साका, नि 7(अ). केन्द्रीय सरकार , सीमा सुरक्षा बल अधिनियम , 1968 ( 1968 का 47 ) की धारा 141 की उप- धारा ( 2 ) के खण्ड ( ख ) और ( ग ) द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए और सीमा सुरक्षा बल , जल स्कध , समूह " क " ( तकनीकी स्टाफ ) भर्ती नियम , 2005 को, उन बातो के सिवाय अधिक्रात करते हुए , जिन्ह ऐस अधिक्रमण से पहले किया गया है या करने का लोप किया गया है , गृह मंत्रालय मे सीमा सुरक्षा बल के जल स्कध मे समूह ' क ' ( तकनीकी स्टाफ ) के पदो पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्
1 संक्षिप्त नाम और प्रारम्भ ( 1 ) इन नियमो का संक्षिप्त नाम सीमा सुरक्षा बल , जल स्कध , समूह ' क ' ( तकनीकी स्टाफ ) भर्ती नियम, 2012 है ।
(2) ये राजपत्र मे प्रकाशन की तारीख को प्रवृत्त होगे ।
2. लागू होना-ये नियम इससे उपाबद्ध अनुसूची के स्तम्भ ( 1 ) मे विनिर्दिष्ट पदो को लागू होगे ।
3 पद संख्या , वर्गीकरण तथा वेतन बैंड और ग्रेड वेतन या वेतनमान. उक्त पदो की सख्या , उनका वर्गीकरण तथा उनके वेतन बैड और ग्रेड वेतन या वेतनमान वे होगे , जो उक्त अनुसूची के स्तभ ( 2 ) से स्तभ ( 4 ) मे विनिर्दिष्ट है ।
4 भर्ती की पद्धति, आयु- सीमा , अर्हताए आदि- उक्त पदो पर भर्ती की पद्धति , आयु सीमा, अर्हताए और उनसे सबंधित अन्य बाते वे होगी जो पूर्वोक्त अनुसूची के स्तभ ( 5 ) से स्तभ ( 13 ) में विनिर्दिष्ट है ।

5. चिकित्सक दृष्टया योग्यता ( 1 ) इन नियमो मे अन्तर्विष्ट किसी बात के होते हुए भी , केवल ऐसे व्यक्ति , जो चिकित्सा प्रवर्ग शेप-1 , मे है , इन नियमो के उपबंधो के अधीन नियुक्ति के लिए पात्र होगे ।
(2 ) शेप -1 से निम्नलिखित रूप में परिभाषित चिकित्सा प्रवर्ग अभिप्रेत है
(1 ) कोड अक्षर शेप ( एस एच ए पी ई ) , जो निम्नलिखित कृत्यां का प्रतिनिधित्व करते है, द्वारा उपदर्शित दिए गए कारको के अधीन अधिकारी की उपयुक्तता निर्धारित करने के पश्चात् चिकित्सा अधिकारी द्वारा किया गया चिकित्सा वर्गीकरण अर्थात् मनोवैज्ञानिक

