सा.का.नि. 902(अ).-राश्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत शक्तियों का प्रयोग और निम्नलिखित का अधिक्रमण करते हुए :-
(i) दक्षिणी क्षेत्र, फार्म मषीनरी प्रषिक्षण एवं परीक्षण संस्थान, अनंतपुर, समूह 'ग' और समूह 'घ' भर्ती नियम, 1985, को जहां तक उनका संबंध मोटर ड्राईवर, बिजली मिस्त्री (इलेक्ट्रीषियन)-2 तथा मेट के पदों से है।
(ii) उत्तरी क्षेत्र फार्म मषीनरी प्रषिक्षण एवं परीक्षण संस्थान, हिसार (उपकरण मैकेनिक और विष्लेशक/सांख्यिकीय सहायकद्ध भर्ती नियम, 1985, को जहां तक उनका संबंध उपकरण मैकेनिक के पद से है।
(iii) उत्तरी क्षेत्र फार्म मषीनरी प्रषिक्षण एवं परीक्षण संस्थान, हिसार (कृषि एवं सहकारिता विभागद्ध (समूह 'ग' तथा समूह 'घ' पद) भर्ती नियम, 1989, को जहां तक उनका संबंध प्रषिक्षण सहायक, कलाकार-सह-फोटोग्राफर, नक्षानवीस श्रेणी-2, कृशि सहायक, तकनीषियन-I, तकनीषियन-II, तकनीषियन-III, तकनीषियन-IV, वैल्डर, लोहार-II, मषीनमैन, बढ़ई-III, ऑयल इंजन ड्राईवर, मोटर ड्राईवर, बिजली मिस्त्री (इलेक्ट्रीषियन) तथा मेट-II, के पदों से है।
(iv) केन्द्रीय फार्म मषीनरी प्रषिक्षण एवं परीक्षण संस्थान, बुदनी (कृषि एवं सहकारिता विभाग) समूह 'ग' तथा समूह 'घ' पद भर्ती नियम, 1990, को जहां तक उनका संबंध तकनीषियन-IV पद से है।
(v) दक्षिणी क्षेत्र फार्म मषीनरी प्रषिक्षण एवं परीक्षण संस्थान, गार्लेदिन्ने, अनंतपुर (आंध्र प्रदेष) समूह 'ग' तथा समूह 'घ' पद भर्ती नियम, 1995, को जहां तक उनका संबंध कृशि सहायक, बिजली मिस्त्री-1, नलकूप आपरेटर तथा टै्रक्टर ड्राईवर के पदों से है;
(vi) केन्द्रीय फार्म मषीनरी प्रषिक्षण एवं परीक्षण संस्थान, बुदनी, (कृषि एवं सहकारिता विभाग) समूह 'ग' और समूह 'घ' पद भर्ती नियम, 2000, को जहां तक उनका संबंध फोरमेन (विद्युत), कृशि सहायक, ज्येश्ठ तकनीषियन, तकनीषियन, बिजली मिस्त्री श्रेणी-1, उपकरण मैकेनिक-I, तेल इंजिन चालक, मोटर ड्राईवर, बढ़ई, वैल्डर तथा कनिश्ठ तकनीषियन के पदों से है।
(vii) उत्तर-पूर्वी क्षेत्र फार्म मषीनरी प्रषिक्षण एवं परीक्षण संस्थान, बिस्वानाथ चारियाली समूह 'ग' और समूह 'घ' पद भर्ती नियम, 2005;
(viii) कृषि एवं सहकारिता विभाग, दक्षिणी क्षेत्र फार्म मषीनरी प्रषिक्षण एवं परीक्षण संस्थान, अनंतपुर (आंध्र प्रदेष), (तकनीषियन तथा प्रषिक्षण सहायक) समूह 'ग' पद भर्ती नियम, 2007;
उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है, कृषि मंत्रालय में कृषि एवं सहकारिता विभाग के फार्म मषीनरी प्रषिक्षण एवं परीक्षण संस्थानों में, समूह 'ग', तकनीकी पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात् :-
5019 GI/2014 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 1. laf{kIr uke vkSj izkjaHk-& (1) इन नियमों का संक्षिप्त नाम, कृषि मंत्रालय, कृषि एवं सहकारिता विभाग, फार्म मषीनरी प्रषिक्षण एवं परीक्षण संस्थान, तकनीकी, समूह 'ग' पद भर्ती नियम, 2014 है।
¼2½ ये राजपत्र में उनके प्रकाषन की तारीख को प्रवृत्त होंगे।
