THE GAZETTE OF INDIA : EXTRAORDINARY

श्री अमिताव नन्दी उपाध्यक्ष, स्टेट फिशरीज डेवेलपमेंट कारपोरेशन (पश्चिमी बंगाल) ;

वेस्ट बेंगाल माइनोरिटीज डेवेलपमेंट एंड फाइनेंश कॉरपोरेशन, वेस्ट बेंगाल माइनोरिटीज, डेवेलपमेंट एंड फाइनेंश कॉरपोरेशन ऐक्ट, 1995 के अधीन गठित एक निकाय ;

वेस्ट बेंगाल फिशरीज कारपोरेशन लिमिटेड ;

383995706-2 6

[PART II-SEC. 3(ii)]

3. The present opinion relates to the question of alleged disqualification of five of the remaining seven Members of Parliament referred to in para 1 above, 38395708-3 10

THE GAZETTE OF INDIA : EXTRAORDINARY

[PART II SEC. 3(1 )] namely, Shri Mohammed Salim Shri Hannan Mollah, Shri Amitava Nandy, Shri Swadesh Chakraborty and Sh. Amar Singh . The opinion in respect of the last two members , namely , Shri Santosh Gangwar and Shri Bhupendra Singh Prabhat Singh Solanki will be finalized subsequently, as their cases are still under enquiry by the Commission .

The allegations in the petition with regard to the offices held by the abovementioned five members are as given below:

Name of Member

Name of office allegedly held by him

1

Shri Mohammed Salim

Chairman, Minority Development Corporation (West Bangal)

21 Shri Hannan Mollah

Head, West Bengal Waqf Board

3 Shri Amitava Nandy

Vice Chairman, State Fisheries Deve- lopment Corporation (W.B)

4

Chairman, HRBC

Shri Swadesh Chakraborty

.5.1 Shri Amar Singh

Chairman, HRBCO

4. The petitioner has contended that the above mentioned offices held by the above members are offices of profit under the Government and the said members have incurred disqualification under Article 102 (1 ) (a) on account of their holding these offices.

5. The petition of Sh . Khandelwal was not accompanied by any document to support his contention that the offices to which the said members had been appointed were offices of profit under the Government. The petition did not even contain the basic information about the dates of appointments of the members to the offices referred to in the petition . The date of appointment of a Member to an office is vital to determine whether the case falls within the jurisdiction of the President to decide in terms of Article 10$ ( 1 ) . It is well settled by catena of decisions of the Supreme Court { See Election Commission Vs. Saka Venkata Rao (AIR 1953 SC 201 ) ; Brundaban Naik Vs. Election Commission (AIR 1965 SC 1892) ; Election Commission Vs. N.G.Ranga ( AIR 1978 SC 1609) } that under Article 103 of the Constitution, the President and the Election

Commission can look into the questions of only those offices to which the Members of Parliament are appointed after their election as such Members . The petitioner was, therefore, asked to furnish , by 5th May, 2006, specific information in that regard , vide the Commission's Notice dated 21st April , 2006 .

6 In reply to the notice dated 21.4.06, the petitioner submitted a letter dated 10.5.06, stating that he would require a minimum period of three months to collect the relevant material , and therefore , requested for further time of three months to furnish the requisite details . The Commission asked the petitioner to submit the requisite information/documents by 22.6.06 . However, the petitioner did not submit any document or reply whatsoever . Still , the Commission wrote to the petitioner again, vide letter dated 14.8.06, asking him to furnish the requisite basic details . In the said letter , the Commission also pointed out to the petitioner that the office mentioned against the names of two of the respondents , Shri Swadesh Chakraborty and Shri Amar Singh, was 'Chairman , HRBC' , and asked the petitioner to clarify this and give the full description of the office referred to against these two respondents . The petitioner was asked to submit his reply by 4.9.06 . Again, the petitioner did not submit any reply to the Commission's letter dated 14-08-06 .

7. In the meantime, the Parliament ( Prevention of Disqualification) Amendment Act, 2006, amending the Principal Act of 1959 , was enacted by the Parliament and notified after the Presidential assent on 18.8.2006. A copy of this Amendment Act was received from the Ministry of Law and Justice on 21.8.2006. By the Amendment Act, the offices ofChairman, Deputy Chairman, Secretary or Member ( by whatever name called) in the following bodies , among others , have been declared under Section 3 (k) of the Principal Act, as the offices the holders whereof shall not be disqualified for being chosen as, and for being , Members of Parliament: -

The West Bengal Minorities Development and Finance Corporation, a body constituted under the West Begai Minorities Development and Finance Corporation Act , 1995 .

[PART II-SEC. 3( i)]

The Board of Wakf, West Bengal ;

The State Fisheries Development Corporation Ltd. , West Bengal ;

TheWest Bengal Fisheries Corporation Ltd .;

The Hooghly River Bridge Commissioners , constituted under the Hooghly River Bridge Act, 1969 ;

These amendments to the Principal Act have been brought into force with retrospective effect from 4th April , 1959 .

