सा.का.नि. 976(अ). केन्द्र सरकार, केन्द्रीय औद्योगिक सुरक्षा बल अधिनियम , 1968 ( 1968 का 50 ) की धारा 22 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय औद्योगिक सुरक्षा बल (समूह ' क' कार्यपालक काडर ) भर्ती नियम , 2002 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्:-
1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम केन्द्रीय औद्योगिक सुरक्षा बल ( समूह ' क ' कार्यपालक काडर भर्ती दूसरा संशोधन ) नियम , 2010 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. केन्द्रीय औद्योगिक सुरक्षा बल ( समूह ' क' कार्यपालक काडर ) भर्ती नियम , 2002 में;-
(i ) नियम 2 में , " वेतनमान " शब्दों के स्थान पर " वेतन बैंड और ग्रेड वेतन या वेतनमान " शब्द रखे जाएंगे ।
(ii) अनुसूची में,-
(क) उप कमांडेंट के पद के सामने ,-
(i) स्तम्भ 4 में , विद्यमान प्रविष्टियों के स्थान पर निम्नलिखित प्रविष्टियां रखी जाएंगी , अर्थात्:- " वेतन बैंड-3 , 15600-39100 रु + ग्रेड वेतन
6600 रु. ";
(ii) स्तम्भ 12 में, उप- शीर्षक " प्रोन्नति " में,
(क) ऐसे " सहायक कमांडेंट से आरम्भ होने वाले और चिकित्सा शेप -1 में आते हैं " से समाप्त होने वाले शब्दों के स्थान पर निम्नलिखित शब्द रखे जाएंगे , अर्थात्:-
(1) 4757 G1/2010
" वेतन बैंड-3 , 15600-39100 रु. + ग्रेड वेतन 5400 रु. में ऐसे सहायक कमांडेंट जिसके अंतर्गत सहायक कमांडेंट ( कनिष्ठ प्रशासनिक अधिकारी ) भी है उस श्रेणी में छः वर्ष की नियमित सेवा की है और जो चिकित्सा प्रवर्ग शेप -1 में है । "
(ख ) टिप्पण 2 के पश्चात् निम्नलिखित टिप्पण अंतःस्थापित किया जाएगा , अर्थात्:--
" टिप्पण 3 : प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए किसी अधिकारी द्वारा 1 जनवरी , 2006 से पहले , उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिफारिशों पर आधारित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधार पर की गई सेवा को आयोग की सिफारिशों पर आधारित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी । " ;
(ग ) उप - शीर्षक " आमेलन " में विद्यमान प्रविष्टियों के पश्चात् निम्नलिखित टिप्पण अंतःस्थापित किया जाएगा , अर्थात्:-
" टिप्पण : प्रतिनियुक्ति या आमेलन के आधार पर नियुक्तिके प्रयोजन के लिए किसी अधिकारी द्वारा , 1 जनवरी , 2006 से पहले , उस तारीख से , जिससे छठे केन्द्रीय वेतन आयोग की सिफारिशों के आधार पर पुनरीक्षित वेतन संरचना का विस्तार किया गया है , नियमित आधार पर की गई सेवा को सिवाय उस दशा में जहां एक से अधिक पूर्व पुनरीक्षित वेतन का साधारण ग्रेड वेतन या वेतनमान सहित एक श्रेणी में विलय हो गया है और वहां यह लाभ केवल उस पद (उन पदों) पर विस्तारित होगा जिसके लिए ग्रेड वेतन या वेतनमान बिना किसी उन्नयन के साधारण प्रतिस्थापन 2

