श्री हेम कान्त फुकन , रूपनगर , गुवाहाटी द्वारा राष्ट्रपति को , संविधान के अनुच्छेद 103 के खंड ( 1 ) के अधीन श्री सिलवियस कोनडपेन , संसद् सदस्य ( राज्य सभा ) की अभिकथित निरर्हता का प्रश्न उठाते हुए तारीख 28 जुलाई , 2006 की याचिका प्रस्तुत की गई है;

और उक्त याची ने यह प्रकथन किया है कि श्री सिलवियस कोन्डपेन , असम को- आपरेटिव एपेक्स बैंक लिमिटेड , गुवाहाटी की प्रशासनिक परिषद् के सदस्य का पद धारण कर रहे हैं और बैंक से फायदा आहरित कर रहे हैं;

और राष्ट्रपति द्वारा संविधान के अनुच्छेद 103 के खंड ( 2 ) के अधीन तारीख 4 अगस्त, 2006 के एक निदेश द्वारा इस प्रश्न पर निर्वाचन आयोग की राय मांगी गई थी कि क्या श्री सिलवियस कोन्डपेन संविधान के अनुच्छेद 102 के खंड ( 1 ) के उपखंड ( क) के अधीन संसद् ( राज्य सभा ) के सदस्य बने रहने के लिए निरर्हित हो गए हैं;

और निर्वाचन आयोग ने यह नोट किया है कि श्री सिलवियस कोन्डपेन , अप्रैल , 2004 में राज्य सभा के सदस्य के रूप में अपने निर्वाचन के पश्चात्, बैंक के एक शेयर धारक के रूप में अपनी निजी हैसियत में बैंक के शेयरधारकों द्वारा असम को- आपरेटिव एपेक्स बैंक लिमिटेड, गुवाहाटी की प्रशासनिक परिषद् के सदस्य के रूप में निर्वाचित हुए थे;

और निर्वाचन आयोग ने यह और नोट किया है कि प्रशासनिक परिषद् के चुने गए सदस्यों की नियुक्ति , उन्हें हटाए जाने आदि में न तो राज्य सरकार की और न ही केन्द्रीय सरकार की कोई भूमिका है और इस प्रकार, प्रशासनिक परिषद् का कोई सदस्य , जो इस प्रकार निर्वाचित हुआ है, सरकार द्वारा की गई किसी नियुक्ति के कारण कोई पद धारण नहीं कर रहा है;

और निर्वाचन आयोग ने भगीरथी प्रसाद दीक्षित घोड़ेवाला बनाम राजीव गांधी ( एआईआर 1986 एससी 658 ) के मामले में उच्चतम न्यायालय के निर्णय का संज्ञान किया है, जिसके द्वारा सर्वोच्च न्यायालय ने यह अभिनिर्धारित किया था कि संसद् और राज्य विधान मंडलों के सदस्य, सरकार के अधीन कोई लाभ का पद धारण नहीं कर रहे हैं, क्योंकि उन्हें उस रूप में सरकार द्वारा नियुक्त नहीं किया गया है अपितु उन्हें जनता द्वारा निर्वाचित किया गया है; और निर्वाचन आयोग ने अपनी राय ( उपाबंध द्वारा ) दे दी है कि श्री सिलवियस कोन्डपेन संविधान के अनुच्छेद 102 के खंड ( 1 ) के उपखंड (क ) के अर्थान्तर्गत असम सरकार या किसी अन्य सरकार के अधीन ' लाभ का पद्' धारण नहीं कर रहे हैं और परिणामतः वे संसद् सदस्य ( राज्य सभा ) , होने के लिए निरर्हता के अध्यधीन नहीं हैं;

(i ) क्या नियुक्ति सरकार द्वारा की जाती है ;

(ii) क्या सरकार के पास पद धारक को हटाने या उसे पदच्युत करने का अधिकार है ;

(iii) क्या पारिश्रमिक का संदाय सरकार द्वारा किया जाता है ;

OPINION

This is a reference dated 4th August, 2006, from the President of India , under Article 103 (2 ) of the Constitution , seeking the opinion of the Election Commission on the question whether Shri Silvius Condpan (respondent ) has become subject to disqualification for being Member of the Rajya Sabha, under Article 102 (1 ) (a) of the Constitution .

