का.आ. 2790(अ).-- केन्द्रीय सरकार ने भूमिगत रेल ( संकर्म सन्निर्माण) अधिनियम, 1978 (1978 का 33) की धारा 1 की उपधारा ( 3 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और संबंधित राज्य सरकार से परामर्श करने के पश्चात् अधिसूचना संख्यांक का.आ. 2625 (अ ) , तारीख 16 अक्तूबर, 2009 द्वारा ऐसे महानगर क्षेत्र घोषित किए हैं जिनको उक्त अधिनियम के उपबंध विस्तारित किए जाएंगे ;
और केन्द्रीय सरकार ऐसे क्षेत्रों को स्पष्ट करना आवश्यक समझती है जिनको उक्त अधिनियम के उपबंध विस्तारित किए जाएंगे ;
अतः , अब, केन्द्रीय सरकार, भूमिगत रेल (संकर्म सन्निर्माण ) अधिनियम , 1978 ( 1978 का 33) की धारा 1 की उपधारा ( 3 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , संबंधित राज्य सरकार से परामर्श करने के पश्चात् ऐसे क्षेत्रों को स्पष्ट करती है जिनको उक्त अधिनियम के उपबंध विस्तारित किए जाएंगे और उस प्रयोजन के लिए भारत सरकार के शहरी विकास मंत्रालय की अधिसूचना संख्यांक का.आ. 2625 (अ) , तारीख 16 अक्तूबर, 2009 में निम्नलिखित संशोधन करती है, अर्थात्: -

[ PART II- SEC . 3 ( ii ) ] उक्त अधिसूचना की सारणी के स्तंभ ( 1 ) के नीचे की प्रविष्टियों में, -
(i ) " बंगलौर" शब्द के पश्चात् निम्नलिखित अंतःस्थापित किया जाएगा , अर्थात्: -
" [बंगलौर महानगर क्षेत्र विकास प्राधिकरण अधिनियम , 11985 (1985 का कर्नाटक अधिनियम संख्यांक 39) की धारा 2 के खंड ( ग) के अधीन यथा परिभाषित क्षेत्र] " ;
(ii) " मुम्बई" शब्द के पश्चात् निम्नलिखित अंतःस्थापित किया जाएगा , अर्थात्: -
" [ मुम्बई महानगर क्षेत्रीय विकास प्राधिकरण अधिनियम, 1974 ( 1975 का महाराष्ट्र अधिनियम संख्यांक का iv) की धारा 2 के खंड (ख) के अधीन्न ग्रथा परिभाषित क्षेत्र ] " ;
(iii ) " चैन्नई" शब्द के पश्चात् निम्नलिखित अंतःस्थापित किया जाएगा, अर्थात्: -
" [तमिलनाडु टाउन और कंट्री प्लानिंग अधिनियम, 1971 (1972 का तमिलनाडु अधिनियम संख्यांक 35) में धारा 2 के खंड (23- क) के अधीन यथा परिभाषित क्षेत्र ] " ;

NOTIFICATION
New Delhi , the 16th November , 2010
S.O. 2790 ( E ) .- WHEREAS the Central Government , in exercise of the powers conferred by sub - section (3 ) of section 1 of the Metro Railways ( Construction of Works ) Act , 1978 (33 of 1978 ) and after consultation with the concerned State Governinent , has vide notification number S.O. 2625 ( E ) , dated the 16th October , 2009 declared the metropolitan areas to which the provisions of the said Act shall extend ;

AND WHEREAS , the Central Government has considered it necessary to clarify the area to which the provisions of the said Act shall extend ;
NOW , THEREFORE , in exercise of the powers conferred by sub- section (3 ) of section 1 of the Metro Railways ( Construction of Works ) Act , 1978 (33 of 1978 ) , the Central Government , after consultation with the concerned State Government , hereby clarifies the area to which the provisions of the said Act shall extend and for that purpose makes the following amendments in the notification of the Government of India in the Ministry of Urban Development number S.O. 2625 (E ) , dated the 16th October , 2009 namely: -
In the said notification , in the Table , in the entries under column ( 1 ) , -
(i) after the word " Bangalore " , the following shall be inserted , namely : -
" [ the area as defined under clause (c ) of section 2 of the Bangalore Metropolitan Region Development Authority Act , 1985 ( Karnataka Act No. 39 of 1985 ) ] " ;
(ii ) after the word " Mumbai " , the following shall be inserted , namely: -
"[ the area as defined under clause (b ) of section 2 of the Mumbai Metropolitan Regional Development Authority Act , 1974 ( Maharashtra Act No. IV of 1975 ) ] " ;
( iii ) after the word " Chennai " , the following shall be inserted , namely: -
" [ the area as defined under clause (23 - a ) of section 2 of the Tamil Nadu Town and Country Planning Act , 1971 (Tamil Nadu Act No. 35 of 1972) ] " .

का.आ. 2791 ( अ).- केन्द्रीय सरकार ने मेट्रो रेल ( प्रचालन और अनुरक्षण) अधिनियम , 2002 (2002 का 60) की धारा 1 की उपधारा (2) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और संबंधित राज्य सरकार से परामर्श करने के पश्चात्, अधिसूचना संख्यांक का.आ. 2626 (अ) , तारीख 16 अक्तूबर, 2009 द्वारा ऐसे महानगर क्षेत्र घोषित किए हैं जिनको उक्त अधिनियम के उपबंध विस्तारित किए जाएंगे ;
और केन्द्रीय सरकार ऐसे क्षेत्रों को स्पष्ट करना आवश्यक समझती है जिनको उक्त अधिनियम के उपबंध विस्तारित किए जाएंगे ;
अतः , अब, केन्द्रीय सरकार, मेट्रो रेल (प्रचालन और अनुरक्षण) अधिनियम , 2002 (2002 का 60 ) की धारा 1 की उपधारा (2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए संबंधित राज्य सरकार से परामर्श करने के पश्चात् ऐसे क्षेत्रों को स्पष्ट करती है जिनको उक्त अधिनियम के उपबंध विस्तारित किए जाएंगे और उस प्रयोजन के लिए भारत सरकार के शहरी विकास मंत्रालय की अधिसूचना संख्यांक का.आ. 2626 (अ) , तारीख 16 अक्तूबर, 2009 में निम्नलिखित संशोधन करती है, अर्थात्: -

AND WHEREAS , the Central Government has considered it necessary to clarify the area to which the provisions of the said Act shall extend;
