सा.का.नि. 874(अ) .-राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय उत्पाद- शुल्क और सीमा शुल्क बोर्ड ( अध्यक्ष और सदस्य) भर्ती नियम , 2006 का संशोधन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्:-
1. इन नियमों का संक्षिप्त नाम केन्द्रीय उत्पाद शुल्क और सीमा शुल्क बोर्ड ( अध्यक्ष और सदस्य ) भर्ती ( संशोधन ) नियम, 2008 है ।
2. केन्द्रीय उत्पाद शुल्क और सीमा शुल्क बोर्ड ( अध्यक्ष और सदस्य ) भर्ती नियम , 2006 की अनुसूची में, -
( i ) अध्यक्ष के पद से संबंधित क्रम संख्यांक ( 1 ) के सामने , स्तंभ ( 4 ) और ( 12 ) में विद्यमान प्रविष्टियों के स्थान पर निम्नलिखित प्रविष्टियां रखी जाएगी, अर्थात्:-

प्रतिनियुक्ति/आमेलन :
रुपए (नियत)
केन्द्रीय उत्पाद शुल्क और सीमा शुल्क बोर्ड के ऐसे सदस्य, जिसकी अध्यक्ष की रिक्ति होने की तारीख को एक वर्ष या अधिक की अवशिष्ट सेवा रहती है :
परन्तु उस दशा में जब किसी सदस्य की अध्यक्ष के पद की रिक्ति की तारीख को एक वर्ष या अधिक की अवशिष्ट सेवा नहीं रहती है, तो सरकार अवशिष्ट सेवा की शर्तों को शिथिल कर सकेगी ।
और जिनके पास निम्नलिखित आवश्यक अर्हता है :-
( i ) केन्द्रीय सरकार में अप्रत्यक्ष कर प्रशासन चलाने का कम से कम बीस वर्ष का अनुभव और केन्द्रीय उत्पाद शुल्क और सीमा शुल्क बोर्ड की संरचनाओं के क्षेत्र में कम- से- कम दस वर्ष काअनुभव;
( ii ) उच्च वृत्तिक गुणवत्ता और उत्कर्ष; और
( iii) सत्यनिष्ठा की अखंडनीय प्रतिष्ठा ।
टिप्पण:- आवेदन की अंतिम तारीख को 56 वर्ष की अधिकतम आयु की सामान्य पात्रता की शर्तें आमेलन के मामलों में लागू नहीं होंगी ।

(i) केन्द्रीय सरकार के ऐसे अधिकारी जिन्हें वेतन बैंड-4 37,400-67,000/- रुपए ग्रेड वेतन 12,000/- रुपए प्रतिमासं सहित नियमित आधार पर नियुक्त किया गया है ।
और जिनके पास निम्नलिखित आवश्यक अर्हताएं है :-
(i) केन्द्रीय सरकार में अप्रत्यक्ष कर प्रशासन चलाने का कम-से- कम पन्द्रह वर्ष का अनुभव और केन्द्रीय उत्पाद- शुल्क और सीमा शुल्क बोर्ड की संरचनाओं के क्षेत्र में कम- से - कम दस वर्ष का अनुभव :
(ii) उच्च वृत्तिक गुणवत्ता और उत्क्तर्ष; और
(iii) सत्यनिष्ठा की अखंडनीय प्रतिष्ठा ।
टिप्पणः-
1. आवेदन की अंतिम तारीख को 56 वर्ष की अधिकतम आयु की सामान्य पात्रता की शर्तें आमेलन के मामलों में लागू नहीं होंगी ।
2. ऐसा कोई व्यक्ति जिसने रिक्ति होने की तारीख को, जिसके लिए चयन किया जा रहा है , एक वर्ष से कम अवशिष्ट सेवा की है, विचार किए जाने हेतु पात्र नहीं होगा ।

NOTIFICATION
New Delhi , the 24th December, 2008
G.S.R. 874(E) . In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President thereby makes the following rules to amend the Central Board ofExcise and Customs (Chairman and Members ) Recruitment Rules , 2006, namely:--
1. These rules may be called the Central Board of Excise and Customs (Chairman and Members ) Recruitment ( Amendment ) Rules , 2008 .
2. In the Schedule to the Central Board of Excise and Customs ( Chairman and Members ) Recruitment Rules , 2006, -
(i) against serial number ( 1 ) relating to the post of Chairman , for the existing entries in columns (4) and ( 12) the following entries shall be substituted , namely: -

"Rs. 80,000/- ( fixed ) Deputation /absorption:
Members of Central Board of Excise and Customs who have a residual service of one year or more on the date of occurrence of the vacancy of Chairperson:
Provided that , in the eventuality of no Member having a residual service of one year or more on the date of occurrence of the vacancy in the post of Chairperson , Government may relax the condition of residual service.
AND possessing the following essential qualification: -
( i ) Having at least twenty years of experience in administering and running the indirect tax administration in the Central Government with at least ten years of experience in the field formations ofCentral Board of Excise and Customs .
( ii) Having high professional merit and excellence ; and
(iii) Having impeccable reputation of integrity.
Note: The normal eligibility conditions of maximum age of 56 years on the date of closing of applications shall not be applicable in cases of absorption ."
(ii) against serial number (2) , relating to the post of Member , for the existing entries in columns ( 4) and ( 12) the following entries shall be substituted, namely:-

"Rs. 80,000/- ( fixed )
( i ) Officers of the Central Government appointed on a regular basis in the grade of Pay Band-4 Rs.37,400- 67,000 with Grade Pay of Rs . 12,000/ - per month .
AND possessing the following essential qualification: -
( i) Having at least fifteen years of experience in administering and running the indirect tax administration in the Central Government with at least ten years of experience in the field formations ofCentral Board of Excise and Customs .
( ii) Having high professional merit and excellence ; and
(iii) Having impeccable reputation of integrity .
Note:
1. The normal eligibility conditions of maximum age of 56 years on the date of closing of applications shall not be applicable in cases of absorption .
2. No person with less than one year residual service on the date of occurrence of vacancy for which selection is being made shall be eligible for consideration . "
