सा.का.नि. 72(अ).-केन्द्रीय सरकार, राष्ट्रीय अन्वेषण अभिकरण अधिनियम, 2008 (2008 का 34) की धारा 25 की केन्द्रीय सरकार, राष्ट्रीय अन्वेषण अभिकरण अधिनियम, 2008 (2008 का 34) की धारा 25 की उप-धारा (2) के खंड (क) के साथ पठित धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और गृह मंत्रालय, राष्ट्रीय अन्वेषण उप-धारा (2) के खंड (क) के साथ पठित धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और गृह मंत्रालय, राष्ट्रीय अन्वेषण उप-धारा (2) के खंड (क) के साथ पठित धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और गृह मंत्रालय, राष्ट्रीय अन्वेषण , उन बातों के सिवाय अधिक्रांत अभिकरण (समूह 'ग' पद) भर्ती नियम, 2009 को जहाँ तक उसका संबंध कांस्टेबल के पद से है, उन बातों के सिवाय अधिक अभिकरण (समूह 'ग' पद) भर्ती नियम, 2009 को जहाँ तक उसका संबंध कांस्टेबल के पद से है मण से पहले किया गया है या करने का लोप किया गया है, गृह मंत्रालय के राष्ट्रीय अन्वेषण करते हुए, जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है, गृह मंत्रालय के राष्ट्रीय अन्वेषण मण से पहले किया गया है या करने का लोप किया गया है, गृह मंत्रालय के राष्ट्रीय अन्वेषण अभिकरण मे कांस्टेबल के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्ः- अभिकरण मे कांस्टेबल के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्ः- अभिकरण मे कांस्टेबल के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्ः-
1. संक्षिप्त नाम और प्रारंभ
म और प्रारंभ.-(1) इन नियमों का संक्षिप्त नाम गृह मंत्रालय,

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत होंगे।
2. पद संख्या, वर्गीकरण तथा वेतन बैंड और ग्रेड वेतन या वेतनमान पद संख्या, उसका वर्गीकरण तथा ये राजपत्र में प्रकाशन की तारीख को प्रवृत होंगे। पद संख्या, वर्गीकरण तथा वेतन बैंड और ग्रेड वेतन या वेतनमान.-पद संख्या, उस वेतन बैंड और ग्रेड वेतन या वेतनमान वह होगा जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ (2) से स्तंभ (4) मे विनिर्दिष्ट हैं। वेतन बैंड और ग्रेड वेतन या वेतनमान वह होगा जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ (2) से स्तंभ (4) मे विनिर्दिष्ट हैं। वेतन बैंड और ग्रेड वेतन या वेतनमान वह होगा जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ (2) से स्तंभ (4) मे विनिर्दिष्ट हैं।
3. भर्ती की पद्धति, आयु सीमा अन्य अर्हताएं आदि भर्ती की पद्धति, आयु-सीमा अर्हताएं और उससे भर्ती की पद्धति, आयु सीमा अन्य अर्हताएं आदि.-भर्ती की पद्धति, आयु-सीमा अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ (5) से स्तंभ (13) में विनिर्दिष्ट हैं।

4. निरर्हता.-वह व्यक्ति
(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, (क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, (क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है,
या
(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है; (ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है; (ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है;
पद पर नियुक्ति का पात्र नहीं होगा।
उक्त पद पर नियुक्ति का पात्र नहीं होगा। परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी।

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 5. षिथिल करने की शक्ति.-जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी।
6. व्यावृत्ति.-इन नियमों की कोई बात ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय-समय पर जारी किए गये आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है।

