सा.का.नि. 1027(अ ) महापत्तन न्यास अधिनियम, 1963 (1963 का 38) की धारा 132 की उप- धारा ( 1 ) द्वारा पठित , धारा 124 की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्र सरकार एतद्वारा इस अधिसूचना को अनुसूची संलग्न में प्रदर्शित के रूप में मुम्बई पत्तन के न्यासियों के बोर्ड द्वारा बनाए गए मुम्बई पत्तन न्यास कर्मचारी निवास ऋण ( संशोधित ) विनियम स्वीकृत करता है ।
2. उक्त विनियम सरकारी राजपत्र में इस अधिसूचना के प्रकाशित होने की दिनांक से लागू होगा।
अनुसूची
मुम्बई पत्तन न्यास कर्मचारी गृह निर्माण ऋण (संशोधन ) विनियम , 2010
महापत्तन न्यास अधिनियम , 1963 ( 1963 का 38 ) की धारा 28 द्वारा सौंपे अधिकारों का उपयोग करते हुए, एवं उसी अधिनियम की धारा 124 की उप - धारा ( 1 ) के अंतर्गत केन्द्र सरकार की मंजूरी से मुम्बई पत्तन न्यास का न्यासी मंडल निम्नलिखित विनियम बनाता है, आगे मुम्बई पत्तन न्यास कर्मचारी गृह निर्माण ऋण विनियम , 1972में समय- समय पर किए संशोधनानुसार यथासंशोधित निम्न संशोधन किया है :
1. लघु शीर्षक और आरंभ. ( 1 ) ये विनियम " मुम्बई पत्तन न्यास कर्मचारी गृह निर्माण ऋण ( संशोधन ) विनियम , 2010 " कहालाये जाएं ।
(2) ये विनियम सरकार की मंजूरी सरकारी राजपत्र में प्रकाशित होने की तिथि से लागू होंगे ।

2. वर्तमान ' मुम्बई पत्तन न्यास कर्मचारी गृह निर्माण ऋण विनियम' में
जाए- ( i ) विनियम 8 में उप- विनियम 3 के रूप में निम्न जोड़ा
" (3 ) अध्यक्ष , मुम्बई पत्तन न्यास , बीमा का न कराया जाना अधिक से अधिक 2 वर्ष की अवधि के लिए माफ कर सकते हैं" ।
(ii ) विनियम 7 में निम्न उप- विनियम जोड़े जाएं-
" ( 1 ) छोटे परिवार को बढ़ावा देने की दृष्टि से जो कर्मचारी बन्ध्यीकरण करवा लें; उस कर्मचारी के मामले में गृह निर्माण पेशगी पर ब्याज की दर सामान्य ब्याज दर से आधा प्रतिशत कम लगायी जाएगी। यह रियायत निम्न शर्तों पर निर्भर होगी--
( i ) कर्मचारी प्रजनन आयु वर्ग में होना चाहिए । अर्थात् पुरुष कर्मचारी के मामले में उसकी उम्र 50 वर्ष से ऊपर नहींहोनी चाहिए; और उसकी पत्नी की उम्र 20 से 45 वर्ष के बीच होनी चाहिए । महिला कर्मचारी के मामले में उसकी उम्र 45 वर्ष से अधिक तथा उसके पति की उम्र 50 वर्ष से अधिक नहीं होनी चाहिए ।
( ii ) कर्मचारी के एक, दो अथवा तीन जीवित संतान होनी चाहिए ।
( iii ) बन्ध्यीकरण शल्यक्रिया मुं.पो.ट्र. अस्पताल/केन्द्र सरकार के अस्पताल/केन्द्रीय सरकार स्वास्थ्य योजना/राज्य सरकार अस्पताल/क्लिनिक में किया होना चाहिए , और बन्ध्यीकरण प्रमाणपत्र वहाँ का जारी किया होना चाहिए , जहाँ यह संभव नहीं होगा , वहाँ बन्ध्यीकरण शल्यक्रिया कराने के लिए भारत सरकार/राज्य सरकारों से अनुदान प्राप्त स्वैच्छिक संस्था अथवा इस कार्य के लिए केंद्र सरकार द्वारा 2

अनुमोदित/मान्यताप्राप्त अन्य किसी संस्था का ऐसा प्रमाणपत्र भी स्वीकार्य होगा; और
( iv) बन्ध्यीकरण शल्यक्रिया कर्मचारी स्वयं; अथवा उसकी पत्नी/उसका पति करा सकती है/सकता है बशर्ते कि उक्त शर्तें ( i ) और ( ii ) पूरी की गयी हों.। "

टिप्पणी : मूल विनियम दिनांक 31 दिसम्बर , 1996 के भारत के राजपत्र के भाग II , खण्ड 3 , उप - खण्ड ( i ) में प्रकाशित किए गए थे और बाद में निम्न के अनुसार संशोधित किए गये :

NOTIFICATION
New Delhi , the 29th December , 2010
G.S.R. 1027 ( E) . In exercise of the powers conferred by sub - section ( 1 ) of Section 124 , read with sub - section ( 1) of Section 132 of the Major Port Trusts Act, 1963 (38 of 1963 ) , the Central Government hereby approves the Mumbai Port Trust Employees Housing Loan ( Amendment) Regulations, 2010 made by the Board of Trustees ofMumbai Portas set out in the Schedule annexed to this notification .
2. The said Regulations shall come into force from the date of publication of this Notification in the Official Gazette.
SCHEDULE
Mumbai Port Trust Employees Housing Loan (Amendment) Regulations , 2010
In exercise of the powers conferred by Section 28 of the Major Port Trusts Act, 1963 ( 38 of 1963 ) , with the sanction of the Central Government under sub - section ( 1) ofSection 124 of the said Act, the Board of Trustees ofthe Port of Mumbai hereby make the following regulations, further to amend the Mumbai Port Trust Employees Housing Loan Regulations , 1972 , as amended from time to time, namely: --
1. Short Title and Commencement . ( 1 ) These regulations may be called the " Mumbai Port Trust Employees Housing Loan (Amendment ) Regulations , 2010" .
(2) They shall come into force on publication of sanction of Government thereto in the Official Gazette.
[PART II--SEC. 3 (i ) ]
2. In the present Mumbai Port Trust Employees Housing Loan Regulations ,
( i) In Regulation 8 , the following may be added as sub-regulation 3-
"(3) The Chairman , Mumbai Port Trust may condone the non- insurance for period not exceeding two years ."
(ii) In Regulation 7, the following sub- regulations may be added as:
"( 1 ) As incentive to promote the Small Family Norms , the rate of interest on House Building Advance to such employee as volunteer for sterilization , will be half per cent less than the normal rate of interest . The concession will be subject to the following conditions :
(i) the employee must be within the reproductive age group . In the case of a male employee , this would mean he should not be over 50 years and hiswife shouldbe between 20 and 45 years of age. In the case of a female employee , she must notbe above 45 years and her husband must not be over 50 years of age .
(ii) The employce should have one , two or three living children;
( iii) The sterilization operation should be conducted in and the sterilization certificate issued by Mumbai Port Trust Hospital/a Central Government Hospital/CGIIS / State Government Hospital/Clinic . Where this may not be possible , such certificate from a Voluntary Institution getting grant from the Government of India State Governments for conducting sterilization operations or any other Institution approved recognised by the Central Government for this purpose will also be acceptable ; and
(iv) The sterilization operation can be undergone either by the employee or his/her spouse provided the conditions at ( i) and ( ii) are fulfilled . "