(ii) प्रत्येक कारक के अधीन, किसी अधिकारी की कार्यात्म क्षमता, प्रत्येक कोड अक्षर के सामने अक 1 से 5 की कार्यक्षमता उपदर्शित करते हुए दर्शाई जाएगी और कोड अक्षर के पश्चात् अक लिखे जाएंगे सिवाय उसके जहा कोई अधिकारी सभी कारको में श्रेणी-1 में हैं चहा उसका प्रवर्ग एस 1 एच 1 ए 1 पी 1 ई 1 लिखने के बजाय शेप -1 लिखकर दर्शाया जा सकेगा । इन अकों का साधारण मूल्याकन निम्नानुसार है -
1 भारत में कहीं भी सभी कर्तव्यों के लिए योग्य ।
2 सभी कर्तव्यों के लिए योग्य किन्तु क्या कर्तव्यों में तीव्र कठिनाई या दोनो कानों या ऑखों को श्रवण शक्ति/ दृष्टि की तीक्ष्णता की मांग अन्तर्ग्रस्त है या नही, पर निर्भर हुए कर्तव्यों के प्रकार और नियोजन योग्यता क्षेत्रों के अनुसार परिसीमाएं हो सकती हैं ।
3 " एस" कारक को छोडकर, नेमी या निष्क्रिय कर्तव्यों के लिए योग्य किन्तु उच्च स्थान (2700 मीटर से अधिक) अत्यधिक ठंडे क्षेत्रो या पहाड़ी भूखडो पर और दीर्घ कर्तव्य भारों के लिए नियोजन योग्यता की परिसीमाएं हो सकती हैं ।
4 अस्पताल में भर्ती होने या बीमारी की छुट्टी के कारण कर्तव्यों के लिए अस्थायी रूप से अयोग्य ।
5 कर्तव्यो के लिए स्थायी रूप से अयोग्य ।
6. सेवा का दायित्व - इन नियमों के अधीन किसी भी प्रवर्ग के पदों पर नियुक्त कोई व्यक्ति भारत या भारत से बाहर कहीं भी सेवा करने के लिए दायी होगा ।
7. ज्येष्ठता सूची का अनुरक्षण सीमा सुरक्षा बल, जल स्कन्ध द्वारा बल के मुख्यालय पर प्रत्येक रैंक के लिए केन्द्रीयकृत पृथक ज्येष्ठता सूची अनुरक्षित होगी ।
8. ज्येष्ठता (1 ) उच्च रैंक धारण करने वाले व्यक्ति चाहे वह किसी भी स्थानापन्न या अधिष्ठायी क्षमता पर हों निम्न रैंक धारण करने वाले व्यक्तियों से ज्येष्ठ होंगे ।
(2) किसी रैंक में ज्येष्ठता, उस रैंक में निरंतर निमित सेवा के आधार पर अवधारित होगीः
परन्तु समान रैंक धारण करने वाले और उसी तारीख को प्रोन्नत किए कार्मिकों की ज्येष्ठता उस 'पद पर नियुक्ति के लिए चयन के कम के अनुसार अवधारित की जाएगी ।
9. निरर्हताएं-वह व्यक्ति-
(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या विवाह की सविदा की है; या
(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है या विवाह की संविदा की है;
उक्त पदों पर नियुक्ति का पात्र नहीं होगा
परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हे तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

अन्य देशीय की अपात्रता -ऐसा कोई भी व्यक्ति जो भारत का नागरिक नही है लिखित में केन्द्रीय सरकार की पूर्व अनुमति के सिवाय इन नियमो के अधीन नियुक्त या नियोजित नही किया जाएगा 10
परन्तु इन नियमो मे अतर्विष्ट किसी बात के होते हुए भी नेपाल, या भूटान के नागरिक इन नियमो के अधीन नियुक्ति पजीयन या नियोजन से विवर्जित नही होगा ।
11 अधिवर्षिता (1 )ऐसे आफिसर जो कमाडेट के रैक से भिन्न उच्चतर पद धारण किए हुए है, मास के उस तारीख को, जिसमे वे साठ वर्ष की आयु पूरी कर लेते हैं, के अतिम तारीख के अपराह्न को सेवानिवृत्त होंगे ; और अन्य रैक के आफिसर जो उस मास के अंतिम तारीख को जिसमे वे सत्तावन वर्ष की आयु पूरी कर लेते हैं, के अपराह्न को सेवानिवृत्त होगे ।
परन्तु ऐसे अधिकारी , जिनके जन्म की तारीख किसी मास की पहली तारीख को है , यथास्थिति साठ वर्ष या सत्तावन वर्ष की आयु पूरी कर लेने के पूर्ववर्ती मास के अंतिम तारीख के अपराहन पर सेवानिवृत्त होगे ।
(2) किसी भी व्यक्ति को साठ वर्ष या सत्तावन वर्ष की सेवा निवृत्ति की आयु के पश्चात सेवा विस्तारण प्रदान नहीं किया जाएगा ।
12 शिथिल करने की शक्ति समीचीन है , वहाँ वह उसके लिए किसी वर्ग या प्रवर्ग के व्यक्तियो की जहाँ केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या जो कारण है उन्हे लेखबद्ध करके इन नियमो के किसी उपबंध को बावत्, आदेश द्वारा शिथिल कर सकेगी ।
13. निर्वचन- यदि इन नियमों के निर्वचन की बापत कोई प्रश्न उठता है तो उसका केन्द्र सरकार द्वारा विनिश्चय किया जाएगा ।
14 व्यावृत्ति इन नियमों के कोई बात, ऐसें आरक्षणो और अन्य रियायतो पर प्रभाव नही डालेगी, जिनका केन्द्रीय सरकार द्वारा इस सबंध में समय- समय पर जारी किए गए आदेशो के अनुसार अनुसृस्चित जातियो, अनुसूचित जनजातियो भूतपूर्व सैनिको और अन्य विशेष प्रवर्ग के व्यक्तियो के लिए उपबंध करना अपेक्षित है ।

