सासासासा.... काकाकाका.... िनिनिनिन.... 209 209 209 209 ((((अअअअ).).).).————धातुत्पादक खान िविनयम, 1961 के िविनयम 22 के प्रावधानों के अनुसार एवं भारत के राजपत्र भाग III – ख(cid:23)ड 1 दिनांक 23 जून 1990 को प्रकाशित भारत सरकार के (cid:29)म एवं रोजगार मंत्रालय के खान सुरक्षा महानिदेशालय की अिधसूचना सं.

बोर्ड/मेटल एक्सेचेंज/90/3513 दिनांक 22 मई 1990 का अति-मण करते /ए, खनन परीक्षा बोर्ड एतद् द्वारा विनिमय प्रमाण-पत्र प्रदान करने और उसके िलए परीक्षा संचालन की प2ति की शत3 विनि4र्दष्ट करता है:

1. विनिमय के लिए विदेशी प्रमाण-पत्रों पर विचार:

(1) िविनयम 22 के उप िविनयम (1) के प्रयोजनार्थ परिशिष्ट–I में दी गई तालिका के स्तम्भ (2) में उल्लिखित प्रत्येक प्रमाण- पत्र (विदेशों में खानों के विनियमन संबंधी विधि के अन्तर्गत प्रदत्त) उसके सामने तािलका (3) में उल्लिखित प्रमाण-पत्र के समरूप (cid:29)ेणी का प्रमाण-पत्र माना जाएगा।

(2) किसी अAयर्थी को पूवDक्त तालिका के स्तम्भ (3) के अन्तर्गत उल्लिखित विनिमय प्रमाण-पत्र प्रदान करने के लिए भारत के धातु-उत्पादक खानों में Eयावहारिक अनुभव प्राप्त करना होगा और परीक्षा में सम्मिलित होना होगा, जैसा कि तालिका के -मश: स्तम्भ (4) एवं (5) के अन्तर्गत उसके सामने उल्लिखित है।

2. विनिमय के लिए कोयला खान विनियम के अंतर्गत प्रमाण-पत्र पर विचार:

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (1) िविनयम 22 के उप-िविनयम (2) के प्रयोजनार्थ परिशिष्ट-II की तालिका के स्तम्भ (2) में उल्लिखित कोयला खान िविनयम, 2017 के अन्तर्गत प्रदत्त प्रत्येक प्रमाण-पत्र उसके सामने तालिका (3) में उल्लिखित प्रमाण-पत्र के समरूप (cid:29)ेणी का प्रमाण-पत्र माना जाएगा।

(2) किसी अAयर्थी को उपरोक्त तालिका के स्तम्भ (3) के अंतर्गत उल्लिखित विनिमय प्रमाण-पत्र प्रदान करने के लिए उसे भारत में धातुत्पादक खानों में Eयवहारिक अनुभव प्राप्त करना होगा और परीक्षा में सम्मिलित होना पड़ेगा जैसा कि तालिका के -मश: स्तम्भ (4) एवं (5) के अन्तर्गत उसके सामने उल्लिखित है।

3. मूल दस्तावेजों के साथ आवेदन पत्र प्रस्तुत किया जाना:

(1) प्रत्येक अनुभव प्रमाण-पत्र में अAयर्थी ने किस हैसियत से काम किया है, काम का प्रकार, अनुभव, प्रारम्भ एवं समाप्त करने की तिथियां तथा प्रत्येक खान में औसत भूमिगत एवं पूण्र् िनयोजन के बारे में भी यथार्थ सूचना होनी चाहिए।

(2) किसी आवेदन-पत्र पर तब तक विचार नही किया जाएगा जब तक इसके साथ अर्हताएं, अनुभव, उM, स्वस्थता एवं सदाचरण संबंधी मूल प्रमाण पत्र संलग्न न हो तथा इस प्रमाण के साथ कि विहित शुल्क का भुगतान किया गया है पुष्टिकृ त न हो।

4. प्रबन्धक विनिमय प्रमाण-पत्र के लिए अAयQर्थयों का Eयावहारिक प्रशिक्षण:

