का.आ. 370(अ) .- जबकि निःशुल्क और अनिवार्य बाल शिक्षा का अधिकार अधिनियम, 2009 (2009 का 35) (जिसे यहां आगे उक्त अधिनियम कहा गया है) की धारा 2 के खंड (घ) के अनुसार 'अलाभित समूह का बालक' से अनुसूचित जाति, अनुसूचित जनजाति, सामाजिक रूप से और शैक्षिक रूप से पिछड़े वर्ग या सामाजिक, सांस्कृतिक , आर्थिक, भौगोलिक, भाषाई, लिंग या ऐसी अन्य बात के कारण , जो समुचित सरकार द्वारा , अधिसूचना द्वारा, विनिर्दिष्ट की जाए , अलाभित ऐसे अन्य समूह को कोई बालक अभिप्रेत है;
और जबकि, किसी ऐसे संघ राज्य क्षेत्र जिसका कोई विधानमंडल नहीं है , के प्रशासक द्वारा स्थापित , उसके स्वामित्व अथवा नियंत्रणाधीन किसी स्कूल के संबंध में समुचित सरकार होने के नाते केन्द्र सरकार को चंडीगढ़ प्रशासन से उक्त अधिनियम की धारा 2 के खंड (घ) के अंतर्गत युद्ध में शहीदों की विधवाओं के बालकों, सामान्य अस्पताल, चंडीगढ़ या राजकीय चिकित्सा कॉलेज एवं अस्पताल, सेक्टर 32, चंडीगढ़ या पीजीआईएमईआर, चंडीगढ़ के चिकित्सा बोर्ड द्वारा जारी प्रमाणपत्र के अनुसार न्यूनतम साठ प्रतिशत की निःशक्तता वाले माता- पिता (दोनों में से कोई एक) के बालकों और चंडीगढ़ संघ राज्य क्षेत्र में रहने वाले अनाथ बालकों को उक्त अधिनियम के प्रयोजन के लिए 'अलाभित समूह का बालक' के रूप में अधिसूचित करने के लिए एक प्रस्ताव प्राप्त हुआ है ।
और जबकि, केन्द्र सरकार ने चंडीगढ़ संघ राज्य क्षेत्र के प्रस्ताव पर विचार किया है ;
इसलिए , अब, शिक्षा का अधिकार अधिनियम की धारा 2 के खंड (घ) के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए चंडीगढ़ संघ राज्य क्षेत्र द्वारा स्थापित उसके स्वामित्व अथवा 602G1/2013

उसके नियंत्रणाधीन स्कूल के संबंध में उपयुक्त सरकार होने के कारण केन्द्र सरकार एतदद्वारा : युद्ध में शहीदों की विधवाओं के बालकों, सामान्य अस्पताल, चंडीगढ़ या राजकीय चिकित्सा कॉलेज एवं अस्पताल , सेक्टर 32 , चंडीगढ़ या पीजीआईएमईआर, चंडीगढ़ के चिकित्सा बोर्ड द्वारा जारी प्रमाणपत्र के अनुसार न्यूनतम साठ प्रतिशत की निःशक्तता वाले माता- पिता (दोनों में से कोई एक) के बालकों और चंडीगढ़ संघ राज्य क्षेत्र में रहने वाले अनाथ बालकों को उक्त अधिनियम के प्रयोजन के लिए अलाभित समूह के बालकों के रूप में अधिसूचित करती है।

NOTIFICATION
New Delhi , the 14th February, 2013
S.O. 370 ( E ) . WHEREAS clause (d ) of section 2 of the Right of Children to Free and Compulsory Education Act , 2009 (35 of 2009) ( hereinafter referred to as the said Act) , defines " child belonging to disadvantaged group " as a child belonging to the Scheduled Caste , the Scheduled Tribe , the socially and educationally backward class , or such other group having disadvantage owing to social , cultural , economical , geographical , linguistic , gender or such other factor , as may be specified by the appropriate Government , by notification;
AND WHEREAS , the Central Government, being the appropriate Government in relation to a school established , owned or controlled by the administrator of the Union territory having no legislature , has received a proposal from Chandigarh Administration for notifying under clause (d) of section 2 of the said Act- Children of war widows ; children of disabled persons with a minimum sixty per cent disability for either of the parents as per the certificate issued by the Medical Board of General Hospital , Chandigarh or Government Medical College and Hospital Sector 32 , Chandigarh or PGIMER , Chandigarh and orphan children , residing in Union territory of Chandigarh ; as children belonging to disadvantaged group .
AND WHEREAS , the Central Government has considered the proposal of the Union territory of Chandigarh Administration;
NOW, THEREFORE , in exercise of powers conferred by clause ( d) of section 2 of the Right of Children to Free and Compulsory Education Act, 2009 , (35 of 2009 ) , the Central Government being the appropriate Government in relation to a school established , owned or controlled by the Union territory of Chandigarh , hereby notifies the children of war widows ; children of disabled persons having minimum sixty per cent disability for either of the parents as per the certificate issued by the Medical Board of General Hospital , Chandigarh or Government Medical College and Hospital Sector 32 , Chandigarh or PGIMER, Chandigarh; and orphan children residing in Union territory of Chandigarh as " children belonging to disadvantaged group " for the purpose of the said Act .