| (1) शैक्षिक अर्हता :- किसी मान्यताप्राप्त बोर्ड से मैट्रिकुलेशन या समतुल्य। (2) न्यूनतम शारीरिक मानक निम्नानुसार हैं : (क) ऊँचाई- पुरूषों के लिए - 170 सें0 मी0 और महिलाओं के लिए- 157 सें0 मी0। (ख) छाती-पुरूषों के लिए - बिना फुलाए-80 सें0 मी0, फुलाकर- न्यूनतम 5 सें0 मी0 का फैलाव टिप्पण- महिला अभ्यर्थियों के लिए छाती के माप की कोई न्यूनतम अपेक्षा नहीं हैं। (ग) वजन- पुरूषों और महिलाओं के लिए-चिकित्सा मानक के अनुसार वजन और आयु के आनुपातिक (3) चिकित्सा मानक : (क) सुधार के बिना अर्थात् चश्मा पहने बिना दोनों आखें न्यूनतम दूर दृष्टि 6/6 और 6/9 हो। (ख) अभ्यर्थियों को संहत जानु, चपटा पाँव, फूली हुई नसें या भैंगी आँखों वाला नहीं होना चाहिए और वे रंग नेत्रहीन न हों। उन्हें अच्छे मानसिक और शारीरिक स्वास्थ्य का और ऐसे शारीरिक रूप से मुक्त होना चाहिए जिसमें उनके कर्तव्यों के दक्षतापूर्ण पालन में बाधा आने की संभावना हो। (4) शिथिलीकरण : (क) ऊँचाई- (i) गढ़वाली, कुमाउंनी, डोगरा, मराठा की श्रेणियों में आने वाले अभ्यर्थियों और असम, हिमाचल प्रदेश तथा जम्मू-कश्मीर राज्यों से संबंधित पुरूष अभ्यर्थियों के लिए न्यूनतम ऊँचाई 165 सें0 मी0 और महिला अभ्यर्थियों के लिए 155 सें0 मी0 होगी। अनुसूचित जनजातियों से संबंधित सभी पुरूष अभ्यर्थियों के लिए न्यूनतम ऊँचाई 162.5 सें0 मी0 और महिला अभ्यर्थियों के लिए 150 सें0 मी0 होगी। (ii) अरूणाचल प्रदेश, मणिपुर, मेघालय, मिजोरम, नागालेैंड, सिक्किम और त्रिपुरा के पूर्वोत्तर राज्यों से आने वाले अभ्यर्थियों और दार्जिलिंग जिले के तीन उप प्रभाग अर्थात दार्जिलिंग, कालिम्पोंग और कुर्सीओंग में समाविष्ट गोरखा राज्य क्षेत्रीय प्रशासन से आने वाले अभ्यर्थियों और इन जिलों के "मौजाज" उपखंड मे ं निम्नलिखित सम्मलित है ः- (1) लोहागढ़ चाय बगान (2) लोहागढ़ वन (3) र गमोहन (4) बाराचेंगा (5) पानीघटा (6) छोटा अदलपुर (7) पहरू (8) सुकना वन ं (9) सुकना भाग-I, (10) पंटापटी वन भाग-I, (11) महानदी वन (12) चंपासरी वन (13) सलबारी छत भाग-II, (14) सिटोंग वन (15) सिवोक पर्वतीय वन (16) सिवोक वन (17) छोटा चेंगा (18) निपानिया के पुरूष अभ्यर्थियों के लिए न्यूनतम ऊँचाई 162.5 सें0 मी0 और महिला अभ्यर्थियों के लिए 152.5 सें0 मी0 होगी। (iii) अरूणाचल प्रदेश, मणिपुर, मेघालय, मिजोरम, नागालैंड, सिक्किम और त्रिपुरा के पूर्वोत्तर राज्यों से और वामपंथी उग्रवाद से प्रभावित जिलों से आने वाले सभी अनुसूचित जनजातियों के पुरूष अभ्यर्थियों के लिए न्यूनतम ऊँचाई 160 सें0 मी0 और महिला अभ्यर्थियों के लिए 147.5 सें0 मी0 होगी। (ख) छाती- (i) गढ़वाली, कुमाऊनी, डोगरा, मराठा प्रवर्ग में आने वाले पुरूष अभ्यर्थियों की और असम, हिमाचल प्रदेश और जम्मू-कश्मीर राज्यों से संबंधित अभ्यर्थियों के लिए न्यूनतम छाती 78 सें0 मी0 (न्यूनतम फैलाव 5 सें0 मी0) होगी। अनुसूचित जनजातियों से संबंधित सभी पुरूष अभ्यर्थियों के लिए न्यूनतम छाती 76 सें0 मी0 (न्यूनतम फैलाव 5 सें0 मी0) होगी। (ii) अरूणाचल प्रदेश, मणिपुर, मेघालय, मिजोरम, नागालैंड, सिक्किम, त्रिपुरा के पूर्वोत्तर राज्यों से आने वाले और गोरखा राज्य क्षेत्रीय प्रशासन {पैरा-4 (क) (ii) में यथावर्णित} के पुरूष अभ्यर्थियों के लिए न्यूनतम छाती बिना फुलाए 77 सें0 मी0 (न्यूनतम फैलाव 5 सें0 मी0 सहित) होगी। (5) शिथिल करने की शक्तिः- महानिदेशक, राष्ट्रीय अन्वेषण अभिकरण के पास अनुकंपा नियुक्ति की दशा में निम्नलिखित पैरामीटर वालों को शिथिल करने की शक्ति है :- (क) ऊँचाई - 5 सें0 मी0। (ख) छाती - 3 सें0 मी0। (ग) वजन - 5 कि0 ग्रा0 (+ -)। (घ) ऊपरी आयु सीमा- दो वर्ष । टिप्पण- अन्य गुणात्मक अपेक्षाएँ अर्थात् शारीरिक और चिकित्सा मानक गृह मंत्रालय द्वारा समय समय पर जारी कर्मचारी चयन आयोग के माध्यम से केन्द्रीय सशस्त्र पुलिस बल और असम राइफल्स में कांस्टेबल के पद के लिए भर्ती कीे स्कीम के अनुसार होंगी। | लागू नहीं होता। | सीधे भर्ती किए जाने वाले व्यक्तियों क े लिए दो वर्ष। | NaN |