(1) िविनमय 22 के उप िविनयम (1) के परन्तुक के अन्तर्गत प्रबन्धक विनिमय प्रमाण-पत्र प्रदान करने के लिए अAयर्थी द्वारा प्रस्तुत भारत के धातु उत्पादक खानों में Eयावहारिक प्रशिक्षण पाR-म के अनुमोदन के लिए आवेदन-पत्र परिशष्ट-III पर दिए प्रपत्र में प्रस्तुत किया जाएगा।

(2) िविनयम 22 के उप िविनयम (1) के अन्तर्गत प्रबन्धक विनिमय प्रमाण-पत्र प्रदान करने के लिए अAयर्थी का Eयावहारिक अनुभव धातुत्पादक खान की होनी चाहिए जिसका औसत भूमिगत िनयोजन 150 Eयक्तियों से कम न हो अथवा पूरे खान में सब िमलाकर 400 Eयक्तियों से कम न हो इसके साथ भूमिगत खान में प्रशिक्षण की अवधि तीन माह से कम नही होनी चािहए।

(3) िविनयम 22 के उप िविनयम (2) के अन्तर्गत प्रबन्धक विनिमय प्रामण-पत्र प्रदान करने के लिए अAयर्थी का Eयावहारिक अनुभव ऐसी खान में होना चाहिए जिसके भूमिगत संकार्य में औसत नियोजन 60 Eयक्ति प्रति दिन से कम न हो अथवा पूरी खान में सब मिलाकर 100 Eयक्ति से कम न हो ।

बशत3 कि असीमित प्रबंधक प्रमाण-पत्र प्रदान करने के लिए अAयQर्थयों के मामले में एक ऐसी खान से जिसके भूमिगत संकार्य में औसत दैिनक िनयोजन 60 Eयक्ति प्रतिदिन से कम न हो, अनुभव प्राप्त होना चाहिए जिसकी अवधि छ: माह से कम न हो:

इसके अतिरिक्त बशत3 कि धातुत्पादक खान अथवा खानों में खनन प्रचालन सम्बन्धी निरीक्षण, बचाव कार्य, अनुसंधान, योजना या अन्य कायD में लगे होने के समय प्राप्त अनुभव के मामले में:

(i) आकलित की जानेवाली अनुभव कि अवधि पूवDक्त सं-ियाओं में वास्तविक अनुभव की अवधि के समतुल्य मानी जाएगी; और

(ii) असीमित प्रबन्धक विनिमय प्रमाण-पत्र प्रदान करने के लिए अAयQर्थयों के मामले में कु ल निरीक्षणों में कम-से-कम आधी संख्या ऐसी खानों में होनी चाहिए, जहां भूमिगत संकार्य हो।

Eयाख्या:- ख(cid:23)ड (3) के द्वतीय अनुबन्ध के प्रयोजनार्थ अपेक्षित अनुभव की गणना प्रतिमाह धातुत्पादक खानों में दस निरीक्षण की औसत दर से की जाएगी। यदि किसी एक दिन में एक से अधिक दौरे विभिन्न खानों में किए जाते है तो वे दो दौरे माने जाएँगे।

5. प्रबन्धक विनिमय प्रमाण-पत्र के लिए अAयQर्थयों की परीक्षा

1. प्रत्येक अAयर्थी को समतुल्य (cid:29)ेणी के प्रबन्धक प्रमाण-पत्र के बदले में प्रबन्धक विनिमय प्रमाण-पत्र प्रदान करने के लिए जैसा कि ख(cid:23)ड 1 एवं 2 में उल्लिखित है, एक लिखित पत्र एवं एक मौखिक परीक्षा में सम्मिलित होना अपेक्षित है, जिसमें निम्निलिखत दो विषय होंगे:-

(I) विनिंग एवं व\क] ग

(II) खनन िवधान

परीक्षा के लिए पाR-म

असीमित प्रथम (cid:29)ेणी प्रबन्धक के विनिमय प्रमाण-पत्र जैसा कि परिशिष्ट-IV में वQर्णत है, असीमित द्वतीय (cid:29)ेणी प्रबन्धक विनिमय प्रमाण-पत्र विनिमय प्रमाण-पत्र के लिए जैसा कि परिशिष्ट-V में वQर्णत है, विवृत्त संकार्य की खानों के लिए सीमित प्रथम (cid:29)ेणी प्रबन्धक के विनिमय विवृत्त प्रमाण-पत्र के लिए जैसा कि परिशिष्ट-VI में वQर्णत है तथा उनमें विवृत्त संकार्य की खानों के लिए सीमित द्वितीय (cid:29)ेणी प्रबन्धक विनिमय प्रमाण-पत्र के लिए जैसा कि परिशिष्ट-VII में वQर्णत है, होगा:

