सा.का.सा.का.सा.का.सा.का.िनिनिनिन .... 864864864864((((अअअअ).).).).————निम्नलिखित प्रारूप िनयम, अर्थात् मजदूरी संदाय (रेल) िनयम, 1938 का और संशोधन करने के िलए कितपय िनयमों का निम्निलिखत प्रारूप जिन्हें के (cid:31)ीय सरकार, मजदूरी संदाय अिधिनयम, 1936 (1936 का 4) की धारा 26 की उपधारा (2) और उपधारा (3333) द्वारा प्रदत्त शक्तियों का प्रयोग करते (ए, बनाने का प्रस्ताव करती है, उक्त अिधिनयम की धारा की उपधारा (5) की अपेक्षानुसार ऐसे सभी /क्तियों की जानकारी के िलए िजनके उससे प्रभावित होने की संभावना है, प्रकािशत किए जाते हैं और सूचना दी जाती है कि उक्त प्रारूप नियमों पर उस तारीख से, िजसको उस राजपत्र की, जिसमें यह अिधसूचना प्रकाशित की जाती है, प्रतियां जनता को उपलब्ध करा दी जाती हैं, तीन मास की अविध के अवसान के प7ात् िवचार किया जाएगा ;

आक्षेप या सुझाव, यदि कोई हों, सिचव, 9म और रोजगार मंत्रालय, भारत सरकार, 9म शक्ति भवन, रफी मार्ग नई दिल्ली - 110001 को भेजे जा सकें गे ;

ऐसे आक्षेपों और सुझावों पर जो उक्त प्रारूप नियमों के संबंध में किसी /क्ति से इस प्रकार विनि<दष्ट अविध के अवसान के पूर्व प्राप्त होते हैं, उन पर के (cid:31)ीय सरकार द्वारा िवचार किया जाएगा ।

1. संक्षिप्तसंक्षिप्तसंक्षिप्तसंक्षिप्त नामनामनामनाम औरऔरऔरऔर प्रारंभप्रारंभप्रारंभप्रारंभ- (1) इन नियमों का संक्षिप्त नाम मजदूरी संदाय (रेल) (संशोधन) िनयम, 2014 है ।

(2) ये राजपत्र में इनके अंितम प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. मजदूरी संदाय (रेल) िनयम, 1938 (िजन्हें इसमें इसके पश्चात् मूल िनयम कहा गया है) के िनयम 17 के स्थान पर िनम्निलिखत िनयम रखा जाएगा, अर्थात् :--

परन्तु यह कि निरीक्षण के दौरान, निरीक्षक यथा स्थिति, खाते, बहियां, रजिस्टर और अन्य दस्तावेज चाहे ये हस्तलिखित या इलैक्ट्रॉनिक रूप में, यदि रखे गए हों, को प्रस्तुत करने की अपेक्षा करेगा।

NOTIFICATION

New Delhi, the 1st December, 2014

G.S.R. 864(E).—The following draft of certain rules further to amend the Payment of Wages (Railways) Rules, 1938, which the Central Government proposes to make in exercise of the powers conferred by sub-section (2) and (3) of section 26 of the Payment of Wages Act, 1936 (4 of 1936), is hereby published, as required by sub-section (5) of the said section, for the information of all persons likely to be affected thereby, and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of three months from the date on which the copies of the Gazette of India in which this notification is published, are made available to the public;

Objections or suggestions, if any, may be addressed to the Secretary, Ministry of Labour and Employment, Government of India, Shram Shakti Bhawan, Rafi Marg, New Delhi- 110 001;

The objection or suggestion, which may be received from any person with respect to the said draft rules before the expiry of the period so specified, will be considered by the Central Government.

DRAFT RULES

1. Short title and commencement. - (1) These rules may be called the Payment of Wages (Railways) (Amendment) Rules, 2014.

(2) They shall come into force on the date of their final publication in the Official Gazette.

2. In the Payment of Wages (Railways) Rules, 1938, (hereinafter referred to as the principal rules), for rule 17, the following rule shall be substituted, namely:-

'17. Annual Returns. – (1) Every employer shall on or before the 1st day of February in each year upload annual returns in the Form III on the web portal of the Ministry of Labour and Employment giving information as to the particulars specified in respect of the preceding year.

(2) Every employer on or before the 1st day of February in each year may file annual returns in the Form III to the Regional Labour Commissioner (Central) giving information as to the particulars specified in respect of the preceding year:

Provided that during inspection, the inspector shall require the production of the accounts, books, register and other documents if the same are maintained in manual form or in electronic form, as the case may be.

Explanation. - For the purposes of this sub-rule, the expression "electronic form" shall have the same meaning as assigned to it in clause (r) of section 2 of the Information Technology Act, 2000 (21 of 2000).'.