2. The above question arose on petition dated 28th July, 2006 submitted by Shri Hema Kant Phukan, Rupnagar, Guwahati to the President, under Article 103( 1 ) of the Constitution, raising the question of alleged disqualification of Shri Shri Silvius Condpan, Member of the Rajya Sabha, under Article 102 (1 )(a) , on the ground that he is also the Member of the Administrative Council of the Assam Co -operative Apex Bank Limited ,. Guwahati (hereinafter referred as Bank) . As per the petitioner's averment, the respondent is holding the post of Member of the Administrative Council of the Bank and drawing the benefit from the said Bank. The date of appointment of the respondent to the said office was , however, not mentioned inthe petition. But, the petitioner had also enclosed a copy of the letter dated 4th July, 2005 of the Office of the Registrar of Co - operative Societies , Assam, Guwahati addressed to the Managing Director of the Bank conveying the approval of the Registrar of Cooperative Societies , Assam to the proceedings of the Annual General Meeting of the Bank constituting the Administrative Council of the Bank. In that Council , the respondent was shown as a Director representing individual shareholders of the Bank in the Administrative Council of the Bank.

3. The respondent was elected to the Member of Rajya Sabha at the biennial election held in April 2004 and it could be deduced from the enclosures to the petition submitted by the petitioner that the respondent became Member of the Administrative Council of the Bank after his election as a Member of Parliament (Rajya Sabha) .

4. The Commission issued notice to the respondent on 6th September , 2006 asking him to file his written statement, supported by proper affidavit, in reply to the allegations contained in the said petition.

5. The respondent filed his written statement on 16-10-2006 and served a copy thereof on the petitioner . The respondent refuted the allegations and stated that the Assam Co-operative Apex Bank Limited is a co -operative society. registeredunder the Assam Co - operative Societies Act, 1949, and further, relying on Section 3 (i ) of the Parliament (Prevention ofDisqualification) Act, 1959 (hereinafter referred as 1959 Act) contended that a member of any such body which comes within the purview of clause ( i) of Section 3 of the 1959 Act and who is not entitled to any remuneration other than compensatory allowanc does not stand disqualified from being a Member of the Parliament .

6. The respondent further contended that the post of a Member of the Administrative Council of the Bank is neither an "Office " nor "Office of Profit" under either the State Government or Central Government as the members of the said Council of the Bank are elected by the shareholders of the Bank in a democratic process and neither the State nor the Central Government has anything to do with the appointment, removal etc. of such members of the Administrative Council of the Bank.

7. The respondent further stated that being a shareholder of the Bank , he was elected in his individual capacity as a member of the Administrative Council and the said election was approved by the Registrar of Co - operative Societies as per the provisions of the Assam Co-operative Societies Act , 1949. The role of the Registrar in approving the elections is only supervisory in nature and is limited to the extent that the Registrar is only to see that the elections have been held in accordance with law.

8. The respondent has also submitted that as per the Bye-law 31 of the Bank, only travelling allowance and a sitting fees of Rs . 100 (Rupees one hundred per sitting) is payable to the members to enable them to attend the meetings of the Council/Board/ Committees only for the day of the meeting . He further stated that he has not drawn any sitting allowance or travelling allowance from the Bank from the date he was elected to the post of Member of the said Council of the Bank . He added that the Compensatory Allowance is paid from the funds of the bank and is not paid by the State or Central Government .

9. The petitioner was asked to submit his rejoinder, if any, within one week of receipt of the written statement of the respondent. The petitioner has neither filed rejoinder nor submitted any communication in this regard.

