सा.का.नि. 49( अ ) राष्ट्रीय ढलाई एवं गढ़ाई प्रौद्योगिकी संस्थान सोसाइटी , रांची , के संगम ज्ञापन के खण्ड 4 ( ञ ) और नियम तथा विनियम के खण्ड 13 (x ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्र सरकार एतद्वारा निम्नलिखित नियम बनाती है, नामतः:
1. लघु शीर्ष और प्रारम्भ:-( 1 ) इन नियमों को राष्ट्रीय ढलाई एवं गढ़ाई प्रौद्योगिकी संस्थान सोसाइटी, रांची ( निदेशक ) भर्ती नियमावली, 2009 कहा जाए ।
(2 ) ये नियम उनकी अधिसूचना जारी करने की तिथि से
लागूहोंगे ।
2. परिभाषाएं:-इन नियमों में, इस संदर्भ में यदि अन्यथा अपेक्षित न हो तो :
(क) " संगम ज्ञापन तथा नियम " का अर्थ है राष्ट्रीय ढलाई एवं गढ़ाई प्रौद्योगिकी संस्थान सोसाइटी, रांची का संगम ज्ञापन और नियम तथा विनियम ।
(ख ) सेवा नियमों का अर्थ है राष्ट्रीय ढलाई एवं गढ़ाई प्रौद्योगिकी संस्थान सोसाइटी रांची के सेवा नियम ।
(ग) " निदेशक " का अर्थ है राष्ट्रीय ढलाई एवं गढ़ाई संस्थान सोसाइटी, रांची का निदेशक- जिन्हें राष्ट्रीय ढलाई एवं गढ़ाई प्रौद्योगिकी संस्थान सोसाइटी , रांची के संगम ज्ञापन के खण्ड 4 ( ञ ) तथा नियम व विनियम के खण्ड 3 (x ) के तहत केन्द्र सरकार द्वारा नियुक्त किया गया हो ।
3. भर्ती का तरीका तथा अन्य मामले निदेशक के पद से संबंधित भर्ती का तरीका और अन्य मामले इन नियमों के साथ संलग्न अनुसूची के कॉलम 3 से 13 में विनिर्दिष्ट होंगे ।
4. अयोग्यता : कोई व्यक्ति
(i ) जिसने किसी ऐसे व्यक्ति के साथ विवाह किया हो अथवा विवाह करार किया हो जिसका पति/पत्नी जीवित हों;
(ii ) जिसने अपने पति/पत्नी के जीवित रहते हुए किसी अन्य व्यक्तिके साथ विवाह किया हो अथवा विवाह करार किया हो; वह व्यक्ति उक्त पद पर नियुक्ति हेतु पात्र होगा;
बशर्ते, केन्द्र सरकार , यदि वह इस बात से संतुष्ट है कि ऐसे किसी व्यक्ति तथा विवाह में शामिल अन्य पक्ष पर लागू व्यक्तिगत कानून के तहत यह अनुमत्य है एवं ऐसा करने के अन्य आधार मौजूद हैं, उस व्यक्ति को इस नियम के दायरे से बाहर रख सकती है ।
5. छूट देने के अधिकार :-जहां केन्द्र सरकार का यह अभिमत हो कि ऐसा करना आवश्यक अथवा उचित है, वह किसी भी वर्ग अथवा श्रेणी के व्यक्तियों के संबंध में इन नियमों के किसी भी प्रावधान में लिखित में प्रलेखित किए जाने वाले कारणों से आदेश के जरिए छूट दे सकती है ।
6. बधाव:-इन नियमों में से कोई भी नियम इस संबंध में केन्द्र सरकार द्वारा समय - समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों तथा अन्य विशेष श्रेणियों के व्यक्तियों हेतु यथा अपेक्षित आरक्षणों, आयु सीमा में छूट तथा अन्य छूट की व्यवस्था को प्रभावित नहीं करेगा । ये नियम मौजूदा भर्ती जो पहले ही की जा चुकी हैं अथवा जिनके लिए भर्ती प्रक्रिया पहले ही प्रारंभ हो चुकी हैं, को भी प्रभावित नहीं करेंगे ।
7. अन्य सेवा शर्तें: निदेशक हेतु अन्य सेवा शर्तें , जिसके लिए इन नियमों में कोई विशेष प्रावधान नहीं किया गया है, समकक्ष वेतनमान में वेतन एवं भत्ते आहरित करने वाले केन्द्र सरकार के समूह -क के अधिकारियों पर समय - समय पर लागू होने वाले नियमों केअनुरूप विनियमित होंगी ।

इंजीनियरी/प्रौद्योगिकी में स्नातकोत्तर डिग्री के साथ उद्योग/व्यवसाय का उम्मीदवार और जिसने विशिष्ट रूप से व्यावसायिक कार्य किया हो और उस कार्य को पीएचडी के समतुल्य मान्यता दी जा सके और 15 वर्ष का अनुभव हो जिसमें से 16400-22400 रु. के वेतनमान में प्रोफेसर के समान वरिष्ठ स्तर पर कम से कम 5 वर्ष का अनुभव हो ।

