सा.का.नि. 819(अ). केन्द्रीय सरकार, जीवन बीमा निगम अधिनियम, 1956 ( 1956 का 31 ) की धारा 48 की उप- धारा ( 2 ) के खण्ड ( गण ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए भारतीय जीवन बीमा निगम , अध्यक्ष ( सेवा के कतिपय निबंधन और शर्तें ) नियम , 1998 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्: - 1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम भारतीय जीवन बीमा निगम , अध्यक्ष (सेवा के कतिपय निबंधन और शर्तें) ( संशोधन ) नियम , 2008 है ।
( 2 ) ये नियम 1 जनवरी , 2006 को प्रवृत्त हुए समझे जाएंगे ।
2. नियम 4 और नियम 5 के स्थान पर नए नियमों का प्रतिस्थापन. भारतीय जीवन बीमा निगम, अध्यक्ष (सेवा के कतिपय निबंधन और शर्तें ) नियम, 1998 ( जिन्हें इसमें इसके पश्चात् उक्त नियम कहा गया है ) में नियम 4 और नियम 5 के स्थान पर निम्नलिखित नियम रखे जाएंगे , अर्थात्:-
" 4. वेतनमान.- 1 जनवरी , 2006 से निगम के अध्यक्ष का वेतनमान ( उच्चतम बेतनमान ) 80,000 रुपए प्रतिमास (नियत) होगा ।
टिप्पण 1 : पुनरीक्षित वेतनमान में वेतन का नियतन केन्द्रीय सिविल सेवा (पुनरीक्षित वेतन ) नियम, 2008 के आधार पर किया गया है ।
टिप्पण 2 : पुनरीक्षित वेतनमान के कारण बकाया का संदाय ( मूल वेतन और महंगाई भत्ते का अंतर ) दो किश्तों में नकद किया जाएगा । पहली किश्त कुल बकाया रकम के 40 प्रतिशत तक निर्बधित होगी । 60 प्रतिशत बकाया रकम का अगले वित्त वर्ष के दौरान संदाय किया जाएगा । " ।
5. महंगाई भत्ता ( 1 ) निगम के अध्यक्ष को संदेय मंहगाई भत्ता निम्नानुसार होगा , अर्थात्:-

(क) 1.1.2006 से 30.6.2006 तक कोई महंगाई भत्ता नहीं
(ख) 1.7.2006 से 31.12.2006 तक मूल वेतन का दो प्रतिशत
(ग) 1.1.2007 से 30.6.2007 तक मूल वेतन का छह प्रतिशत
(घ) 1.7.2007 से 31.12.2007 तक मूल वेतन का नौ प्रतिशत
(ड) 1.1.2008 से 30.6.2008 तक मूल वेतन का बारह प्रतिशत
(च) 1.7.2008 से आगे तक सोलह प्रतिशत
(2) उपनियम (1 ) में किसी बात के होते हुए भी, केन्द्रीय सरकार, आदेश द्वारा , समय - समय पर महंगाई भत्ते की दर में परिवर्तन कर सकेगी ।"
3. नियम 7 के स्थान पर नए नियम का प्रतिस्थापन उक्त नियमों में नियम 7 के स्थान पर निम्नलिखित नियम रखा जाएगा, अर्थात् : -
"7 नए प्रतिकारात्मक भत्ता 1 सितंबर, 2008 से नगर प्रतिकारात्मक भत्ते को समाप्त किया जाएगा ।" ।
4. नए नियम ४ ख और नियम 8 ग का अंतःस्थापन, उक्त नियमों में, नियम 8क के पश्चात् निम्नलिखित नियम अंतःस्थापित किया जाएगा, अर्थात्:-
" 8ख . बाल शिक्षा भत्ता और होस्टल सहायिकी 1 सितंबर, 2008 से बाल शिक्षा भत्ता की प्रतिपूर्ति अधिकतम 1000 रुपए प्रतिमास प्रति बालक अधिकत्तम दो बालकों के अध्यधीन की जाएगी और होस्टल सहायिकी की प्रतिपूर्ति अधिकतम सीमा 3000 रुपए प्रति बालक प्रतिमास अधिकतम दो बालकों के अध्यधीन की जाएगी । पुनरीक्षित मूल वेतन पर महंगाई भत्ता 50 प्रतिशत होने पर स्वतः ही यह सीमा 25 प्रतिशत तक बढ़ाई जाएगी ।
B ग परिवहन भत्ता- 1 सितंबर, 2008 से निगम के अध्यक्ष को 7000 रुपए धन महंगाई भत्ते की उच्चतर दर पर प्रतिमास परिवहन भत्ता लेने का विकल्प होगा परंतु यदि वह निवास और कार्यालय के बीच यात्रा के लिए सरकारी कार का उपयोग न करता हो । " ।

केन्द्रीय सरकार ने 1 जनवरी , 2006 से भारतीय जीवन बीमा निगम अध्यक्ष के वेतनमान और कतिपय सेवा के निबंधन और शर्तों को पुनरीक्षित करने का अनुमोदन कर दिया है ।
यह प्रमाणित किया जाता है कि इस अधिसूचना को भूतलक्षी प्रभाव दिए जाने से भारतीय जीवन बीमा निगम के अध्यक्ष पर कोई प्रतिकूल प्रभाव पड़ने की कोई संभावना नहीं है ।