3. In the principal rules, for Form III, the following Form shall be substituted, namely.-

सा.का.सा.का.सा.का.सा.का.िनिनिनिन .... 868686866666((((अअअअ).).).).————निम्नलिखित प्रारूप िनयम, अर्थात् मजदूरी संदाय (खान) िनयम, 1956 का और संशोधन करने के िलए कितपय िनयमों का निम्निलिखत प्रारूप जिन्हें के (cid:28)ीय सरकार, मजदूरी संदाय अिधिनयम, 1936 (1936 का 4) की धारा 26 की उपधारा (2) और उपधारा (3333) द्वारा प्रदत्त शक्तियों का प्रयोग करते &ए, बनाने का प्रस्ताव करती है, उक्त अिधिनयम की धारा की उपधारा (5) की अपेक्षानुसार ऐसे सभी .क्तियों की जानकारी के िलए िजनके उससे प्रभावित होने की संभावना है, प्रकाशित किए जाते हैं और सूचना दी जाती है कि उक्त प्रारूप नियमों पर उस तारीख से, िजसको उस राजपत्र की, जिसमें यह अिधसूचना प्रकाशित की जाती है, प्रतियां जनता को उपलब्ध करा दी जाती हैa, तीन मास की अविध के अवसान के प7ात् िवचार किया जाएगा ;

1. संक्षिप्तसंक्षिप्तसंक्षिप्तसंक्षिप्त नामनामनामनाम औरऔरऔरऔर प्रारंभप्रारंभप्रारंभप्रारंभ- (1) इन नियमों का संक्षिप्त नाम मजदूरी संदाय (खान) (संशोधन) िनयम, 2014141414 है ।

(2) ये राजपत्र में इनके अंितम प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. मजदूरी संदाय (खान) िनयम, 1956 (िजन्हें इसमें इसके पश्चात् मूल िनयम कहा गया है) के िनयम 18 के स्थान पर िनम्निलिखत िनयम रखा जाएगा, अर्थात् :--

''18. वाHषक विवरणी– (1) प्रत्येक िनयोजक प्रत्येक वर्ष 1 फरवरी को या उसके पूर्व 9म और रोजगार मंत्रालय के वेब पोर्टल पर पूर्ववर्ती वर्ष के संबंध में विHनदिष्ट िविशष्टियों के बारे में जानकारी देते &ए प्ररूप-5 में वाHषक विवरणी अपलोड करेगा ।

(2) प्रत्येक िनयोजक प्रत्येक वर्ष 1 फरवरी को या उसके पूर्व क्षेत्रीय 9म आयुक्त (के न्(cid:28)ीय) तथा िनरीक्षक को पूर्ववर्ती वर्ष के संबंध में िवHनदिष्ट विशिष्टियों के बारे में जानकारी देते &ए प्ररूप-5 वाHषक विवरणी फाइल कर सके गा :

परन्तु यह कि निरीक्षण के दौरान, निरीक्षक यथा स्थिति, खाते, बहियां, रजिस्टर और अन्य दस्तावेज चाहे ये हस्तलिखित या इलैक्ट्रॉनिक रूप में, यदि रखे गए हों, को प्रस्तुत करने की अपेक्षा करेगा।

स्पष्टीकरण – इस उप-नियम के प्रयोजनों के िलए, "इलैक्ट्रॉनिक रूप" अभि.क्ति का वही अर्थ होगा जो सूचना प्रौद्योगिकी अधिनियम, 2000 (2000 का 21) के अनु[छेद 2 के ख]ड (द) में उसका है।

NOTIFICATION

New Delhi, the 1st December, 2014

G.S.R. 866(E).—The following draft of certain rules further to amend the Payment of Wages (Mines) Rules, 1956, which the Central Government proposes to make in exercise of the powers conferred by sub-sections (2) and (3) of section 26 of the Payment of Wages Act, 1936 (4 of 1936), is hereby published, as required by sub-section (5) of the said section, for the information of all persons likely to be affected thereby, and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of three months from the date on which the copies of the Gazette of India in which this notification is published, are made available to the public;

Objections or suggestions, if any, may be addressed to the Secretary, Ministry of Labour and Employment, Government of India, Shram Shakti Bhawan, Rafi Marg, New Delhi- 110 001;

The objection or suggestion, which may be received from any person with respect to the said draft rules before the expiry of the period so specified, will be considered by the Central Government.

DRAFT RULES

1. Short title and commencement. - (1) These rules may be called the Payment of Wages (Mines)(Amendment) Rules, 2014.

(2) They shall come into force on the date of their final publication in the Official Gazette.

2. In the Payment of Wages (Mines) Rules, 1956, (hereinafter referred to as the principal rules), for rule 18, the following rule shall be substituted, namely:-

'18. Annual Returns. – (1) Every employer shall on or before the 1st day of February in each year upload annual returns in the Form V on the web portal of the Ministry of Labour and Employment giving information as to the particulars specified in respect of the preceding year.

(2) Every employer on or before the 1st day of February in each year may file annual returns in the Form V to the Regional Labour Commissioner (Central) and Inspector giving information as to the particulars specified in respect of the preceding year:

Provided that during inspection, the inspector shall require the production of the accounts, books, register and other documents if the same are maintained in manual form or in electronic form, as the case may be.

Explanation. - For the purposes of this sub-rule, the expression "electronic form" shall have the same meaning as assigned to it in clause (r) of section 2 of the Information Technology Act, 2000 (21 of 2000).'.

3. In the principal rules, for Form V, the following Form shall be substituted, namely:-
