नई दिल्ली, 11 नवम्बर, 2005
सं. 8/35/ 2005 -ई. एस. जबकि अप्रैल 2004 में, संयुक्त राष्ट्र इराक तेल के बदले अनाज कार्यक्रम ( यहां इसके बाद " कार्यक्रम " के रूप में उल्लिखित ) को लागू करने एवं उसके प्रबंधन में लगाए गए गंभीर आरोपों को ध्यान में रखते हुए, संयुक्त राष्ट्र महासचिव ने इराक में उस कार्यक्रम को लागू करने तथा उसके प्रबंधन की जाँच करने हेतु एक स्वतंत्र , उच्च- स्तरीय जाँच समिति की नियुक्ति की थी ;
और जबकि इसके पश्चात, संयुक्त राष्ट्र सुरक्षा परिषद ने एकमत से संकल्प 1538 (2004) को पारित किया जो जाँच का समर्थन करता है । तीन सदस्यीय स्वतंत्र जाँच समिति (जिसका इसके बाद " समिति " के रूप में उल्लेख किया गया है) की अध्यक्षता संयुक्त राज्य फेडरल रिजर्व के पूर्व अध्यक्ष श्री पॉल वोल्कर ने की थी ;
और जबकि 27 अक्तूबर, 2005 को इस समिति ने अपनी 5 वीं तथा अंतिम तथ्यात्मक रिपोर्ट प्रस्तुत की जिसमें कहा गया है कि रिपोर्ट उस तरीके को स्पष्ट करती है जिसके माध्यम से इराक ने राजनीतिक वरीयता के आधार पर ठेके देने और तेल तथा मानवीयता आधारित सहायता संविदाए प्राप्त करने वाली कम्पनियों से अवैध भुगतान प्राप्त करने के लिए कार्यक्रम को छल से प्रभावित किया ;
और जबकि उसी दिन, समिति ने कार्यक्रम के अंतर्गत 8 व्यापक सारणियों का एक सैट भी जारी किया जिसमें कार्यक्रम के अंतर्गत ठेकेदारों तथा कार्यक्रम के लेन -देन (इराक के तेल आवंटनों के गैर- संविदात्मक लाभार्थियों एवं पार्टियों सहित जिन्होंने तेल से संबंधित लेन- देनों का वित्त पोषण किया था) में अन्य महत्वपूर्ण व्यक्तियों की पहचान कराई गई है ; (1)

और जबकि सारणी 1 से 5 में तेल के लेन- देन के ब्यौरे हैं , जबकि सारणी 6 से 8 में मानवीय सहायता से संबंधित लेन- देन का विवरण है ;
और जबकि सारणी 3 में एक संविदा जो मैसफील्ड ए० जी ० , स्विटजरलैंड, कंपनी के नाम पर है और जिसका नम्बर एम/ 09 / 54 हैं, के ब्यौरों से पता चलता है कि 2,000,000 बैरल तेल का आवंटन संभवतः किया गया था और 1,936,000 बैरल तेल का उठान किया गया । सारणी 5 की ऐसी ही प्रविष्टि में संविदा सं ० एम/ 09 / 54 और मैसफील्ड ए जी कंपनी दर्शाती है कि 498,973 अमरीकी डॉलर की राशि अधिभार के रूप में उगाही गई थी और श्री अंदलीब सहगल ने 13 मार्च, 2001 को 60,000 अमरीकी डॉलर की राशि जमा करवाई थी तथा मै ० हमदान एक्सपोर्ट ने दिनांक 27 मई , 2001 को 438,518 अमरीकी डॉलर की राशि जोर्डन नेशनल बैंक में जमा करवाई थी । इस संविदा के भावी लाभार्थी के रूप में " श्री के० नटवर सिंह , भारतीय कांग्रेस पार्टी के सदस्य" को सूचीबद्ध किया गया है ;
और जबकि इसी प्रकार सारणी 3 में , संख्या एम/ 10 / 57 वाली एक संविदा के ब्यौरे , जो मैसफील्ड ए ० जी० , स्विटजरलैंड कंपनी के नाम में है, निर्दिष्ट करता है कि तेल के 1,000,000 बैरल संभवतः आवंटित किए गए थे और 1,001,000 बैरल उठाए गए थे । इस संविदा और मैसफील्ड ए ० जी० कंपनी से संबंधित सारिणी 5 में तदनुरूपी प्रविष्टि यह निर्दिष्ट करती है कि 250,224 अमरीकी डालर अधिभार के रूप में लगाए गए थे और यह कि मैसर्स हमदान एक्सपोर्ट ने 11 जून , 2001 को 59,808 अमरीकी डालर की राशि और 19 दिसम्बर, 2001 को 190,214 अमरीकी डालर की एक और राशि जॉर्डन नेशनल बैंक में जमा करवाई थी । इस आवंटन के भावी लाभार्थी के रूप में " भारत- कांग्रेस पार्टी " को सूचीबद्ध किया गया है ;
और जबकि श्री के० नटवर सिंह और कांग्रेस पार्टी का उल्लेख निश्चित रूप से सार्वजनिक महत्व का मामला बनता है और परिणामतः सरकार ने इस मामले की जड़ तक जाने का निर्णय लिया है ताकि वोल्कर समिति की रिपोर्ट में निहित अधिभार की अदायगी से संबंधित असत्यापित संदर्भों की सत्यता या अन्यथा को प्रमाणित किया जा सके
और जबकि ऐसा करने के उद्देश्य से यह वांछनीय महसूस किया गया कि सरकार के आदेश द्वारा एक जाँच प्राधिकरण की स्थापना की जाए ;