का.आ. 371 (अ).- जबकि निःशुल्क और अनिवार्य बाल शिक्षा का अधिकार अधिनियम, 2009 (2009 का 35) (जिसे यहां आगे उक्त अधिनियम कहा गया है) की धारा 2 के खंड (ड. ) में ऐसे माता- पिता अथवा संरक्षक, जिनकी वार्षिक आय समुचित सरकार द्वारा , अधिसूचना द्वारा विनिर्दिष्ट न्यूनतम सीमा से कम है, के बच्चे को "कमजोर वर्ग के बच्चे" के रूप में परिभाषित किया गया है;
जबकि किसी ऐसे संघ राज्य क्षेत्र जिसका कोई विधानमंडल नहीं है, के प्रशासक द्वारा स्थापित, उसके स्वामित्व अथवा नियंत्रणाधीन किसी स्कूल के संबंध में समुचित सरकार होने के नाते केन्द्र सरकार को चंडीगढ़ प्रशासन से शिक्षा का अधिकार अधिनियम की धारा 2 के खंड (ड. ) के अंतर्गत उन सभी माता- पिताओं या अभिभावकों के बच्चे को " कमजोर वर्ग के बच्चे" के रूप में अधिसूचित करने का प्रस्ताव प्राप्त हुआ है जिनकी वार्षिक आय एक लाख पचास हजार रूपए अथवा उससे कम है;
जबकि केन्द्र सरकार ने चंडीगढ़ प्रशासन के प्रस्ताव पर विचार किया है;
इसलिए , अब, शिक्षा का अधिकार अधिनियम, 2009 (2009 का 35) की धारा 2 के खंड (ड. ) के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए चंडीगढ़ संघ राज्य क्षेत्र द्वारा स्थापित उसके स्वामित्व अथवा नियंत्रणाधीन स्कूल के संबंध में उपयुक्त सरकार होने के कारण केन्द्र सरकार ऐसे माता पिता या अभिभावक के बालक को उक्त अधिनियम के प्रयोजन के लिए कमजोर वर्ग के बालक के रूप में अधिसूचित करती है जिसकी समस्त स्रोतों से वार्षिक आय एक लाख पचास हजार रूपए से कम है ।

S.O. 371 ( E ) .- WHEREAS clause ( e ) of section 2 of the Right of Children to Free and Compulsory Education Act , 2009 (35 of 2009) ( hereinafter referred to as the said Act ) , defines " child belonging to weaker section" as a child belonging to such parent or guardian whose annual income is lower than the minimum limit specified by the appropriate Government , by notification;

AND WHEREAS , the Central Government , being the appropriate Government in relation to a school established , owned or controlled by the administrator of the Union territory having no legislature , has received a proposal from Chandigarh Administration for notifying under clause ( e) of section 2 of the RTE Act , a child belonging to such parent or guardian whose annual income from all sources is less than one lakh fifty thousand rupees annually , as a child belonging to weaker section;
AND WHEREAS the Central Government has considered the proposal of the Chandigarh Administration ;
NOW , THEREFORE , in exercise of powers conferred by clause (e) of section 2 of the Right of Children to Free and Compulsory Education Act , 2009 , (35 of 2009 ) the Central Government being the appropriate Government in relation to a school established , owned or controlled by the Union territory of Chandigarh , hereby notifies a child belonging to the parent or guardian whose annual income from all sources is less than one lakh fifty thousand rupees annually , as a child belonging to weaker section for the purpose of the said Act .
