का.आ. 2786 (अ).- अंतर्राज्यिक नदी महादायी और उसकी नदी घाटी से संबंधित जल विवादों को न्यायनिर्णयन के लिए किसी अधिकरण को निर्दिष्ट करने के लिए गोवा की राज्य सरकार से अन्तर्राज्यिक नदी जल विवाद अधिनियम , 1956 ( 1956 का 33 ) की धारा 3 के अधीन अनुरोध प्राप्त हुआ है ;
और गोआ , कर्नाटक और महाराष्ट्र राज्य महादायी नदी के द्रोणी राज्य हैं और केन्द्रीय सरकार की राय है कि अन्तर्राज्यिक नदी महादायी और उसकी नदी घाटी से संबंधित जल विवादों को बातचीत के द्वारा तय नहीं किया जा सकता है ;
अतः , अब , केन्द्रीय सरकार , उक्त अधिनियम की धारा 4 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , अन्तर्राज्यिक नदी महादायी और उसकी नदी घाटी से संबंधित जल विवादों के न्यायनिर्णयन के लिए , नई दिल्ली स्थित मुख्यालय सहित " महादायी जल विवाद अधिकरण " नामक एक जल विवाद अधिकरण का गठन करती है , जो भारत के मुख्य न्यायमूर्ति द्वारा इस निमित्त नामनिर्दिष्ट निम्नलिखित सदस्यों से मिलकर बनेगा , अर्थात्:-
-अध्यक्ष ( i ) माननीय न्यायमूर्ति श्री जे . एन. पाँचाल , न्यायाधीश , भारत का उच्चतम न्यायालय
-सदस्य ( ii ) माननीय न्यायमूर्ति श्री विनय मित्तल न्यायाधीश , मध्य प्रदेश उच्च न्यायालय
-सदस्य ( iii ) न्यायमूर्ति श्री पी.एस. नारायण ,
भूतपूर्व न्यायाधीश , आन्ध्र प्रदेश उच्च न्यायालय

New Delhi , the 16th November , 2010
S.O.2786 ( E ) .- Whereas a request has been received under Section 3 of the Inter - State River Water Disputes Act , 1956 ( 33 of 1956 ) , from the State Government of Goa to refer the water disputes relating to the inter - State river Mahadayi , and the river valley thereof, to a Tribunal for adjudication ;
And whereas , the States of Goa , Karnataka and Maharashtra are the basin States of Mahadayi river and the Central Government is of the opinion that the water disputes relating to the inter- State river Mahadayi , and the river valley thereof cannot be settled by negotiations ;
Now, therefore , in exercise of the powers conferred by Section 4 of the said Act , the Central Government hereby constitutes a Water Disputes Tribunal to be called as " the Mahadayi Water Disputes Tribunal " , with its headquarters at New Delhi , for the adjudication of the water disputes relating to the inter - State river Mahadayi , and the river valley thereof, consisting of the following members nominated in this behalf by the Chief Justice of India , namely :-
-Chairman 1. Hon'ble Mr. Justice J.M. Panchal , Judge, The Supreme Court of India
-Member 2. Hon'ble Mr. Justice Viney Mittal , Judge , High Court of Madhya Pradesh
--Member 3. Mr. Justice P.S. Narayana , Former Judge , High Court of Andhra Pradesh
