सा.का.नि. 775(अ).—केन्द्र सरकार, महा पत्तन न्यास अधिनियम, 1963 (1963 का 38) की धारा 132 की उप-धारा (1) के साथ पठित धारा 124 की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, नव मंगलूर पत्तन न्यास हेतु न्यासी मंडल द्वारा बनाए गए नव मंगलूर पत्तन कर्मचारी (वर्गीकरण, नियंत्रण व अपील) विनियम, 1980 में फिर से संषोधन करते हुए और इस अधिसूचना के साथ संलग्न अनुसूची में दिए गए नव मंगलूर पत्तन न्यास कर्मचारी (वर्गीकरण, नियंत्रण व अपील) संषोधन विनियम, 2013 का अनुमोदन करती है ।
2. उक्त संषोधन विनियम सरकारी राजपत्र में इस अधिसूचना के प्रकाषन की तारीख से प्रवृत्त होंगे।
अनुसूची
नव मंगलूर पत्तन न्यास
नव मंगलूर पत्तन न्यास कर्मचारी (वर्गीकरण, नियंत्रण व अपील) संषोधन विनियम, 2013
महा पत्तन न्यास अधिनियम, 1963 (1963 का 38) की धारा 28 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, नव मंगलूर पत्तन का न्यासी मंडल नव मंगलूर पत्तन न्यास कर्मचारी (वर्गीकरण, नियंत्रण व अपील) विनियम, 1980 में पुनः संषोधन करते हुए निम्नलिखित विनियम बनाता है, अर्थात्:—
1. संक्षिप्त नाम व प्रारंभ:—
(i) इन विनियमों को नव मंगलूर पत्तन कर्मचारी (वर्गीकरण, नियंत्रण व अपील) संषोधन विनियम, 2013 कहा जाएगा ।

2. विनियम में (2) :—
(i) उप विनियम (ई) के बाद, उप विनियम (ईए) निम्नानुसार शामिल किया जाएगा :—
कर्मचारी के संबंध में "(इए) "समीक्षा समिति" का अर्थ है अनुसूची II में इस प्रकार निर्धारित समिति ।" (ii) उप विनियम (एफ) निम्नानुसार प्रतिस्थापित किया जाएगा :—
"(एफ) अनुसूची" का अर्थ है इन विनियमों के साथ संलग्न अनुसूची I व अनुसूची II"
3. विनियम 7 में:—
(i) वर्तमान विनियम के उप विनियम 6(ए) में, अंतिम शब्द के बाद निम्नलिखित शब्द जोडे जाएं:
"उप विनियम (7) में समाविश्ट प्रावधानों के अधीन"
(ii) वर्तमान के उप विनियम (7) को नया क्रमांक 6 (सी) दिया जाए ।
(iii) उप विनियम 6 (सी) के बाद निम्नलिखित उप विनियम, (7) व (8), शामिल किए जाए ।
"(7) इस विनियम के अंतर्गत बनाया गया अथवा बनने की तरह माना गया निलंबन आदेष प्राधिकारी जो समीक्षा समिति की सिफारिषों के आधार पर निलंबन करने हेतु सक्षम है, द्वारा निलंबन की प्रभावी तारीख से 90 दिन पूरा होने के पहले परिवर्तन या प्रतिसंहरण (रिवोक) किया जाना चाहिए और निलंबन को आगे बढ़ाने या प्रतिसंहरण करने पर आदेष निकाला जाना जाहिए । आगामी समीक्षाएं निलंबन की विस्तरित अवधि पूरा होने के पहले की जानी चाहिए । निलंबन का विस्तरण एक बार एक सौ व अस्सी दिनों से अधिक दिनों की अवधि के लिए नहीं किया जाना चाहिए।"
" (8) इस विनियम के उप विनियम (1) या (3) के अंतर्गत किए गए या बनने की तरह माने गए निलंबन आदेष, समीक्षा करके और नब्बे दिनों की अवधि के लिए विस्तरित नहीं किए जाने पर, नब्बे दिनों की अवधि के पष्चात् वैध नहीं होगा :
बषर्ते कि उप विनियम (3) के अंतर्गत मानित निलंबन के मामले में, वैसी समीक्षा आवष्यक नहीं है, यदि निलंबन पर रहे कर्मचारी निलंबन अवधि के नब्बे दिनों की समाप्ति पर रहता है और ऐसे मामले में नब्बे दिनों की अवधि का हिसाब कर्मचारी को हिरासत में लेने की तिथि या निलंबन (सस्पेन्षन) से विमोचन की वास्तविक तिथि पर अपने नियुक्ति प्राधिकारी को सूचित किए जाने की तिथि, जो भी बाद हो, से किया जाना चाहिए ।"
4. (i) उपर्युक्त विनियमों के साथ संलग्न "अनुसूची" को "अनुसूची- I" किया जाए ।
(ii) उपर्युक्त विनियम में निम्नलिखत "अनुसूची- II" जोड़ दी जाए ।

NOTIFICATION
New Delhi, the 30th October, 2013
G.S.R. 775 (E). - In exercise of the powers conferred by Sub-section (1) of Section 124, read with Sub-section (1) of Section 132 of the Major Port Trusts Act, 1963 (38 of 1963), the Central Government hereby approves the New Mangalore Port Trust Employees (Classification, Control and Appeal) Amendment Regulations, 2013 made by the Board of Trustees for the Port of New Mangalore further to amend the New Mangalore Port Trust Employees (Classification, Control and Appeal) Regulations, 1980 and are set out in the Schedule annexed to this Notification.