ग्रेड है, आयोग की सिफारिशों के आधार पर विस्तारित " वेतन बैंड -4 , 37400-67000 रु. + ग्रेड वेतन
तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा 8700 रु.";
समझी जाएगी ।"; ( ii) स्तम्भ 12 में, उप-शीर्षक " प्रोन्नति " में,--
(ख ) कमांडेंट के पद के सामने,-
(क) " कुल 15 वर्ष से प्रारम्भ होने वाले और प्रवर्ग
(i) स्तम्भ 4 में , विद्यमान प्रविष्टियों के स्थान पर शेप -1 में है " से समाप्त होने वाले शब्दों के
निम्नलिखित प्रविष्टियां रखी जाएंगी , अर्थात्:- स्थान पर निम्नलिखित शब्द रखे जाएंगे,
" वेतन बैंड-3 , 15600-39100 रु. + ग्रेड वेतन अर्थात्:-
7600रु.";
" वेतन बैंड-3 , 15600-39100 रु. + ग्रेड वेतन
(ii ) स्तम्भ 12 में, उप-शीर्षक " प्रोन्नति " में,-
(क) " कुल 11 वर्ष से प्रारम्भ होने वाले और चिकित्सा 7600 रु. में समूह ' क ' में कुल 15 वर्ष नियमित
शेप -1 में आते हैं " से समाप्त होने वाले शब्दों के सेवा की है जिसके अंतर्गत कमांडेंट की श्रेणी
स्थान पर निम्नलिखित शब्द रखे जाएंगे , अर्थात्:- में दो वर्ष की नियमित सेवा भी है , और जो
" वेतन बैंड-3 , 15600-39100 रु. + ग्रेड वेतन चिकित्सा प्रवर्ग शेप-1 में हों । " ;
6600 रु. में ऐसे उप- कमांडेंट जिन्होंने समूह 'क' ( ख ) टिप्पण 1 के पश्चात् निम्नलिखित टिप्पण
में ग्यारह वर्ष नियमित सेवा की है जिसके अंतर्गत अंतःस्थापित किया जाएगा अर्थात् :---
उस श्रेणी में दो वर्ष की नियमित सेवा भी है, और "टिप्पण 2 : प्रोन्नति के लिए न्यूनतम अर्हक
जो चिकित्सा प्रवर्ग शेप -1 में हो । " ; सेवा की संगणना करने के प्रयोजन के लिए
( ग्व) टिप्पण 1 के पश्चात निम्नलिखि किमी अधिकारी द्वारा 1 जनवरी , 2006 से
अंतःस्थापित किया जाएगा अर्थात्:- पहले , उस तारीख से जिससे छठे केन्द्रीय
"टिप्पण 2: प्रोन्नति के लिए न्यूनतम अर्हक वेतन आयोग की सिफारिशों पर आधारित
सेवा की संगणना करने के प्रयोजन के लिए किसी पुनरीक्षित वेतन संरचना का विस्तार किया

गई सेवा को आयोग की सिफारिशों पर आधारित
(ग ) उप - शीर्ष " प्रतिनियुक्ति " में भारतीय पुलिस

सेवा से प्रारम्भ होने वाले और मूल
गई सेवा समझी जाएगी । " ;
संवर्ग/विभाग में सदृश पद धारण किए हुए हैं
(ग ) उप- शीर्षक " प्रतिनियुक्ति" में टिप्पण 3 के बाद , पर समाप्त होने वाले शब्दों के स्थान पर
निम्नलिखित टिप्पण अंतःस्थापित किया जाएगा , निम्नलिखित शब्द रखे जाएंगे , अर्थात्
अर्थात्:-
" भारतीय पुलिस सेवा के ऐसे अधिकारी जो
"टिप्पण 4 : प्रतिनियुक्ति या आमेलन के आधार
नियमित आधार पर सदृश पद धारण किए हुए
पर नियुक्तिके प्रयोजन के लिए किसी अधिकारी
हैं या केन्द्रीय अर्द्ध सैनिक बलों ( सीमा सुरक्षा
द्वारा , 1 जनवरी , 2006 से पहले , उस तारीख से,
बल या केन्द्रीय रिजर्व पुलिस बल या असम
जिससे छठे केन्द्रीय वेतन आयोग की सिफारिशों
राईफल्स या भारत तिब्बत सीमा पुलिस) के
के आधार पर पुनरीक्षित वेतन संरचना का विस्तार
ऐसे अधिकारी जो मूल काडर या विभाग में
किया गया है , नियमित आधार पर की गई सेवा
नियमित आधार पर वेतन बैंड -3
को सिवाय उस दशा में जहां एक से अधिक पूर्व 15600-39100 रु. + ग्रेड वेतन 7600 रु. में
पुनरीक्षित वेतन का साधारण ग्रेड वेतन या वेतनमान
सदृश पद धारण किए हुए हैं । "
सहित एक श्रेणी में विलय हो गया है और वहां
यह लाभ केवल उस पद ( उन पदों ) पर विस्तारित (घ) उप- शीर्षक " प्रतिनियुक्ति " में टिप्पण 3 के
पश्चात्निम्नलिखित टिप्पण अंतःस्थापित किया
होगा जिसके लिए ग्रेड वेतन या वेतनमान बिना
जाएगा:
किसो उन्नयन के साधारण प्रतिस्थापन ग्रेड है
आयोग की सिफारिशों के आधार पर विस्तारित "टिप्पण 4 : प्रतिनियुक्ति या आमेलन के
तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा आधार पर नियुक्ति के प्रयोजन के लिए किसी
समझी जाएगी । "; अधिकारी द्वारा , 1 जनवरी , 2006 से पहले ,
(ग ) वरिष्ठ कमाडेंट के पद के सामने, उस तारीख से , जिससे छठे केन्द्रीय वेतन आयोग
(i) स्तम्भ 4 में , विद्यमान प्रविष्टियों के स्थान पर की सिफारिशों के आधार पर पुनरीक्षित वेतन
निम्नलिखित प्रविष्टियां रखी जाएंगी , अर्थात्:- संरचना का विस्तार किया गया है, नियमित