बशत3 कि अAयर्थी धातुत्पादक खान िविनयम, 1961 के िविनयम 16 के अन्तर्गत अनुमोदित खनन अभियंत्रण में डि^ी अथवा उसके समतुल्य योग्यता रखता हो, उसे के वल खनन विधान के लिखित पत्र एवं मौखिक जांच में सम्मिलित होना अपेक्षित है:

(2) परीक्षाओं के लिए नियुक्त परीक्षकों में कम से कम एक परीक्षक खान निरीक्षक होगा।

(3) परीक्षा में प्रत्येक िवषय के िलए अिधकतम कु ल अंक 150 होंगे जिसमें लिखित प्रश्न पत्र के लिए अधिकतम 100 अंक और मैखिक परीक्षा के लिए 50 अंक होंगे। परीक्षा में उत्तीर्ण होने के लिए अAयर्थी को प्रत्येक विषय की लिखित परीक्षा में कम से कम 40 अंक तथा मौखिक जांच में कम से कम 20 अंक प्राप्त करना आवश्यक होगा और प्रत्येक विषय की लिखित परीक्षा एवं मौखिक परीक्षा को साथ मिलाकर कु ल योग 60 प्रतिशत से कम नही होना चाहिए।

6. असीमित सव3क्षक विनिमय प्रमाण-पत्र के लिए आवेदकों का Eयावहारिक प्रशिक्षण:

सव3क्षक के प्रमाण-पत्र के बदले में असीमित सव3क्षक विनिमय प्रमाण-पत्र प्रदान करने के लिए प्रत्येक अAयर्थी जैसा कि 1 एवं 2 में उल्लिखित है, कम से कम तीन माह तक भूमिगत संकार्य में सव3क्षण का Eयावहारिक अनुभव वैसी धातुत्पादक खान में जिसके भूमिगत संकार्य में औसत नियोजन 60 Eयक्तियों से कम न हो अपेक्षित होगा।

7. असीमित सव3क्षक विनिमय प्रमाण-पत्र के लिए अAयQर्थयों की परीक्षा:

(1) उपयु र्क्त ख(cid:23)ड 6 में संदQर्भत प्रत्येक अAयर्थी को परिशिष्ट-VIII में वQर्णत पाR-म पर एक लिखित पत्र एवं एक मौिखक जांच वाली परीक्षा में सम्मिलित होना अपेक्षित होगा:

(2) परीक्षा के लिए नियुक्त परीक्षकों में कम से कम एक परीक्षक खान निरीक्षक होगा ।

(3) पूवDक्त परीक्षा में एक लिखित पत्र एवं एक मौखिक जांच परीक्षा होगी जिनमें प्रत्येक में कु ल अधिकतम अंक 100 होंगे। परीक्षा में उत्तीर्ण होने के लिए अAयर्थी को प्रत्येक लिखित पत्र एवं मौखिक जांच में कम से कम 50 अंक प्राप्त करना आवश्यक होगा और लिखित परीक्षा एवं मौखिक जांच दोनो मिलाकर कु ल कम से कम 120 अंक प्राप्त करने होंगे ।

8. फोरमैन और मेट विनिमय प्रमाण-पत्र के लिए अAयQर्थयों का Eयावहारिक प्रशिक्षण:

(क) ख(cid:23)ड 1 और 2 के अन्तर्गत उल्लिखित समतुल्य प्रमाण-पत्र के बदले में फोरमैन अथवा मेट विनिमय प्रमाण-पत्र प्रदान करने के लिए प्रत्येक अAयर्थी को परिशिष्ट 1 और 2 में वQर्णत अवधि के लिए भारत के धातुत्पादक खानों में Eयावहारिक प्रशिक्षण अपेक्षित होगा।

