित किया जाएगा , अर्थात " 12क - नियम 4 से नियम 12 तक में किसी बात के होते हुए भी बौद्धिक संपदा अपील बोर्ड का अध्यक्ष और उपाध्यक्ष की सेवा शर्तें और उन्हें उपलब्ध अन्य परिलब्धियां वही होंगी जो कि उच्च न्यायालय न्यायाधीश ( सेवा की शर्तें) अधिनियम , 1954, 1954 का 28 तथा उच्च न्यायालय न्यायाधीश ( यात्रा भत्ते ) नियम , 1956 में यथाअन्तर्विष्ट उच्च न्यायालयों के सेवारत न्यायाधीश को अनुज्ञेय है ।"

NOTIFICATION
New Delhi , the 11th January, 2005
G.S.R. 13 ( E ) . The following draft rules relating to amendment of the Intellectual Property Appellate Board ( Salaries and allowances payable to , and other terms and conditions of service of the Chairman , Vice - Chairman and Members ) Rules, 2003 which the Central Government proposes to make in exercise of the powers conferred by section 157 of the Trade Marks Act, 1999 (47 of 1999) , read with section 22 of the General Clauses Act , 1897 ( 10 of 1897) , is hereby published as required under sub - section ( 1 ) of section 157 of the said Act , for information of all persons likely to be affected thereby and notice is hereby given that the said draft rules will be taken into consideration after expiry of a period of forty five days from the date on which the copies of the Official Gazette in which this notification is published , are made available to the public;
Any objection or suggestion which may be received from any person in respect of the said draft rules within expiry of the period specified above will be considered by the Central Government .
Objections or suggestions , if any, maybe addressed to the Secretary to the Government of India , Ministry of Commerce and Industry ( Department of Industrial Policy and Promotion ) , Udyog Bhavan , New Delhi - 110 011 .
DRAFT RULES
1. Short title and commencement. (1) These rules may be called the Intellectual Property Appellate Board (Salaries and allowances payable to , and other terms and conditions of service of Chairman , Vice-Chairman and Members ) Amendment Rules, 2005.
(2) They shall be deemed to have come into force on the 15th day of September, 2003 .

2. In the Intellectual Property Appellate Board ( Salaries and allowances payable to, and other terms and conditions of service of Chairman , Vice- Chairman and Members) Rules, 2003 (hereinafter referred to as principal rules) , - ( i ) for rule 5 , the following rule shall be substituted , namely: -
5 " Leave.- (1 ) A person , on appointment in the Appellate Board as a Chairman, Vice-Chairman or other Member shall be entitled to leave as follows:
(i) earned leave at the rate of thirty days for every completed calendar year of service or a part thereof,
(ii) half pay leave on medical certificate or on private affairs , at the rate of twenty days in respect of each completed year of service and the leave salary for half pay leave shall be equivalent to half of the leave salary admissible during the earned leave;
(iii) leave on half pay can be commuted to full pay leave at the discretion of the Chairman , Vice-Chairman or Member , provided it is taken on medical grounds and is supported by a medical certificate from the competent medical authority;
(iv) extra -ordinary leave without pay and allowances upto a maximum period of onehundred and eighty days in one term of office .
(2) On expiry of his term of office in the Appellate Board , the Chairman , Vice- Chairman or other Member shall be entitled to receive cash equivalent of leave salary in respect of the earned leave standing to his credit subject to the condition that the maximum of leave encashed under this sub -rule and at the time of retirement from previous service taken together shall not in any case exceed 300 days" .
(ii ) after rule 6 of the principal rules , the following rule shall be inserted , namely: - " Pension: 6A( 1 ) Every person appointed to the Appellate Board as the Chairman, Vice-Chairman , or other Member shall be entitled to pension , provided that no such pension shall be payable to such person if he has been removedfrom his office under sub- section (2) of section 89 of theAct.

[PART II-SEC .3(1 ) ] (2) Pension under sub - rule ( 1 ) shall be calculated at the rate of rupees two thousand three hundred and fifty eight per annum for every completed six monthly period of service:
Provided that the aggregate amount of pension payable under this rule together with amount of any pension including commuted portion of pension , if any, drawn or entitled to be drawn while holding office in the Appellate Board, shall not exceed the maximum amount of pension prescribed for a Judge of the High Court:
Provided further that the Chairman , Vice- Chairman or any other Member , within a period of three months from the date of his appointment or within one month of coming into force of the IPAB (Salaries and allowances payable to , and other terms and conditions of service of Chairman , Vice- Chairman and Members ) Amendment Rules , 2005, whichever is later, may, elect to forego his right to pension under these Rules whereupon he shall be eligible to subscribe to Contributory Provident Fund:
Provided also that the Chairman , Vice- Chairman or any other Member who enters office on or after 1st January, 2004 shall be eligible to subscribe to Contributory Provident Fund and not to Pension .
(iii ) . in rule 10 of the principal rules , for sub - rule (2) , the following sub- rule shall be substituted , namely:-
"(2) When the Chairman , Vice- Chairman or a Member is not provided with , or does not avail himself of the accommodation referred to in sub - rule (1 ) , he may be paid , every month , house rent allowance as may be admissible from time to time to an officer of equivalent pay scale in the Central Government . " .
(iv) after rule 12 of the principal rules , the following rule shall be inserted , namely: - " 12A. Notwithstanding anything contained in rule 4 to rule 12, the conditions of service and other perquisites available to the Chairman and Vice-Chairman of the Intellectual Property Appellate Board shall be the same as admissible to a serving Judge of a High Court as contained in the High Court Judges ( Conditions of Service) Act, 1954 (28 of 1954) and the High Court Judges (Travelling Allowances ) Rules , 1956. " .
