फा. सं. ए-12( 11 )/ 11 /डी/2010-चि,4.-कर्मचारी राज्य बीमा अधिनियम , 1948 ( 1948 का 34 ) की धारा 97 की उप - धारा ( 2क ) के साथ पठित उक्त धारा की उप - धारा ( 1 ) और धारा 17 की उप - धारा ( 3 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा जहाँ तक वे दंत्य सर्जन के पद/संवर्ग से संबंधित है , के सभी पूर्व भर्ती विनियमों के अधिक्रमण में, ऐसे अधिक्रमण से पहले की गई अथवा किए जाने से रह गई बातों के अलावा, निगम एतद्वारा दंत्य संवर्ग/पद की भर्ती प्रक्रिया को विनियमित करने हेतु निम्नलिखित विनियम बनाता है , अर्थात्:-
1. संक्षिप्त नाम और प्रारम्भ:
(i ) ये विनियम कर्मचारी राज्य बीमा निगम ( दंत्य संवर्ग पद ) भर्ती विनियम , 2010 कहे जाएंगे ।
( ii ) ये शासकीय राजपत्र में इनके प्रकाशन की तारीख से लागू होंगे ।
2. अनुप्रयोग:
ये विनियम इसके साथ संलग्न अनुसूची के कालम 1 में विनिर्दिष्ट पदों पर लागू होंगे ।
3. पदों की संख्या , वर्गीकरण एवं वेतनमान :
उक्त पदों की संख्या , उनका वर्गीकरण और उनसे सम्बद्ध वेतनमान इन विनियमों के साथ संलग्न अनुसूची के कालम 2 से 4 में यथा- विनिर्दिष्ट होंगे।
4. भर्ती की पद्धति , आयु सीमा , अर्हताएं तथा अन्य मामले आदि:
भर्ती की पद्धति, आयु सीमा , अर्हताएं और उंक्त पद से संबंधित अन्य मामले उक्त अनुसूची के कालम 5 से 13 में यथाविनिर्दिष्ट होंगे ।
5. जिन पदों के संबंध में सीधी भर्ती विहित की गई है उनके संबंध में चयन बोर्ड का गठन , चयन की प्रक्रिया आदि :
( 1 ) चयन बोर्ड :
(i ) चयन बोर्ड में निम्नलिखित शामिल होंगे :-
(क) भारत सरकार के सचिव या अपर सचिव स्तर का अंशकालिक अध्यक्ष जिसे सचिव या महानिदेशक, कर्मचारी राज्य बीमा निगम द्वारा अध्यक्ष , कर्मचारी राज्य बीमा निगम के सुस्पष्ट पूर्व-अनुमोदन से नियुक्त किया जाएगा ।