2. The said Amendment Regulations shall come into force from the date of publication of this notification in the Official Gazette.
SCHEDULE
New Mangalore Port Trust
New Mangalore Port Trust Employees (Classification, Control & Appeal) Amendment Regulations, 2013
In exercise of the powers conferred by Section 28 of the Major Port Trusts Act, 1963 (38 of 1963), the Board of Trustees of New Mangalore Port hereby makes the following regulations further to amend the New Mangalore Port Trust Employees (Classification, Control and Appeal) Regulations, 1980 namely :–
1. Short Title and Commencement :–
(i) These Regulations may be called the New Mangalore Port Trust Employees (Classification, Control and Appeal) Amendment Regulations, 2013.
(ii) These regulations shall come into force from the date of publication in the Official Gazette.
2. In Regulation 2.–
(i) after sub-regulation (e), sub-regulation (ea) may be inserted as under :–
"(ea) "Review Committee" in relation to an employee means the committee prescribed as such in the Schedule II."
(ii) Sub-regulation (f) may be substituted as under :–
"(f) "Schedule" means the Schedule I and Schedule II annexed to these Regulations."
3. In Regulation 7. –
(i) in the existing sub-regulation 6(a), the following words shall be added after the last word.- "subject to the provisions contained in sub-regulation (7)"
(ii) the existing sub-regulation (7) shall be re-numbered as 6(c). (iii) the following sub-regulations, (7) and (8), shall be inserted after sub-regulation 6(c) " (7) An order of suspension made or deemed to have been made under this Regulation shall be reviewed by the authority which is competent to modify or revoke the suspension before the expiry of 90 days from the effective date of suspension on the recommendation of the Review Committee and pass orders either extending or revoking the suspension. Subsequent reviews shall be made before expiry of the extended period of suspension. Extension of suspension shall not be for a period exceeding one hundred and eighty days at a time."[भाग II—खण्ड 3;iद्ध] भारत का राजपत्रा : असाधरण 5 "(8) An order of suspension made or deemed to have been made under sub-regulations (1) or (3) of this Regulation shall not be valid after a period of ninety days unless it is extended after review, for a further period before the expiry of ninety days :
Provided that no such review of suspension shall be necessary in the case of deemed suspension under sub- Regulation (3), if the employee continues to be under suspension at the time of completion of ninety days of suspension and the ninety days period in such case will count from the date the employee detained in custody is released from detention or the date on which the fact of this release from detention is intimated to his appointing authority, whichever is later."
4. (i) The "Schedule" annexed to the aforesaid Regulations shall be re-named as "Schedule – I".
(ii) In the aforesaid Regulations, the following shall be added as "Schedule – II".
