(ix ) फेडरेशन ऑफ इंडियन चैम्बर ऑफ कामर्स एंड इंडस्ट्री (फिक्की) में विभिन्न अन्य पद;

और राष्ट्रपति द्वारा तारीख 19 अप्रैल , 2006 को संविधान के अनुच्छेद 103 के खंड ( 2 ) के अधीन एक निर्देश द्वारा इस बारे में निर्वाचन आयोग की राय मांगी गई है कि क्या श्री नवीन जिन्दल , संविधान के अनुच्छेद 102 के खंड ( 1 ) के उप - खंड ( क ) के अधीन संसद सदस्य ( लोक सभा ) होने के लिए निरर्हित हो गए हैं अथवा नहीं;

अतिरिक्त रवि शंकर शुक्ला विश्वविद्यालय में सिनेट के पद को संसद (निरर्हता निवारण ) अधिनियम , 1959 की धारा 3 के खंड (च ) के अधीन निरर्हता से छूट प्राप्त है;

और निर्वाचन आयोग ने यह कथन किया है कि हरियाणा राज्य का प्रतिनिधित्व करने के लिए परिसीमन आयोग के सहबद्ध सदस्य के पदं को सरकार के अधीन लाभ का पद इसलिए नहीं माना जा सकता क्योंकि सहबद्ध सदस्यों को लोक सभा के अध्यक्ष और संबंधित राज्य की विधान सभा के अध्यक्ष द्वारा सदन के या संबंधित विधान सभा के सदस्यों में से , उस सदन/विधान सभा की सरंचना का सम्यक् ध्यान रखते हुए परिसीमन अधिनियम, 2002 की धारा 5 के अधीन नामनिर्दिष्ट किए जाते हैं और साथ ही उन्हें परिसीमन आयोग की बैठकों में उपस्थित होने वाले दिवसों के लिए टी ए और डी ए के अलावा किसी पारिश्रमिक का संदाय नहीं किया जाता है ;

और निर्वाचन आयोग ने अपनी राय ( उपाबंध द्वारा ) दे दी है कि ( i ) सरकार के अधीन न आने वाले पदों, जो इस कारण से संविधान के अनुच्छेद 102 के खंड ( 1 ) के उप-खंड ( क ) के उपबंधों को आकर्षित नहीं करते हैं या ( ii ) श्री नवीन जिन्दल के 2004 में संसद सदस्य ( लोक सभा ) के रूप में निर्वाचन से काफी समय पूर्व की गई नियुक्तियों के संबंध में याचिका में उठाए गए प्रश्न संविधान के अनुच्छेद 103 के खंड ( 1 ) के अधीन चलाने योग्य नहीं हैं;

[PART II- SEC . 3 (ii ) ]

(i ) सदस्य, राज्य निवेश संवर्धन बोर्ड, छत्तीसगढ़;

(ii ) सदस्य , छत्तीसगढ़ विज्ञान एवं प्रौद्योगिकी परिषद्;

(iii) सिनेट सदस्य, रवि शंकर शुक्ला विश्वविद्यालय , रायपुर;

(iv) सहबद्ध सदस्य , हरियाणा से परिसीमन आयोग;

(v) अध्यक्ष, छत्तीसगढ़ इक्वीस्ट्रीयन संगम;

(vi ) उपाध्यक्ष , जिन्दल इस्पात और विद्युत लिमिटेड;

(vii ) निदेशक, जिन्दल विद्युत लिमिटेड;

[PART II- SEC . 3 (ii ) ] THE GAZETTE OF INDIA : EXTRAORDINARY

OPINION

This is a reference dated 19th April , 2000, from the President of India, under Article 103 (2) of the Constitution , seeking the opinion of the Election Commission on the question whether Shri Naveen Jindal (respondent ) has become subject to disqualification for being Member of the Lok Sabha, under Article 102 ( 1)(a) of the Constitution .

2. The above question arose on a petition dated 7thApril , 2006 submitted by Shri Jayant Bhidar , Ex-member , Pradesh Congress Committee , Raigarh, Chhattisgarh , to the President, under Article 103 (1) . of the Constitution , raising the question of alleged disqualification of Shri Naveen Jindal , Member of the Lok Sabha, under Article 102(1) (a) , on the ground that he is also holding the following nine offices ofprofit:---

(i) Member , State Investment Promotion Board, Chhattisgarh,

(ii) Member , Chhattisgarh Science & Technology Council,

(iii) Senate member, Ravishankar Shukla University, Raipur;

(iv) Associate Member , Delimitation Commission fromHaryana;

(v) President , Equestrian Association of Chhattisgarh ;

(vi) Vice-President, Jindal Steel and Power Limited ;

(vii) Director , Jindal Power Limited;

(viii) Chairman , FICCI State Council of Chhattisgarh and

(ix) Holding various other posts in Federation of Indian Chamber of Commerce and Industry (FICCI).

3. However , in the petition , neither the date of appointment of the respondent to any of the said offices was mentioned , nor was there any mention of details regarding any ' profit ' accruing from those offices to the respondent.

4. The information relating to the date ofappointment to the alleged offices and whether the Government has any control over the alleged office are crucial in taking a decision on such petition under Article 103 (1 ) , as it is only those cases where a sitting member of the House incurs disqualification after becoming a member ofthe House for holding an' office of profit' under the Central or State Govt . that come within the jurisdiction of the President under the said Article . As the petition did not contain any statement with regard to the dates of appointment of the respondent to the alleged offices , the Commission , vide its notice dated 29-04-2006 , asked the petitioner to furnish specific information about the dates of appointment of the respondent to the said offices and also all relevant information/documents to substantiate the contention that

954 GT/07-2

the respondent was holding offices of profit under the Government within the meaning of Article 102(1)(a) .

