1. (1) इन ननयम(cid:7298) का संन(cid:6979)(cid:7385) नाम भारतीय ीिर्न बीमा ननगम, अ(cid:7007)य(cid:6979) (र्सेा के कनतपय ननबंधन और त(cid:7288)) संोधन ननयम, 2017 है।

(2) ये ननयम 1 र्निरी, 2016 को (cid:7079र्)ृ(cid:7275) (cid:7263)ए समझे ािएंगे।

2. भारतीयर् ीिन बीमा ननगम, अ(cid:7007)य(cid:6979) (र्सेा के कनतपय ननबंधन और त(cid:7288)) ननयम, 1998 म(cid:7286) ननयम 4 और 5 के (cid:7021)ान पर नन(cid:7388)नलनखत ननयम रखे ािएंगे, अा(cid:6981)त :-

"4.र् ेतनमान- 1 र्निरी, 2016 से (cid:7079र्)ृ(cid:7275) ननगम के अ(cid:7007)य(cid:6979) कार् ेतनमानर् ेतन मे(cid:7407)(cid:7069)(cid:6989)स म(cid:7286) (cid:7021)तर 17 [2,25,000 (cid:7271)पए (cid:7079)नतमाह (ननयत)] होगा।

(cid:7407)ट(cid:7009)पण 1 : पुनरीन(cid:6979)त र्ेतनमान म(cid:7286) र्ेतन का ननयतन के (cid:7008)(cid:7076)ीय नसर्नल र्सेा (पुनरीन(cid:6979)त र्ेतन) ननयम, 2016 के आधार पर (cid:7408)कया गया है।

G.S.R. 29(E).—In exercise of the powers conferred by clause (cc) of sub-section (2) of Section 48 of the Life Insurance Corporation Act, 1956 (31 of 1956), the Central Government hereby makes the following rules further to amend the Life Insurance Corporation of India, Chairman (Certain Terms and Conditions of Service) Rules,1998, namely:-

1. (1) These rules may be called the Life Insurance Corporation of India Chairman (Certain Terms and Conditions of Service) Amendment Rules, 2016. (2) They shall be deemed to have come into force on the 1st day of January, 2016.

2. In the Life Insurance Corporation of India Chairman (Certain Terms and Conditions of Service) Rules,1998, for rules 4 and 5, the following rules shall be substituted, namely:—

"4. Scale of pay.- With effect from the 1st day of January, 2016 , the scale of pay of the Chairman of the Corporation shall be Level 17 in the Pay matrix [ Rs.2,25,000 per month (Fixed)].

Note 1: The fixation of pay in the revised scale has been done on the basis of the

Central Civil Services (Revised Pay) Rules, 2016.

Note 2: The arrears on account of revised scale of pay shall be paid during the Financial Year 2016-2017.

Note 3: The decision on the revised rates and the date effect of all allowances (other than Dearness Allowance) based on the recommendations of Seventh Central Pay Commission shall be notified subsequently and separately and until then, all such allowances shall continue to be reckoned and paid at the existing rates under the terms and conditions prevailing in the pre- revised pay structure as if the existing pay structure has not been revised under the Central Civil Services (Revised Pay) Rules, 2016.

5. Dearness Allowance:- (1) Dearness Allowance payable to the Chairman shall be as follows, namely:—

(a) From 1st January, 2016 to 30th June, 2016 – No Dearness Allowance (b) From 1st July, 2016 onwards – As declared by the Central Government from time to time.".

EXPLANATORY MEMORANDUM

The Central Government has decided to extend the benefit of revised scales of pay based on the recommendations of Seventh Central Pay Commission to the Chairman, Life Insurance Corporation of India with effect from 1st January, 2016.

It is certified that no Chairman of Life Insurance Corporation of India is likely to be affected adversely by the notification being given retrospective effect.

Note: The principal rules were published in the Gazette of India, Extraordinary, Part II, Section 3, sub-section (i) vide notification number G.S.R.124(E), dated the 5th March, 1998 and subsequently amended vide notification numbers:-

1. G.S.R.No. 591(E), dated the 14th August, 2001;

2. G.S.R.No. 629(E), dated the 22nd September, 2004; and

3. G.S.R.No. 819(E), dated the 26th November, 2008.

2. भारतीयर् ीिन बीमा ननगम (cid:7079)बंध ननदेक (र्सेा के कनतपय ननबंधन और त(cid:7300) का पुनरी(cid:6979)ण) ननयम, 1988 म(cid:7286) (i) ननयम 4 और 5 के (cid:7021)ान पर नन(cid:7388)नलनखत ननयम रखे ािएंगे, अा(cid:6981)त् : -

"4.र् ेतनमान- (1) 1 र्निरी, 2016 से (cid:7079र्)ृ(cid:7275) (cid:7079)बंध ननदेक कार् ेतनमान,र् ेतन मे(cid:7407)(cid:7069)(cid:6989)स के 16र् (cid:7286) (cid:7021)तर का होगा (2,05,400 (cid:7272). से 2,24,400 (cid:7272).)

