का.आ. 3554(अ).—जबकि कृषि एवं सहकारिता विभाग ;डीएसीद्ध ने भारत के राजपत्रा, असाधरण, भाग-II, खण्ड 3, उप-खण्ड-ii में प्रकाशित दिनांक 12 अक्तूबर, 2011 की अध्सिूचना संख्या का.आ. 2353 ;असाधरणद्ध के माध्यम ये मैसर्स डी-नोसिल क्रोप प्रोटेक्शन लिमिटेड ;अभी मैसर्स डोव एग्रो साइन्सेस ;डासद्ध को कीटनाशी अध्निियम, 1968 ;अध्निियमद्ध की धरा 9;3द्ध के अंतर्गत ऐसटैमीप्रिड टैक्निकल, ऐसटैमीप्रिड 20 प्रतिशत एसपी पफोर्मूलेशन, क्लोरपायरीपफोस 10 प्रतिशत ग्रेन्यूलस पफोर्मूलेशन व क्लोरपायरीपफोस 50 प्रतिशत+साइपरमैथरीन 5 प्रतिशत ईसी पफोर्मूलेशन, हेतु प्रदत्त पंजीकरण प्रमाण पत्रा को रद्द किया । क्लोरपायरीपफोस 50 प्रतिशत +साइपरमैथरीन 5 प्रतिशत ईसी पफोर्मूलेशन, के लिए धरा 9;4द्धके अंतर्गत प्रदत्त पंजीकरण प्रमाणपत्राों को भी रद्द कर दिया गया ।
जबकि दिनांक 12 अक्तूबर, 2011 की राजपत्रा अध्सिूचना संख्या का.आ. 2353 ;असाधरणद्ध में संशोध्न मैसर्स घरडा कैमिकल लिमिटेड के क्लोरपायरीपफोस 50 प्रतिशत+साइपरमैथरीन 5 प्रतिशत ईसी पफोर्मूलेशन के लिए पंजीकरण प्रमाणपत्रा को बहाल दिनांक 20 सितम्बर, 2013 की अध्सिूचना के माध्यम से किया गया क्योंकि यह पफोर्मूलेशन सुरक्षित है बशर्ते इसे निर्धरित खुराक व ढंग से प्रयोग किया जाए ।
जबकि दिनांक 20 सितम्बर, 2013 की अध्सिूचना को ध्यान में रखते हुए पेस्टीसाइड एसोशिएशन और पेस्टीसाइड कंपनियों ने क्लोरपायरीपफोस 50 प्रतिशत+साइपरमैथरीन 5 प्रतिशत ईसी पफोर्मूलेशन के लिए धरा 9;4द्ध के अंतर्गत प्रदत्त पंजीकरण प्रमाणपत्राों को रद्द करने के विरोध् में अभिवेदन दिये हैं ।
और जबकि सभी अभिवेदनों पर विचार करने के पश्चात्् भारत के राजपत्रा, असाधरण, भाग-II, खण्ड 3, उप-खण्ड-ii में प्रकाशित दिनांक 12 अक्तूबर, 2011 की अध्सिूचना संख्या का.आ. 2353 ;असाधरणद्ध में इस सीमा तक आंशिक संशोध्न किया जाता है कि क्लोरपायरीपफोस 50 प्रतिशत+साइपरमैथरीन 5 प्रतिशत ईसी पफोर्मूलेशन के लिए कीटनाशी अध्निियम, 1968 की धरा 9;4द्ध के अंतर्गत प्रदत्त सभी पंजीकरण प्रमाणपत्राों को पंजीकरण समिति द््वारा अनुमोदित खुराक व प(ति के अनुसार कृषि में उपयोग के लिए भारत के राजपत्रा में अध्सिूचना की तारीख से बहाल किया जाएगा ।

S.O. 3554(E).—Whereas Department of Agriculture & Cooperation vide Notification No. S.O. 2353(E) dated 12th October, 2011 published in the Gazette of India Extraordinary Part-II Section -3 Sub-Section-ii cancelled certificates of registration for Acetamiprid Technical, Acetamiprid 20% SP Formulation, Chlorpyriphos 10% Granules Formulation and Chlorpyriphos 50% +Cypermethrin 5% EC Formulation granted under Section 9(3) of the Insecticides Act, 1968 (the Act) to M/s. De-Nocil Crop Protection Ltd. [now M/s. Dow Agro Sciences (DAS)]. All certificates of registration granted under Section 9(4) for Chlorpyriphos 50%+ Cypermethrin 5% EC Formulation were also cancelled.
Whereas Gazette Notification No. S.O. 2353(E) dated 12th October, 2011 was amended vide Notification dated 20th September, 2013 to the extent of restoration of certificate of registration for Chlorpyriphos 50 % +Cypermethrin 5% EC Formulation of M/s. Gharda Chemicals Limited, as the formulation was held to be safe, provided it is applied in the presribed dosage and manner.
Whereas, taking notice of Notification dated 20th September, 2013 Pesticides Associations and Pesticides Companies have represented against the cancellation of certificates of registration granted under Section 9(4) for Chlorpyriphos 50 % + Cypermethrin 5% EC Formulation.
And whereas, after consideration of all representations, Notification No. S.O. 2353(E) dated 12th October, 2011 published in the Gazette of India Extraordinary Part -II Section-3 Sub-Section-ii is partially amended to the extent that all certificates of registration granted under Section 9(4) of the Insecticides Act, 1968 for Chlorpyriphos 50%+ Cypermethrin 5% EC Formulation are restored from the date of notification in the Gazette of India for application in agriculture as per dosage and method approved by the Registration Committee.