टिप्पण
आमेलन केवल केन्द्र सरकार या राज्य सरकार के अधिकारियो की दशा मे प्रभावी हो सकता है ।
प्रोन्नति या प्रतिनुियक्ति/ आमेलन द्वारा भर्ती की दशा में वे श्रेणियों जिनसे प्रोन्नति या प्रतिनियुक्ति /आमेलन किया जाएगा

1. प्रतिनियुक्ति ( जिसके अन्तर्गत अल्पकालिक सविदा भी है) / आमेलन द्वारा केन्द्रीय अर्द्धसैनिक बलों या केन्द्रीय सरकार या राज्य सरकार या पब्लिक सेक्टर उपक्रमों के ऐसे अधिकारी जिन्होंने समूह 'क' में 20 वर्ष सेवा की है; और
(क
) (i) जो नियमित आधार पर सदृश पद धारण किए हुए हैं, या
(ii) वेतन बैड-4 + ग्रेड वेतन 8700 रू0 मे ऐसे कमाण्डेंट जिन्होंने उस श्रेणी में दो वर्ष नियमित सेवा की है ; और
(ख) (i ) जिनके पास मोटर परिवहन या जल स्कन्धः या विशेष मरम्मत संगठन या केन्द्रीय मोटर परिवहन स्कूल में न्यूनतम तीन वर्ष का अनुभव है; या
(ii) जिनके पास यांत्रिक इंजीनियरी या मोटरगाड़ी इंजीनियरी या नौ इंजीनियरी में डिग्री है ।
II . भूतपूर्व सैनिकों के लिए
प्रतिनियुक्ति/ पुनर्नियोजन सशस्त्र बल के ऐसे कार्मिको के संबंध में भी विचार किया जाएगा जो एक वर्ष की अवधि के भीतर सेवानिवृत्त होने वाले हैं या रिजर्व में स्थानान्तरित किए जाने वाले हैं और जिनके पास अपेक्षित अनुभव और विहित अर्हताएं हैं । ऐसे व्यक्तियों को उस तारीख तक प्रतिनियुक्ति के निबंधनों पर रखा जाएगा जिस तारीख से उन्हे सशस्त्र बल से निर्मुक्त किया जाना है; तत्पश्चात् उन्हें पुनर्नियोजन पर बने रहे दिया जा सकता है ।
टिष्ट्या 1 प्रप्तिनियुक्ति के आधार पर नियुक्ति के प्रयोजन के लिए किसी अधिकारी द्वारा 1 जनवरी , 2006 से पहले , उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिफारिशो पर आधारित पुनरीक्षित वेतन सरचना का विस्तार किया गया है, नियमित आधार पर की गई सेवा को, सिवाय उस दशा के जहाँ एक से अधिक पूर्व पुनरीक्षित वेतन का साधारण ग्रेड वेतन या वेतनमान सहित एक श्रेणी में विलय हो गया है और वहाँ यह लाभ केवल उस पद (उन पदो) पर विस्तारित होगा जिसके लिए ग्रेड वेतन या वेतनमान बिना किसी उन्नयन का साधारण प्रतिस्थापन ग्रेड है, आयोग की सिफारिशों के आधार पर विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी ।

