और संसद् (निरर्हता निवारण ) संशोधन अधिनियम , 2006 की धारा 2 के खंड (ii ) द्वारा 4 अप्रैल , 1959 से यथा अंतःस्थापित संसद् (निरर्हता निवारण ) अधिनियम , 1959 की धारा 3 के खंड (ट) द्वारा हुगली रिवर ब्रिज कमीशनर्स के अध्यक्ष के पद को, अन्य पदों के साथ , ऐसे पद के रुप में घोषित किया गया है , जिसका धारक संसद् का सदस्य चुने जाने के लिए और सदस्य होने के लिए निरर्हित नहीं होगा;
और निर्वाचन आयोग ने अपनी राय ( उपाबंध द्वारा ) दे दी है कि वर्तमान याचिका में उठाया गया श्री स्वदेश चक्रवर्ती की अभिकथित निरर्हता का प्रश्न अब निरर्थक हो गया है क्योंकि अभिकथित निरर्हता, यदि कोई थी, संसद् (निरर्हता निवारण ) संशोधन अधिनियम, 2006 के उपबंधों के कारण भूतलक्षी प्रभाव से हट गई है;

THE GAZETTE OF INDIA : EXTRAORDINARY
[PART II-SEC . 3 (ii)]

In re:
Alleged disqualification of Shri Swadesh Chakraborty, Member of Parliament (Lok Sabha), under Article 102 ( 1 ) ( a) of the Constitution.
Reference Case No. 26 of 2006
[Reference from the President under Article 103 (2) of the Constitution]
OPINION
This is a reference dated 30th March , 2006 from the President of India, under Article 103 (2 ) of the Constitution , seeking the opinion of the Election Commission on the question whether Shri Swadesh Chakraborty , MP ( Lok Sabha) has become subject to disqualification for being Member of the House concerned under Article 102 (1 )( a) of the Constitution.
2. The question of alleged disqualification of Shri Swadesh Chakraborty , MP was raised in a petition dated 24th March , 2006 submitted to the President by Shri Mukul Roy , General Secretary , All India Trinamool Congress , 30B Harish Chatterjee Street , Kolkata. The petitioner has stated in this said petition that Shri Swadesh Chakraborty was holding the office of the Chairman, Hooghly River Bridge Corporation. The petitioner's contention was that the said office is an office of profit under the Government within the meaning of Art 102 (1 ) of the Constitution.
3. The petition of Sh . Mukul Roy was , however , not accompanied by any document in support of his contention that the office to which Shri Swadesh Chakraborty (respondent) had been appointed was an office of profit under the Government . The petition of Shri Mukul Roy did not even contain the basic information about the date of appointment of the respondent to the office referred to in the petition. The date of appointment of a Member to an office is vital to determine whether the case falls within the jurisdiction of the President to decide in terms of Article 103 ( 1 ) . It is well settled by a catena of decisions of the Supreme Court { see Election Commission Vs. Saka Venkata Rao (AIR 1953 SC 201 ) ; Brundaban Naik Vs. Election Commission (AIR 1965 SC 1892 ) ; Election Commission Vs. N.G.Ranga ( AIR 1978 SC 1609 ) } that under Article 103 of the Constitution , the President and the Election Commission can look into the questions of only those offices to which the Members of Parliament are appointed after ⚫their election as such Members . The Petitioner was , therefore , asked to furnish specific information in that regard vide the Commission's Notice dated 6th April , 2006 .
4. The Petitioner submitted. a letter dated 28th April , 2006, enclosing therewith a biographical sketch of the respondent, downloaded from the website prepared by the Parliament Secretariat on the basis of self declaration by the respondent. He did not furnish any document containing the specific information as called for. He , however , stated that he would furnish the desired information shortly. Therefore , the petitioner was again called upon, vide Notice on 12th May, 2006, to furnish the requisite specific information, by 31st May , 2006.
5. The Petitioner thereafter forwarded a photocopy of the "Hooghly River Bridge Act, 1969 " with his letter in reply to the said Notice, on 3rd June, 2006, and contended that as per provisions of Section 3 (4) of the Act, the post of the Chairman of the Corporation was an office of profit . He also requested the Commission to proceed expeditiously in the matter, collect all the required materials and send its opinion to the President .
6. As the petitioner was not able to furnish specific information about the date of last/ latest appointment of the respondent to the said office and other details about the profit, if any , accruing to the respondent , the Commission decided to obtain the relevant information from the State Government of West Bengal , to enable the Commission to give its opinion to the President on the question of alleged disqualification referred to the Commission under Article 103(2) . Accordingly, vide letter dated 17 : 6.2006 , the Commission requested the State Government to furnish the relevant information by 3.7.2006. On a request from the State Government , the time was extended to 15.7.2006 , on which date a reply was received from the State Government .
