सं. बी-12015/33 (34)/समन्वयन/ 2009.-जल ( प्रदूषण निवारण एवं नियंत्रण) अधिनियम , 1974 ( 1974 का 6) की धारा 12 की उप- धारो ( 3 क ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय प्रदूषण नियंत्रण बोर्ड, केन्द्रीय सरकार के पूर्व अनुमोदन से केन्द्रीय प्रदूषण नियंत्रण बोर्ड में समूह ' क ' वैज्ञानिक एवं तकनीकी पद विनियम , 2009 में संशोधन हेतु एतद्वारा निम्नलिखित विनियम बनाता है , अर्थात्:-
1. ( 1 ) इन विनियमों को " केन्द्रीय प्रदूषण नियंत्रण बोर्ड में वैज्ञानिक एवं तकनीकी समूह " क " पद (संशोधन ) विनियम , 2011 " कहा जायेगा ।
( 2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. ' भर्ती, पुनर्विलोकन एवं पदोन्नति ' से संबंधित विनियम-8 के स्थान पर निम्नलिखित को प्रतिस्थापित किया जाएगा , अर्थात्:-
" भर्ती, पुनर्विलोकन एवं पदोन्नति ":-
( 1 ) सुनम्य अनुपूरक प्रणाली के अंतर्गत दो स्तरों पर मूल्यांकन किया जायेगा । स्क्रीनिंग के प्रयोजन से पहले स्तर का मूल्यांकन आंतरिक स्तर पर होगा तथा दूसरे स्तर पर बाह्य सदस्यों की अधिकता होगी ।
( 2) पहले स्तर की स्क्रीनिंग हेतु बोर्ड की आंतरिक स्क्रीनिंग कमेटी ( आंतरिक ): वार्षिक कार्य रिपोटों के मूल्यांकन के लिए सुनम्य अनुपूरक प्रणाली के अंतर्गत पदों के उन्नयन के लिए मापदण्ड हेतु निम्नानुसार बोर्ड की एक समुचित आंतरिक स्क्रीनिंग कंमेटी गठित की जायेगी , अर्थात्: -

आन्तरिक स्क्रीनिंग कमेटी वैज्ञानिक द्वारा किये गये कार्य की वैज्ञानिक विषय- वस्तु को रिपोर्टिंग प्रपत्र [ परिशिष्ट- III ] के भाग - ग में प्रतिवेदित करेगी , जिसे दूसरे स्तर की स्क्रीनिंग हेतु केन्द्रीय प्रदूषण नियंत्रण बोर्ड की मूल्यांकन समिति ( बाह्य ) को उपलब्ध कराया जायेगा ।
( 3 ) दूसरे स्तर की स्क्रीनिंग हेतु केन्द्रीय प्रदूषण नियंत्रण बोर्ड की मूल्यांकन समिति ( बाह्य ) उच्च ग्रेड के लिए वैज्ञानिकों की योग्यता जानने हेतु उनके कार्य की वैज्ञानिक विषय - वस्तु के मूल्यांकन एवं भर्ती के लिए केन्द्रीय प्रदूषण नियंत्रण बोर्ड का एक समुचित मूल्यांकन बोर्ड गठित किया जायेगा । यह मूल्यांकन बोर्ड सुनम्य अनुपूरक प्रणाली के अधीन विचार करने हेतु योग्यता को उचित सिद्ध करने के लिए , किये गये कार्यों की विशिष्ट विषय - वस्तु का एक पृष्ठ को सारांश तैयार करेगा । मूल्यांकन बोर्ड का गठन निम्न प्रकार से होगा , अर्थात्: -

टिप्पणी:
1. पहले स्तर की स्क्रीनिंग के लिए बोर्ड की आंतरिक स्क्रीनिंग कमेटी के सदस्य तथा दूसरे स्तर की स्क्रीनिंग के लिए केन्द्रीय प्रदूषण नियंत्रण बोर्ड की मूल्यांकन समिति , जिस स्तर के अधिकारियों के चयन तथा प्रोन्नति पर विचार किया जा रहा है , उनसे कम से कम एक स्तर ऊपर होगा ।

