का.आ. 356( अ ). न्यूनतम मजदूरी अधिनियम, 1948 (1948 का 11 ) की धारा 26 की उप - धारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार मुम्बई पोर्ट ट्रस्ट के अन्तर्गत कार्यरत फ्लोटिला कर्मकारों के कार्य घंटों, अवकाश दिवस और अतिरिक्त समय के संबंध में लागू विशेष विनियमों के संबंध में एतद्वारा यह निर्देश देती है कि सरकारी राजपत्र में इस अधिसूचना के उक्त अधिनियम की धारा 13 एवं 14 के प्रावधान इस अधिसूचना के सरकारी राजपत्र में प्रकाशन की तारीख से पांच वर्षों की अवधि के लिए निम्नलिखित शर्तों के अध्यधीन उक्त कर्मचारियों पर लागू नहीं होंगे नामतः:-
( i ) पत्तनन्यास उक्त विनियमों को एक पुस्तिका के रूप में हिन्दी और अंग्रेजी भाषा में और भाषा या भाषाओं में प्रकाशित कराएगा जिसे अधिकतर कर्मचारी समझते हों;
(ii ) उपरोक्त विनियमों में कोई संशोधन करने से पूर्व पत्तनन्यास संबंधित कर्मचारियों को प्रस्तावित संशोधनों को सूचना देने के लिए नोटिस देगा , इस नोटिस को उपरोक्त पत्तनन्यास के कार्यालय के सूचना पटल पर लगाया जायेगा और ऐसी सभी आपत्तियों और सुझावों पर विचार करेगा जो नोटिस देने की तारीख से इक्कीस दिन के भीतर प्राप्त हों , और
( iii ) उपरोक्त खण्ड ( i ) में निर्दिष्ट पुस्तिका की एक प्रति और उसमें किये जाने वाले प्रत्येक संशोधन की एक प्रति प्रत्येक संबंधित कर्मचारी को उपलब्ध करायी जायेगी; और
( iv ) पत्तनन्यास प्रत्येक संबंधित कर्मकार को प्रतिवर्ष कम से कम 52 दिनों का अवकाश सुनिश्चित करेगा तथा इस संबंध में रजिस्टर रखेगा ।

MINISTRY OF LABOUR AND EMPLOYMENT NOTIFICATION
New Delhi , the 7th February, 2013
S.O. 356 (E) . In exercise of the powers conferred by sub - section (2) of Section 26 of the Minimum Wages Act, 1948 ( 11 of 1948 ) , the Central Government having regard to the special regulations in force in respect of the duty hours , rest day and overtime of the Flotilla workers working under Mumbai Port Trust hereinafter referred to as the Port Trust , hereby directs that the provisions of Sections 13 and 14 of the said Act shall not apply to the said workers for a period of five years commencing from the date of publication of this notification in the Official Gazette, subject to the following conditions , namely :---
(i) the Port Trust shall publish the said regulations in a pamphlet form in Hindi and English languages and in the language or the languages understood by the majority of the workers;
(ii) before making any amendment to the aforesaid regulations , the port Trust shall inform the workers concerned, by notice to be put up on the Notice Board in the office of the aforesaid Port Trust , of the proposed amendments and shall consider any objections or suggestions thatmay be made in respect thereofby persons likely to be affected thereby within twenty one days of such notice;
( iii) a copy of the pamphlet referred to in condition ( i) above and a copy of every amendment thereto shall be supplied by the Port Trustto each worker concerned ; and
(iv) the Port Trust shall ensure atleast fifty two rest days to each concerned workman every year and shall maintain a register in this regard . [No. S- 32014/1 /2006-WC]