भारत का राजपत्र असाधारण
आधार पर की गई सेवा को सिवाय उस दशा में जहां एक से अधिक पूर्व पुनरीक्षित वेतन का साधारण ग्रेड वेतन या वेतनमान सहित एक श्रेणी में विलय हो गया है और वहां यह लाभ केवल उस पद ( उन पदों ) पर विस्तारित होगा जिसके लिए ग्रेड वेतन या वेतनमान बिना किसी उन्नयन के साधारण प्रतिस्थापन ग्रेड है आयोग की सिफारिशों के आधार पर विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी । " ;

टिप्पण. मूल नियम भारत के राजपत्र , असाधारण, भाग- II , खंड 3 , उप- खंड ( i ) , में सा.का.नि. 101 ( अ ) , तारीख 13 फरवरी , 2002 द्वारा प्रकाशित किए गए थे और सा.का.नि. 5 ( अ ) , तारीख 2 जनवरी , 2008 , सा.का.नि. 201 ( अ ) , तारीख 24 मार्च , 2008 और सा.का.नि. 327 ( अ ) , दिनांक15 अप्रैल , 2010 द्वारा संशोधित किए गए थे ।

G.S.R. 976(E).-In exercise of the powers conferred by Section 22 of the Central Industrial Security Force Act , 1968 ( 50 of 1968 ) , the Central Government hereby makes the following rules further to amend the Central Industrial Security Force (Group ' A ' Executive Cadre Recruitment Rules, 2002) , namely
1. Short title and commencement. ( 1) These rules may be called the Central Industrial Security Force ( Group 'A' Executive Cadre Recruitment Second Amendment) Rules, 2010.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Central Industrial Security Force (Group 'A' Executive Cadre Recruitment Rules , 2002) ,-
(1) In rule 2, for the words " Scale of Pay" , the words"Pay Band and Grade Pay or Pay Scale" shall be substituted;
(ii) In the Schedule ,-
(A) against the post of Deputy Commandant,-
(i) In column 4, for the existing entries , the fol- lowing entries shall be substituted namely :--- "Pay Band- 3 Rs. 15600-39100 plus Grade Pay Rs . 6600";
(ii) In column 12 , in sub -heading " Promotion:",-
(a) for the words beginning with " Assistant Com- mandant including ......... and ending with

Medical Category SHAPE - I " , the following shall be substituted namely :----
"Assistant Commandant including Assistant Commandant ( Junior Administrative Officer) inthe Pay band - 3 Rs . 15600-39100 with Grade pay of Rs . 5400 with six years regular service in the grade and being in Medical Category SHAPE - I ." ;
(b) after Note 2 : the following note shall be in- serted , namely :---
"Note 3 : For the purpose of computing mini- mum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 1st January, 2006 , the date from which the revised pay structure based on the SixthCentral Pay Commission recommenda- tions has been extended , shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the Commission . " ;
(c) in the sub-heading " Absorption " , after the existing entries , the following note shall be inserted, namely :-
"Note : For the purposes of appointment on deputation or absorption basis , the service rendered on a regular basis by an officer prior to 1st January, 2006 , the date from which the revised pay structure based on the Sixth Central Pay Commission recommendations has been extended , shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommen- dations of the Commission except where there has been merger of more than one pre - revised scale of pay into one grade with a common grade pay or pay scale , and where this benefit will extend only for the post for which that grade pay or pay scale is the normal replace- ment grade without any upgradation ." ;
(B) against the post of Commandant ,-
(1) in column 4, for the existing entries , the following entries shall be substituted namely:--- "PayBand-3 Rs. 15600-39100 plus Grade Pay Rs . 7600 "
(ii) in column 12 , in sub - heading " Promotion",-
(a) for the words beginning with , " Total eleven years' and ending with Medical Category SHAPE - I " , the following shall be substituted , namely :----
Deputy Commandant in the Pay Band- 3 Rs . 15600-39,100 with Grade Pay of Rs . 6,600 with eleven years regular Group ' A' service , including two years regular service in the grade andbeing inMedical Category SHAPE- 1 . " ;