II. स्क्रीनिंग कमेटी/मूल्यांकन बोर्ड आयोजित साक्षात्कार , पूर्व कार्य- निष्पादन तथा वार्षिक कार्य रिपोर्ट ( परिशिष्ट- III ) के मूल्यांकन के आधार पर अपनी सिफारिशें प्रस्तुत करेगा ।
III. अध्यक्ष से भिन्न कमेटी के किसी सदस्य की अनुपस्थिति में कमेटी की कार्यवाही अविधिमान्य नहीं होगी ।
IV. कमेटी की सिफारिशें, नियुक्तिकर्ता प्राधिकारी द्वारा स्वीकृति की तिथि से प्रभावी होंगी ।
3. विनियम 9 निम्नलिखित द्वारा प्रतिस्थापित होगा , अर्थात्:- "सुनम्य अनुपूरक प्रणाली के अधीन प्रोन्नति के लिए मापदण्ड : -- " .
( क ) वार्षिक गोपनीय रिपोर्ट के अतिरिक्त किये गये कार्य वैज्ञानिक स्वरूप पृथक करने के लिए अधिकारी द्वारा एक वार्षिक कार्य रिपोर्ट प्रपत्र ( परिशिष्ट- III ) भरा जायेगा तथा रिपोर्टिंग अधिकारी उस पर रिपोर्ट करेगा । सुनम्य अनुपूरक प्रणाली के अधीन प्रोन्नति हेतु विचार के समय आन्तरिक पीयर मूल्यांकन भाग' ग ' में होगा ।
" वार्षिक कार्य रिपोर्ट " पर नया प्रपत्र , वार्षिक गोपनीय रिपोर्ट रिकार्ड करने की नियमित प्रणाली का स्थान नहीं लेगा । मूल्यांकन एवं स्क्रीनिंग के लिए विचाराधीन अधिकारी द्वारा प्रस्तावित प्रपत्र भरा जायेगा ।
( ख ) सुनम्य अनुपूरक प्रणाली के लिए योजना के अनुसार पात्र सभी वैज्ञानिक तथा जो वैज्ञानिक ' ग ' के लिए ' अच्छा' तथा वैज्ञानिक ' घ ' तथा उससे ऊपर के लिए ' बहुत अच्छा' का बैंचमार्क पूर्ण करते हों , उनके संबंध में सुनम्य अनुपूरक प्रणाली के अधीन उन्नयन पर विचार किया जायेगा । असाधारण रूप से योग्य अभ्यर्थियों जिनके पास सभी उत्तम ग्रेडिंग हों , को पदावास अवधि में छूट दी जा सकेगी । यह छूट किसी एक समय पर एक वर्ष से अधिक नहीं होगी , जो सम्पूर्ण सेवा अवधि में अधिकतम दो बार के लिए सीमित होगी । तथापि अगला ग्रेड प्रदान करने के लिए सुनम्य अनुपूरक प्रणाली के अंतर्गत मूल्यांकन मात्र तीन बार किया जाएगा और इसके उपरांत वैज्ञानिक इस योजना के प्रावधानों के अनुरूप संशोधित सुनिश्चित करयिर उन्नयन योजना के अधीन होगा । ऐसा वैज्ञानिक , जिसे संशोधित सुनिश्चित कस्थिर उन्नयन योजना के अधीन कोई ग्रेड प्रदान किया गया हो , उसके संदर्भ में सुनम्य अनुपूरक प्रणाली की पात्रता और अन्य प्रावधानों के अनुसार सुनम्य अनुपूरक प्रणाली के अधीन अगला ग्रेड प्रदान करने पर विचार किया जायेगा ।
( ग ) ऐसे वैज्ञानिकों/ तकनीकी विशेषज्ञों के संबंध में सुनम्य अनुपूरक प्रणाली के अधीन उन्नयन हेतु विचार नहीं किया जायेगा जो प्रबंधन/प्रशासनिक कार्य कर रहे हों । उन्हें केवल संशोधित सुनिश्चित केरियर उन्नयन योजना के अधीन उन्नयन का लाभ प्राप्त होगा ।
4. निम्नलिखित को विद्यमान विनियम 9 क , के रूप में अंतःस्थापित किया जायेगा , अर्थात्: -
" वैज्ञानिकों की उन्नति के लिए एक वैकल्पिक माध्यम प्रदान करने हेतु केन्द्रीय प्रदूषण नियंत्रण बोर्ड के कर्मचारियों के लिए स्वीकृत संशोधित सुनिश्चित करियर उन्नयन योजना को सुनम्थ अनुपूरक प्रणाली के अधीन सम्मिलित वैज्ञानिकों के संबंध में भी लागू किया जायेगा एवं यह संभावित है कि इसके अन्तर्गत . मूल्यांकन की कसौटी सुनम्य अनुपूरक के अधीन अपेक्षित मूल्यांकन के अनुरूप ही सख्त होगी । "
5. विनियम 10 का सन्नियम ( 3 ) निम्नलिखित द्वारा प्रतिस्थापित होगा , अर्थात्:
" अनुसंधान एवं विकास में क्षेत्र अनुभव और/या ऐसी वैज्ञानिक परियोजनाओं के कार्यान्वयन का अनुभव , वैज्ञानिकों की उच्च ग्रेडोंमें प्रोन्नति के लिए अनिवार्य है । वैज्ञानिक " च " में प्रोन्नति के लिए कम से कम 2 वर्ष का क्षेत्र अनुभव अनिवार्य होगा । " 6. निम्नलिखित को ' परिशिष्ट- II ' के नोट 6 के नीचे ' परिशिष्ट- III ' के रूप में जोड़ा जाएगा , अर्थात्:-