2. लागू होना.-ये नियम इन नियमों से उपाबद्ध अनुसूची के स्तंभ (1) में विनिर्दिष्ट पदों पर लागू होंगे। 3. पदों की संख्या, वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान.-उक्त पदों की संख्या, उनका वर्गीकरण, उनका वेतन बैंड तथा ग्रेड वेतन या उनसे संलग्न वेतनमान वे होंगे जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ (2) से स्तंभ (4) में विनिर्दिष्ट हैं। 4. भर्ती की पद्धति, आयु-सीमा, अर्हताएं, आदि.-उक्त पदों पर भर्ती की पद्धति, आयु-सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वह होंगी जो उक्त अनुसूची के स्तंभ (5) से (13) में विनिर्दिष्ट हैं। 5. आरंभिक गठन.-उत्तर-पूर्वी क्षेत्र फार्म मषीनरी प्रषिक्षण एवं परीक्षण संस्थान के ज्ञापन सं. 2-9/2010-स्था, तारीख 13 अगस्त, 2010, उत्तर-पूर्वी क्षेत्र फार्म मषीनरी प्रषिक्षण एवं परीक्षण संस्थान के ज्ञापन सं. 2-3/90-पी.एफ-1677 तारीख 19 मार्च, 2013 और 1-1/2008-स्था., तारीख 25 फरवरी, 2009 और उत्तर-पूर्वी क्षेत्र फार्म मषीनरी प्रषिक्षण और परीक्षण संस्थान के ज्ञापन सं. 2-3/2010-स्था./674/675, तारीख, 22 जुलाई, 2010 के अनुसरण में कृशि सहायक, प्रषिक्षक आपरेटर और बिजली मिस्त्री का पद धारण करने वाले पदधारियों तथा मोटर ड्राईवर को अब क्रमषः ज्येश्ठ तकनीषियन और तकनीषियन के रूप में पुनः नाम निर्दिश्ट किया गया है और उनको इन नियमों के उपबंधों के अनुसार नियुक्त किया गया समझा जाएगा तथा उनके द्वारा इन नियमों के प्रारंभ होने से पहले उस पद पर की गयी निरंतर सेवा प्रोन्नति और परीवीक्षा के प्रयोजन के लिए अर्हक सेवा हेतु हिसाब में ली जाएगी। 6. निरर्हरता.-वह व्यक्ति.-
(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या
(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,
उक्त पदों पर नियुक्ति का पात्र नहीं होगा :
परंतु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह उस व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी। 7. षिथिल करने की शक्ति.-जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवष्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेष द्वारा षिथिल कर सकेगी। 8. व्यावृत्ति.-इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय-समय पर जारी किए गए आदेषों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विषेष वर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है।

| प्रोन्नति : वेतन बैंड-1; 5200-20200/- रुपये ग्रेड वेतन 2400/- रुपये में से ऐसे ज्येश्ठ तकनीषियन जिन्होंने उस श्रेणी में पांच वर्श नियमित सेवा की हो। टिप्पण 1ः जहां ऐसे कनिश्ठ व्यक्तियों के संबंध में, जिन्होंने अपनी अर्हक या पात्रता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, वहां उनके ज्येश्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जब कि उनके द्वारा की गई ऐसी अर्हक या पात्रता सेवा, अपेक्षित अर्हक या पात्रता सेवा के आधे से अधिक से या दो वर्श से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिश्ठ व्यक्तियों सहित, जिन्होंने ऐसे अर्हक या पात्रता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो। टिप्पण 2ः प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए, किसी अधिकारी द्वारा 1 जनवरी, 2006 से पहले या उस तारीख से, जिससे छठे केन्द्रीय वेतन आयोग की सिफारिषों पर आधारित पुनर्रीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधार पर की गई सेवा को उक्त आयोग की सिफारिषों के आधार पर विस्तरित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी। | समूह 'ग' विभागीय प्रोन्नति समिति (प्रोन्नति के सम्बन्ध में विचार करने के लिए) जिसमें निम्नलिखिखित होंगेः- (1) निदेषक, फार्म मषीनरी प्रषिक्षण एवं परीक्षण संस्थान - अध्यक्ष; (2) अवर सचिव (यंत्रीकरण एवं प्रौद्योगिकी प्रभाग), कृशि एवं (3) प्रषासनिक अधिकारी या कार्यालयाध्यक्ष, फार्म मषीनरी प्रषिक्षण एवं परीक्षण संस्थान समूह 'ग' विभागीय पुश्टि समिति (पुश्टि के सम्बन्ध में विचार करने के लिए) जिसमें निम्नलिखित होंगे ः- (1) निदेषक, फार्म मषीनरी प्रषिक्षण एवं परीक्षण संस्थान - अध्यक्ष; (2) अवर सचिव (यंत्रीकरण एवं प्रौद्योगिकी प्रभाग), कृशि एवं (3) प्रषासनिक अधिकारी या कार्यालयाध्यक्ष, फार्म मषीनरी प्रषिक्षण एवं परीक्षण संस्थान | लागू नहीं होता। सहकारिता विभाग - सदस्य; - सदस्य सहकारिता विभाग - सदस्य; - सदस्य। | NaN |