I प्रोन्नति द्वारा - सीमा सुरक्षा बल के ऐसे उप कमाण्डेट (जल स्कन्ध ) मे से जिन्होने उस श्रेणी मे पाच वर्ष नियमित सेवा और समूह 'क मे 10 वर्ष सेवा की है, और
(i ) जो चिकित्सा प्रवर्ग SHAPE - I मे है;
(ii ) जो प्रवेश स्तर के पद के लिए यथा विहित बुनियादी प्रशिक्षण पाठ्यक्रम अर्हित किया हो, और
(iii ) जो महानिदेशक, सीमा सुरक्षाबल द्वारा समय समय पर यथाविहित अन्य पाठ्यक्रमो या प्रशिक्षण
मे अर्हित हो ।

टिप्पण 1 - जहां ऐसे कनिष्ठ व्यक्तियो के सबंध में, जिन्होंने अपनी अर्हक या पात्रता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो वहां उनसे ज्येष्ठ व्यक्तियों के सबध मे भी विचार किया जाएंगा परन्तु यह तब जब कि उनके द्वारा की गई ऐसी अर्हक या पात्रता सेवा, अपेक्षित अर्हक या पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कंनिष्ठ व्यक्तियों सहित , जिन्होंने ऐसी अर्हक या पात्रता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो ।
टिप्पण 2 :- प्रोन्नति के लिए न्यूनतम अर्हक सेवा की सगणना करने के प्रयोजन के लिए किसी अधिकारी द्वारा 1 जनवरी , 2006 से पहले या उस तारीख जिससे छठे केन्द्रीय वेतन आयोग की सिफारिशों पर आधारित पुनरीक्षित वेतन संरचना का विस्तार किया गया है नियमित आधार पर की गई सेवा को, सिवाय उस दशा के जहाँ एक से अधिक पूर्व पुनरीक्षित वेतन का साधारण ग्रेड वेतन या वेतनमान सहित एक श्रेणी में विलय हो गया है और वहाँ यह लाभ केवल उस पद (उन पदों) पर विस्तारित होगा जिसके लिए ग्रेड वेतन या वेतनमान बिना किसी उन्नयन का साधारण प्रतिस्थापन ग्रेड है, आयोग की सिफारिशों के आधार पर विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी ।
II प्रतिनियुक्ति (जिसके अतर्गत अल्पकालिक संविदा भी है) / आमेलन द्वारा केन्द्रीय अर्द्धसैनिक बलों या केन्द्रीय सरकार या राज्य सरकार या पब्लिक सेक्टर उपक्रमों के ऐसे अधिकारी-
(क
) (i ) जो नियमित आधार पर सदृश पद धारण किए हुए हैं; या
(ii ) जिन्होंने वेतन बैंड-3 + ग्रेड वेतन 6600 रू0 में उस श्रेणी में पॉच वर्ष नियमित सेवा की है ; और
(ख) (i ) जिनके पास मोटर परिवहन या जल स्कन्ध या विशेष मरम्मत संगठन या केन्द्रीय मोटर परिवहन स्कूल में न्यूनतम तीन वर्ष का अनुभव हैं; या
(ii) जिनके पास यांत्रिक इंजीनियरी या मोटरगाड़ी इंजीनियरी या नौ इंजीनियरी में डिग्री या समतुल्य है ।
III भूतपूर्व सैनिकों के लिए
प्रतिनियुक्ति / पुनर्नियोजनः- सशस्त्र बल के ऐसे कार्मिकों के संबंध में भी विचार किया जाएगा जो एक वर्ष की अवधि के भीतर सेवानिवृत्त होने वाले हैं या रिजर्व में स्थानान्तरित किए जाने वाले है और जिनके पास अपेक्षित अनुभव और विहित अर्हताएं हैं । ऐसे व्यक्तियों को उस तारीख तक प्रतिनियुक्ति के निबंधनों पर रखा जाएगा जिस तारीख से उन्हें सशस्त्र बल से निर्मुक्त किया जाना है; तत्पश्चात् उन्हें पुनर्नियोजन पर बने रहे दिया जा सकता है ।
टिप्पण : 1 पोषक प्रवर्ग के ऐसे विभागीय अधिकारी जो प्रोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नही होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्तिके लिए विचार किए जाने के पात्र नही होगे ।
टिप्पण: 2 प्रतिनियुक्ति की अवधि, जिसके अन्तर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर नियुक्ति की अवधि है, साधारणतया तीन वर्ष से अधिक नहीं होगी ।
टिप्पण: 3 प्रतिनियुक्ति द्वारा नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 52 वर्ष से अधिक नहीं होगी ।