केन्द्रीय सरकार ने कार्मिक एवं प्रशिक्षण विभाग के दिनांक 10 सितम्बर , 2010 के कार्यालय ज्ञापन संख्या ए.बी. -14017/37 /2008 -स्था. (भ.नि. ) , द्वारा वैज्ञानिकों के लिए 01-01-2011 से प्रभावी छठे वेतन आयोग की सिफारिशों पर आधारित संशोधित सुनम्य अनुपूरक प्रणाली के कार्यान्वयन हेतु निदेश जारी किये हैं । इन निर्देशों को कार्यान्वयन की दृष्टि से ' केन्द्रीय प्रदूषण नियंत्रण बोर्ड में वैज्ञानिक एवं तकनीकी समूह ' क ' पदों संबंधी विनियम , 2009 ' को तद्नुसार सरकारी राजपत्र में प्रकाशन की तारीख से संशोधित किया जा रहा है ।

No.B- 12015 /33 ( 34 )/Co-Ord./2009.-In exercise of the powers conferred by sub - section 3A of Section 12 of the Water (Prevention and Control of Pollution) Act , 1974 (6 of 1974) , the Central Pollution Control Board , with the previous approval of the Central Government , hereby makes the following regulations to amend the Scientific and Technical group 'A' posts in Central Pollution Control Board Regulations , 2009 , namely :---
1. ( 1 ) These regulations may be called " The Scientific and Technical group ' A' posts in Central Pollution Control Board (Amendment) Regulations , 2011 .
( 2) They shall come into force on the date of their publication in the Official Gazette .
2. Regulation 8 relating to ' Recruitment , Review and Promotion ' shall be substituted by the following , namely :--
" Recruitment , Review and promotion : -
( 1 ). There shall be two levels of assessment for Flexible Complementing Scheme ( FCS ) . The first one would be at internal level for screening purpose and next level assessment should have majority of external members .
(2) Board's Internal Screening Committee for level 1 screening ( Internal ) : There shall be constituted an appropriate Board's Internal Screening Committee for evaluation of annual work reports vis - a- vis the criteria for upgradation under the FCS , as follows , namely :--
-Chairman Post Scientist F and Scientist E
Composition of Board's Internal Screening Committee Secretary , MoEF or his nominee who shall be at least two levels above the level of the post ( s ) for which selection is to be made
---Member Chairman , Central Pollution Control Board
-Member One expert from the Ministry of Environment and Forests ( to be nominated by the Secretary , MoEF )
---Chairman Chairman , Central Pollution Control Board
Scientist D, Scientist C and Scientist B