NOTIFICATION
New Delhi, the 26th November, 2008
G.S.R. 819(E )-In exercise of the powers conferred by clause (cc) of sub- section (2) of section 48 of the Life Insurance Corporation Act , 1956 ( 31 of 1956) , the Central Government hereby makes the following rules further to amend the Life Insurance Corporation of India Chairman (certain Terms and Conditions of Service) Rules, 1998 , namely: -
1. Short title and commencement.- ( 1 ) These rules may be called the Life Insurance Corporation of India Chairman ( Certain Terms and Conditions of Service) (Amendment) Rules, 2008.
(2) They shall be deemed to have come into force on the 1st day of January, 2006.
2. Substitution of new rules for rule 4 and rule 5.- In the Life Insurance Corporation of India Chairman ( Certain Terms and Conditions of Service) Rules, 1 ( hereinafter referred to as the said rule), for rules 4 and 5, the following rules shale substituted, namely,-
"4. Scale of Pay. With effect from 1st day of January, 2006 , the scale of pay of the Chairman of the Corporation shall be (Apex Scale ) Rs.80,000/- per month (Fixed).
Note 1 : The fixation of pay in the revised scale has been done on the basis of the Central Civil Services ( Revised Pay) Rules, 2008.
Note 2 The arrears on account of revised scale of pay shalt be paid (difference of basis pay and dearness allowance) in cash in two installments . The first installment shall be restricted to 40% of the total arrears . The remaining 60% of arrears shall be paid during the next financial year" .
5. Dearness Allowance: - ( 1 ) Dearness Allowance payable to the Chairman ofthe Corporation shall be such as follows , namely, -
(a) From 1-1-2006 to 30-06-2006 No Dearness Allowance
2% of Basic Pay
(b) From 1-7-2006 to 31-12-2006 -
(c) From1-1-2007 to 30-6-2007 6% ofBasic Pay
9 % of Basic Pay
(d) From 1-7-2007 to 31-12-2007
12% ofBasic Pay
(e) From 1-1-2008 to 30-6-2008
16% of Basic Pay
(f) From 1.7.2008 onwards
(2) Notwithstanding anything contained in sub- rule( 1 ), the Central Government may, by order , vary the rate of Dearness Allowance from time to time" .

3. Substitution of new rule for rule 7.- In the said rule, the following rule shall be substituted , namely.-
7. City Compensatory Allowance: With effect from 1st September , 2008, City Compensatory Allowance shallbe abolished" .
4. Insertion of new rules 8B and 8C.In the said rule . after rute 8A, the following rules shall be inserted, namely.-
"8B Children Education Allowance and Hostel Subsidy:
With effect from 1st September, 2008 , Children Education Allowance shall be reimbursed upto the maximum of Rs . 1000 per child per month subject to a maximum of two children and Hostel Subsidy shalt be reimbursed upto a maximum limit of Rs.3000 per child per month subject to a maximum of two children . The limits shall be automatically raised by 25 % every time the Dearness Allowance on the revised Basic Pay goes up by 50% .
8C Transport Allowance. With effect from I " September . 2008. the Chairman of the Corporation shall have an option to draw transport allowance at a higher rate of Rs.7000 p.m. plus dearness allowance provided he does not use the official car for travel hetween residence and office" .

Foot Note : Life Insurance Corporation of India Chairman ( certain Terms and Conditions of Service ) Rules, 1998 were published in the Gazette of India. Extraordinary . Part II , Section 3, sub -section ( i ) vide G.S.R.No.124 ) dated 5th March . 1998 and subsequently amended vide: -

EXPLANATORY MEMORANDUM
The Central Government has accorded approval to revise the scales of Pay and certain terms and conditions of service of the Chairman of the Life Insurance Corporation of India , with effect from 1st January , 2006..
It is certified that no Chairman of Life Insurance Corporation of India is likely to be affected adversely by the notification being given retrospective effect.

1. संक्षिप्त नाम और प्रारंभः (1) इन नियमों का संक्षिप्त नाम भारतीय जीवन बीमा निगम प्रबंध निदेशक (सेवा के कतिषय निबंधनों और शर्तों का पुनरीक्षण) (संशोधन) नियम, 2008 है ।
(2) ये नियम 1 जनवरी , 2006 को प्रवृत्त हुए समझे जाएंगे ।

(2) प्रबंध निदेशक का वेतन नियतन 1 जनवरी, 2006 से निम्नानुसार किया जाएगा:-

टिप्पण 1 : पुनरीक्षित वेतनमान में वेतन का नियतन केन्द्रीय सिविल सेवा (पुनरीक्षित वेतन) नियम, 2008 के आधार पर किया गया है ।

(ङ) 1.1.2008 से 30.6.2008 तक मूल वेतन का 12 प्रतिशत
(च) 1.7.2008 से आगे तक - 16 प्रतिशत

(2) उपनियम (1 ) में किसी बात के होते हुए भी केन्द्रीय सरकार, आदेश द्वारा, समय- समय पर महंगाई भत्ते की दर में परिवर्तन कर सकेगी ।"
3. नियम 7 के स्थान पर नए नियम का प्रतिस्थापन उक्त नियमों में, निम्नलिखित नियम रखा जाएगा, अर्थात् :- :
"7 नगर प्रतिकरात्मक भत्ता 1 सितंबर, 2008 से नगर प्रतिकरात्मक भत्ते को समाप्त किया जाएगा " |
4. नए नियम ४ ख और नियम ४ ग का अंत्तः स्थापन, उक्त नियमों में नियम 8 क के पश्चात् निम्नलिखित नियम अंतःस्थापित किया जाएगा, अर्थात् :-

स्पष्टीकारक ज्ञापन
