सासासासा....काकाकाका....निनिनिनि.... 882882882882(अ)(अ)(अ)(अ)....----के न्(cid:4)ीय मोटर यान िनयम, 1989 का और संशोधन करने के िलए कितपय नियमों का निम्नलिखित प्रारूप, के न्(cid:4)ीय सरकार, मोटर यान अिधिनयम, 1988 (1988 का 59) की धारा 110 द्वारा प्रदत्त शक्तियों का प्रयोग करते (cid:28)ए बनाने का प्रस्ताव करती है, उक्त अिधिनयम की धारा 212 की उपधारा (1) की अपेक्षानुसार उन सभी %क्तियों की जानकारी के िलए िजनके उससे प्रभावित होने की संभावना है, प्रकाशित किया जाता है और यह सूचना दी जाती है कि उक्त प्रारूप नियमों को उस तारीख से, िजसको भारत के उस राजपत्र जिसमें यह अिधसूचना प्रकाशित की गई थी, की प्रतियां जनता को उपलब्ध करा दी जाती हैं, तीस दिन की अविध की समाप्ति के प0ात् िवचार किया जाएगा;
इन प्रारूप नियमों पर आक्षेप या सुझाव, यदि कोई हों, संयुक्त सिचव (परिवहन), सड़क परिवहन और राजमार्ग मंत्रालय, परिवहन भवन, संसद मार्ग, नई दिल्ली- 110001 को भेजे जा सकें गे;
के न्(cid:4)ीय सरकार द्वारा उक्त प्रारूप नियमों की बाबत, ऐसे किन्ही आक्षेपों और सुझावों पर, जो किसी %क्ति से पूव;क्त अविध की समाप्ति से पूर्व प्राप्त हों, िवचार किया जाएगा;
प्रारूपप्रारूपप्रारूपप्रारूप िनयमिनयमिनयमिनयम
1. (1) इन नियमों का संक्षिप्त नाम के न्(cid:4)ीय मोटर यान (......संशोधन) िनयम, 2014 है ।
(2) ये नियम उनके राजपत्र में अंतिम प्रकाशन की तारीख को प्रवृत्त होंगे।
2. के न्(cid:4)ीय मोटर यान िनयम, 1989 (जिसे इसमें इसके पश्चात मूल िनयम कहा गया है) के िनयम 115घ के पश्चात् निम्निलिखत िनयम अंत:स्थापित किया जाएगा, अर्थात् :-
"115ड. Cलैक्स Fधन इथनोल (ई-85) और इथनोल (ईडी-95) यानों के लिए बृहत उत्सर्जन मानक -
(1) स्पार्क Fधन इंजन से सुसज्जित नए विनिJमत पेट्रोल यान जो पेट्रोल या पेट्रोल के मिLण और 85 प्रतिशत इथनोल

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] संमिLण (ई-85) से चालन के लिए संगत हैं (जिसे इसमें इसके पश्चात् Cलैक्स Fधन इथनोल यान कहा गया है), अिभभावी पेट्रोल उत्सर्जन मानकों के अनुसार अनुमोदित किस्म के होंगे ।
(2) 3.5 टन से अधिक समP भाग वाले नए विनिJमत इथनोल यान जो 95 प्रतिशत इथनोल Fधन ( ईडी-95) से चालन के िलए संगत है, उस Lेणी को यथा लागू, अिभभावी डीजल उत्सर्जन मानकों के अनुसार अनुमोदित किस्म के होंगे ।
(3) इथनोल संमिLण के स्तर के लिए यानों की संगतता को यान विनिर्माता द्वारा परिभाषित किया जाएगा और उसे स्पष्ट रूप से दृश्य स्टीकर लगाकर यान पर प्रदJशत किया जाएगा ।
(4) अनुमोदित किस्म के लिए परीक्षण अपेक्षाएं तथा विभिन्न वगT के यानों के लिए विस्तार Uमश: नीचे दी गई सारणी 1, सारणी 2 और सारणी 3 में दिया गया है :

