सा.का.नि. 64 ( अ).-केन्द्रीय सरकार, उपभोक्ता संरक्षण अधिनियम, 1986 (1986 का 68 ) की धारा 30 की उपधारा (1 ) द्वारा प्रदत शक्तियों का प्रयोग करते हुए, उपभोक्ता संरक्षण नियम, 1987 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात् : -
1. संक्षिप्त नाम , विस्तार और प्रारंभ, (1 ) इन नियमों का संक्षिप्त नाम उपभोक्ता संरक्षण (दूसरा संशोधन) नियम, 2005 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. उपभोक्ता संरक्षण नियम, 1987 ( जिसे इसमें इसके पश्चात् उक्त नियम कहा गया है) के नियम 4 में, --
(क) "एक हजार रुपए प्रतिदिन " शब्दों के स्थान पर "अधिवेशन के प्रत्येक दिन 1000 रुपए" शब्द और अंक रखे जाएंगे ;
(ख) उपनियम (6) में "दैनिक भत्ते की क्षतिपूर्ति करने के लिए समेकित वाहन या प्रभार या आनुषंगिक प्रभार" शब्दों के स्थान पर "समेकित वाहन और किराया प्रभार" शब्द रखे जाएंगे ।

[PART II -SEC. 3 ( i ) ] 3. उक्त नियमों के नियम 9 क और उसके अधीन सारणी के स्थान पर निम्नलिखित रखा जाएगा, अर्थात् : -
" (1 ) अधिनियम की धारा 12 की उपधारा ( 1 ) , धारा 17 की उपधारा (1 ) और धारा 21 के खंड (क) के उपखंड ( i ) के अधीन प्रत्येक परिवाद के साथ, यथास्थिति, जिला फोरम के अध्यक्ष, राज्य आयोग के रजिस्ट्रार या राष्ट्रीय आयोग के रजिस्ट्रार के पक्ष में किसी राष्ट्रीयकृत बैंक में लिखित क्रास मांग देय ड्राफ्ट के रूप में या किसी क्रास भारतीय पोस्टल आर्डर के माध्यम से नीचे दी गई सारणी में यथा विनिर्दिष्ट फीस होगी और संबंधित स्थान पर संदेय होगी जहां जिला फोरम , राज्य आयोग या राष्ट्रीय आयोग अवस्थित है ।
(2) उपनियम (1) में निर्दिष्ट संबद्ध प्राधिकारी उसके द्वारा प्राप्त फीस की राशि को संबंधित राज्य के उपभोक्ता कल्याण निधि में और जहां ऐसी निधि स्थापित नहीं है वहां राज्य सरकार प्राप्ति लेखा में और राष्ट्रीय आयोग की दशा में केन्द्रीय सरकार के उपभोक्ता कल्याण निधि में जमा करेगा ।

(3) ऐसे परिवादी जो गरीबी रेखा के नीचे के अधीन हैं केवल अंत्योदय योजना कार्यों की अनुप्रमाणित प्रति के प्रस्तुत करने पर फीस के संदाय की छूट के लिए हकदार होंगे । " ।

4. उक्त नियमों के नियम 10ख में "छह " शब्द के स्थान पर "नौ " शब्द रखा जाएगा ।
5. उक्त नियमों के नियम 14 में उपनियम (1 ) के पश्चात् निम्नलिखित उपनियम अंतःस्थापित किया जाएगा, अर्थात्: - •
" ( 1 क) उपनियम (1 ) के अधीन प्रत्येक परिवाद चार प्रतियों में या प्रतियों की ऐसी संख्या के साथ जो राष्ट्रीय आयोग द्वारा अपेक्षित हों, फाइल की जाएगी ।" ।
6. उक्त नियमों के नियम 15 के उपनियम (5) में "छह प्रतिलिपियाँ " के स्थान पर "चार प्रतियाँ या प्रतियों की ऐसी संख्या " शब्द रखे जाएंगे ।
7. उक्त नियमों के नियम 15 क में, -
!
(क) उपनियम (1 ) में " ज्येष्ठतम सदस्य" शब्दों के पूर्व "नियम 12 के अधीन प्राधिकृत" शब्दों का लोप किया जाएगा ;
(ख) उपनियम (1 ) के परंतुक के स्थान पर निम्नलिखित परंतुक रखा जाएगा, अर्थात्ः- "परंतु किसी कारण से एक सदस्य या सदस्य कार्यवाही का संचालन उसके पूर्ण होने तक THE GAZETTE OF INDIA : EXTRAORDINARY
[PART II-SEC. 3 (1)] करने में असमर्थ हैं, अधिनियम की धारा 22 घ में यथा उपबंधित अध्यक्ष या ज्येष्ठतम सदस्य ऐसी कार्यवाहियों का संचालन उस प्रक्रम से जिस पर इसकी पूर्ववर्ती सदस्य द्वारा अंतिम बार सुनवाई की गई थी, करेगा ।" ;
(ग) उपनियम (2) और उक्त उपनियम के परंतुक में "नियम 12 के अधीन प्राधिकृत" शब्दों और अंकों के स्थान पर " धारा 22 घ के अधीन यथा उपबंधित " शब्द, अंक और अक्षर रखे जाएंगे ।

