2. ऋण क/ <पा+मकताएं और (cid:8)व)ता

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC. 1] िजसम(cid:25) समय-समय पर चीनी उ(cid:29)योग के 7लए भारतीय !रजव ब?क (cid:29)वारा अ$धसू$चत Fदशा(cid:30)नद_शानुसार पुनस`रचना शा7मल है। ऋण(cid:19) को ऋण @ाaत करने वाले संबं$धत चीनी उ(cid:29)योग क/ @(cid:30)तभू(cid:30)तय(cid:19) और संपाि5व क से (cid:8)पbटपे(cid:8)षत (cid:23)कया जाएगा िजसम(cid:25) (यिCतगत गारंFटयां और @वत क(cid:19) क/ अ(cid:22)य प!रसRपि+तयाँ शा7मल ह? जो पृथक ब?क(cid:19) (cid:29)वारा (cid:30)नण य 7लए जाने वाले ऋणभार(cid:19) से )वतंA होती ह?।
(iv) एनपीए इकाइय(cid:19) को भी )क/म के अंतग त कवर (cid:23)कया जाता है बशत_ क/ राdय सरकार उनके ऋण(cid:19) के 7लए गारंट(cid:27) दे दे।
(v) इस अ$धसूचना के अनुसरण म(cid:25) ऋणदाता ब?क(cid:19) (cid:29)वारा वे सभी ऋण जो 30 जून, 2014 तक )वीकृ त कर Fदये जाते ह? और 30 7सतंबर, 2014 तक सं(cid:8)वत!रत कर Fदए जाते ह? उ(cid:22)ह(cid:25) Xयाज प!रदान सु(cid:8)वधा के अंतग त कवर (cid:23)कया जाएगा।
(vi) (cid:8)वतरण एक पृथक खाते म(cid:25) (cid:23)कया जाएगा ता(cid:23)क उCत उ4े5य हेतु धनरा7श क/ उपयो$गता क/ (cid:30)नगरानी सरलता से क/ जा सके ।
(vii) (cid:8)व+तीय सेवा (cid:8)वभाग )क/म को @चालना+मक बनाने के 7लए ब?क(cid:19) को उ$चत (cid:30)नद_श जार(cid:27) करेगा िजसम(cid:25) नोडल ब?क का (cid:30)नयोजन शा7मल होगा।
3. Xयाज प!रदान का (cid:8)व)तार.—
(i) ब?क(cid:19) (cid:29)वारा @भा!रत वा)त(cid:8)वक दर पर अथवा 12 @(cid:30)तशत तक Xयाज प!रदान, इनम(cid:25) से जो भी कम हो, सामा(cid:22)य ब?(cid:23)कं ग @था के अनुसार चीनी 7मल(cid:19) को भागीदार(cid:27) अनुसू$चत ब?क(cid:19), GेAीय fामीण ब?क(cid:19) और सहकार(cid:27) ब?क(cid:19) के माgयम से ऋण क/ कु ल अव$ध अथा त् 5 वष[ के 7लए िजसम(cid:25) 2 वष का (cid:8)वलंबन काल शा7मल है, के 7लए उपलXध कराया जाएगा।
(ii) यFद खाता (cid:30)नय7मत रहता है अथा त् मूल का पुनभु गतान अनुसूची के अनुसार होता है तो गतान अव$ध अथा त् तीसरे से पांचवे वष के दौरान Xयाज प!रदान के (cid:22)(cid:26)(cid:27)य सरकार पुनभु
(cid:29)वारा उपलXध कराया जाएगा। यFद कोई चीनी 7मल मूल के भुगतान म(cid:25) चूक करती है तो जब तक खाता अ(cid:30)नय7मतता रहता है तब तक उसे Xयाज प!रदान का लाभ नह(cid:27)ं Fदया
गतान जाएगा और चीनी 7मल मूल के साथ-साथ चूक क/ अव$ध के 7लए Xयाज के पुनभु के 7लए िजRमेदार होगी। इसके अ(cid:30)त!रCत ब?क चूककता कज दार के Sखलाफ ब?(cid:23)कं ग मानक(cid:19) के अनुसार आव5यक कार वाई करने के 7लए )वतंA ह(cid:19)गे।
गतान अव$ध के दौरान यFद नकद @वाह (iii) कज दार(cid:19) के पास (cid:8)वलंबन काल अथवा पुनभु
अ$धक होता है तो +व!रत भुगतान(cid:19) पर (cid:8)वचार (cid:23)कया जाएगा िजसका (cid:30)नण य ब?क (cid:29)वारा 7लया जाना है और ऋण खाते के @(cid:30)त खा(cid:29)य एवं साव ज(cid:30)नक (cid:8)वतरण (cid:8)वभाग क/ Xयाज प!रदान देयता को तदनुसार घटा Fदया जाएगा।
4. के (cid:22)(cid:26)(cid:27)य सरकार (cid:29)वारा Xयाज प!रदान क/ रा7श के भुगतान क/ <पा+मकताएं.—खा(cid:29)य और साव ज(cid:30)नक (cid:8)वतरण (cid:8)वभाग (cid:8)व+तीय सेवा (cid:8)वभाग (cid:29)वारा (cid:30)नयोिजत नोडल ब?क को अ$fम <प से (cid:30)तमाह(cid:27) आधार पर Xयाज प!रदान रा7श जार(cid:27) करेगा। तीसर(cid:27) (cid:30)तमाह(cid:27) से रा7श अ$fम <प से जार(cid:27) कर द(cid:27) जाएगी जो खा(cid:29)य और साव ज(cid:30)नक (cid:8)वतरण (cid:8)वभाग को (cid:8)पछल(cid:27) (cid:30)तमाह(cid:27) से पूव क/ (cid:30)तमाह(cid:27) के 7लए ब?क (cid:29)वारा अिज त

NOTIFICATION
New Delhi, the 3rd January, 2014
No. 20-90/2013-SP.-II.—The Central Government, with a view to improve the liquidity position of sugar factories for enabling them to clear cane price arrears of previous sugar seasons and timely settlement of cane price of current sugar season relating to the Fair and Remunerative Price (FRP) fixed by the Central Government, to the sugarcane farmers, hereby notifies the following scheme, namely :— "Scheme for Extending Financial Assistance to Sugar Undertakings, 2014"
1. Purpose of loan.—The loan will be utilized by the sugar mills for clearance of cane price arrears of previous sugar seasons and timely settlement of cane price of current sugar season relating to the Fair and Remunerative Price (FRP) fixed by the Central Government to the sugarcane farmers.
