परAतु य<द के A])य सरकार का यह समाधान हो जाता है \क ऐसा (cid:27)ववाह ऐसे DयिFत और (cid:27)ववाह के अAय प$कार को लागू (cid:18)वीय (cid:27)वHध के अधीन अनु^ेय है और ऐसा करने के (cid:29)लए अAय आधार ह9 तो वह \कसी DयिFत को इस (cid:5)नयम के 'वत=न से छू ट दे सके गी।
5. (cid:29)शHथल करने क(cid:25) शिFत.—जहां के A])य सरकार क(cid:25) यह राय है \क ऐसा करना आव_यक या समीचीन है, वहां वह उसके (cid:29)लए जो कारण ह9 उAह(cid:24) लेखब(cid:26) करके इन (cid:5)नयमB के \कसी उपबंध को \कसी वग= या 'वग= के DयिFतयB क(cid:25) बाबत, आदेश Rवारा (cid:29)शHथल कर सके गी।
6. Dयावृि2त.—इन (cid:5)नयमB क(cid:25) कोई बात, ऐसे आर$ण, आयु-सीमा म(cid:24) छू ट और `रयायतB पर 'भाव नह)ं डालेगी, िजनका के A])य सरकार Rवारा इस संबंध म(cid:24) समय-समय पर (cid:5)नकाले गए आदेशB के अनुसार अनुसूHचत जा(cid:5)तयB, अनुसूHचत जनजा(cid:5)तयB, भूतपूव= सै(cid:5)नकB, अAय (cid:27)पछड़े वगb और अAय (cid:27)वशेष 'वग= के DयिFतयB के (cid:29)लए उपबंध करना अपे#$त है।

| का माणत रकाड। ट पण : 1. वभागीय नदेशक, जो इस ेणी म तीन वष क नयमत स ेवा के साथ पी.बी. 4. ेड वेतन 8700 . म है और िजनके पास तनयुित के आधार पर नयुित पर वचार करने के लए वहत शैक अहताएं एवं अनुभव है, पर भी बाय अ यथय के साथ वचार कया जाएगा। यद वभागीय अ यथ का पद पर नयुित के लए चयन हो जाता है, तो इसे ो नत वारा भरा हुआ समझा जाएगा। ट पण : 2. तनयुि त वारा नयुि त के लए अधकतम आयु- सीमा आवेदन ा त करने क अि तम तारख को 56 वष से अधक नहं होगी। (II) संवदा के आधार पर ऐसे यित िजनके पास तनयुित वारा नयुित के लए उपरो त मद । ख (i) और (ii) म यथा वनद ट शैक अहताएं और अनुभव है। ट पण –1 संवदा के आधार पर नयुि त के लए अधकतम आयु- सीमा आवेदन ा त करने क अितम तारख को 67 वष से अधक नहं होगी। ट पण-2 संवदा के आधार पर नयुित 3 वष क अवध के लए होगी तथा इसे संतोषद काय न पादन के अ यधीन अधकतम 70 वष क आयु-सीमा तक बढ़ाई जा सकती है। | वह संबंधत े म यो यता वाले उ कृ ट यितय का पता लगाने और उनके नाम पर वचार करने के लए उचत समझे। | ||

NOTIFICATION
New Delhi, the 4th February, 2014
G.S.R. 79(E).—In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules regulating the method of recruitment to the post of Director- General, National Gallery of Modern Art, New Delhi in the Ministry of Culture, namely :—
1. Short title and commencement.—(1) These rules may be called the Ministry of Culture, Director-General, National Gallery of Modern Art, New Delhi Recruitment Rules, 2014.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Number of post, classification and Pay Band and Grade Pay or Pay Scale--- The number of the said post their classification and the Pay Band and Grade Pay or Pay Scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.
3. Method of recruitment, age limit and other qualifications, etc.—The method of recruitment, age limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to (13) of the said Schedule.
4. Disqualification.—No person,
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who, having a spouse living , has entered into or contracted a marriage with any person,
shall be eligible for appointment to the said post:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of these rules.
5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing relax any of the provisions of these rules with respect to any class or category of persons.
6. Savings.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Ex-servicemen, the Other Backward Classes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

| (b) Possessing the Educational Qualifications and experience as under: (i) Master's degree in Fine Arts or History of Art from a recognized University, and | |||
| (ii) 15 years' experience including research work in one or more of the fields of Fine Art or History of Art out of which five years' experience should be in administrative matters. Desirable: (i) Ph. D. in Fine Arts or History of Arts. (ii) Proven record of Publication or Exhibition participations and Fellowships Note 1 : The Departmental Director in PB-4 Grade Pay Rs. 8700 with three years regular service in the grade and having the educational qualifications and experience prescribed for considering appointment on deputation basis shall also be considered along with outsiders. If the departmental candidate is selected for appointment to the post; it shall be treated as having been filled by promotion. Note 2: The maximum age limit for appointment by deputation shall not exceed fifty six years as on the closing date for receipt of applications. II. On Contract basis Persons possessing educational qualifications and experience as specified in item I(b) (i) and (ii) above for appointment by deputation. Note 1: The maximum age limit for appointment on contract basis shall not exceed sixty seven years as on the closing date for receipt of applications. Note 2: Appointment on contract basis shall be for a period of three years and may be extended subject to age limit of seventy years and satisfactory performance. Note 3: In case of appointment on contract basis, the terms and conditions of service of the incumbent of the post shall be as applicable to a Group A officer of the Central Government holding analogous post. |