8. The abovementioned amendment has a direct bearing on the question of alleged disqualification of Shri Mohammed Salim , Shri Hannan Mollah, Shri Amitava Nandy, Shri Swadesh Chakraborty and Shri Amar Singh. The office mentioned against Shri Swadesh Chakraborty and Sh . Amar Singh is 'HRBC' . In another reference case , on a petition of Sh . Mukul Roy , the question of alleged disqualification of Sh . Swadesh Chakraborty was raised on the ground of his appointment to the office of Chairman of Hooghly River Bridge Commissioners . In the absence of any clarification or response by the present petitioner about the full description of the office represented by ' HRBC' , it has to be presumed that the acronym 'HRBC' stands for 'Hooghly River Bridge Commissioners ' . The office mentioned against Sh . Amar Singh also , therefore , has to be presumed to be ' Hooghly River Bridge Commissioners ' , although it is not clear how two different persons could be stated to be holding the same office. If the petitioner's case was that they held it in different periods , he had a duty to tell the specific period during which they held the office , a duty which the petitioner has failed to discharge despite repeated opportunities and specific notice to that effect.

買 9. As stated above , the provisions of clause (k) of Section 3 of the Principal Act of 1959 and the Table containing the names of the bodies , specified in paragraph 7 above , have been brought into force with effect from 4.4.1959. It is a settled position that under Article 102( 1 ) (a) , the Parliament is empowered to declare , with retrospective effect , an office to be an office the holder whereof shall not be disqualified. The decision of the Supreme Court in Smt. Kanta Kathuria vs. M. Manak Chand Surana [ 1970 (2) -SCR 838 ] upholds this constitutional position. In the past also the Commission has taken 13

cognizance of similar laws passed by the legislatures with retrospective effect, even as enquiry into the references concerned was in progress . In the Reference Case No. 4 of 1980 regarding alleged disqualification of Sh . Gaya Lal and 23 other members of the Haryana Legislative Assembly, during the pendency of the reference before the Commission, the Haryana State Legislature amended the Haryana State Legislature (Prevention of Disqualification) Act, 1974, twice , by virtue of which the offices held by the said MLAs were brought under the exempted categories . In that case , the Commission, in its opinion dated 21-05-1981 , held the view that the disqualifications , if any, stood removed in their cases and the reference became infructuous . Similarly, in a recent reference case ( No. 2(G) of 2005 , } relating to alleged disqualification of Shri Mohd . Azam Khan for membership of Uttar Pradesh Legislative Assembly, the State Legislature passed an amendment to the Uttar Pradesh State Legislature (Prevention of Disqualification) Act, 1971 , during the pendency of the proceedings before the Commission. In that matter also , the Commission tendered its opinion to the effect that disqualification, if any, stood removed in view of the amended provisions of the law . Again, in another recent case { Reference Case Nos . 65(G) to 70 ( G) 2006) )} on the petition of Sh. Y. Mangi Singh regarding alleged disqualification of 6 MLAs of Manipur , the Commission took note of the Amendment Act passed by the Manipur State Legislature, exempting the offices concerned from disqualification, and opined that the reference had been rendered infructuous . The present case, in so far as S/Shri Mohammed Salim , MP (Lok Sabha) , Hannan Mollah, MP (Lok Sabha) , Amitava Nandy, MP (Lok Sabha) , Swadesh Chakraborty, MP (Lok Sabha) , and Amar Singh MP (Rajya Sabha) are concerned , is also similar in facts and circumstances to the above referred cases and the amended provisions of law removing the disqualification, if any, squarely apply in their cases .

10. Having regard to the above constitutional , legal and factual position , the Commission is of the considered view that the question raised in the petition dated 24th March , 2006 , of Sh . Khandelwal , does not survive now, in so far as it relates to the question of alleged disqualification of ( 1) Shri Mohammed Salim , MP (Lok Sabha) , (2) Shri Hannan Mollah , MP ( Lok Sabha) , (3 ) Shri Amitava Nandy, MP (Lok Sabha) , (4) 38391/06-4 14

THE GAZETTE OF INDIA : EXTRAORDINARY

PART II SEC . 3(ii) )

Shri Swadesh Chakraborty , MP (Lok Sabha) , and (5) Shri Amar Singh , MP (Rajya Sabha) , as the alleged disqualifications , if any, in their cases stand removed with retrospective effect by virtue of the Parliament ( Prevention of Disqualification) Amendment Act 2006. Accordingly, the reference from the President is returned with the Commission's opinion to the effect that the aforesaid five Members of Parliament are not subject to disqualification under Article 102 ( 1 ) (a) on account of their appointments to the offices mentioned in the petition . As mentioned above, the opinion on the question of alleged disqualification of Sh . Santosh Gangwar and Sh . Bhupendra Singh Prabhat Singh Solanki which has also been raised in the petition of Sh. Khandelwal, will be tendered separately after further consideration and enquiry.