10. भर्ती की पद्धतिः
वांछनीय : जिम्मेदार पद पर प्रशासनिक अनुभव ।
(क) क्या सीधी भर्ती द्वारा या
संविदा आधार पर 5 ( पांच ) वर्षों की अवधिके लिए
(ख) पदोन्नति द्वारा या प्रतिनियुक्ति/समामेलन द्वारा और विभिन्न प्रणालियों द्वारा भरी जाने वाली रिक्तियों का प्रतिशत

13. नियुक्ति की अवधि निदेशक केन्द्र सरकार द्वारा नियुक्त किया जाएगा जो कार्य ग्रहण करने की तारीख से 5 वर्षों की अवधि तक अपने पद पर बने रहेंगे और उनका कार्यकाल सामान्य रूप से सेवानिवृत्त की आयु जो केन्द्रीय विश्वविद्यालय की संकाय के लिए लागू है , से आगे की अवधि के लिए नहीं बढ़ाया जाएगा , 5 वर्षों की अवधि, जो सेवानिवृत्ति की सामान्य आयु के भीतर हो जनहित में केवल छह माह की अधिकतम अवधि के लिए बढ़ाई जा सकती है । ऐसा व्यक्ति जिसने दो बार निदेशक के पद पर कार्य किया हो, निदेशक के रूप में आगे पुनः नियुक्त किए जाने का पात्र नहीं होगा ।
11. पदोन्नति/प्रतिनियुक्ति/ समामेलन के मामले में ये पदोन्नति/प्रतिनियुक्ति/ समामेलन के किन ग्रेडों पर लागूहोगी
टिप्पणी 1 : निदेशक के पद पर नियुक्ति के लिए विचार करने हेतु आवेदन खुले विज्ञापन और विश्वविद्यालय स्तर की अकादमी संस्थाओं के अध्यक्षों द्वारा नामित उम्मीदवारों से आमंत्रित किए जाएंगे ।
1. पीएचडी ( स्नातक या स्नातकोत्तर स्तर पर प्रथम श्रेणी की डिग्री सहित )
12. न्यूनतम अर्हताएं और अनुभव
2. शिक्षण/उद्योग/अनुसंधान में 15 वर्ष का अनुभवजिसमें से इंजीनियरी/प्रौद्योगिकी के प्रोफेसर या उसके ऊपर के स्तर पर 16400-22400 रु. के वेतनमान में 5 वर्ष का अनुभव हो ।
टिप्पणी 2 : निदेशक के पद के लिए कोई पैंशन नहीं होगी । तथापि यदि कोई व्यक्ति निदेशक के रूप में अपनी नियुक्ति से पहले स्वायत्त आधार पर किसी पैंशन योग्य पद पर कार्यरत हैं तो उसे उसके कार्यकाल के पूरा होने तक अथवा सामान्य अधिवर्षिता की आयु प्राप्त कर लेने तक की अवधि इनमें से जो भी पहले हो , सेवानिवृत्ति और पैंशन संबंधी लाभ प्रदान करने के लिए अर्हक सेवा 3

माना जाएगा । यदि चुना गया संबंधित व्यक्ति/निदेशक पैंशन का पात्र नहीं था तो वह संस्थान की सीपीएफ योजना के लिए अंशदान करेगा । यदि अवधि सेवानिवृत्ति की सामान्य तिथि के आगे बढ़ाई जाती है तो यह बढ़ाई गई अवधि अर्हक सेवा के लिए नहीं मानी जाएगी और यह सेवा उसी तरीके से विनियमित की जाएगी जो कि पुनः नियोजित पैंशन प्राप्त करने वालों पर लागू होती है ।
टिप्पणी 3 : निदेशक के रूप में संविदा आधार पर नियुक्ति की
अवधिके दौरान उस व्यक्ति की सेवा को विदेश सेवा के रूप में माना जाएगा और वह अवकाश वेतन और पैंशन अंशदान का पात्र होगा । वह स्वयं और अपने परिवार के लिए स्थानान्तरण अनुदान के साथ सेवा ग्रहण करने के समय और सेवा ग्रहण करने के समय वेतन का भी पात्र होगा ।
टिप्पणी 4 : उम्मीदवार का चयन कार्मिक तथा प्रशिक्षण विभाग की
सहमति से माध्यमिक और उच्चतर शिक्षा विभाग द्वारा इस उद्देश्य हेतु गठित खोज एवं चयन समिति द्वारा किया जाएगा । खोज एवं चयन समिति में निम्नलिखित सदस्यहोंगे जैसे :-
1. अध्यक्ष के रूप में नियुक्त किया जाने वाला व्यक्ति -अध्यक्ष जिसे मानव संसाधन विकास मंत्री का अनुमोदन प्राप्त हो ।
-मानव संसाधन विकास मंत्रालय द्वारा नामित किए जाने वाले सदस्य जो अपर सचिव के रैंक से नीचे न हों ।
2. बाहर के दो लब्धप्रतिष्ठ तकनीकी विशेषज्ञ
3. संयुक्त सचिव -संयोजक , उच्चतर शिक्षा विभाग , मानव संसाधन विकास मंत्रालय ।
खोज एवं चयन समिति द्वारा सुझाए गए नाम/पैनल एक वर्ष के लिए वैद्य होंगे । यदि एक वर्ष की अवधि में इस पैनल से कोई चयन नहीं किया गया तो एक नई खोज एवं चयन समिति एक नया पैनल बनाने के लिए गठित की जाएगी । ऐसी खोज एवं चयन समिति प्रथम पैनल में सिफारिश किए गए व्यक्तियों के नामों पर भी विचार करेगी ।

