का. आ. 2742(अ).-केंद्रीय सरकार, साधारण बीमा कारबार ( राष्ट्रीयकरण ) अधिनियम, 1972 ( 1972 का 57 ) की धारा 17क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , साधारण बीमा ( अधिकारियों के वेतनमान और सेवा की अन्य शर्तों का सुव्यवस्थीकरण ) स्कीम , 1975 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्:-
1. संक्षिप्त नाम और प्रारंभ :
( 1 ) इस स्कीम का संक्षिप्त नाम साधारण बीमा ( अधिकारियों के वेतनमानों और सेवा की अन्य शर्तों का सुव्यवस्थीकरण) संशोधन नियम, 2008 है ।
( 2 ) इस स्कीम के उपबंध , इसमें इसके पश्चात् अन्यथा यथा उपबंधित के सिवाय , 1 जनवरी , 2006 को प्रवृत्त हुए समझे जाएंगे ।
2. पैरा 3 का संशोधन :-
साधारण बीमा ( अधिकारियों के वेतनमानों और सेवा की अन्य शर्तों का सुव्यवस्थीकरण ) स्कीम, 1975 के (जिसे इसमें इसके पश्चात् उक्त स्कीम कहा गया है ) के पैरा 3 में , खंड ( ढक ) और खंड ( ढख ) के स्थान पर निम्नलिखित खंड रखे जाएंगे , अर्थात्:-
" (ढक ) " पुनरीक्षित निबंधनों " से अध्यक्ष - सह- प्रबंध निदेशक, से भिन्न अधिकारियों के सम्बन्ध में ग्यारहवीं अनुसूची में यथा विनिर्दिष्ट वेतनमान और भत्ते अभिप्रेत हैं और अध्यक्ष- सह - प्रबंध निदेशक के सम्बन्ध में बारहवीं अनुसूची में यथा विनिर्दिष्ट वेतनमान और भत्ते अभिप्रेत हैं ।
(ढख) " पुनरीक्षित वेतनमान " से अध्यक्ष- सह - प्रबंध निदेशक से भिन्न अधिकारियों के सम्बन्ध में ग्यारहवीं अनुसूची में यथा विनिर्दिष्ट पुनरीक्षित वेतनमान अभिप्रेत है और अध्यक्ष- सह- प्रबंध निदेशक के सम्बन्ध में बारहवीं अनुसूची में यथा विनिर्दिष्ट वेतनमान अभिप्रेत है । "

3. पैरा 6ख का संशोधन :-
उक्त स्कीम के पैरा 6ख में दूसरे परंतुक के पश्चात् निम्नलिखित परंतुक अंतःस्थापित किया जाएगा, अर्थात्:-
" परंतु 1 जनवरी , 2006 से, अध्यक्ष- सह- प्रबंध निदेशक का मूल वेतन बारहवीं अनुसूची में विनिर्दिष्ट रीति से नियत किया जाएगा । "
4. पैरा 6ग के स्थान पर नए पैरा का प्रतिस्थापन:-
उक्त स्कीम में , पैरा 6 ग के स्थान पर निम्नलिखित पैरा रखा जाएगा, अर्थात् :-
" 6 ग . सेवा की अन्य शर्तें :-
دو समय- समय पर यथा संशोधित पैरा 9 पैरा 10 और पैरा 11 में विनिर्दिष्ट सेवा के अन्य निबंधन और शर्तें 1 जनवरी , 2006 से अध्यक्ष सह प्रबंध निदेशक के संबंध में लागू होंगी । " ।
5. पैरा 9 का संशोधन :-
उक्त स्कीम में, पैरा 9 के स्पष्टीकरण के खंड (iii) में, उपखंड (क) के पश्चात् निम्नलिखित खंड अंतःस्थापित किया जाएगा, अर्थात् :
66 (कक) यथास्थिति, निगम के अध्यक्ष - सह- प्रबंध निदेशक या कंपनी के अध्यक्ष सह प्रबंध निदेशक की दशा में 1 जनवरी , 2006 से प्रारंभ होने वाली अवधि के लिए बारहवीं अनुसूची के अनुसार ।" ।
6. ग्यारहवीं अनुसूची के पश्चात् नई अनुसूची का अंतःस्थापन : -
उक्त स्कीम में, ग्यारहवीं अनुसूची के पश्चात् निम्नलिखित अनुसूची अंतःस्थापित की जाएगी, अर्थात् : -