बशत3 कि असीमित फोरमैन अथवा मेट विनिमय प्रमाण-पत्र प्रदान करने के लिए अAयQर्थयों के मामले में उन्हें भूमिगत संकार्य वाली किसी खान में कम से कम तीन माह की अवधि का अनुभव प्राप्त होना होगा।

(ख) के वल वैसा अनुभव जो वैसे धातुत्पादक खान जिसमें कु ल मिलाकर औसत नियोजन 100 Eयक्तियों से कम न हो अथवा खान के भूमिगत संकार्य में 40 Eयक्तियों से कम न हो जैसा मामला हो, उपयु र्क्त ख(cid:23)ड 8 (क) के प्रयोजनार्थ अनुमोदित किया जाएगा ।

9. फोरमैन और मेट के विनिमय प्रमाण-पत्र के लिए अAयQर्थयों की परीक्षा:-

(1) फोरमैन विनिमय प्रमाण-पत्र प्रदान करने के लिए प्रत्येक अAयर्थी को परिशिष्ट IX (क) में उल्लिखित पाR-म के अनुसार असीमित प्रमाण-पत्र प्राप्त करने और विवृत्त संकायD वाली खानों के लिए सीमित प्रमाण-पत्र प्राप्त करने के लिए परिशिष्ट-IX (ख) में वQर्णत पाR-म के अनुसार मौखिक परीक्षा में सम्मिलित होना अपेक्षित होगा।

(2) मेट विनिमय प्रमाण-पत्र प्रदान करने के लिए प्रत्येक अAयर्थी को परिशिष्ट-X में उल्लिखित पाR-म के अनुसार असीमित प्रमाण-पत्र प्राप्त करने और के वल विवृत्त संकायD वाली खानों के लिए सीमित प्रमाण-पत्र प्राप्त करने के िलए परिशिष्ट-XI में वQर्णत पाR-म के अनुसार मौखिक परीक्षा में सम्मिलित होना अपेक्षित होगा ।

(3) परीक्षा के लिए नियुक्त परीक्षकों में कम से कम एक परीक्षक खान निरीक्षक होगा ।

(4) परीक्षा कु ल अधिकतम 100 अंको की होगी और परीक्षा उत्तीर्ण होने के लिए अAयर्थी को कम से कम 60 अंक प्राप्त करना आवश्यक होगा ।

10. परीक्षार्थी की पहचान तथा आचरण

(1) विनिमय प्रमाण-पत्र के प्रत्येक परीक्षार्थी को परीक्षा के समय परीक्षा में सम्मिलित होने के लिए जारी किया गया प्राधिकार पत्र प्रस्तुत करना होगा ।

(2) (क) प्रबंधक, सव3क्षक तथा फोरमैन विनिमय प्रमाण-पत्र के लिए प्रत्येक परीक्षार्थी को एक रजिस्टर में हस्ताक्षर करना होगा जिसमें उनका अनु-मांक दर्ज किया गया है।

(ख) फोरमैन तथा मेट प्रमाण-पत्र के लिए परीक्षार्थी परीक्षा के समय दो पासपोर्ट आकार का फोटो (5 से. मी. X 6.5 से. मी. आकार का) परीक्षा सचिव को जमा करेगा, जो अपनी संतुष्टि के पश्चात कि फोटो परीक्षार्थी का है, उसके पीछे परीक्षार्थी का नाम पृष्ठांकित कर देंगे ।

(ग) मेट विनिमय प्रमाण-पत्र प्रदान करने के लिए परीक्षा सचिव, किसी भी परीक्षार्थी के बाँए हाथ के अंगूठे का निशान ले सकते है।

(3) प्रत्येक अAयर्थी परीक्षा सचिव द्वारा अपेक्षित आचरण का पालन करेगा। परिशिष्ट-XII में निर्धारित नियम लिखित परीक्षा के संचालन में लागू होंगे।

