श्री येरननायडू, संसद् सदस्य ( लोक सभा) और तेलुगु देशम संसदीय पार्टी के अन्य संसद् सदस्यों द्वारा भी हस्ताक्षर की गई याचिका राष्ट्रपति को, संविधान के अनुच्छेद 103 के खंडू ( 1 ) के अधीन श्री टी० सुब्बारामी रेड्डी, आसीन संसद् सदस्य (राज्य सभा) की अभिकथित निरर्हता के संबंध में तारीख 14 मार्च , 2006 और 20 मार्च , 2006 को प्रस्तुत की गई है;
और उक्त याचियों ने यह प्रकथन किया था कि श्री टी० सुब्बारामी रेड्डी तिरुमाला - तिरुपति देव- स्थानम बोर्ड , आंध्र प्रदेश के अध्यक्ष का पद धारण कर रहे हैं जो अभिकथित रुप से लाभ का पद है;
और राष्ट्रपति द्वारा संविधान के अनुच्छेद 103 के खंड (2) के अधीन दो अलग-अलग निर्देशों, अर्थात् एक तारीख 21 मार्च , 2006 के और दूसरे 22 मार्च, 2006 के निर्देश के अधीन इस प्रश्न के संबंध में निर्वाचन आयोग की राय मांगी गई है कि क्या श्री टी० सुब्बारामी रेड्डी संविधान के अनुच्छेद 102 के खंड ( 1 ) के उपखंड (क) के अधीन संसद् सदस्य ( राज्य सभा) होने के लिए निरर्हित हो गए हैं;

और संसद् (निरर्हता निवारण ) संशोधन अधिनियम , 2006 की धारा 2 के खंड ( 11) द्वारा 4 अप्रैल, 1959 से यथा अंतःस्थापित संसद् (निरर्हता निवारण) अधिनियम , 1959 की धारा 3 के खंड (ट ) द्वारा तिरुमाला तिरुपति देव-स्थानम बोर्ड के अध्यक्ष का पद को, अन्य पदों के साथ , ऐसे पद के रुप में घोषित किया गया है, जिसका धारक संसद् का सदस्य चुने जाने के लिए और सदस्य होने के लिए निरर्हित नहीं होगा;
और निर्वाचन आयोग ने अपनी राय (उपाबंध द्वारा) दे दी है कि ऊपर वर्णित याचिका में उठाया गया श्री टी ० सुब्बारामी रेड्डी की अभिकथित निरर्हता का प्रश्न अब निरर्थक हो गया है क्योंकि अभिकथित निरर्हता, यदि कोई थी, संसद (निरर्हता निवारण ) संशोधन अधिनियम , 2006 के उपबंधों के कारण भूतलक्षी प्रभाव से हट गई है;

THE GAZETTE OF INDIA : EXTRAORDINARY

În re:
Alleged disqualification of Shri T. Subba Rami Reddi , Member of the Rajya Sabha, under Article 102 ( 1 ) ( a) of the Constitution
Reference Cases Nos . 7-8 of 2006
[References from the President under Article 103 ( 2 ) of the Constitution ]
OPINION
This opinion relates to two references dated 21st March and 22nd March, 2006, from the President of India, under Article 103 (2) of the Constitution, seeking the opinion of the Election Commission on the question whether, among others , Shri T. Subba Rami Reddi , has become subject to disqualification for being Member of the Rajya Sabha, under Article 102 ( 1 ) (a) of the Constitution . These references dated 21st March , 2006 and 22nd March, 2006 arose out of petitions dated 14th March and 20th March, 2006 submitted to the President by Shri Yerrannaidu , MP ( Lok Sabha) and signed by other MPs of Telugu Desam Parliamentary Party mentioned in the petition .
2. The Commission has already tenderd its Opinion on the question of alleged disqualification in respect of Smt . Sonia Gandhi , Smt. Kapila Vatsayan and Dr. Karan Singh, which was also raised in the aforesaid petitions . The present opinion relates to the question of alleged disqualification of Shri T. Subba Rami Reddi , who was elected to the Rajya Sabha from Andhra Pradesh at the biennial election held in 2002. The petitions of Sh . Yerrannaidu only contained a bald statement that Shri T. Subba Rami Reddi ( respondent ) was holding the office of the Chairman of Tirumala- Tirupathi Devasthanam Board, Andhra Pradesh. The date