5. In response to the said notice , the petitioner vide his letter dated 15-05-2006 furnished some sketchy information about the dates of appointment of the respondent to some of the offices mentioned in the original petition.He also furnished some self- attested photo copies of-documents, like , press clippings , letters, list of directors , Govt . Notifications , information collected under RTI Act 2005, bio- data downloaded from website in support of his contentions.

6. On scrutiny of the information and documents furnished by the petitioner , it was observed that the offices ofthe(1) Executive Vice Chairman and Managing Director , Jindal Steel and Power Ltd .; (2) Chairman , Board of Directors , Jindal Power Ltd .; (3 ) President , Equestrian Association of Chhattisgarh ; and (4 ) Co - President , Federation of Indian Chamber of Commerce and Industry (FICCI) , Chairman, FICCL State Council of Chhattisgarh; Chairman , Young Leader Forum - FICCI; Chairman, Steel Committee - FICCI were not offices under the Central or State Govt. The offices held by the resporident in the Jindal Group of Companies, private companies , can by no stretch of imagination be said to be offices under the Government. Similar is the position in respect of the offices held by him in FICCI. Appointment to the office of the Senate Member , Ravi Shankar Shukla University was made in 2002, and hence is a pre -election case , apart from the fact that the office is exempted from disqualification under clause (f) of Section 3 of the Parliament (Prevention of Disqualification) Act, 1959. The appointment as a Member of the Chhattisgarh State Investment Promotion Board, as per petitioner's own statement, was made on 15-11-2003 , and hence is again a case of pre -election disqualification , if any. The office of Associate Member of the Delimitation Commission representing the State of Haryana cannot be considered as an office of profit under the Government . The Associate Members of the Delimitation Commission are nominated under Section 5 of the Delimitation Act, 2002, by the Speaker of the Lok Sabha and the Speaker of the Legislative Assembly of the State concerned from amongst the members of the House of the Assembly concerned having due regard to the composition of the House/Assembly. They are not paid any remuneration except the TA& DA for the days they attend the meetings ofthe Delimitation Commission .

7. Thus , the only issue left is the appointment of the respondent as Member , Chhattisgarh Science and Technology Council . The petitioner did not submit the requisite information regarding this appointment . Therefore , the Commission decided to obtain necessary details from the Govt . of Chhattisgarh . Accordingly , the State Government of Chhattisgarh was requested to furnish necessary basic infromation with regard to the date and mode of appointment of the respondent to the said office alongwith copies of the relevant orders /notifications making 6

THE GAZETTE OF INDIA : EXTRAORDINARY

the initial appointment , re - appointment , terms and conditions of appointment and subsequent modifications , ifany, vide the Commission's letter dated 17-06-06 , which was followed by reminders dated 13-09-06 and 06-11-06 as the State Govt . did not respond initially.

8. The State Govt . of Chhattisgarh ultimately furnished the desired information vide letters dated 23-11-2006 and 28-11-2006 . The information furnished by the Govt. shows that the respondent was nominated as a member of the Executive Committee of the Chhattisgarh Council of Science and Technology , Raipur . in the month ofOctober , 2002 by a decision taken by the then Chief Minister , who was the ex - officio President of the Council . Following this decision , a letter was sent to Sh. Jindal to attend the meeting of the Council. Other than this letter , there was no order/ notification about the appointment of the respondent to this office . As per the Memorandum of Association and Regulation (5 ) of the Council , the term of the member of the Council , other than official members. shall be three years from the date of their nomination or till such time as their membership is terminatedby the State Government , but will not continue for more than 6 months . Further , it is observed that no sitting fees or compensation isapplicable to members of the Executive Committee of the Council . The State Government has also informed that the respondent has not attended any of the meetings of the Executive Committee of the Council . Therefore , it cannot be said that the respondent assumed the said office. In any event, the case is of a pre - election appointment and hence it is not necessary to go further into this question .

9. Therefore , there is no question of any disqualification under Article 102 ( 1 ) ( a ) on account of the alleged appointment of the respondent to these positions . it is well- settled constitutional position that the question ofpre-electiondisqualification cannot be raised before the President under Art . 103 ( 1 ) . The Election Commission also has no jurisdiction to express any opinion on the question of such alleged pre - election disqualification. if any . Cases

[PART II -SEC . 3 ( ii) ]

ofpre- electiondisqualification , i.e. disqualification existing on the date of or prior to the election can only be raised before the High Court concerned , under Article 329 (b ) of the Constitution and Part VI of Representation of the People Act, 1951. and not before the President under Article 103 ( 1 ) . The question of allegeddisqualification of Shri Naveen Jindal on the ground of appointments to various offices made prior to his election as Member of Parliament in April - May , 2004 is thus not maintainable before the President in terms of Article 103 ( 1 ) of the Constitution . Reference is invited , in this connection, to the Supreme Court's catena of decision in Election Commission Vs. Saka Venkata Rao ( AIR 1953 SC 201 ) ; Brundaban Naik Vs. Election Commission ( AIR 1965 SC 1892 ) ; Election Commission Vs. N.G. Ranga (AIR 1978 SC 1609 ); etc. In a very large number of other similar cases in the past, the Commission has given similar opinion , on the references madeto it by the President and Governors of States .

10. In view of the above , the questions raised in the petition are either ( i ) in respect of offices not under the Government and hence not attracting the disqualification provisions of Article 102 ( 1 ) ( a) , or ( ii ) in respect of appointments made well before the election of the respondent as Member of the Lok Sabha in 2004 and hence not maintainable under Article 103(1) .

11. The reference received from the Hon'ble President of India. in the present case , is accordingly, returned with the opinion of the Election Commission of India, under Article 103 ( 2 ) of the Constitution , to the above effect.
