सं. 308-05/ 2011 -सेवा गुणवत्ता. भारतीय दूरसंचार विनियामक प्राधिकरण , 1997 ( 1997 का 24वां) की धारा 11 की उप- धारा ( 1 ) के खंड ( ख ) के उप - खंड ( i ) और ( v ) के साथ पठित धारा 36 के अंतर्गत प्राधिकरण को प्राप्त शक्तियों का प्रयोग करते हुए भारतीय दूरसंचार विनियामक प्राधिकरण, दूरसंचार उपभोक्ता संरक्षण विनियम, 2012 ( 2012 का 2 ) में संशोधन करने के लिए एतद्वारा निम्नलिखित विनियम बनाता है , अर्थात् :-
1. ( 1 ) इन विनियमों को " दूरसंचार उपभोक्ता संरक्षण ( संशोधन ) विनियम , 2012 " कहा जाएगा ।
(2) ये इनके राजपत्र में प्रकाशन से प्रवृत्त होंगे ।
2. दूरसंचार संरक्षण विनियम , 2012 के विनियम 3 के उप -विनियम ( 1 ) के खंड ( च ) में, " नागरिक घोषणा पत्र " शब्दों को "दूरसंचार उपभोकता घोषणा पत्र " शब्दों से प्रतिस्थापित किया जाएगा।

टिप्पणी 2:-व्याख्यात्मक ज्ञापन में दूरसंचार उपभोक्ता संरक्षण ( संशोधन ) विनियम , 2012 ( 2012 का 04 ) के उद्देश्यों एवं कारणों की व्याख्या दी गई है।
व्याख्यात्मक ज्ञापन
1. पारदर्शिता लाने , उपभोक्ताओ को प्रस्तावित किए जाने वाले वाउचरों एवं विभिन्न प्रशुल्क प्लानों को समझने में सहायता प्रदान करने तथा प्रत्येक वाउचर के सक्रियण करने पर उपभोक्ताओं को सूचना प्रदान करने के लिए, भारतीय दूरसंचार विनियामक प्राधिकरण द्वारा 98 GI/2012 (1) 2

दिनांक 6 जनवरी , 2012 को दूरसंचार उपभोक्ता संरक्षण विनियम , 2012 ( 2012 का 2 ) जारी किया गया । इन विनियमों के विनियम 3 के उप -विनियम ( 1 ) के खंड ( च ) में प्रावधान किया गया है कि दूरसंचार उपभोक्ता शिकायत निवारण विनियम , 2012 के विनियम 17 में यथानिर्दिष्ट के अनुसार " स्टार्ट अप किट " में परस्पर नागरिक घोषणा पत्र का संक्षिप्त पाठ होगा ।
2. इन विनियमों के प्रावधान केवल दूरसचार उपभोक्ताओ पर लागू होते हैं। अतः प्राधिकरण ने " नागरिक घोषणा पत्र " के शब्द को बदलकर " दूरसंचार उपभोक्ता घोषणा पत्र " करने का निर्णय लिया है । तद्नुसार, दूरसचार उपभोक्ता शिकायत निवारण विनियम, 2012 के अध्याय- V में वर्णित " नागरिक घोषणा पत्र " को दूरसचार उपभोक्ता शिकायत निवारण ( सशोधन) विनियम , 2013 के माध्यम से " दूरसंचारं उपभोक्ता घोषणा पत्र" मे बदला गया है । परिणामस्वरूप, दिनांक 06 जनवरी , 2012 को जारी दूरसंचार संरक्षण विनियम , 2012 ( 2012 का 2 ) के विनियम 3 के उप - विनियम ( 1 ) के खड ( च) में दूरसंचार उपभोक्ता शिकायत निवारण ( संशोधन) विनियम , 2012 की तर्ज पर सशोधन कियागयाहै।

TELECOM CONSUMERS PROTECTION (AMENDMENT) REGULATIONS , 2012 (4 OF 2012)
No. 308-5/2011- ( QoS) . In exercise of the powers conferred upon it under Section 36, read with sub -clauses ( i) and(v) of clause (b) of sub - section (1 ) of Section 11 , of the Telecom RegulatoryAuthority ofIndiaAct, 1997 (24 of 1997) , the Telecom Regulatory Authority of India hereby makes the following regulations to amend the Telecom Consumers Protec- tionRegulations , 2012 (2 of2012) , namely:-
1. (1) These regulations may be called the Telecom Consumers Protection (Amendment) Regulations , 2012 .
(2) They shall come into force with effect from the date oftheir publication in the Official Gazette .
2. In clause ( e) of sub - regulation ( 1) of regulation 3 of the Telecour Consumers Protection Regulations, 2012, for the words " Citizen's Charter " , the words "Telecom Consumers Charter " shall be substituted.

Note 1: The principal regulations were published in the Gazette of India, Extraordinary , Part III, Section 4 dated the 6thJanuary, 2012 vide notification number No. 308-5 / 2011 - QOS dated the 6th January, 2012.
Note 2: The Explanatory Memorandum explains the objects and reasons of the Telecom Consumers Protection (Amend- ment) Regulations , 2012.
EXPLANATORY MEMORANDUM
1 The Telecom Regulatory Authority of India issued the Telecom Consumers Protection Regulations, 2012 (2 of 2012 ) on 6th January, 2012 to bring in transparency, help consumers in understanding the various tariff plans and vouchers on offer ånd for provision of information to consumers after every activation of vouchers. In clause (e) of sub -regulation (1 ) of regulation 3 of these regulations , it has been provided that the Start- up Kit shall, inter alia, contain abridged version of the Citizens Charter, as specified under regulation 17 of the Telecom Consumers Complaint Redressal Regulations , 2012 .
2. The provisions of these regulations are applicable only to telecom consumers . So the Authority has decided to rename the " Citizens Charter" as "Telecom Consumers Charter ". Accordingly, the term " Citizens Charter " wherever appearing in Chapter- V ofthe Telecom Consumers Complaint Redressal Regulations , 2012 has been replaced by the term "Telecom Consumers Charter " through the Telecom Consumers Complaint Redressal (Amendment) Regulations , 2012 (3 of2012) . Consequently, clause (c) ofsub-regulation ( 1) ofregulation 3 ofthe Telecom Consumers Protection Regulations, 2012 (2 of 2012) dated 6th January, 2012 has been amended to make it in line with the Telecom Consumers Complaint Redressal (Amendment) Regulations, 2012