NOTIFICATION
New Delhi, the 30th January, 2014
G.S.R. 72(E).—In exercise of the powers conferred by section 5 read with clause (a) of sub-section (2) of section 25 of National Investigation Agency Act, 2008 (34 of 2008), and in supersession of the Ministry of Home Affairs, National Investigation Agency (Group 'C' Posts) Recruitment Rules, 2009, in so far as they relate to the post of Constable, except as respects things done or omitted to be done before such supersession, the Central Government hereby makes the following rules regulating the method of recruitment to the post of Constable in the National Investigation Agency, Ministry of Home Affairs, namely:-
1. Short title and commencement. - (1) These rules may be called the Ministry of Home Affairs, National Investigation Agency, Constable (Group 'C' Post) Recruitment Rules, 2014.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Number of posts, classification and pay band, grade pay or pay scale. – The number of posts, its classification and the pay band, grade pay or pay scale attached thereto shall be as specified in the columns (2) to (4) of the Schedule annexed to these rules.
3. Method of recruitment, age-limit, other qualifications, etc. – The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.
4. Disqualification. – No person,-
(a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living, has entered into or contracted a marriage with any person,
shall be eligible for appointment to the said post:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
5. Power to relax. – Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.
6. Saving. – Nothing in these rules shall affect reservations, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, ex-servicemen and other special categories of persons, in accordance with the orders issued by the Central Government from time to time in this regard.

| 4) Relaxation: (a) Height:- (i) The minimum height of candidates falling in the categories of Garhwalis, Kumaonis, Dogras, Marathas and candidates belonging to the States of Assam, Himachal Pradesh and Jammu and Kashmir shall be 165 cms. for males and 155 cms. for females. The minimum height for all candidates belonging to the Scheduled Tribes shall be 162.5 cms. for males and 150 cms. for females; (ii) The minimum height shall be 162.5 cms. for males and 152.5 cms for females for candi- dates hailing from the North-Eastern States of Arunachal Pradesh, Manipur, Meghalaya, Mizoram, Nagaland, Sikkim and Tripura and candidates hail- ing from Gorkha Territorial Adminis- tration comprising of the three Sub- Divisions of Darjeeling District namely, Darjeeling, Kalimpong and Kurseong and includes the following "Mouzas" Sub-Division of these Districts:- | regular basis by an officer prior to the 1st January, 2006 or the date from which the revised pay structure based on the recommnendat ion of the Sixth Central Pay Commission has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendati ons of the said Pay Commission except where there has been merger of more than one pre-revised scale of pay into one grade with a common grade pay or pay scale, and where this benefit will extend only for the post (s) for which that grade pay or pay scale is the normal replacement grade without any upgradation. | ||||

(ii) The minimum chest of male candidates hailing from North-Eastern States of Arunachal Pradesh, Manipur, Meghalaya, Mizoram, Nagaland, Sikkim, Tripura and Gorkha Territorial Administration {as mentioned in paragraph 4 (a) (ii)} shall be 77 cms unexpanded (with minimum 5 cms expansion). (5) Power of Relaxation: The Director General, National Investigation Agency has power to relax the following parameters in cases of compassionate appointment :- (a) Height – 5 cms (b) Chest - 3 cms (c) Weight – 5 Kgs (+-) (d) Upper age limit – two years. Note- Other qualitative requirements i.e. physical and medical tandards will be as per the scheme of recruitment for the post of Constable in Central Armed Police Forces and Assam Rifles through Staff Selection Commission issued by Ministry of Home Affairs from time to time. |