7. The State Govt . enclosed a copy of a note given by the Advocate General of the State. with an endorsement that the Government agreed with the view of the Advocate General . The Advocate General's note basically stated that the Commission should obtain the information from the respondent. The Commission wrote back to the State Government, on 21.7.2006, bringing to its notice the provisions of Section 146 of the Representation of the People Act, 1951 , and pointing out that the State Government was obliged to furnish the information sought by the Commission.
8. The State Government submitted a reply on 1.8.2006 , enclosing, inter alia, copies of notifications of appointments of the respondent in this reference case as well in respect of respondents in another case. The documents submitted by the State Government showed that the respondent's case is of post-election appointment . The notification of
33 63 G1/06-3 10
THE GAZETTE OF INDIA : EXTRAORDINARY
[PART II-SEC . 3 (ii) ] appointment of the member furnished by the State Govt . mentioned that he will not draw any salary during his tenure as Chairman , Hooghly River Bridge Commissioners . In these circumstances, the Commission , on 18.8.2006, sent copies of the documents furnished by the State Govt .to the petitioner for his comments thereon by 25.8.2006 . It is seen that the name of the office has been wrongly described by the petitioner as ' Chairman , Hooghly River Bridge Corporation ' . The correct name appears to be " Chairman , Hooghly River Bridge Commissioners ' , as mentioned in the documents submitted by the StateGovt.
9 . In the meantime, the Parliament (Prevention of Disqualification) Amendment Act , 2006, amending the Principal Act of 1959 , was enacted by the Parliament and notified after the Presidential assent on 18.8.2006 . A copy of this Amendment Act was received from the Ministry of Law and Justice on 21.8.2006 . By the Amendment Act, the offices of Chairman , Deputy Chairman , Secretary or Member ( by whatever name called) , among others , in The Hooghly River Bridge Commissioners , constituted under the Hooghly River Bridge Act, 1969 , have been declared under Section 3 (k) of the Principal Act , as the office the holders whereof shall not be disqualified for being chosen as , and for being Members of Parliament. These amendments to the Principal Act have been brought into force with retrospective effect from 4th April , 1959 .
10. On 25.8.2006, the petitioner submitted his response to the documents made available by the West Bengal Government reiterating his earlier contention .
11. In the present case , the Parliament (Prevention of Disqualification ) Amendment Act, 2006 , has a direct bearing . As mentioned above, the provisions of clause (k) of Section 3 of the Principal Act of 1959 and the Table containing the names of the bodies specified therein have been brought into force with effect from 4.4.1959. It is a settled position that under Article 102 ( 1 ) ( a) , the Parliament is empowered to declare, with retrospective effect, an office to be an office the holder whereof shall not be disqualified. The decision of the Supreme Court in Smt . Kanta Kathuria vs. M. Manak Chand Surana [ 1970 (2 ) SCR 838 ] upholds this Constitution position. In the past also , the Commission has taken cognizance.of similar laws passed by the legislatures with retrospective effect, even as enquiry into the references concerned was in progress. In the reference case (No. 4 of 1980 ) regarding alleged disqualification of Sh . Gaya Lal and 23 other members of the Haryana Legislative Assembly , during the pendency of the reference before the Commission, the Haryana State Legislature amended the Haryana State Legislature (Prevention of Disqualification ) Act, 1974 , twice by virtue of which the offices held by

the said MLAs were brought under the exempted categories . In that case , the Commission, in its opinion dated 21-05-1981 held the view that the disqualifications, if any, stood removed in their cases and the reference became infructuous . Similarly, in a reference case { No. 2( G) of 2005 , } relating to alleged disqualification of Shri Mohd. Azam Khan for membership of Uttar Pradesh Legislative Assembly , the State Legislature passed an amendment to the Uttar Pradesh State Legislature (Prevention of Disqualification) Act, 1971 , during the pendency of the proceedings before the Commission . In that matter also , the Commission tendered its opinion to the effect that disqualification, if any, stood removed in view of the amended provisions of the law. Again, in another recent case { Reference Case Nos . 65 (G) to 70 ( G ) 2006 ) on the petition of Sh. Y. Mangi Singh regarding alleged disqualification of 6 MLAs of Manipur , the Commission took note of the Amendment Act passed by the Manipur State Legislature , exempting the offices concerned from disqualification, and opined that the reference had been rendered infructuous . The present case is also similar in facts and circumstances to the above referred cases and the amended provision of law removing the disqualification, if any, squarely apply in this case.