उच्चतर श्रेणी + वेतनमान 75,500 रुपए ( तीन प्रतिशत की दर से वार्षिक वेतन वृद्धि) 80,000 टिप्पणः पुनरीक्षित वेतनमान में वार्षिक वेतनवृद्धि का अनुदत्त किया जाना जो केन्द्रीय सिविल सेवा (पुनरीक्षित वेतन ) नियम, 2008 के उपबंधों द्वारा शासित होगा ।
II . पुनरीक्षित वेतनमान में मूल वेतन के नियतन की रीति :

( 1 ) 1 जनवरी , 2006 से अध्यक्ष - सह - प्रबंध निदेशक का मूल वेतन नीचे सारणी में यथा विनिर्दिष्ट बारहवीं अनुसूची के अनुसार नियत किया जाएगा ,

टिप्पणः पुनरीक्षित वेतनमान में वेतन का नियतन केन्द्रीय सिविल सेवा (पुनरीक्षित वेतनमान नियम, 2008) के आधार पर किया गया है ।
(2) अध्यक्ष- सह- प्रबंध निदेशक जिसका मूल वेतन ऊपर मद (1 ) के अधीन पुनरीक्षित वेतनमान में नियत किया जाता है, उसे पुनरीक्षण पूर्व निबंधनों और उक्त स्कीम की नवीं अनुसूची के अनुसार और पुनरीक्षित निबंधनों के अनुसार उनके बीच मूल वेतन और महंगाई भत्ते का (अधिकारी की भविष्य निधि में अनिवार्य अभिदाय की कटौती करने के पश्चात्) संदाय किया जाएगा, जो निम्नानुसार है :-
चालू वित्त वर्ष अर्थात् 2008-09 में ऐसे अंतर का 40 प्रतिशत और वर्ष 2009-2010 का ऐसे अंतर का 60 प्रतिशत ।
III . महंगाई भत्ता--
(1) अध्यक्ष- सह-प्रबंध निदेशक को संदेय मंहगाई भत्ता निम्नानुसार होगाः-
(क) 1.1.2006 से 30.6.2006 तक शून्य
(ख) 1.7.2006 से 31.12.2006 तक वेतन का 2प्रतिशत
(ग) 1.1.2007 से 30.6.2007 तक वेतन का 6 प्रतिशत
(घ) 1.7.2007 से 31.12.2007 तक वेतन का 9 प्रतिशत
(ड) 1.1.2008 से 30.6.2008 तक वेतन का 12 प्रतिशत
(च) 1.7.2008 से आगे तक वेतन का 16 प्रतिशत THE GAZETTE OF INDIA : EXTRAORDINARY