1. बृहत उत्सर्जन परीक्षण यथा लागू एमओआरटीएच/सीएमवीआर/टीएपी-115/116 अंक चार और पश्चातवर्ती अंकों या संशोधनों के अनुसार किया जाएगा और निष्कासक गैस घनत्व से गैस संघटक घनत्वों का समुचित उन्नयन, हाइXोजन- कार्बन-ऑक्सीजन अनुपात और Fधन उपभोग सूत्र किस्म अनुमोदन प्रUिया में किया जाएगा ।
[भाग II—खण्ड 3(i)] भारत का राजपत्रा : असाधरण 32. यान विनिर्माता, किस्म अनुमोदन के िलए िनयम 126 में विनिZदष्ट किसी भी परीक्षण अभिकरण को स[पेंगे ।
3. Cलैक्स Fधन यान जिनका समP यान भार 3.5 टन से कम या उसके बराबर है का परीक्षण विद्यमान पेट्रोल यान उत्सर्जन चालन चU का उपयोग करते (cid:28)ए चेसिस डायनमों मीटर पर किया जाएगा, शु] इथनोल Fधन यान जिनका समP यान भार 3.5 टन से अधिक है का परीक्षण विद्यमान डीजल इंजन उत्सर्जन चालन चU का उपयोग करते (cid:28)ए इंजन डायनमो मीटर पर किया जाएगा ।
4. Cलैक्स Fधन यानों का परीक्षण उपाबंध 4-ञ और उपाबंध 4-थ में निZदष्ट संदर्भ Fधन के साथ किया जाएगा और शु] इथनोल Fधन यानों का परीक्षण इन नियमों के उपाबंध 4-द में विनिZदष्ट संदर्भ Fधन के साथ किया जाएगा ।
5. उत्पादन परीक्षण के लागू होने की पुष्टि के िलए सारणी 1, सारणी 2 और सारणी 3 को यथा लागू एमओआरटीएच/सीएमवीआर/टीएपी-115/116 अंक चार और उसके पश्चातवर्ती अंकों या संशोधनों के संयोजन में निZदष्ट किया जाएगा ।
6. पेट्रोल के लिए निZदष्ट Fधन उपाबंध 4ञ; ई-85 यानों के लिए उपाबंध 4थ और ईडी-95 यानों के लिए उपाबंध- 4द में यथा विनिZदष्ट होगा ।
7. वाणिज्यिक Fधन विनिZदष्टियों के िलए आईएस 2796: 2008 और पश्चावतव^ संशोधनों को निZदष्ट किया जाएगा ।
8. आधारभूत इथनोल विनिZदष्टियों के लिए आईएस 15464: 2004 को निZदष्ट करें और ई-85 तथा ईडी-95 वाणिज्यिक Fधन के लिए विपणन कं पनियां उत्पाद में समुचित सहयोज्यों का उपयोग करेंगी और Fधन के ऐसे Pेड को अभिमुक्त करेंगी । वाणिज्यिक ई-85 और ईडी-95 के लिए विशिष्टियां भारतीय मानक ब्यूरो द्वारा तैयार की जाएंगी ।
9. उत्पादन आवृत्ति की पुष्टि और नमूनाकरण यथा लागू एमओआरटीएच/सीएमवीआर/टीएपी-115/116 अंक चार और पश्चातवर्ती अंक या संशोधनों की अपेक्षाओं के अनुसार यान की Lेणी के अनुसार होगा ।
10. अपकर्षक कारक, यान की Lेणियों के अनुसार अभिभावी उत्सर्जन मानकों के अनुसार होंगे ।
11. स्पार्क इगनीशन यानों के लिए शु] पावर का माप आईएस: 14599 – 1999 के अनुसार Fजन डायनमों मीटर पर किया जाएगा ।"।
3. मूल नियमों में उपाबंध 4त के पश्चात् निम्निलिखत उपाबंध अंत:स्थापित किए जाएंगे, अर्थात् :-