: (ख) जिसं विधा/विशेषज्ञ क्षेत्र के संबंध में भर्ती की जानी है उससे संबंधित दो चिकित्सा विशेषज्ञ जिन्हें महानिदेशक , कर्मचारी. राज्य बीमा निगम द्वारा इस प्रयोजन के लिए अनुरक्षित विशेषज्ञों के पैनल में से, चयन बोर्ड के अध्यक्ष द्वारा चुना जाएगा ।
(ग ) नई दिल्ली में चिकित्सा आयुक्त, कर्मचारी राज्य बीमा निगम विभागीय प्रतिनिधि होगा तथा अन्य राज्यों के मामलों मैं संबंधित राज्यका वरिष्ठ राज्य चिकित्सा आयुक्त अथवा राज्य चिकित्सा आयुक्त विभागीय प्रतिनिधि होगा । इन अधिकारियों के किसी कारणवश उपलब्ध न होने की स्थिति में महानिदेशक विभागीय प्रतिनिधि के रूप में किसी अन्य अधिकारी को नामित कर सकता है ।
(ii ) अंशकालिक अध्यक्ष. की पदावधि सामान्यतः चयन बोर्ड के गठन की तारीख से एक वर्ष के लिए होगी । परन्तु , अध्यक्ष , कर्मचारीः राज्य बीमा के सुस्पष्ट पूर्व- अनुमोदन से महानिदेशक द्वारा उनकी पदावधि कम की जा सकती है अथवा बढ़ाई जा सकती है ।
(iii ) अंशकालिक अध्यक्ष और चिकित्सा विशेषज्ञ , समय- समय पर महानिदेशक द्वारा सरकार द्वारा विहित दरों को ध्यान में रखते हुए नियत दरों पर यात्रा भत्ता, बैठक शुल्क आदि के हकदार होंगे ।
(2) चयन की प्रक्रिया तथा रीति :
(क) दंत्य सर्जन के पदों पर सीधी भर्ती सामान्यतः राज्य स्तर पर लिखित परीक्षा के आधार पर सफल और पात्र उम्मीदवारों के साक्षात्कार के आधार पर की जाएगी ।
यदि भर्ती हेतु भिन्न तरीका अंगीकृत करना आवश्यक हो जाता है तो अध्यक्ष , कर्मचारी राज्य बीमा निगम का सुस्पष्ट पूर्व-अनुमोदन प्राप्त करने के पश्चात् महानिदेशक द्वारा इसे अंगीकृत किया जा सकेगा । तथापि , भर्ती की रीति विज्ञापन में अधिसूचित कर दी जाने के पश्चात् कोई अनुवर्ती परिवर्तन नहीं किया जा सकेगा ।
(ख) साक्षात्कार के लिए आमंत्रित किए जाने वाले उम्मीदवारों की संख्या का निर्णय अध्यक्ष , चयन बोर्ड द्वारा रिक्तियों की संख्या और विहित अपेक्षाओं को पूरा करने वाले आवेदकों की संख्या को ध्यान में रखते हुए किया जाएगा ।
(ग ) आयु , अर्हता, अनुभव आदि की विहित अपेक्षाएं पूरा करने मात्र से ही आवेदक को साक्षात्कार हेतु आमंत्रित किए जाने अथवा विज्ञापित पद पर किसी प्रकार के दावे का अधिकार प्राप्त नहीं हो जाएगा ।
(घ) आवेदनों के संबंध में विज्ञापन जारी करने तथा अध्यक्ष, चयन बोर्ड को प्रस्तुत करने के लिए आवेदनों के प्रक्रमण संबंधी समस्त कार्य महानिदेशक , कर्मचारी राज्य बीमा निगम के कार्यालय द्वारा किया जाएगा ।
(ङ ) चयन बोर्ड को आवश्यक सचिवीय सहायता , महानिदेशक, कर्मचारी राज्य बीमा निगम के कार्यालय द्वारा उपलब्ध कराई जाएगी ।
6. निरर्हताः
ऐसा कोई व्यक्ति :-
(क) जिसने ऐसे व्यक्ति से विवाह किया है या विवाह करने का करार किया है जिसका विवाहिती जीवित है ; अथवा (ख) जिसने अपने विवाहिती के जीवित रहते हुए किसी व्यक्ति से विवाह किया है या विवाह करने का इकरार किया है उक्त पद पर नियुक्ति का पात्र नहीं होगा :
परन्तु यदि महानिदेशक इस बात से संतुष्ट है कि ऐसा विवाह ऐसे व्यक्ति और विवाह की दूसरी पार्टी पर लागू वैयक्तिक कानून के अन्तर्गत अनुमेय है और ऐसा करने के अन्य आधार भी हैं तो वे किसी व्यक्ति को इस विनियम से छूट दे सकते हैं ।
7. ढील देने की शक्ति :
जहाँ निगम के महानिदेशक की राय में ऐसा करना आवश्यक अथवा कालोचित है तो वह अध्यक्ष , कर्मचारी राज्य बीमा निगम का सुस्पष्ट पूर्व-अनुमोदन लेने के पश्चात्, कारणों को लेखबद्ध करके आदेश द्वारा किसी श्रेणी अथवा व्यक्तियों के वर्ग के लिए इन विनियमों के किसी भी उपबंध में ढील दे सकते हैं ।
8. अपवाद :
इन विनियमों की कोई बात आरक्षणों , आयु- सीमा में ढील और अन्य रियायतों पर प्रभाव नहीं डालेगी जिनका केन्द्रीय सरकार द्वारा. इस संबंध में समय - समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जाति , अनुसूचित जनजाति, भूतपूर्व सैनिकों और व्यक्तियों के अन्य विशेष वर्गों के लिए उपबंध कराना अपेक्षित है ।

अन्यथा सुयोग्य उम्मीदवारों के मामले में चयन समिति की सिफारिश पर नियुक्ति प्राधिकारी के विवेकानुसारं अनुभव संबंधी अर्हताएं शिथिलनीय है ।