10. The Commission has considèred all aspects of the matter, the written submissions made and the legal position. The primary issue for consideration here is whether the office of Member of the Administrative Council of the Assam Co -operative Bank Limited is an " Office" under the Government within the meaning of Article 102( 1 )(a) of the Constitution of India.

11. In this regard, it is to be noted that it is not the holding of every office which disqualifies a persori for membership of Parliament or of a State Legislature but it should be the holding of (i) an office (ii) an office of Profit ( iii ) and office under the Government of India or the Government of any State . All these ingredients must be satisfied together , before a person can be said to have incurred disqualification under Article 102(1 ) (a) .

12. The term 'office of profit under the Government ' though not defined in Constitution or the Representation of the People Act, 1951 , has been the subject matter of interpretation in several cases before the Supreme Court . Through authoritative rulings in several decisions , the Supreme Court has enunciated the factors that determine whether an office is an office ofprofit under Government for the purposes of Articles 102( 1 )(a) and 191 ( 1 ) ( a) . In Maulana Abdul Shakur Vs Rikhab Chand ( AIR 1958 SC 52), the Supreme Court held:

[PART II- SEC . 3 ( ii ) )

THE GAZETTE OF INDIA : EXTRAORDINARY

8

"... the power of the Government to appoint a person to an office or to continue him in that office or revoke his appointment at their discretion and payment from out of Governinent revenues important factors in determining whether a person is holding office of profit under the Government, though payment from a source other than Government is not a decisive factor . "

13.In Shivamurthy Swami Inamdar Vs Agadi Sanganna Andanappa (AIR 1971 SCE 870 ) , the Supreme Court summed up the following tests to determine whether an office is an office of profit under the Govemment:

(1) Whether the Government makes the appointment;

(ii) Whether the Government has the right to remove or dismiss the holder,

(iii) Whether the Government pays remuncration;

(iv) What the functions of the holder are and whether he performs them for Government; and

(v) Whether the Government exercises any control over the performance of these functions .

14. In the instant case , it is an admitted position that the respondent , after his election as a Member of Rajya Sabha in April, 2004, was elected as a member of the Administrative Council of the said Bank, by the shareholders of the Bank being a shareholder of the bank in his individual capacity . Neither the State Govt. nor the Central Government has any role in the appointment, removal etc. of the Members of the Administrative Council to chosen . Thus , a Member of the Administrative Council , so elected, is not holding that post or office by virtue of any appointment made by the Government . The role of the Registrar in approving the elections is only supervisory in nature and is limited to the extent to see that the elections are held in accordance with law. The appointment is wholly dependent on the choice of the shareholders of the Bank.

15. Under the Constitutional provisions and the abovementioned interpretation given thereto in judicial pronouncements , for an office to be treated as an office under the Government for the purposes of disqualification , the office, in the first place, has to be an office under the Central Government or the Government of a State . The basic criteria to determine whether an office is an office under the Government is the vital issue of power to make the appointment to the office and , further, to continue or remove the incumbent from the office at the discretion of the Government. In the instant case , as already observed above , the Government has neither any power nor any role either in the appointment or removal ofthe respondent as a Member of the Administrative Council of Bank.

16. In this context, it would be apt to refer to the decision of the Supreme Court inBhagrathi Pd. Dixit Ghorewala Vs.Rajiv Gandhi ( AIR 1986 SC 658 ) whereby the Apex Court held that Members of Parliament and State Legislatures are not holdingOffice of Profit under the Government, as they are not appointed as such by the Government but are elected bythe people

17. Having regard to the above , the Commission is of the considered opinion that the respondent does not hold and 'Office of Profit under the Government ' of Assam or any other Government within the meaning of Article 102( 1 ) (a) of the Constitution , and consequently , he is not subject to disqualification for being a Member of Parliament (Rajya Sabha) under the said Article. The reference is , accordingly , returned with the opinion under Article 103 (2 ) . to the effect that the respondent is not subject to disqualification under Article 102 ( 1 ) (a) , on the ground raised in the present petition.