टिप्पण. 5 -यदि किसी विशेष पद पर प्रोन्नति के लिए पोषक प्रवर्ग मे पात्र अधिकारी उपलब्ध न हों तो महानिदेशक, सीमा सुरक्षा बल द्वारा उन पदधारियो के कार्य निष्पादन का मूल्याकन करके आमेलन पर विचार किया जा सकता है जो अपने सबधित श्रेणी में तीन वर्ष की प्रतिनियुक्ति पर है ।

प्रोन्नति द्वारा जिसके न हो सकने पर प्रतिनियुक्ति (जिसके अन्तर्गत अल्पकालिक है)/ आमेलन द्वारा सविदा भी
सीमा सुरक्षा बल के ऐसे सहायक कमाण्डेट ( जल स्कन्ध) मे से जिन्होने उस श्रेणी मे 05 वर्ष नियमित सेवा की है; और
भूतपूर्व सैनिको के लिए
(क) जो चिकित्सा श्रेणी शेप -1 मे है;
प्रतिनियुक्ति/ पुनर्नियोजन
(ख) जो किसी मान्यताप्राप्त बोर्ड से मैट्रिकुलेशन या समतुल्य उत्तीर्ण किया है; और
(i) जो प्रवेश स्तर के पद के लिए यथाविहित बुनियादी प्रशिक्षण अर्हित किया है; और
टिप्पण आमेलन केवल केन्द्र सरकार या राज्य सरकार के अधिकारियो की दशा में प्रभावी हो सकता है ।
( II) जो महानिदेशक, सीमा सुरक्षा बल द्वारा समय समय पर यथाविहित पूर्व प्रोन्नति (तकनीकी)पाठ्यक्रम अर्हित किया है ।
टिप्पण 1 जहा ऐसे कनिष्ठ व्यक्तियों के संबंध में, जिन्होने अपनी अर्हक या पात्रता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो वहा उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परन्तु यह तब जब कि उनके द्वारा की गई एसी अर्हक या पात्रता सेवा, अपेक्षित अर्हक या पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमे से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्हाने ऐसी अर्हक या पात्रता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो ।
टिप्पण 2 :-प्रोन्नति के लिए न्यूनतम अर्हक सेवा की सगणना करने के प्रयोजन के लिए किसी अधिकारी द्वारा 1 जनवरी 2006 से पहले या उस तारीख जिससे छठे केन्द्रीय वेतन आयोग की सिफारिशो पर आधारित पुनरीक्षित वेतन सरचना का विस्तार किया गया है, नियमित आधार पर की गई सेवा को, सिवाय उस दशा के जहाँ एक से अधिक पूर्व पुनरीक्षित वेतन का साधारण ग्रेड वेतन या वेतनमान सहित एक श्रेणी में. विलय हो गया है और वहाँ यह लाभ केवल उस पदः (उन पदों) पर विस्तारित होगा जिसके लिए ग्रड वेतन या वेतनमान बिना किसी उन्नयन का साधारण प्रतिस्थापन ग्रेड है, आयोग की सिफारिशों के आधार पर विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी ।