(2) उप मद ( 1 ) में किसी बात के होते हुए भी , केन्द्रीय सरकार, आदेश द्वारा , समय- समय पर महंगाई भत्ते की रकम में परिवर्तन कर सकेगी ।
IV. मकान किराया भत्ता :
प्रत्येक अध्यक्ष - सह-प्रबंध निदेशक को यथास्थिति निगम या कंपनी द्वारा किराया मुक्त निवास स्थान का प्रबंध किया जाएगा :
परंतु ऐसे अध्यक्ष- सह-प्रबंध निदेशक, जिसके लिए ऐसे निवास की व्यवस्था नहीं की गई है उसे निम्न प्रकार से मकान किराए भत्ते का संदाय किया जाएगा : -
(i ) 1.1.2006 से 31.6.2008 के बीच की अवधि के लिए नवीं अनुसूची की मद 4 के अनुसार ; और
(ii) 1 सितंबर, 2008 से पुनरीक्षित वेतनमान में प्रतिमास प्राप्त मूल वेतन के 30 प्रतिशत की दर पर ।
V. नगर प्रतिकारात्मक भत्ता अध्यक्ष- सह- प्रबंध निदेशक, तारीख 31.08.2008 तक की अवधि के लिए नवीं अनुसूची की मद V के अनुसार नगर प्रतिकरात्मक भत्ता प्राप्त करने का हकदार होगा और 1 सितंबर, 2008 से कोई नगर प्रतिकरात्मक भत्ता नहीं होगा ।
VI . परिवहन भत्ता 1 सितंबर, 2008 से ऐसा अध्यक्ष- सह- प्रबंध निदेशक जो अन्यथा अपने निवास और कार्यालय के बीच यात्रा के लिए सरकारी कार का उपयोग करने का हकदार है उसको यह विकल्प होगा कि वह 7000 प्रतिमास धन उस पर महंगाई भत्ता की दर पर परिवहन भत्ता प्राप्त करे । परंतु यदि वह निवास और कार्यालय के बीच यात्रा के लिए सरकारी कार का उपयोग न करता हो । " |
VII . बाल शिक्षा भत्ता :1 सितंबर, 2008 से अध्यक्ष- सह-प्रबंध निदेशक को बाल शिक्षा भत्ता
की प्रतिपूर्ति अधिकतम 1000 रुपए प्रतिमास प्रति बालक अधिकतम दो बालकों के अध्यधीन की जाएगी और होस्टल सहायिकी की प्रतिपूर्ति अधिकतम सीमा 3000 रुपए प्रति बालक प्रतिमास अधिकतम दो बालकों के अध्यधीन की जाएगी । पुनरीक्षित मूल वेतन पर महंगाई भत्ता 50 प्रतिशत होने पर स्वतः ही यह सीमा 25 प्रतिशत तक बढ़ाई जाएगी ।
IX. अन्य भत्ते जो इस अनुसूची में विनिर्दिष्ट रूप में सम्मिलित नहीं हैं :
अध्यक्ष - सह- प्रबंध- निदेशक को ऐसे अन्य भत्तों का संदाय जो इस अनुसूची में विनिर्दिष्ट रूप से वर्णित नहीं हैं, उसी प्रकार किया जाएगा जैसा कि उच्चतर प्रशासनिक श्रेणी के अधिकारियों की दशा में केन्द्रीय सिविल सेवा (पुनरीक्षित वेतन) नियम, 2008 के आधार पर किया जाता । " ।
स्पष्टीकारक ज्ञापन
1. केन्द्रीय सरकार ने निगम के अध्यक्ष सह प्रबंध निदेशक और कंपनियों के अध्यक्ष- सह-प्रबंध निदेशकों की बाबत वेतनमान और सेवा की शर्तों का अनुमोदन 1 जनवरी , 2006 से कर दिया है और तदनुसार साधारण बीमा ( अधिकारियों के वेतनमानों और सेवा की अन्य शर्तों का सुव्यवस्थीकरण ) स्कीम , 1975 का 1 जनवरी , 2006 से संशोधन किया जा रहा है ।
2. यह प्रमाणित किया जाता है कि इस अधिसूचना को भूतलक्षी प्रभाव दिए जाने से निगम के अध्यक्ष- सह- प्रबंध निदेशक या कंपनी के अध्यक्ष - सह- प्रबंध निदेशक पर कोई प्रतिकूल प्रभाव पड़ने की संभावना नहीं है।

NOTIFICATION
New Delhi , the 26th November, 2008
S.O. 2742( E) . In exercise of the powers conferredby section 17A of the General. Insurance Business (Nationalisation ) Act, 1972 (57 of 1972) , the Central Government hereby frames the following Scheme further to amend the General Insurance ( Rationalisation of Pay Scales and Other Conditions of Service of Officers ) Scheme, 1975, namely: -
1. Short title and Commencement.-
(1 ) ThisScheme maybe called the General Insurance ( Rationalisation of Pay Scales and Other Conditions of Service of Officers) Amendment Scheme, 2008.
(2) Saveas otherwise provided hereinafter, the provisions of this Scheme shall be deemed to have come into force on the 1st day of January, 2006.
2. Amendment of paragraph 3.-
Inthe General Insurance (Rationalisation of Pay Scales and Other Conditions of Service of Officers) Scheme, 1975 (hereinafter referred to as the said Scheme) , in paragraph 3 , for clauses (na ) and ( nb) , thefollowing clauses shall be substituted, namely, -
'(na) " revised terms", in relation to Officers , other than the Chairman -cum -Managing Director , means the scales of pay and allowances as specified in the Eleventh Schedule; and in relation to the Chairman -cum- Managing Director, means the scales of pay and allowances asspecified in the Twelfth Schedule;
(nb) "revised scales of pay" , in relation to Officers , other than the Chairman-cum- Managing Director, means the revised scales of pay as specified in the Eleventh Schedule; and in relation to the Chairman -cum-Managing Director, means the revised scales of pay and allowances as specified in the Twelfth Schedule;'.
3. Amendment of paragraph 6B.-
Inthe said Scheme , in paragraph 6B , after the second proviso, the following proviso shall be inserted, namely, -
"Provided also that with effect from 1st January , 2006, the basic pay of the Chairman -cum- Managing Director shall be fixed in the manner specified in the Twelfth Schedule.".