[PART II-SEC . 3 (ii)] of his appointment to the said office was , however, not mentioned in the petitions , nor was there any mention of details regarding any ' profit' to the respondent on account of holding the said office . The date of appointment to the alleged office is crucial in taking a decision on such petitions under Article 103 ( 1 ) , as it is only those cases where a sitting member of the House incurs disqualification after becoming a member of the House that come within the jurisdiction of the President under the said Article . As the petitions did not contain any statement with regard to the date of appointment of the respondent as the Chairman of the Tirumala Tirupathi Devasthanam Board, Andhra Pradesh, the Commission asked the petitioners to furnish specific information about the date of appointment of the respondent to the said office and also all relevant information/documents to substantiate the contention that the respondent was holding an office of profit under the Government within the meaning of Article 102 ( 1 ) ( a) . The petitioner , Shri K. Yerrannaidu , in an application dated 15th May 2006 , stated that he was in the process of collecting the requisite information, and that as an individual , he would require substantial time for the same . He made a request that the Commission may obtain the requisite information from the Govt. department concerned .
13. As nothing further was heard from the petitioners , the Commission vide letter dated 17.06.2006 , asked the Government of Andhra Pradesh to furnish the information about the date of appointment of Shri T. Subba Rami Reddi to the aforesaid office , along with copy of the relevant notification . In reply thereto , the Government of Andhra Pradesh , vide letter dated 29th June , 2006 , informed that the matter was transmitted to the Revenue (Endowments) Department and requested to make further correspondence with that department in the matter . The Commission then, vide letter dated 27.07.2006, asked the aforesaid department to furnish the information by 8.8.2006 . However , no reply was received from them.
4. While the matter was thus under consideration of the Commission for further enquiry , the Parliament (Prevention of Disqualification ) Amendment Act , 9
2006, amending the Principal Act of 1959 , was enacted by the Parliament and notified after the Presidential assent on 18.8.2006 . A copy of this Amendment Act was received in the Commission from the Ministry of Law and Justice on 21.8.2006 . By the Amendment Act, the office of Chairman of the Tirumala Tirupathi Devasthanam Board , among others , has been declared, under Section 3 (k) of the Principal Act, as an office the holder of which shall not be disqualified for being chosen as , and for being Member of Parliament . This amendment to the Principal Act has been brought into force with retrospective effect from 4th April , 1959 .
5. The above mentioned Amendment Act of 2006 has a direct bearing on the present reference cases . As mentioned above , the provisions of clause (k) of Section 3 of the Principal Act of 1959 have been brought into force with effect from 4.4.1959 . It is a settled position that under Article 102( 1 ) ( a) , the Parliament is empowered to declare , with retrospective effect , an office to be an office the holder whereof shall not be disqualified . The decision of the Supreme Court in Smt . Kanta Kathuria vs. M. Manak Chand Surana [ 1970 (2) SCR 838 ] upholds this constitutional position. In the past also , the Commission has taken cognizance of similar laws passed by the legislatures with retrospective effect , even as enquiry into the references concerned was in progress . In the reference case (No. 4 of 1980) regarding alleged disqualification of Sh . Gaya Lal and 23 other members of the Haryana Legislative Assembly, during the pendency of the reference before the Commission , the Haryana State Legislature amended the Haryana State Legislature (Prevention of Disqualification) Act , 1974, twice by virtue of which the offices held by the said MLAs were brought under the exempted categories . In that case , the Commission, in its opinion dated 21-05-1981 held the view that the disqualifications , if any, stood removed in their cases and the reference became infructuous . Similarly , in a reference case { No. 2( G) of 2005 , } relating to alleged disqualification of Shri Mohd . Azam Khan for membership of Uttar Pradesh Legislative Assembly , the State Legislature passed an amendment to the Uttar THE GAZETTE OF INDIA : EXTRAORDINARY
[PART II-SEC . 3 (ii) ] 10
Pradesh State Legislature ( Prevention of Disqualification) Act, 1971 , during the pendancy of the proceedings before the Commission. In that matter also , the Commission tendered its opinion to the effect that disqualification, if any , stood removed in view of the amended provisions of the law . Again, in another recent case { Reference Case Nos . 65 (G) to 70 ( G) 2006) on the petition of Sh . Y. Mangi Singh regarding alleged disqualification of 6 MLAs of Manipur , the Commission took note of the Amendment Act passed by the Manipur State Legislature, exempting the offices concerned from disqualification , and opined that the reference had been rendered infructuous . The present cases are similar in facts and circumstances to the above referred cases and the amended provisions of law removing the disqualification , if any , squarely apply in these cases .
6. Having regard to the above constitutional , legal and factual position, the Commission is of the considered view that the question of alleged disqualification of Shri T. Subba Rami Reddi raised in the two petitions , referred to in paragraph 1 above , has now become infructuous as the alleged disqualification , if any , stands removed with retrospective effect by virtue of the Parliament ( Prevention of Disqualification) Amendment Act , 2006. Accordingly , the two references from the President referred to in paragraph 1 above are returned with the Commission's opinion to the effect that the Shri T. Subba Rami Reddi is not subject to disqualification under Article 102 ( 1 ) (a) on account of his appointment to the office of the Chairman of the Tirumala - Tirupathi Devasthanam Board, as alleged in the two petitions .