II प्रप्तिनियुक्ति (जिसके अन्तर्गत अल्पकालिक संविदा भी है)/ आमेलन द्वारा-
केन्द्रीय अर्द्ध सैनिक बलो या केन्द्र सरकार या राज्य सरकार या पब्लिक सेक्टर उपक्रम के ऐसे अधिकारी-
(क) (j ) जो नियमित आधार पर सदृश पद धारण किए हुए है; या
(ii) ऐस सहायक कमाण्डेट जिन्हान उस श्रेणी मे पाँच वर्ष नियमित सेवाँ की है ; और
(ख) जिनके पास मोटर परिवहन या जल स्कन्ध या विशेष मरम्मत सगठन या केन्द्रीय मोटर परिवहन स्कूल में न्यूनतम तीन वर्ष का अनुभव है , या
जिनके पास यात्रिक इजीनियरी या मोटरगाडी इजीनियरी या नौ इजीनियरी में डिग्री या समतुल्य या तीन वर्ष का डिप्लोमा है । 3
III भूतपूर्व सैनिको के लिए
प्रतिनियुक्त्ति/ पुनर्नियोजन सशस्त्र बल के एसे कार्मिको के सबध मे भी विचार किया जाएगा जो एक वर्ष की अवधि क भीतर सवानिवृत्त होने वाले है या रिजर्व मे स्थानान्तरित किए जाने वाले है और जिनके पास अपेक्षित अनुभव और विहित अर्हताए है । ऐसे व्यक्तियो को उस तारीख तक प्रतिनियुक्ति के निबधनो पर रखा जाएगा जिस तारीख से उन्हे सशस्त्र बल से निर्मुक्त किया जाना है; तत्पश्चात उन्हे पुनर्नियोजन पर बने रहे दिया जा सकता है ।
टिप्पण 1 पोषक प्रवर्ग के ऐसे विभागीय अधिकारी जो प्रोन्नति की सीधी पक्ति में है, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नही होगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रान्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नही होगे ।
टिप्पण 2 प्रतिनियुक्ति की अवधि जिसके अन्तर्गत केन्द्रीय सरकार के उसी या किसी अन्य सगठन या विभाग मे इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर नियुक्ति की अवधि हे साधारणतया तीन वर्ष से अधिक नही होगी ।
टिप्पण 3 प्रतिनियुक्ति द्वारा नियुक्ति के लिए जिसके अन्तर्गत अल्पकालिक सविदा भी है, अधिकतम आयु सीमा आवेदन प्राप्त करने की अतिम तारीख को 52 वर्ष से अधिक नही होगी ।

पोषक प्रवर्ग में अधिकारी उपलब्ध न हों तो महानिदेशक, सीमा सुरक्षा बल द्वारा उन पदधारियो के कार्य निष्पादन का मूल्यांकन करके आमेलन पर विचार किया जा सकता है जो अपने संबंधित श्रेणी में तीन वर्ष की प्रतिनियुक्ति पर हैं ।

03 वर्ष नियमित सेवा की हैं; और (क) जो चिकित्सा प्रवर्ग शेप- मे है; और भूतपूर्व सैनिको के लिए प्रतिनियुक्ति/ पुनर्नियोजन
(ख) जो किसी मान्यताप्राप्त बोर्ड से मैट्रिकुलेशन या समतुल्य उत्तीर्ण किया हो; और

प्रतिनियुक्ति/ पुनर्नियोजन सशस्त्र बल के ऐसे कार्मिको के सबध मे भी विचार किया जाएगा जो एक वर्ष की अवधि के भीतर सवानिवृत्त होने वाले है या रिज़र्व मे स्थानान्तरित किए जाने वाले है और जिनके पास अपेक्षित अनुभव और विहित अर्हताएं है । ऐसे व्यक्तियो को उस तारीख तक प्रतिनियुक्ति के निबधनो पर रखा जाएगा जिस तारीख से भारतः कोराजन्न मारिए

उन्हे सशस्त्र बल से निर्मुक्त किया जाना है; तत्पश्चात् उन्हे पुनर्नियोजन पर बने रहे दिया जा सकता है ।
प्रकार टिप्पण 1 पोषक प्रवर्ग के ऐसे विभागीय अधिकारी जो प्रोन्नति की सीधी पक्ति मे हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नही होगे । इसी प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नही होगे ।