(4) (क) कोई भी परीक्षार्थी जो जाली प्रमाण-पत्र प्रस्तुत करता है, या झूठी घोषणा करता है, या परीक्षा में किसी प्रकार के अनुचित साधन का Eयवहार करता है तो बोर्ड उसे अयोग्य घोषित कर सकता है और मामले की वास्तविकता के अनुसार तीन वर्ष की अनधिक अवधि के लिए किसी भी अनुवर्ती परीक्षा में सम्मिलिति होने से वंचित कर सकता है।

(ख) यदि किसी अAयर्थी को किसी भी परीक्षा में सफल घोषित किया जा चुका हो या उसे प्रमाण-पत्र मिल चुका हो पर बाद में यह पता चलता है कि जाली प्रमाण-पत्र जमा किया है या झूठी घोषणा की है तो वैसी स्थिति में बोर्ड उसका परीक्षाफल रद्द कर सकता है या उसका प्रमाण पत्र वापस ले सकता है।

11. पुनर्परीक्षा

कोई भी अAयर्थी जो परीक्षा में उत्तीर्ण होने में असफल /आ है, वह असफल /ई परीक्षा की तिथि से तीन मास की अवधि से पहले पुन: परीक्षा में सम्मिलित नही हो सके गा।

12. इस अधिसूचना में किसी बात के होते /ए भी :--

(1) बोर्ड किसी भी योग्य Eयक्ति को विनिमय प्रमाण-पत्र दे सकता है।

(2) इस अधिसूचना के लागू होने के पहले बोर्ड द्वारा किया गया कोई भी कार्य या कार्रवाई वैध और प्रभावी रहेगी।

1. किसी भी अAयर्थी को सचिव द्वारा प्रेषित प्राधिकार पत्र नहs लाने पर परीक्षा भवन में प्रवेश नहs करने दिया जाएगा। 30 मिनट देर से आने वाले किसी भी अAयर्थी को परीक्षा में सम्मिलित होने की अनुमति नहs दी जायगी और न देर से प/चने के लिए अतिरिक्त प्रतिपूरक समय दिया जायेगा।

2. परीक्षा भवन में प्रवेश करने से पहले सभी अAयQर्थयों को पुस्तक, नोट, कागज इत्यादि बाहर रख देना होगा।

3. प्रत्येक अAयर्थी को बही में हस्ताक्षर करना होगा जहां उनका -मांक दर्ज किया /आ है।

4. परीक्षाQर्थयों को कागज दिया जाएगा और उस कागज को छोड़कर अन्य कागज का Eयवहार नहs किया जाएगा।

5. उत्तर पुस्तिका में नाम नहs लिखा जाएगा। प्रत्येक अAयर्थी उत्तर पुस्तिका में संलग्न पर्ची पर ही अपना -मांक लिखेगा। इसे और कहs नहs लिखा जाएगा। अपनी उत्तर पुस्तिका में -मांक या नाम के आद्यक्षर लिखने वाले Eयक्ति का अयोग्य समझा जाएगा।

6. चाहने पर अAयर्थी को स्याही उपलब्ध करायी जायगी, अAयर्थी कोणमापक के साथ अपनी कलम और पेन्सिल, रेखण पेन्सिल, रेखण औजार साथ लेते आयेंगे।

7. परीक्षक द्वारा आवश्यक समझे जाने पर अAयर्थी को लघुगणकीय तालिका उपलब्ध कराया जायगा। अAयर्थी अपना स्लाईड रेखक और गणक Eयवहार कर सकते हैं।

9. उत्तर स्पष्ट करने के लिए रेखाचित्र बनाया जा सकता है और जब इसके लिए रेखाचित्र बनाने को कहा जाता है तो बिना कहे समझना चाहिए कि परिमाप के साथ रेखाचित्र जरूरी है और अAयर्थी को रेखाचित्र बनाने में विशेष समय नहs दिया जाएगा।

10. कोई अAयर्थी परीक्षक से परामर्श करना चाहता हों या कागज साम^ी की आवश्यकता हो तो ध्यान आकQर्षत करने के िलए अपने सीट से खड़ा हो जाए, बुलाए नहs।

11. कोई अAयर्थी किसी अन्य अAयर्थी से बातचीत करता हो, पुस्तक या नोट देखता हो, बोर्ड द्वारा दी गयी या कोई उत्त्र पुस्तिका के अलावे अन्य पुस्तिका का Eयवहार करता हो, या किसी अनुचित साधन का Eयवहार करता हो या परीक्षक द्वारा अनुचित कार्य करते /ए पाये जाने पर परीक्षा के लिए अयोग्य माना जाएगा।