4. Substitution of new paragraph for paragraph 6C.-
In the said Scheme, for paragraph 6C, the following paragraph shall be substituted , namely, -
"6C. The Other Conditions of service:-
The other terms and conditions of service specified in paragraphs 9 , 10 and 11 as amended from time to time, shall apply in relation to the Chairman- cum-Managing Director with effect from the 1st day of January, 2006." .
5. Amendment of paragraph 9.-
Inthe said Scheme, in paragraph 9, in the Explanation , in clause (iii) , after sub- clause ( a) , thefollowing sub-clauseshall be inserted , namely, -
"(aa) in the case of Chairman -cum - Managing Director of the Corporation or Chairman -cum- Managing Director of the Company, as the case maybe, for the period commencing on the 1st day of January, 2006, as per the Twelfth Schedule . " .
6. Insertion of new Schedule after Eleventh Schedule.-
In the said Scheme, after the Eleventh Schedule, the following Schedule shall be inserted , namely, -
TWELFTH SCHEDULE
(see paragraphs 3(na ) , ( nb ) and 6B )
1. Pay Scales ( Basic Pay) -
Chairman-cum -Managing Director
HAG+ Pay Scale of Rs. 75,500/- (annual increment @ 3%) 80,000/-
Note: The grant of annual increment in the revised scale shall be governed by the provisions of the Central CivilServices (Revised Pay) Rules , 2008.
Manner of fixation of basic pay in the revised scales of pay: II .
(1) With effectfrom 1st day of January, 2006 , the basic pay of Chairman- cum- Managing Director shallbe fixed as per Twelfth Schedule as specified in the Table below; -

Note: The fixation of pay in the revised scale has been done on the basis of the Central Civil Services (Revised Pay) Rules, 2008.
(2) Chairman- cum- Managing Director, whose basic pay is fixed in the revised scale of pay under item ( 1 ) above shall be paid the difference of basic pay and dearness allowance (after deducting the Officer's compulsory contribution to the Provident Fund ) between the Pre- revised terms , as per Ninth Schedule to the said Scheme and revised terms , as under:
40% of such difference in current financial year, viz. , 2008-09; and
60% of such difference in 2009-10 .

١٢١ . Dearness Allowance :
) The Dearness Allowance payable to Chairman - cum- Managing Director shall be as under : -

(2) Notwithstanding anything contained in sub- item ( 1 ) , the Central Government may, by order , vary the amount of Dearness Allowance from time to time .
IV. House RentAllowance:
Every Chairman-cum- Managing Director shall be provided by the Corporation , or the Company, as the casemaybe, a rent free residential accommodation:
Provided that the Chairman- cum - Managing Director who has not been provided with such accommodation , shall be paid a house rent allowance as under, -
(i ) for the period between 1.1.2006 and 31.8.2008 , as per item IV of the Ninth Schedule; and
(ii) with effect from 1st day of September, 2008, at the rate of 30 per cent of basic pay in the revised scale , drawn per month
V. CityCompensatory Allowance:
Chairman-cum-Managing Director shallbe entitled to get City Compensatory Allowance as per item V of the Ninth Schedule for the period upto 31.08.2008 and , with effect from 1st day of September, 2008 ,there shallbe no City Compensatory Allowance.
VI . Transport Allowance:
With effect from 1st September , 2008 , the Chairman-cum-Managing Director, who is otherwise entitled to the use of official car for travel between residence and office , shall have an option to drawtransport allowance at the rate of Rs.7000 p.m. plus dearness allowance thereon provided hedoes not use of official car for travel between residence and office.
VII . Children Education Allowance :
With effect from 1st September, 2008, Children Education Allowance shall be reimbursed to the Chairman-cum-Managing Director upto the maximum of Rs.1000 per child per month subject to a maximum of two children and , in case of the child residing in Hostel , Hostel Subsidy shallbe reimbursed upto the maximum limit of Rs.3000 per child per month subject to a maximum of two children . The limits would be automatically raised by 25% every time the Dearness Allowance on the revised Basic Pay goes upby 50% .
IX. Other allowances not specifically included in this Schedule:
The payment of Other allowances to the Chairman -cum - Managing Director , not specifically mentioned in this Schedule , shallbe done as in the case of officers in Higher Administrative Grade on the basis of the Central Civil Services ( Revised Pay) Rules , 2008. " .

EXPLANATORY MEMORANDUM
1 . TheCentral Government has accorded approval to revise the scales of pay and conditions of service in respect of the Chairman- cum- Managing Director of the Corporation and Chairman - cum - Managing Directors of the Companies with effect from 1st January, 2006 and the General insurance ( Rationalisation of Pay Scales and Other Conditions of Service of Officers ) Scheme , 1975 is being amended accordingly with effect from 1st January, 2006.
2. It is certified that no Chairman -cum - Managing Director of the Corporation or Chairman - cum - Managing Director of the Company is likely to be affected adversely by the notification being given retrospective effect .