NOTIFICATION
New Delhi , the 10th February, 2005
G.S.R. 64(E)-In exercise of the powers conferred by sub - section ( i ) of section 30 ofthe Consumer Protection Act , 1986 (68 of 1986 ) , the Central Government hereby makes the following rules further to amend the Consumer Protection Rules , 1987, namely:-
1 . Shorttitle , extent and commencement ( 1 ) These rules may be called the Consumer Protection ( Second Amendment ) Rules , 2005.

(2) They shall come into force on the date of their publication in the Official Gazette .
2. In rule 4 of the Consumer Protection Rules , 1987 ( hereinafter referredto as the said rules) .-
(a) In sub- rule (6) for the letters , figures and words " Rs . 1000/- per day" , the letters , figures and words shall be substituted " Rs . 1000/- per each day of the meeting " shall be substituted;
(b) In sub-rule (6) for the words " consolidated conveyance , hire charges and incidental charges to cover the daily allowances " the words "consolidated conveyance and hire charges " shall be substituted.
3. For rule 9A and the Table there under of the said rules , the following shall be substituted , namely: -
" ( 1 ) Every complaint filed under sub - section ( 1 ) of section 12, sub- section ( 1 ) ofsection 17 and clause (a ) in sub-clause ( i ) of section 21 of the Act shall be accompaniedby a fee as specified in the table given below in the form of crossed Demand Draft drawn on a nationalized bank or through a crossed Indian Postal Order in favour of the President of the of the District Forum , Registrar of the State Commission or the Registrar of the National Commission as the case may be , and payable at the respective place where the District Forum , State Commission or the National Commission is situated.
(2) The concerned authority referred to in sub- rule ( 1 ) shall credit the amount of fee received by it into the Consumer Welfare Fund of the respective State and where such Fund is not established into the Receipt Account of the State Government and in the case of the National Commission , to the Consumer Welfare Fund of the Central Government .

[PART II SEC. 3 (i) ] (3) The complainant who are under the Below Poverty Line shall be entitled for the exemption of payment of fee only on production of an attested copy of the Antyodaya Anna Yojana cards ." .
4. In rule 10B of the said rules . for the word "six" the word " nine" shall be substituted.
5. In rule 14, of the said rules , after sub - rule ( 1 ) the following sub- rule shall beinserted , namely: -
"(1A) Every complaint under sub - rule ( 1 ) shall be filed in quadruplicate or with such number of copies as may be required by the National Commission . " .
6. In rule 15 of the said Rules , in sub- rule ( 5) for the words " six copies " the words " four copies or such number of copies " shall be substituted .
7. In rule 15A of the said rules, -
(a) in sub- rule ( 1 ) after the word " senior most member " , the words " authorized under rule 12 " shall be omitted ;
(b) for the proviso to sub -rule ( 1 ) the following proviso shall be substituted , namely : -
" Provided that one member or members for any reason are unable to conduct proceedings till it is completed, the President or the senior most member, as provided in section 22D of the Act, shall conduct such proceedings from the stage at which it was last heard by the previous member.";
(c ) in sub - rule (2) and to the proviso to the said sub - rule , for the words and figures "authorized under rule 12 " , the words, figures and letter " as provided under section 22D " shall be substituted .
