का.आ. 1620(अ).- जबकि, भारत के राजपत्र, असाधारण, भाग II , खंड 3 उप खंड ( ii) में दिनांक 1.8.1997 को प्रकाशित दिनांक 1.8.1997 की अधिसूचना का.आ. संख्या 542 (अ. ) के द्वारा पूरे भारत में पत्थर खानों के कर्मचारियों को देय न्यूनतम उजरती दर मजदूरी निर्धारित की गयी थी ।
और जबकि न्यूनतम मजदूरी अधिनियम, 1948 ( 1948 का 11 ) की धारा 7 के अंतर्गत गठित न्यूनतम मजदूरी सलाहकार बोर्ड ने दिनांक 6 अप्रैल, 1993 को आयोजित अपनी 25 वीं बैठक में भारत सरकार से यह सिफारिश की कि पूरे भारत में पत्थर खानों में नियोजित कर्मचारियों को देय न्यूनतम उजरती दर मजदूरी को संशोधित किया जाए ।
इसलिए, अब , न्यूनतम मजदूरी अधिनियम , 1948 ( 1948 का 11 ) की धारा 3 की उप- धारा ( 1 ) के साथ पठित उप- धारा (2) के खंड (ख) तथा (ग) और धारा 4 की उप -धारा ( 1 ) के खंड (i ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्र सरकार दिनांक 1.8.1997 की अधिसूचना का. आ. संख्या 542 (अ. ) का अधिक्रमण करते हुए , उन बातों को छोड़कर जो ऐसे अधिक्रमण से पहले की गयी हों अथवा किए जाने से छूट गयी हों, पूरे भारत में पत्थर खानों में प्रत्येक कर्मचारी को प्रतिदिन देय न्यूनतम उजरती दर मजदूरी तथा न्यूनतम गारंटीकृत समय दर मजदूरी निर्धारित करने के लिए निम्नलिखित 3316 GI/ 2005 (1) 2

प्रारूप का प्रस्ताव करती है , इसे उक्त अधिनियम की धारा 5 की उप - धारा ( 1 ) के खंड (ख) की अपेक्षानुसार , उन सभी व्यक्तियों के सूचनार्थ प्रकाशित किया जाता है जिनकी इससे प्रभावित होने की संभावना है और अतएव नोटिस दिया जाता है कि सरकारी राजपत्र में प्रकाशित इस अधिसूचना की प्रतियां आम जनता को उपलब्ध करवाये जाने की तारीख से दो माह की अवधि समाप्त होने के बाद उक्त प्रस्ताव के प्रारूप पर विचार किया जाएगा ।
2. उक्त प्रस्ताव के प्रारूप के संबंध में ऊपर विनिर्दिष्ट अवधि के भीतर व्यक्तियों अथवा संगठनों से प्राप्त किन्हीं आपत्तियों अथवा सुझावों पर केन्द्र सरकार द्वारा विचार किया जाएगा । ऐसी आपत्तियां अथवा सुझाव सचिव, श्रम और रोजगार मंत्रालय , मजदूरी प्रकोष्ठ, श्रम शक्ति भवन , रफी मार्ग , नई दिल्ली -110001 के पते पर भेजे जाने चाहिए
प्रस्ताव का प्रारूप
संशोधित न्यूनतम उजरती दर मजदूरी तथा न्यूनतम गारंटीकृत समय दर मजदूरी में इस अधिसूचना के साथ संलग्न सारणी के कालम (6) में उनके सामने उसके कॉलम (2) में उल्लिखित कार्य में लगे कर्मचारियों के वर्गों को देय न्यूनतम मजदूरी निर्धारित करने के लिए क्रमशः कॉलम (3 ) और (4 ) में यथानिर्दिष्ट मूल मजदूरी दर , परिवर्ती महंगाई भत्ता तथा दोनों की 5 % अतिरिक्त राशि और न्यूनतम उजरती दर मजदूरी के लिए उक्त सारणी के स्तम्भ (7 ) में यथानिर्दिष्ट दर पर विशेष भत्ता शामिल होंगे । विशेष भत्ते को मुख्य श्रम आयुक्त (के. ) द्वारा प्रत्येक वर्ष 30 जून और 31 दिसम्बर को समाप्त होने वाली छमाही की पूर्ववर्ती अवधि के लिए औद्योगिक कामगारों हेतु उपभोक्ता मूल्य सूचकांक ( आधार 1982 = 100 ) के औसत के आधार पर क्रमशः 1 अक्तूबर तथा 1 अप्रैल को प्रारम्भ होने वाली प्रत्येक छमाही के अंतराल पर समायोजित किया जाएगा ।

1. मजदूरी की मूल उजरती दर में साप्ताहिक विश्राम दिवस के लिए देय मजदूरी शामिल है ।
2. न्यूनतम मजदूरी दरें ठेकेदारों द्वारा नियोजित कर्मचारियों पर भी अनुप्रयोज्य हैं ।
3. जहां ठेका या समझौता या अन्य कारणवश मजदूरी की लागू दरें अधिनियम के तहत अधिसूचित दरों से ज्यादा हैं, वहां उच्चतर दरों को बनाए रखा जाना चाहिए और इस अधिसूचना के प्रयोजनार्थ न्यूनतम मजदूरी दरें माना जाना चाहिए ।