12. कोई भी अAयर्थी परीक्षा प्रारम्भ होने के एक घंटा समाप्त होने से पहले परीक्षा भवन से बाहर नहs जाएगा।

13. जब अAयर्थी प्रश्न का उत्तर पूर्ण कर लेता है, या प्रश्नोत्तर के लिए निर्धारित समय समाप्त हो जाता है या िनयम II के अन्तर्गत जब अAयर्थी को अयोग्य घोषित कर दिया जाता है, तो वह सचिव को अवश्य ही उत्त्र पुस्तिका सुपुर्द कर देगा और परीक्षा भवन तुरन्त छोड़ देगा।

NOTIFICATION

Dhanbad, the 20th February, 2018

G.S.R. 209 (E).—In accordance with the provisions of Regulation 22 of the Metalliferous Mines Regulations, 1961 and in supersession of the notification no. Board/Metal Exchange/90/3513, dated 22nd May, 1990 published in the Gazette of India, Part-III, Section 1 dated 23rd June 1990, the Board of Mining Examinations hereby stipulate the conditions for the grant of exchange certificate and the manner of conduct of examination there-for:

1. Foreign certificates considered for exchange:

(1) For the purpose of Sub-regulation (1) of Regulation 22, each of the certificates (granted under laws for the regulation of mines in foreign countries) mentioned under column (2) of the table in Appendix-I shall be considered to be a certificate of a class similar to the certificate mentioned against it under column (3) of the table.

(2) A candidate for the grant of an exchange certificate mentioned under column (3) of the table aforesaid shall be required to obtain practical experience in metalliferous mines in India and appear at an examination, as specified against it under column (4) and (5) respectively of the table.

2. Certificate under Coal Mines Regulations considered for exchange:

(1) For the purpose of Sub-regulation (2) of Regulation 22, each of the certificates (granted under the Coal Mines Regulations, 2017) mentioned under column (2) of the table in Appendix-II shall be considered to be a certificate of a class similar to the certificate mentioned against it under column(3) of the table

(2) A candidate for the grant of an exchange certificate mentioned under column (3) of the table aforesaid shall be required to obtain practical experience in metalliferous mines in India and appear at an examination, asभारत का राजपत्रा : असाधरण [भाग II—खण्ड 3(i)] 15 specified against it under columns (4) & (5) respectively of the table.

3. Applications to be supported by original documents etc.:

(1) Every certificate of experience should contain precise information about the capacity in which the candidate worked, the nature of work done, the dates of commencement and termination of experience as also the average employment, both underground and total, at each mine.

(2) No application shall be considered unless it is supported by original certificates as to qualifications held, experience, age, health and general good conduct, and is accompanied by evidence that the prescribed fee has been paid.

4. Practical Training of applicants for Manager's Exchange Certificate:

(1) The application, for approval of the course of practical training in metalliferous mines in India, submitted by an applicant for the grant of a Manager's Exchange Certificate under the proviso to sub-regulation (1) of Regulation 22 shall be submitted in the form at Appendix-III.

(2) The practical experience of a candidate for the grant of a Manager's Exchange Certificate under Sub-Regulation (1) of Regulation 22 should be in a metal mine having an average employment of not less than 150 persons in workings belowground or 400 persons in all in the mine, and should include training in underground mines for a period of not less than three months.

(3) For the grant of a Manager's Exchange Certificate under sub-regulation (2) of regulation 22 the practical experience of a candidate shall be in a mine having an average daily employment of not less than 60 persons in workings belowground or 100 persons in all in the mine:

Provided that in the case of candidates for the grant of Unrestricted Manager's Exchange Certificate a period of not less than six months experience should have been obtained in workings belowground of a mine having an average daily employment not less than 60 persons:

Provided further that in the case of experience gained while engaged in inspection, rescue, research, planning or in other work connected with mining operations in any metalliferous mine or mines:

(i) the period to be credited to experience shall be considered equal to the period of actual experience in the operations aforesaid; and

(ii) in the case of candidates for the grant of Unrestricted Manager's Exchange Certificate at least half the number of visits shall be to mines having workings belowground.