The Internal Screening Committee would report on the scientific content of work done by the Scientist in part C of the reporting format [ Appendix - III ] which would be made available to the Assessment Board of the CPCB for level 2 screening (External) .
(3 ) Assessment Board of the CPCB for level 2 screening ( External ) : There shall be constituted an appropriate Assessment Board of the CPCB for recruitment and for the assessment of the scientific content of the work of scientists for their suitability for higher grade . The Assessment Board shall document specifically through one page summary, the specific content of the work done justifying the merit for consideration under FCS . Note:
(i) The members ofthe Board's Internal Screening Committee for level - 1 screening and Assessment Board of the CPCB for level 2 screening shall be at least one level above the level for which the persons are to be considered for selection and promotion.
(ii ) The Committee/Board shall make their recommendations on the basis of the interview held, the evaluation ofthe past performance of the candidates and the Annual Work Report (Appendix- III ) .
(iii ) The absence of a member of the Committee other than Chairman shall not invalidate the proceedings ofthe Committee .
(iv) The recommendations of the Committee shall be effective from the date on which the appointing authority approves the recommendations.
3. Regulation 9 shall be substituted by the following, namely:-
Criteria for considering promotions under Flexible Complementing Scheme:-
(a) An annual work report format to capture scientific content of work performed (Appendix - III ) would be filled up by the officer along with the ACR and would get reported upon by the reporting officer. The internal peer assessment wouldbe in part ' C ' at the time of consideration under FCS.
The new format on " annual work report " will not replace the regular system of recording ACR . The proposed format will be filled by the officer under consideration for the purpose of assessment and screening.
(b) All scientists eligible as per the scheme for the FCS and meeting the benchmark of ' Good ' for Scientist C and 'Very Good' för Scientist D and above shall be considered for up-gradation under FCS . Exceptionally meritorious candidates with all outstanding grading may be granted relaxation in the residency period, the relaxation being not more than one year on any single occasion, limited to a maximum of two occasions in their entire career. However the assessment under FCS for next grade would only be three times and thereafter the scientist would be covered under modified ACP scheme according to provisions of that scheme . The scientist who has been granted any grade under MACP can be considered for next grade under FCS according to the eligibility and other provisions of FCS .
(c) Scientists /Technical experts doing management/ administrative work shall not be considered for up gradation under FCS. They shall only be given benefit of up gradation under MACP."
4. The following shall be inserted in the existing Regulations as ' Regulation 9 A' , namely:
"TheModified ACP as approved for employees of the CPCB would also be applicable to scientists covered under Flexible Complementing Scheme to provide an alternate channel for development for scientists and is expected to maintain the rigors of assessment required for assessment under FCS . "
5. Sub - Regulation (3 ) of Regulation 10 shall be substituted by the following, namely:-
"Field experience in research and development and/ or experience in implementation of such scientific projects is compulsory for promotion of scientists to higher grades . Field experience of at least two years will be essential for promotion to Scientist F. "
6. The following shall be added as ' Appendix - III ' below Notes 6 of ' Appendix- II ' , namely:

The Central Government has issued directions vide Department of Personnel and Training's Office Memorandum No. AB - 14017/37/2008 -Estt . (RR) , dated the 10th September, 2010 for implementation ofthe Modified Flexible Complementing Scheme for Scientists based on the recommendations of the Sixth Central Pay Commission with effect from 1stjanuary, 2011 . With a view to implement these directions, " The Scientific and Technical group ' A' posts in Central Pollution Control Board Regulations , 2009 " , are accordingly being amended with effect from the date of publication in the Official Gazette .
