NEW DELHI, FRIDAY, FEBRUARY 8, 2008/MAGHA 19, 1929

विधि और न्याय मंत्रालयः

(विधायी विभाग)

आदेश

नईदिल्ली, 8 फरवरी , 2008

के कारण भड़कने की संभावना है कि अनेक निर्वाचन क्षेत्रों में नए परिसीमन के परिणाम स्वरूप जनता और उसके प्रतिनिधियों के बीच संबंध विच्छेद हो सकता है , और उसकी सीमाओं के परिवर्तन से जनजातियों के विभिन्न जातीय और मूलवंशीय समूहों का अन्यसंक्रमण हो सकता है;

और, अरुणाचल प्रदेश राज्य 26 प्रमुख जनजातियों और 100 से अधिक उप -जनजातियों वाला अत्यंत संवेदनशील सीमावर्ती राज्य है , जिनमें से प्रत्येक के अपने भिन्न-भिन्न पारंपरिक क्षेत्र और सीमाएं हैं, जिसके आधार पर विद्यमान जिले और विधान सभा निर्वाचन क्षेत्र की सीमाओं का व्यापक रूप से सीमांकन किया गया था , जिसके कारण नए सिरे से ऐसा परिसीमन एक जटिल और संवेदनशील कार्य होगा जिसमें एक जनजातीय जिले से दूसरे जनजातीय जिले में विधान सभा स्थानों का अंतरण अंतर्वलित है;

का.आ. 284(अ).-संविधान ( चौरासीवां संशोधन) अधिनियम , 2001 द्वारा यथासंशोधित संविधान के अनुच्छेद 82 और अनुच्छेद 170(3 ) के उपबंधों के अधीन संसद् ने परिसीमन अधिनियम , 2002 अधिनियमित किया था और लोक सभा तथा राज्य विधान सभाओं के निर्वाचनों के प्रयोजन के लिए प्रत्येक राज्य और संघ राज्यक्षेत्र के प्रादेशिक निर्वाचन क्षेत्रों में विभाजन को वर्ष 2001 में की गई जनगणना के आधार पर अभिनिश्चित किए गए जनगणना के आंकड़ों के आधार पर पुनः समायोजित करने के लिए परिसीमन आयोग स्थापित किया गया था। [ जैसाकि संविधान ( सतासीवां संशोधन ) अधिनियम , 2003 के अधीन परिकल्पित है ];

और विद्यमान विधान सभा निर्वाचन क्षेत्रों के अनुसार प्रत्येक प्रभुख जनजातियों/उप - जनजातियों का विधान सभा में साम्यापूर्ण प्रतिनिधित्व किया जाता है;

और , परिसीमन आयोग ने अभी तक 25 राज्यों/संघ राज्यक्षेत्रों में परिसीमन कार्य को पूरा कर लिया है;

और अरुणाचल प्रदेश में निर्वाचन क्षेत्रों के परिसीमन से संबंधित मुद्दे गंभीर और अत्यंत संवेदनशील प्रकृति के हैं और उसका इस संवेदनशील सीमावर्ती राज्य में विधि और व्यवस्था की स्थिति पर भी गंभीर प्रभाव पड़ सकता है ;

और अरुणाचल प्रदेश की बाबत परिसीमन कार्य को पहले, 2001 की जनगणना के जनसंख्या आंकड़ों के आधार पर परिसीमन को प्रश्नगत करते हुए, लोक हित मुकदमों की श्रृंखला [ श्री रिकराम तारेहाके बनाम भारत संघ ( लोकहित मुकदमा 54/07 ) , श्री ताकम सोरंग बनाम भारत संघ ( लोक हितमुकदमा 55/07 ) , श्री देखबन एस (लोक हितमुकदमा 78/07 ) और श्री चांगकोम होंडिक ( लोक हितमुकदमा 98/07 ) ] के मामलों में गुवाहाटी उच्च न्यायालय के रोक आदेशों के अनुसरंण में निलंबित कर दिया गया था;

और केन्द्रीय सरकार ने सुरक्षा स्थिति को ध्यान में रखते हुए , सशस्त्र बल ( विशेष शक्तियां ) अधिनियम , 1958 ( 1958 का 28 ) की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, अरुणाचल प्रदेश और मेघालय राज्य में असम से लगी हुई सीमा पर बीस किलोमीटर की विस्तृत पट्टी को, का. आ. 1878 ( अ ) , तारीख 4 नवम्बर , 2007 द्वारा " विक्षुब्ध क्षेत्र " घोषित किया है;

और , अरुणाचल प्र ५श राज्य में तिराप और चांगलांग जिलों को.भी.का.आ. 1685 ( अ ) , तारीख 30 सितंबर , 2007 द्वारा " विक्षुब्ध क्षेत्र" घोषित किया गया है;