NOTIFICATION
New Delhi , the 14th December, 2010

In exercise of the powers conferred by sub - section ( 1 ) of Section 97 read with sub-section (2A) of the said section and sub - section (3 ) of Section 17 of the Employees ' State Insurance Act , 1948 (34 of 1948) and in supersession of the Employees ' State Insurance Corporation Recruitment Regulations , so far as they relate to the post/ cadre of Dental Surgeon except as respects things done or omitted to be done before such supersession , the Corporation hereby makes the following regulations regulating the method of recruitment to the Dental / Cadre post namely:-
1. Short title and commencement. ( 1 ) These Regulations may be called the Employees ' State Insurance Corporatioon(Dental Cadre Post) , Recruitment Regulations , 2008 .
(2) They shall come into force on the date of their publication in the Official Gazette .
2. Application .-- These regulations shall apply to the post specified in Column 1 of the Schedule annexed hereto.
3. Number of post , classification and scale of pay. The number ofthe said post, their classification and scale of pay attached thereto shall be as specified in columns 2 to 4 of the Schedules annexed to these Regulations .
4. Method of recruitment, age - limit, qualifications and other matters , etc. The method of recruitment , age- limit , qualifications and other matters relating to the said post shall be as specified in columns 5 to 13 of the said Schedule .
5. Composition of Selection Board , procedure of selection etc. in respect of post for which direct recruitment is prescribed:
(1 ) Selection Board :
(i) The Selection Board shall consist of :----
(a) Apart - time Chairman of the status of Secretary or Additional Secretary to the Government of India , who may be appointed by Secretary or the Director General , Employees ' State Insurance Corporation , with the specific prior approval of the Chairman , Employees ' State Insurance Corporation .

(b) Two Medical.experts from the discipline/specialized field pertaining to which recruitment is to be made, who may be chosen by the Chairman Selection Board from the panel of experts maintained for the purpose by the Director General , Employee ' State Insurance Corporation .
(c) The Medical Commissioner , Employees ' State Insuance Corporation will be the departmental representative in New Delhi and in case of other States , the Senior State Medical Commissioner or State Medical Commissioner of the respective States will be departmental representatives . In case these officers are not available for some reasons , then the Director General can nominate some other officers as the departmental representative .
(ii) The term of office of the part - time.Chairman shall ordinarily be one year from the date of constitution of the Selection Board. His term may, however, be curtailed or extended by the Director General , with the specific prior approval of the Chairman , Employees ' State Insurance Corporation .
(iii) The part -time Chairman and the Medical Experts shall be entitled to travelling allowances , sitting fees , etc. at such rates as may be fixed by the Director General from time to time , keeping in view the rates prescribed by the Government.
(2) Procedure and manner of Selection :
(a) Direct recruitment to the post Dental Surgeon shall ordinarily be made at state level on the basis of a written examination.followed by an interview of eligible and successful candidates .
In case, it becomes necessary to adopt a different mode of recruitment , the same may be adopted by the Director General after obtaining specific prior approval ofthe Chairman, Employees ' State Insurance Corporation . However, once a mode of recruitment is notified in the advertisement , no change shall be made subsequently.
(b) The number of candidates to be invited for interview shall be decided by the Chairman , Selection Board, keeping in view the number of vacancies and the number of applicants who satisfy the prescribed requirement .
(c) Mere fulfillment of the prescribed rquirement of age , qualification , experience , etc. will not confer any right on the applicant to be called for interview or to any claim over the post advertised .
(d) All work relating to issue of advertisement in respect of applications and processing of applications for submission to the Chairman , Selection Board will be handled by the office of the Director General , Employees ' State Insurance Corporation .
(c) The Selection Board will be provided necessary Secretarial assistant by the office of the Director General , Employees ' State Insurance Corporation .
6. Disqualification . No person ,--
(a) who has entered into or contracted a marriage with a person having a spouse living : or
(b) who , having a spouse living , has entered into or contracted a marriage with any person;
shall be eligible for appointment to the said post :
Provided that the Director General may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this Regulation .
7. Power to relax . Where the Director General of the Corporation is of the opinion that it is necessary or expedient to do so, he may, by order , for reasons to be recorded in writing and after obtaining specific prior approval of the Chairman, Employees ' State Insurance Corporation , relax any of the provisions of these regulations with respect to any class or category of persons .
8. Savings . Nothing in these regulations shall affect reservations , relaxation of age - limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Ex - servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

(i) Aqualification included in Part - I of Part - II ofDentists Act, 1948 ( 16 of 1948) .
(ii) 9 years experience after registration as a Dental Graduate .
Language Test : The candidate shall have to
pass a qualifying middle standard test in official language of the State concerned where the vacancies are notified or if no candidate is available who fulfills the required conditions , selection board will have powers to recommend candidates who have working knowledge of local language .
Note : Qualifications with regard to experience are relaxable at the discretion of the Appointing Authority on recommendations of the Selection Committee in case of candidates otherwise well qualified.

Transfer on deputation :
Officers under the Central /State Government service /Public Sector
undertaking:
(i) Holding analogous posts and possessing the educational qualifications and experience prescribed under column No. 8 except language test .
Through Contract :
Short-term appointment for one year of Medical Officers who fulfills essential educational qualification requirement except the language test .
Note : The period of deputation including the period of deputation inanother ex - cadre post held immediately preceding this appointment in the same or some other organization /department of the Central Government shall not exceed five years .