GS.R. 7 (E) . In exercise ofthe powers conferred by clauses (b ) and (c ) ofsub- section (2) of Section 141 ofthe Border Security Force Act, 1968 (47 of 1968), and in supersession of the Border Security Force Water Wing Group 'A' (Technical Staff) Recruitment Rules , 2005, except as respects things done or omitted to be done before such supersession, the Central Government hereby makes the following rules regulating the method ofrecruitment to the Group-' A' (Techni- cal Staff) posts in the Water Wing ofBorder Security Force in the Ministry of the Home Affairs, namely:-
1. Short title and commencement.-( 1 ) These rules may be called the Border Security Force, Water.Wing, Group-'A' (Technical Staff) , Recruitment Rules, 2012
(2)They shall come into force on the date of their publication in the Official Gazette
rules. 2. Application .-These rules shall apply to the posts specified in column ( 1 ) ofthe Schedule annexed to these
3.Number of Posts, Classification and Pay Band and Grade Pay or Pay Scale. The number of the said posts, their classification and the pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) ofthe said Schedule
4.Method of recruitment, age limit , qualifications, etc. The method of recruitment to the said posts , age limit, qualifications and other matters relating thereto shall be as specified in columns (5 ) to (13 ) of the aforesaid Schedule.
5.Medical Fitness.---( 1) Notwithstanding anything contained in these rules , only those persons who are in medical category SHAPE- I , shali be eligible for appointment under the provisions ofthese rules .
(2) "SHAPE- 1 " means Medical Category defined as under

1. Fit for all duties anywhere .
2. Fit for all duties but may have limitations as to type of duties and areas of employability, depending on whether the duties involve severe stress or demand acuity of hearing or vision of both ears or eyes .
3. Excepting " S" factor , fit for routine or sedentary duties but may have limitations of employability at high altitude ( above 2.700 meters) extreme cold areas or hilly terrain and for long assignments
4 Temporarily unfit for duties on account of hospitalization or sick leave
5. Permanently unfit for duties .
6 Liability of Service . Any person appointed to any category of posts under these rules shall be liable to serve anywhere in India or abroad
7. Maintenance of Seniority Lists.- Separate seniority lists for each of the ranks shall be maintained centrally at Force Head Quarter by Border Security Force , Water Wing
8. Seniority: - ( 1 ) Persons holding a higher rank whether in an officiating or substantive capacity shall be senior to the persons holding a lower rank
(2) Seniority in any rank shall be determined on the basis of continuous regular service in that rank .
Provided that the seniority of the personnel holding the same rank and promoted on the same day shall be determined in accordance with the order of selection for appointment to that post.
9. Disqualifications.- No person . -
(a) who has entered into, or contracted a marriage with a person having a spouse living;or
(b) who , having a spouse living, has entered into or contracted a marriage with any person ,
shall be eligible for appointment to the said posts:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operatlon of this rule .
10. Ineligibility of aliens. No persons who is not a citizen of India shall , except with the prior permission of the Central Government in writing, be appointed or employed under these rules:
Provided that nothing contained in these rules shall debar the appointment, enrolment or employment of a subject of Nepal , or Bhutan under these rules 16

11 Superannuation ( 1 ) The officers holding posts higher than that of a rank of Commandant shall retire from service on the afternoon of the last day of the month in which they attain the age of sixty years ; and officers of other ranks shall retire from service on the afternoon of the last day of the month in which they attain the age of fifty seven years
Provided that an officer whose date of birth is the first of a month shall retire from service on the afternoon of the last day of the preceding month on attaining the age of sixty years or fifty- seven years , as the case may be
(2) No person shall be granted extension in service beyond the age of retirement of sixty years or fifty- seven years , as the case may be

12. Powers to relax Where the Central Government is of the opinton that it is necessary or expedient so to do , it may, by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons
13. Interpretation- If any question relating to the interpretation of these rules arises, it shall be decided by the Central Government