1. विशिष्टियों में कोट किया गया मान, "'सत्यमान" है । उनका सीमा मान स्थापित करने में आईएसओ 4259 पेट्रोिलयम उत्पाद-परीक्षण की विधि के संबंध में प्रमितता डाटा का अवधारण और उपयोग को न्यूनतम मान नियत करने के लिए लागू किया गया है, 0 से ऊपर 2R के न्यूनतम अंतर को गणना में लिया गया है; अधिकतम और न्यूनतम मान िनयत करने के लिए न्यूनतम अंतर 4R है (R=पुन:उत्पादकता ) । इस माप के होते (cid:28)ए भी जो तकनीकी कारणों से आवश्यक है Fधन का विनिर्माता इसके बावजूद शून्य मान का और जहां अनुब] न्यूनतम मान 2R है और अधिकतम और न्यूनतम सीमाओं को कोट करने की दशा में औसत मान का लbय करेगा । जहां क्या Fधन विनिदcशन की अपेक्षाओं को पूरा करता है का स्पष्टीकरण करना आवश्यक हो वहां आईएसओ 4259 पद को लागू किया जाएगा ।
2. विवाद की दशा में विवाद का समाधान करने के लिए और परीक्षण विधि की स्टीकता के आधार पर परिणामों के निर्वचन के िलए ईएनआईएसओ 4259 में वर्णत प्रUिया का उपयोग किया जाएगा ।
3. गंधक की अंतर्वस्तु से संबंधित राष्ट्रीय विवाद की दशा में ईएनआईएसओ 20846 या ईएन आईएस 20884 को ईएन 228 का राष्ट्रीय उपाबंध में निदcश के समान उपयोग किया जाएगा ।
4. किस्म 1 परीक्षण में उपयोग की गई वास्तविक गंधक अंतर्वस्तु को रिपोर्ट किया जाएगा ।
5. सीसा रहित पेट्रोल अंतर्वस्तु का अवधारण जल और एल्कोहल की अंतर्वस्तु के 100वें भाग के रूप में किया जा सकता है ।
6. इस निZदष्ट Fधन में फास्फोरस, लौह, मैeीज या सीसे को अंतJवष्ट करने वाले संयोजनों का जानबूझकर वर्धन नह^ किया जाएगा ।
7. ईएन-15376 की विशिष्टियों को पूरा करने के लिए इथनोल के वल आक्सीजेनेट है जिसका निZदष्ट Fधन में आशयपूर्वक वर्धन किया जाएगा ।

1. इंजन विनिर्माता द्वारा यथा विनिZदष्ट योजक जैसे िसटेन सुधारक को इथनोल Fधन में तब तक डाला जा सकता है जब तक कि उसका कोई fात नकारात्मक दुश्प्रभाव नह^ होता है । यदि इन शब्दों को पूरा किया जाता है तो अधिकतम अनुfात मात्रा दस प्रतिशत m/m है ।
2. विनिदcशों में कोट किया गया मान "सत्यमान है" उनका सीमा मान स्थापित करने में आईएसओ 4259 पेट्रोलियम उत्पाद- परीक्षण की विधि के संबंध में स्टीक डाटा का अवधारण और उपयोग को न्यूनतम मान नियत करने के लिए लागू किया गया6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] है, 0 से ऊपर 2R के न्यूनतम अंतर को गणना में लिया गया है; अधिकतम और न्यूनतम मान नियत करने के लिए न्यूनतम

3. जब सूचीब] गुणधर्म के लिए जारी किया जाए तब समतुल्य ईएन/आईएसओ विधियों को अंगीकार किया जाएगा ।
4. जब यह स्पष्ट करना आवश्यक हो कि क्या Fधन विनिदcशों की अपेक्षाओं को पूरा करता है तो ईएन- 15489 के निबंधनों को लागू किया जाएगा ।

NOTIFICATION
New Delhi, the 10th December, 2014
G.S.R. 882(E).—The following draft of certain rules further to amend the Central Motor Vehicles Rules, 1989, which the Central Government proposes to make in exercise of the powers conferred by Section 110 of the Motor Vehicles Act, 1988 (59 of 1988), is hereby published as required by sub-section (1) of Section 212 of the said Act for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of thirty days from the date on which the copies of this notification as published in the Official Gazette, are made available to the public;
Objections or suggestions, if any, may be sent to the Joint Secretary (Transport), Ministry of Road Transport and Highways, Transport Bhawan, Parliament Street, New Delhi-110001;
The objections or suggestions which may be received from any person in respect of the said draft rules before the expiry of the aforesaid period will be considered by the Central Government.
DRAFT RULES
1. (1) These rules may be called the Central Motor Vehicles (……Amendment) Rules, 2014.
(2) These rules shall come into force on the date of their final publication in the Official Gazette.
2. In Central Motor Vehicle Rules, 1989 (hereinafter referred as the principal rules) after rule 115D, the following rule shall be inserted namely:–
"115E. Mass emission standards for flex-fuel ethanol (E85) and ethanol (ED95) vehicles.–
(1) The newly manufactured petrol vehicles fitted with spark ignition engine compatible to run on petrol or a mixture of petrol and ethanol up to eighty-five percent ethanol blend (E85), (hereinafter referred to as flex- fuel ethanol vehicle), shall be type approved as per prevailing petrol emission norms.
(2) The newly manufactured ethanol vehicle with Gross Vehicle Weight above 3.5tonnescompatibleto run on ninety-five per cent ethanol fuel (ED95), shall be type approved as per prevailing diesel emission norms, as applicable for that category.
(3) The compatibility of vehicle to level of ethanol blend shall be defined by the vehicle manufacturer and the same shall be displayed on vehicle by putting a clearly visible sticker.
(4) Test requirements for the type approval and extension for different classes of vehicles are specified in Table 1, Table 2 and Table 3 below, respectively:

Notes:—
1. Mass emission tests shall be carried out as per MoRTH/ CMVR / TAP-115/116 Issue 4 and its subsequent issues or amendments, as applicable and suitable updation of the ratios of gas component densities to exhaust gas density, hydrogen-carbon-oxygen ratio and fuel consumption formula shall be done in type approval procedure.
2. Vehicle manufacturer shall submit the vehicle to any of the test agencies specified in rule 126, for type approval.
3. Flex fuel vehicles with Gross Vehicle Weightless than or equal to 3.5 tones shall be tested on chassis dynamometers using the prevailing petrol vehicle emission driving cycle pure ethanol fuel vehicles with Gross Vehicle Weight greater than 3.5 tones shall be tested on engine dynamometers using the prevailing diesel engine emission driving cycle.
4. Flex fuel vehicles shall be tested with reference fuel specified in Annexure IV-J and IV-Q and pure ethanol fuel vehicle shall be tested with reference fuel specified in Annexure-IV-R to these rules.
8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]5. For Conformity of Production test applicability, Table 1, Table 2 and Table 3 may be referred in conjunction with MoRTH/ CMVR/ TAP-115/116 Issue 4 and its subsequent issues or amendments, as applicable.
6. The reference fuel shall be as specified in Annexure IV-J for petrol; Annexure IV Q for E85 vehicles and in Annexure-IV-R for ED95 vehicles.
7. For commercial fuel specifications IS 2796:2008 and its subsequent amendments may be referred.
8. For base ethanol specifications refer IS 15464:2004 and for E85 and ED95 commercial fuel, oil marketing companies shall use suitable additives to produce and dispense such grade of fuel. Specification for commercial E85 and ED95 shall be prepared by Bureau of Indian Standards.
9. The Conformity of Production frequency and sampling shall be as per requirements given in MoRTH/CMVR/ TAP-115/116 Issue 4 and its subsequent issues or amendments, as applicable, according to category of vehicle.
10. Deterioration factors shall be as per prevailing emission norms, according to the vehicle categories.
11. For spark ignition vehicle, measurement of net power shall be carried out on engine dynamometer as per IS:
14599-1999.".

1. The values quoted in the specifications are "true values". In establishment of their limit values the terms of ISO 4259 Petroleum products - Determination and application of precision data in relation to methods of test have been applied and in fixing a minimum value, a minimum difference of 2R above zero has been taken into account; in fixing a maximum and minimum value, the minimum difference is 4R (R = reproducibility). Notwithstanding this measure, which is necessary for technical reasons, the manufacturer of fuels shall nevertheless aim at a zero value where the stipulated maximum value is 2R and at the mean value in the case of quotations of maximum and minimum limits. Should it be necessary to clarify whether a fuel meets the requirements of the specifications, the terms of ISO 4259 shall be applied.
2. In case of dispute, the procedure for dissolving the dispute and interpretations of the results based on test method precision, describe in EN ISO 4259 shall be used.
3. In case of national dispute concerning sulphur content, either EN ISO 20846 or EN IS) 20884 shall be called up similar to the reference in the National annex of EN 228.
4. The actual sulphur content of the fuel used for the Type I Test shall be reported.
5. The unleaded petrol content can be determined as 100-the sum of the per cent content of water and alcohol.
6. There shall be no intentional addition of compounds containing phosphorus, iron, manganese, or lead to this reference fuel.
7. Ethanol to meet the specification of EN 15376 is the only oxygenate that shall be intentionally added to this reference fuel.

1. Additives, such as cetane improver as specified by the engine manufacturer, may be added to the ethanol fuel, as long as no negative side effects are known. If these conditions are satisfied, the maximum allowed amount is 10 % m/m.