(2) (cid:7079)बंध ननदेक कार् ेतन ननयतन 1 र्निरी, 2016 से नन(cid:7388)ानुसार (cid:7408)कया ािएगा:

(cid:7407)ट(cid:7009)पण 1 : पुनरीन(cid:6979)त र्ेतनमान म(cid:7286) र्ेतन का ननयतन के (cid:7008)(cid:7076)ीय नसर्नल र्सेा (पुनरीन(cid:6979)त र्ेतन) ननयम, 2016 के आधार पर (cid:7408)कया गया है।

5. महंगाई भ(cid:7275)ा- (1) ननगम के (cid:7079)बंध ननदेक(cid:7298) को संदेय महंगाई भ(cid:7275)ा नन(cid:7388)ानुसार होगा, अा(cid:6981)त,—

(ग) 1 र्निरी, 2016 से 30 ूिन, 2016 तक – कोई महंगाई भ(cid:7275)ा नह(cid:7277)

(घ) 1 ुिलाई, 2016 से आगे तक – के (cid:7008)(cid:7076)ीय सरकार (cid:7367)ारा समय समय पर घोषणा के अनुसार"

(ii) ननयम 8 ग के प(cid:7391)ात, नन(cid:7388)नलनखत ननयम अंतः(cid:7021)ानपत (cid:7408)कया ाियेगा, अा(cid:6981)त:—

"8 घ पुनरीन(cid:6979)त र्ेतनमान म(cid:7286) अगली र्ेतर्नृन(cid:7373) क(cid:7409) तारीख.– (1) र्ेतर्नृन(cid:7373) क(cid:7409) र्त(cid:6981)मान (cid:7408)दनांक ,1 ुिलाई के (cid:7021)ान पर र्ेतर्नृन(cid:7373) (cid:7079)द(cid:7275) के नलए (cid:7079)(cid:7004)येकर् ष(cid:6981) दो तारीख(cid:7286) ह(cid:7298)गी अा(cid:6981)त 1 र्निरीर् 1 ुिलाई: परंतु एक (cid:7079)बंध ननदेक अपनी ननयुन(cid:7334) तारीख के आधार पर या तोर् ह 1 र्निरी या 1 ुिलाई म(cid:7286) से के र्ल एक हीर् ेतर्नृन(cid:7373) का पा(cid:7074) होगा।

(2) ऐसे (cid:7079)ब(cid:7008)ध ननदेक ोि 2 र्निरी और 1 ुिलाई (दोनो (cid:7408)दन सन(cid:7013)मनलत) के बीच ननयु(cid:7334) (cid:7263)ए ह(cid:7298),र् ेतर्नृन(cid:7373) 1 र्निरी को (cid:7079)दान (cid:7408)कया ाियेगा और ऐसे (cid:7079)ब(cid:7008)ध ननदेक क(cid:7409) बाबत ननिक(cid:7409) ननयुन(cid:7334) 2 ुिलाई और 1 र्निरी (दोनो (cid:7408)दन सन(cid:7013)मनलत) के बीच हो,र् ेतर्नृन(cid:7373) 1 ुिलाई को (cid:7079)दान क(cid:7409) ाियेगी।

उदाहरण (क) ऐसे (cid:7079)ब(cid:7008)ध ननदेक ोि 2 ुिलाई 2016 और 1 र्निरी 2017 के दौरान ननयु(cid:7334) (cid:7408)कये गये हो, को (cid:7079)म र्ेतर्नृन(cid:7373) 1 ुिलाई 2017 को (cid:7079)ोदभूत होगी, त(cid:7004)प(cid:7391)ात यह एकर् ष(cid:6981) के प(cid:7391)ातर् ा(cid:7414)षक आधार पर (cid:7079)ोदभूत होगी।

ँ, ोि 2 र्निरी 2016 और 1 ुिलाई 2016 के बीच ननयु(cid:7334) (cid:7408)कये गये हो, और न(िcid:7008)ह(cid:7298)ने 1 (ख) ऐसे (cid:7079)ब(cid:7008)ध ननदेक के मामले मे ुिलाई 2016 को कोईर् ेतर्नृन(cid:7373) (cid:7079)ा(cid:7385) नह(cid:7277) क(cid:7409) हो, को अगलीर् ेतर्नृन(cid:7373) 1 र्निरी 2017 को (cid:7079)ोदभूत होगी और त(cid:7004)प(cid:7391)ात हर एकर् ष(cid:6981) के प(cid:7391)ातर् ा(cid:7414)षक आधार पर (cid:7079)ोदभूत होगी:

परंतु 1 ुिलाई 2017 कोर् ेतर्नृन(cid:7373) (cid:7079)ा(cid:7385) करने के प(cid:7391)ात अगलीर् ेतर्नृन(cid:7373) 1 ुिलाई 2018 को आहरण होगा।

(b) From 1-7-2016 onwards – As declared by the Central Government from time to time.".

(ii). after rule 8C, the following rule shall be inserted, namely.—

"8D Date of next increment in revised scale of pay.- (1) There shall be two dates for grant of increment namely, 1st January and 1st July of every year, instead of existing date of 1st July:

Provided that a Managing Director shall be entitled to only one increment either on 1st January or 1st July depending on the date of his appointment.

(2) The increment in respect of a Managing Director appointed during the period between the 2nd day of January and 1st day of July (both inclusive) shall be granted on 1st day of January and the increment in respect of a Managing Director appointed during the period between the 2nd day of July and 1st day of January (both inclusive) shall be granted on 1st day of July.

Illustration: (a) In case of a Managing Director appointed during the period between the 2nd day of July, 2016 and the 1st day of January, 2017, the first increment shall accrue on the 1st day of July, 2017 and thereafter it shall accrue after one year on annual basis.

(b) In case of a Managing Director appointed during the period between 2nd day of January, 2016 and 1st day of July, 2016, who did not draw any increment on 1st day of July, 2016, the next increment shall accrue on 1st day of January, 2017and thereafter it shall accrue after one year on annual basis:

Provided that in the case of a Managing Director whose pay in the revised scale of pay has been fixed as on 1st day of January, 2017, the next increment shall accrue on 1st day of July, 2017:

Provided further that the next increment after drawal of increment on 1st day of July, 2017 shall accrue on 1st day of July, 2018.

8E Increments in pay matrix.- The increment shall be as specified in the vertical cells of level 16 in the pay matrix".