(b) after Note 1 :, the following note shall be inserted, namely :---
"Note 2 : For the purpose of computing minimum qualifying service for promotion , the service rendered on a regular basis by an officer prior to 1st January, 2006 , the date from which the revised pay structure based on the Sixth Central Pay Commission recommenda- tions has been extended , shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the Commission .
"Note 2 : For the purpose of computing minimum qualifying service for promotion , the service rendered on a regular basis by an officer prior to 1st January, 2006 , the date from which the revised pay structure based on the SixthCentral Pay Commission recommenda- tions has been extended , shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the Commission . "
(c) in sub -heading " Deputation " , after note 3, the following note shall be inserted , namely :-
(c) in the sub -heading " Deputation " for the words beginning " with officers of Indian Polices Service and ending with analogous posts in the parent cadie/department " , following shall be substituted, namely :-
"Officers of Indian Police Service, holding analogous posts on regular basis or Officers of Central Para Military Forces ( Border Security Force or Central Reserve Police Force orAssam Rifles or Indo Tibetan Border Police holding analogous posts in the PB - 3 Rs.15600- 39100 with Grade Pay of Rs.7,600 on regular basis in the parent cadre or department . "
(d) in sub-heading "Deputation" , after Note 3 :, the following note shall be inserted , namely :----
"Note 4: For the purposes of appointment on deputation or absorption basis , the service rendered on a regular basis by an officer prior to 1st January , 2006 , the date from which the revised pay structure based on the Sixth Central Pay Commission recommendations has been extended , shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommen- dations of the Commission except where there has been merger of more than one pre - revised scale of pay into one grade with a common grade pay or pay scale , and where this benefit will extend only for the post for which that grade pay or pay scale is the normal replace- mentgrade without any upgradation . " ;
(C) against the post of Senior Commandant , ----
(i) in column 4, the existing entries the fol- lowing entries shall be substituted, namely:-
"Pay Band -4 Rs . 37400-67000 plus Grade Pay of Rs . 8700 "
(ii) in column 12 , in sub- heading " Promo- tion"-
"Note 4: For the purposes of appointment on deputation or absorption basis , the service rendered on a regular basis by an officer prior to 1st January , 2006 , the date from which the revised pay structure based on the Sixth Central Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommen- dations of the Commission except where there has been merger of more than one pre - revised scale of pay into one grade with a common grade pay or pay scale , and where this benefit will extend only for the post for which that grade pay or pay scale is the normal replace- ment grade without any upgradation. " (a) for the words beginning with " Total 15 years Group and ending with category SHAPE - I " , the following shall be substituted , namely:-
[F. No. E-32012/ 1 /98 /L & R/Pers . II ] S. C. SIVAJI RAO , Dy . Secy. ( Pers . 1) "Total Fifteen years ' regular Group 'A' service including two years ' regular service in the grade of Commandant in the PB - 3 Rs. 15600-39100 with Grade Pay of Rs . 7600 and being in Medical Category SHAPE - I . "
(b) after note 1 the following note shall be
inserted , namely :-
Note:-- The principal rules were published in the Gazette ofIndia, Extraordinary, Part II , Section 3 , Sub- section ( i ) , vide number G.S.R. 101 ( E) , dated the 13thFebruary, 2002 , and amended vide G.S.R. 5(E) , dated the 2nd January , 2008 , G.S.R. 201 ( F ) , dated the 24th March , 2008 and G.S.R. 327 ( E ) , dated the 15th April , 2010 .