2. Modalities and extent of loan.—
(i) Loans will be sanctioned to the sugar mills which have been functional during 2013-14 sugar season and the quantum of loan would be equivalent to last three sugar seasons' excise duty, cess and surcharge on sugar paid by the mill (including notional equivalence for exports or availed Cenvat).
(ii) The loan duration would be 5 years including 2 years of moratorium.
(iii) The lending will be subject to various norms relating to scrutiny, future cash flows of five years, establishing the viability & debt servicing capacity, conduct of loan including the restructuring guidelines as notified by RBI for the sugar industry from time to time. The loans will be backed by the security and collateral of the concerned sugar industry availing the loan including personal guarantees and other assets of promoters which are free from encumbrances to be decided by the individual banks.
(iv) The NPA units are also covered under the scheme provided the State Government gives guarantee for their new loans.
(v) All loans which are sanctioned by 30th June, 2014 and disbursed by 30th September, 2014 by the lending banks, pursuant to this notification, would be covered under interest subvention facility.
(vi) The disbursement shall be in a separate account so that the utilization of the money for the said purpose is easily monitored.
(vii) The Department of Financial Services (DFS) will issue suitable instructions to the banks to operationalize the scheme including appointment of a nodal bank.
3. Extent of interest subvention.—
(i) Interest subvention up to 12% or at actual rate charged by the banks, whichever is lower, as per normal banking practice shall be provided to the sugar mills through participating Scheduled Commercial Banks, Regional Rural Banks and Cooperative Banks for the total duration of the loan, i.e., 5 years including 2 years moratorium.
4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC. 1](ii) The interest subvention during the repayment period i.e. from 3rd to 5th year would be provided by the Central Government if the account is regular, i.e., the repayment of principal is as per schedule. If a sugar mill defaults on payment of principal, the benefit of interest subvention will not be available as long as the account is irregular and the sugar mill will be responsible for repayment of interest for the period of default along with the principal. Further, banks will be free to take necessary action against the defaulting borrower as per banking norms.
(iii) In the event of surplus cash flow during moratorium or repayment period with the borrowers, accelerated payments will be considered to be decided by the bank and the interest subvention liability of DFPD towards loan account would accordingly get reduced.
4. Modalities of payment of interest subvention amount by Central Government.—The Department of Food and Public Distribution (DFPD) will release the interest subvention amount on quarterly basis in advance to the nodal bank as appointed by DFS. The amount from third quarter onwards shall be released as advance subject to furnishing of disbursement particulars as well as interest earned by the bank for the quarter preceding the last quarter to DFPD. The interest earned on the interest subvention advance shall be adjusted in the quarterly installment from 3rd quarter onwards. The expenditure would be entirely met from SDF.
5. Utilisation certificate.—The concerned sugar mill shall submit utilization certificate duly verified by the respective sugar/cane commissioner certifying that the loan amount has been utilized for the purpose specified in the scheme. The State sugar/ cane commissioner shall also monitor the utilization of the loan. Any failure to submit the utilisation certificate shall lead to non-re-imbursement of interest subvention by the Central Government.