और, अरुणाचल प्रदेश राज्य सरकार ने केन्द्रीय सरकार को विधान सभा और संसदीय निर्वाचन क्षेत्रों के प्रस्तावित परिसीमन के संबंध में विधायकों , सांसदों, राजनैतिक दलों, पंचायतों और जन नेताओं द्वारा किए गए कड़े आक्षेपों के बारे में सुचित कर दिया है और सरकार से अनुरोध किया है कि वह इस मुद्दे की संवेदनशीलता और इन आशंकाओं पर विचार करे कि जन नेताओं और देशी जनजातीय समुदायों की शिकायतों पर विचार किए बिना किसी परिसीमन की कार्यवाही के परिणामस्वरूप विभिन्न जिलों में विधि और व्यवस्था संबंधी प्रमुख समस्याएं उत्पन्न होने की संभावना है , जिससे आगे चल कर अरुणाचल प्रदेश राज्य की लोक व्यवस्था को गंभीर खतरा हो सकता है;

और, यदि 2001 की जनगणना के आधार पर परिसीमन कार्यवाही की जाती है तो अनेक विधान सभा निर्वाचन क्षेत्रों का लोप हो जाएगा , जबकि कुछ निर्वाचन क्षेत्रों को अतिरिक्त स्थान देने होंगे , जिससे राज्य विधान सभा में विभिन्न जातीय जनजातियों जातिनिधित्व असंतुलित हो जाएगा और उन क्षेत्रों के कारण जिनका प्रतिनिधित्व नहींहै , शांति और लोक व्यवस्था को गंभीर खतरा हो सकता है;

और , अरुणाचल प्रदेश की राज्य सरकार ने राज्य के जनजातीय समुदायों में शांतिपूर्ण सौहार्द के हित में यथास्थिति बनाए रखने का अनुरोध किया है क्योंकि यदि इस मुद्दे पर जनता की शिकायतों को दूर किएबिना प्रस्तावित परिसीमन किया जाता है तो विघटनकारी शक्तियां अस्थिरस्थिति का लाभ उठा सकती हैं;

[PART II-SEC . 3 (ii) ]

Andwhereas, the Delimitation Commission has , so farcompleted the delimitation exercise in 25 States/Union Territories;

And whereas , the delimitation work in respect of Arunachal Pradesh was suspended first in pursuance of the stay orders of the Guwahati High Court in a series of PILs, cases [ Shri Rikam Tarehake Vs. UOI ( PIL 54/07), Shri Takam Sorang Vs. UOI (PIL 55/07) , Shri DekbanEse (PIL 78/07) and Shri Chang Kom Hondik (PIL 98/07 ) ] questioning the delimitation based on population figure of 2001 census;

Andwhereas, resumption of delimitation process by the Delimitation Commission consequent to the Hon'ble Supreme Court's stay on the orders of the Guwahati High Court is likely to arouse the sentiments of the hilly and tribal people living in the State of Arunachal Pradesh due totheir apprehension that new delimitation in many electoral constituencies may result in break-up of affiliation between public and its representatives , and that change of boundaries thereof, may cause alienation of different ethnic and racial groups of tribes ;

And whereas , the State of Arunachal Pradesh is a verysensitiveborder State having 26 major tribes and more than 100 sub -tribes , each having their own distinct traditional areas and boundaries on the basis of which the existing district and Assembly constituency boundaries were largely demarcated , thereby making a fresh delimitation, involving transfer of Assembly seats from one tribal district to another a complicated and sensitive exercise;

And whereas , as per the existing Assembly constituencies , each and every major tribe/sub- tribe is equitably represented in the Assembly;

Andwhereas, the issues in regard to delimitation of constituencies in Arunachal Pradesh are serious and very sensitive in nature and could have a serious impact even onthe law and order situation in this sensitive border State;

MINISTRY OF LAW AND JUSTICE

ORDER

[भाग II-खण्ड 3 ( ii ) ]

address the sensitiveness of the issue and the apprehension that any delimitation exercise without addressing the concerns of the public leaders and the indigenous tribal communities , is likely to result in major lawand order problems in different districts and which can in turn seriously threaten the public order in the State of Arunachal Pradesh;

Andwhereas , ifthe delimitation process on the basis of 2001 census is carried out, many of the existing Assembly constituencies will stand deleted while in some of the constituencies additional seats will have to be provided which would result in a imbalanced representation ofvarious ethnic tribes in the State Assembly and the un- represented areas and this could cause serious threat to peace and public order ;

Andwhereas, the State Government of Arunachal Pradesh has requested for the maintenance of status quo inthe interest ofpeaceful coexistence of tribal communities of the State as divisive forces may exploit the volatile situation, ifthe proposed delimitation is carried out without addressing people's grievances on the issue;

Now, therefore, keeping in view the serious problem inthe State of Arunachal Pradesh and to obviate the above problems , the President, in exercise ofthe powers conferred by sub- section (1 ) of Section 10A of the Delimitation Act, 2002 (33 of 2002) , and on being satisfied that a situation has arisen where unity and integrity of India is likely to be threatened and there is a serious threat to the peace and public order , hereby defer the delimitation exercise in the State ofArunachal Pradesh with immediate effect and until further orders .