G.S.R. 49 (E) .- In exercise ofthe powers conferred by clause 4(j ) of the Memorandum of Association (MOA) and clause 13 (x) of the Rules and Regulations of the National Institute of Foundry and Forg Technology (NIFFT) Society , Ranchi , the Central Government herebymakes the following rules , namely :--
1. Short title and commencement .-( 1 ) These rules maybe called the National Institute of Foundry and Forge Technology (NIFFT ) Society , Ranchi , ( Director) Recruitment Rules, 2009 ..
(2) These shall come into force on the date of their notification .
2. Definitions . In these rules , unless the context otherwise requires ;
(a) "Memorandum of Association and Rules " means Memorandum of Association and Rules and Regulations of National Institute of Foundry and Forge Technology (NIFFT) Society, Ranchi ;
(b) Service Rules means Service Rules ofNational Institute of Foundry and Forge Technology (NIFFT) Society, Ranchi;
(c) "Director" means the Director of the National Institute of Foundry and Forge Technology (NIFFT) Society, Ranchi-appointed by the Central Government under clause 4(j ) of the Memorandum of Association (MOA) and clause 13(x) of the Rules and Regulations of the National Institute of Foundry and Forge Technology (NIFFT) Society, Ranchi .
3. Method of recruitment and other matters. The method of recruitment and other matters relating to the post of Director shall be specified in columns (3) to ( 13 ) of the Schedule annexed to these rules .
4. Disqualification .-No person,-
(i) who had entered into or contracted a marriage with a person having a spouse living ; or
(ii) who having a spouse living, has entered into or contracted a marriage with any person,

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such a person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule .

5. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order, for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category or persons .

6. Saving . Nothing in these rules shall affect reservations , relaxation of age - limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Other Backward Classes , Ex- servicemen and other special categories of persons, in accordance with the orders issued by the Central Government from time to time in this regard. These rules , shall also not affect any existing recruitment already made or for which recruitment process has already commenced.
7. Other conditions of service . The other conditions of service of the Director for which no specific provisions have been provided in these rules , shall be regulated in accordance with such rules as are , from time to time, applicable to officers of the Central Government Group -Adrawing the pay and allowances in corresponding scale of pay.

Officers of Universities Research Institute or academic organizations not below the rank of Registrar of Central Universities or equivalent with at least 10 years regular service in the Grade of Rs . 1640022400.

Desirable : Administrative experience in a responsible position.
13. Tenure of Appointment. The Director shall be appointed by the Central Government who would hold office for tenure of five years from the date ofjoining which shall not ordinarily extend beyond the age of normal superannuation as applicable to a faculty of a Central University. The tenure of 5 years which is within the normal age of superannuation can be extended in public interest for a maximum period of six months only . A person who has held the post of Director for two terms would not be eligible for futher re -appointment as Director .
Note 1. Applications for consideration for appointment to the post of Director shall be invited through open advertisement as well as through nomination by heads of University level Academics institutions .
Note 2. The post of Director shall not carry any pension. However, a person who held a pensionable post on substantive basis before his appointment as Director for the purpose of qualifying service for grant of retirement and pensionary benefit up to the completion of his term or up to the age of normal supernnuation whichever is earlier . Ifthe person concerned selected/Director was not eligible for pension, then he would subscribeto the CPF scheme of the institute . If the tenure is extended beyond the normal date of superannuation , such extend period shall not be treated for qualifying service and the service would be regulated in the same manner as applicable to re- employed pensioners.
Note 3. For the period of appointment on contract as Director, the person concerned shall be treated as on Foreign Service and he shall be eligible for leave salary and pension contribution . He would be also entitled to joining time and joining time pay along with transfer grant for self and family.

Note 4. Selection of the Candidate shall be made by a Search-cum-Selection Committee constituted for this purpose by the Department of Secondary and Higher Education with the concurrence of the DOPT . The Search- cum- Selection Committee shall consist of the following members , namely:-
Chairman with the apporval ofthe Minister of HRD 1. A person to be appointed as Chairman
2. Two outside eminent technical experts
Members not below the rank ofAdditional Secretary to be nominatedby Human Resource Development .
3. Joint Secretary
Convener, Department of Higher Education, Ministry ofHRD.
The name/panel suggested by the Search- cum- Selection Committee shall be valid for one year. If no selection is made from the panel within a period of one year, then a fresh Search-cum- Selection Committee shall be constituted to prepare a fresh panel . Such Search- cum- Selection Committee shall also consider the names of persons recommended in the first panel .
