सा.का.नि. 16 ( अ ).-राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, कोयला नियंत्रक संगठन ( समूह " क " पद ) भर्ती नियम , 1986 का और संशोधन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्:-
1. ( i ) इन नियमों का संक्षिप्त नाम कोयला नियंत्रक संगठन (समूह " क" पद ) भर्ती ( संशोधन ) नियम , 2009 है ।
( ii ) ये राजपत्र में प्रकाशन की तारीख से प्रवृत्त होंगे ।
2. कोयला नियंत्रक संगठन ( समूह ' क ' पद ) भर्ती नियम , 1986 की अनुसूची में , क्र. सं. 1 , कोयला नियंत्रक पद से संबंधित प्रविष्टियों के स्थान पर , क्रमशः निम्नलिखित क्रम संख्यांक और प्रविष्टियां रखी जाएंगी , अर्थात्:-

सीधे भर्ती किए जाने वाले व्यक्तियों के लिए अपेक्षित शैक्षिक और अन्य अर्हताएं

भर्ती की पद्धति : भर्ती सीधे होगी या प्रोन्नति द्वारा प्रोन्नति/प्रतिनियुक्ति/आमेलन द्वारा भर्ती की दशा में वे श्रेणियां जिनसे प्रोन्नति/ प्रतिनियुक्ति/आमेलन किया जाएगा
या प्रतिनियुक्तिया आमेलन द्वारा तथा विभिन्न पद्धतियों द्वारा भरे जाने वाले पदों की प्रतिशतता

प्रतिनियुक्तिद्वारा (जिसके अंतर्गत अल्पकालिक संविदा भी है )
निम्नलिखित में से प्रतिनियुक्ति द्वारा ( जिसके अंतर्गत अल्पकालिक संविदा भी है ) केन्द्रीय सरकार या राज्य सरकारों या संघ राज्य क्षेत्रों या पब्लिक सेक्टर उपक्रमों या मान्यताप्राप्त अनुसंधान संस्थाओं या अर्द्ध सरकारी या कानूनी या स्वायत्त संगठनों के अधीन ऐसे अधिकारी :-
(क ) जो मूल काडर या विभाग में नियमित आधार पर सदृश पद धारण किया हुए हैं; या
( ख ) जिन्होंने मूल काडर या विभाग में 16400-20000 रु. या समतुल्य वेतनमान में नियुक्तिके पश्चात्, नियमित आधार पर , उस श्रेणी में दो वर्ष सेवा की है ; या (ग) जिन्होंने मूल काडर या विभाग में 14300-18300 रु. या समतुल्य वेतनमान में नियुक्तिके पश्चात्, नियमित आधार पर , उस श्रेणी में तीन वर्ष सेवा की है ; और
(घ ) जिनके पास निम्नलिखित शैक्षिक अर्हताएं और अनुभव हैं-
(i ) किसी मान्यताप्राप्त विश्वविद्यालय से खनन इंजीनियरी में बैचलर डिग्री या
समतुल्य डिप्लोमा या समतुल्य; या
(ii) खान अधिनियम , 1952 के अधीन प्रथम श्रेणी कोयला खान प्रबंधक का
सक्षमता प्रमाण पत्र; और
(iii) कोयला खनन संक्रिया , कोयला खनन योजना , मानिटरिंग और कोयले से संबंधित परियोजनाओं को पुनर्विलोकन करने का पन्द्रह वर्ष का अनुभव ।
टिप्पण I : प्रतिनियुक्ति की अवधि , जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर ( जिसके अंतर्गत अल्पकालिक संविदा भी है ) पर प्रतिनियुक्तिकी अवधि है, साधारणतया पांच वर्ष से अधिक नहीं होगी ।
टिप्पण II : प्रतिनियुक्ति द्वारा नियुक्ति के लिए ( जिसके अंतर्गत अल्पकालिक संविदा भी है ) अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी ।
यदि विभागीय प्रोन्नति समिति है तो उसकी संरचना
भर्ती करने में किन परिस्थितियों में संघ लोक सेवा आयोग से परामर्श किया जाएगा

G.S.R. 16(E). In exercise of the powers conferred by the proviso to Article 309 of the Constitution, the President hereby makes the following rules regulating the method of recruitment further to amend the Coal Controller's Organisation (Group ' A' Posts) recruitment Rules , 1986 , namely :-
1. (i) These rules may be called the Coal Controller's Organisation (Group ' A' Posts ) Recruitment (Amendment) Rules, 2009.
( ii) They shall come into force on the date oftheir publication in the Official Gazette.
2. In the Coal Controller's Organisation (Group ' A' Posts) Recruitment Rules, 1986, in the Schedule for serial number 1 relating to the post of Coal Controller , and the entries relating thereto , the following serial number and entries shall respectively be substituted, namely :-

(c) with three years ' service in the grade rendered after appointment thereto on a regular basis in posts in the scale ofpay of Rs . 14,300- 18,300 or equivalent in the parent cadre or Department ; and
(d) Possessing the following educational qualifications and experience:-
(i) Bachelor'sDegree or equivalent Diploma in Mining Engineering from a recognised University or equivalent ;
(ii) First Class Colliery Managers ' Certificate of Competence under Mines Act , 1952 ; and
(iii) Fifteen years ' experience in coal mining operation, coal mining planning, monitoring and review of projects relating to coal .
Note 1 : Period of deputation ( including short - term contract) including period of deputation ( including short- term contract) in another ex - cadre postheld immediately preceding this appointment in the same or some other Organization or Department of the Central Government shall not exceed five years.
Note 2 : The maximum age limit for appointment on deputation ( including short -term contract) shall be not exceeding 56 years as on the closing date of receipt of the applications .