except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to Group 'C', technical posts in the Ministry of Agriculture, Department of Agriculture and Cooperation, in the Farm Machinery Training and Testing Institutes, namely:-
1. Short title and commencement.- (1) These rules may be called the Ministry of Agriculture, Department of Agriculture and Cooperation, Farm Machinery Training and Testing Institute, Technical, Group 'C' Posts Recruitment Rules, 2014.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Application. – These rules shall apply to the posts specified in column (1) of the Schedule annexed to these rules.
3. Number of posts, classification, pay band and grade pay or pay scale.– The number of said post, their classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the said Schedule.
4. Method of recruitment, age-limit, qualifications, etc.– The method of recruitment, age-limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to (13) of the aforesaid Schedule.
5. Initial Constitution.– The incumbents holding the posts of Agricultural Assistant, Trainer Operator and Electrician now re-designated as Senior Technician and Motor Driver now re-designated as Technician on regular basis in pursuance of North Eastern Region Farm Machinery Training and Testing Institute, Memorandum No.2-9/2010-Estt., dated the 13th August, 2010, North Eastern Region Farm Machinery Training and Testing Institute Memoranda numbers 2-3/90-PF-1677, dated the 19th March, 2013 and 1-1/2008-Estt., dated the 25th February, 2009 and North Eastern Region Farm Machinery Training and Testing Institute, Memorandum No.2-3/2010-Estt./674/675, dated the 22nd July, 2010, respectively, shall be deemed to have been appointed in accordance with the provisions of these rules and their continuous service in the post immediately before the commencement of these rules shall be taken into account for the purpose of qualifying service for probation and promotion.
10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]6. Disqualification.– No person.-
(a) who has entered into or contracted a marriage with a person having a spouse living, or
(b) who, having a spouse living, has entered into or contracted a marriage with any person,
shall be eligible for appointment to the said posts:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
7. Power to relax.– Where the Central Government is of the opinion that it is necessary or expedient so to do, it may by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.
8. Saving.– Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
