सा.का.नि. 72( अ ) - केन्द्रीय सरकार, जीवन बीमा निगम अधिनियम , 1956 ( 1956 का 31 ) की धारा 48 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, भारतीय जीवन बीमा निगम वर्ग 3 और वर्ग 4 कर्मचारी ( सेवा निबंधनों और शर्तों का पुनरीक्षण ) नियम , 1985 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्: -
1. ( 1 ) इन नियमों का संक्षिप्त नाम जीवन बीमा निगम वर्ग 3 और वर्ग 4 कर्मचारी ( सेवा निबंधनों और शर्तों का पुनरीक्षण ) संशोधन नियम , 2008 है ।
(2) ये 1 अप्रैल , 2006 को प्रवृत्त हुए समझे जाएंगे ।
2. जीवन बीमा निगम वर्ग 3 और वर्ग 4 कर्मचारी ( सेवा निबंधनों और शर्तों का पुनरीक्षण ) नियम , 1985 के नियम 13 के उप - नियम (2 ) के परन्तुक के स्थान पर निम्नलिखित परंतुक रखा जाएगा , अर्थात्: -
" परन्तु यह कि-
(i) 10,000 रुपए प्रतिमास से अधिक वेतन पाने वाले किसी कर्मचारी को बोनस के बदले में कोई रकम देय नहीं होगी ;
(ii ) जहां किसी कर्मचारी का वेतन 3,500 रुपए प्रतिमास से अधिक है किन्तु 10,000 रुपए प्रतिमास से अधिक नहीं हैं, वहा ऐसे कर्मचारी को देय बोनस के बदले में अधिकतम भुगतान इस प्रकार संगणित किया जाएगा मानो उसका वेतन 3500 रुपए प्रतिमास है।"

( Insurance and Banking ) चूंकि बोनस संदाय अधिनियम , 1965 की धारा 2 का संशोधन 1 अप्रैल , 2006 से प्रभावी हुआ था , भारतीय जीवन बीमा वर्ग 3 और वर्ग 4 कर्मचारी ( सेवा निबंधनों और शर्तों का पुनरीक्षण ) नियम , 1985 की धारा 13 में । अप्रैल , 2006 से संशोधन करना भी प्रस्तावित था । उक्त नियम के नियम 13 में उपरोक्त संशोधन परिणामिक प्रकृति के हैं। यह प्रमाणित किया जाता है कि इन परिणामिक संशोध नों से किसी कर्मचारी पर प्रतिकूल प्रभाव पड़ने की संभावना नहीं है ।

G.S.R. 72 ( E ) . In exercise of the powers conferred by Section 48 ofthe Life Insurance Corporation Act . 1956 (31 of 1956 ) , the Central Government hereby makes the following rules further to amend the Life Insurance Corporation of India Class II and Class IV Employees (Revision of Terms and Conditions of Service ) Rules , 1985 , namely:-
1. ( 1 ) These rules may be called the Life Insurance Corporation of India Class III and Class IV Employees ( Re- vision of Terms and Conditions of Service ) Amendment Rules , 2008 .
(2) They shall be deemed to have come into force on the 1st day of April, 2006 .

EXPLANATORY MEMORANDUM 2. In the Life Insurance Corporation of India Class III and Class IV Employees ( Revision of Terms and Condi- tions of Service ) Rules , 1985. in rule 13. for the proviso to sub- rule ( 2 ) , the following proviso shall be substituted namely:--
"Provided that:-
( i ) no payment in lieu of bonus shall be payable to any employce drawing a salary exceeding Rs . 10,000 per month:
Since amendment of Section 2 of the Payment of Bonus Act, 1965 came into force with effect from 1st April , 2006 , the amendment in rule 13 of Life Insurance Corpora- tion of India Class III and Class IV Employees ( Revision of Terms and Conditions of Service ) Rules , 1985 also pro- posed with effect from 1st April , 2006. The above amend- ments in rule 13 of said rules are of a consequential nature . It is certified that no employee is likely to be adversely affected by these consequential amendments .
(ii ) where the salary of any employee exceeds Rs . 3.500 per month but does not exceed Rs . 10.000