4. न्यूनतम गारंटी मजदूरी , यानी, उजरती दर वाले सभी कर्मचारियों के लिए फॉल-बैक मजदूरी प्रत्येक कार्य श्रेणी के लिए तालिका के कॉलम 5 के तहत यथाविनिर्दिष्टानुसार होगी ।
5. नियोक्ता, विस्फोटकों, डेटोनेटर, मिट्टी हटाने, जलरहित करने संबंधी शुल्कों आदि की लागत के नाम पर उक्त उजरती दर मजदूरी से किसी भी प्रकार की कटौती नहीं करेगा । नियोक्ता, विस्फोट, होल बनाने तथा जलरहित करने संबंधी सुविधाओं के लिए सामग्री की आपूर्ति करेगा ।
6. विकलांग कर्मचारियों को देय न्यूनतम मजदूरी दरें समुचित श्रेणी के श्रमिकों को देय दरों जितनी ही होंगी ।
7. उक्त तालिका के कॉलम 3 में उल्लिखित मजदूरी दिसम्बर, 2004 को समस्त माह के लिए औद्योगिक श्रमिकों संबंधी अखिल भारतीय उपभोक्ता मूल्य सूचकांक 522 (आधार वर्ष 1982= 100) की छमाही औसत पर आधारित हैं ।

S.O. 1620 (E ) . Whereas, the minimum piece rate wages payable to the employees employed in the stone mines in the whole of India were fixed vide notification number S.O.542 (E) , dated the 1st August, 1997, published in the Gazette of India, Extraordinary, Part- II Section 3 , Sub - section (ii ) dated the 1st August, 1997.
And whereas Minimum Wages Advisory Board constituted under section 7 of the Minimum Wages Act, 1948 ( 11 of 1948 ) recommended to the Government of India in its 25th meeting held on 6th April , 1993 to revise the minimum piece rate wages payable to the employees employed in the stone mines in the whole of India.
Now, therefore , in exercise of the powers conferred by clause (b) and (c) of sub- section (2) of section (3 ) , read with sub - section ( 1 ) thereof and clause ( i ) of sub - section (1) of section 4 of the Minimum Wages Act , 1948 ( 11 of 1948 ) , the Central Government in supersession of notification number S.O. 542 (E) dated 1st August , 1997 except as respective things done or omitted to be done before such supersession, makes the 5

following draft proposal for fixing the minimum piece rate of wages and minimum guaranteed time rate of wages per day per employee payable in the stone mines in the whole of India , the same is hereby published , as required by clause (b) of sub - section ( 1) of section 5 of the said Act, for the information of all persons likely to be affected thereby and therefore , notice is hereby given that the said draft proposal shall be taken into consideration after the expiry of two months from the date on which the copies of this notification as published in the Official Gazette are made available to the public.
2. Any objections or suggestions which may be received from the persons or organisations with respect to the said draft proposal within the period specified above will be considered by the Central Government . Such objections or suggestions should be addressed to the Secretary, Ministry of Labour and Employment , Wage Cell , Shram Shakti Bhawan, Rafi Marg , New Delhi - 110001 .
DRAFT PROPOSAL
The revised minimum piece - rate wages and minimum guaranteed time- rate wages shall consist of basic rate of wages , Variable Dearness Allowance (VDA) as set out in column (3 ) and (4) respectively of the Table annexed to this notification and an addition of 5 percent of basic rate of wages and Variable Dearness Allowance (VDA) to make minimum wages as given in column (6) of the said Table payable to the classes of employees engaged in the work mentioned against them in column (2) thereof and a special allowance at the rate set out in column (7) of the said Table for minimum piece rate of wages . The Special allowance shall be adjusted by the Chief Labour Commissioner ( Central ) (CLC ) , at the interval of every six months commencing on the 1st October and 1st April on the basis of the average Consumer Price Index number for Industrial Workers ( Base 1982 = 100 ) for preceding period of six months ending on the 30th June and the 31st December every year , respectively.

Explanation:
1. The basic minimum piece - rate of wages are inclusive of wages payable for the weekly day of rest .
2. The minimum rates of wages are applicable to employees employed by contractors also .
3. Where the prevailing rates of wages based on contract or agreement or otherwise are higher than the notified rates under the Act , the higher rates should be protected and treated as the minimum rates of wages for the purpose of this notification .
4. The minimum guaranteed wage , i.e. the fall -back wage for all piece rated employees shall be as specified under column 6 of the Table against each category of work.
5. The employer shall not make any deductions whatsoever from the aforesaid piece -rate of wages on account of the cost of explosives , detonator , removal of soil , dewatering charges etc. The employer will supply material for blasting, drilling of holes and dewatering facilities .
6. The minimum rates of wages payable to disabled employees shall be the same as payable to workers of the appropriate category .
7. The above mentioned wages as set out in column (3 ) of the above Table are based on six monthly average of All India Consumer Price Index number 522 (base year 1982 100) for Industrial workers for the month ending . December 2004.