Explanation: - For the purpose of second proviso to clause (3) the required experience shall be calculated at an average rate of ten visits to metalliferous mines per month. If, on any one day more than one visit is made to different mines it shall be counted as two visits.

5. Examination of candidates for the Manager's Exchange Certificate:

(1) Every candidate for the grant of a Manager's Exchange Certificate in lieu of a Manager's Certificate of a similar class as mentioned in clauses 1 and 2 above shall be required to appear in an examination consisting of a written paper and an oral test in each of the following two subjects:

(i) Winning and Working.

(ii) Mining Legislation.

The syllabus for the examination for the unrestricted First Class Manager's Exchange Certificate shall be as laid down in Appendix-IV, for the unrestricted Second Class Manager's Exchange Certificate as laid down in Appendix-V, for the First Class Manager's Exchange Certificate Restricted to mines having opencast workings as laid down in Appendix-VI and for the Second Class Manager's Exchange Certificate Restricted to mines having opencast workings as laid down in Appendix-VII.

Provided that a candidate holding a degree in mining engineering or its equivalent qualification approved under Regulation 16 of the Metalliferous Mines Regulations, 1961 shall be required to appear in written paper and oral test only in Mining Legislation.

(2) At least one of the examiners appointed for the examinations shall be an Inspector of Mines.

(3) The examination shall carry a total maximum of 150 marks for each subject with a maximum of 100 marks for the written paper, and 50 marks for the oral test. In order to pass the examination, a candidate must16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] obtain not less than 40 marks in the written and 20 marks in the oral test in each subject and an aggregate of not less than 60% marks in the written examinations and oral tests in all the subjects taken together.

6. Practical Training of applications for Unrestricted Surveyor's Exchange Certificate:

Every candidate for the grant of an Unrestricted Surveyor's Exchange Certificate in lieu of a Surveyor's certificates as mentioned in 1 and 2 shall be required to have practical experience for a period of not less than three months of surveying in the working belowground of a Metalliferous mine having an average employment of not less than 60 persons in its working belowground.

7. Examination of candidates for Unrestricted Surveyor's Exchange Certificates:

(1) Every candidate referred to in clause 6 above shall be required to appear in an examination consisting of a written paper and an oral test, on the syllabus laid down in Appendix- VIII:

(2) At least one of the Examiners appointed for the above examination shall be an Inspector of Mines.

(3) The aforesaid examination shall consist of a written paper and an oral test each carrying total maximum of 100 marks. In order to pass the examination, a candidate must obtain a minimum of 50 marks each in the written paper, and oral test and an aggregate of not less than 120 marks in both written examination and oral test taken together.

8. Practical Training of applicants for Foreman's and Mate's Exchange Certificates:

(a) Every candidate for the grant of a Foreman's or Mate's Exchange Certificate in lieu of a similar certificate as mentioned under clauses 1 and 2 shall be required to have practical training in metalliferous mines in India for periods laid down in appendices I and II:

Provided that in the case of candidates for the grant of an Unrestricted Foreman's or Mate's Exchange Certificate a period of not less than three months experience should have been obtained in the workings belowground of a mine.

(b) Only such experience as is obtained in a metalliferous mine having an average employment of not less than 100 in all in the mine or not less than 40 in the workings belowground of the mine as the case may be shall be approved for the purpose of clause 8(a) above.

9. Examination of candidates for Foreman's and Mate's Exchange Certificates:

(1) Every candidate for the grant of a Foreman's Exchange Certificate shall be required to appear in an oral examination on the syllabus laid down in Appendix-IX(A) for unrestricted certificates and on the syllabus laid down in Appendix IX(B) for certificates restricted to mines having opencast workings only.

(2) Every candidate for the grant of a Mate's Exchange Certificate shall be required to appear in an oral examination on the syllabus laid down in Appendix-X for unrestricted certificates and on the syllabus laid down in Appendix-XI for certificates restricted to mines having opencast workings only.

(3) At least one of the examiners appointed for the examinations shall be an Inspector of Mines.

(4) The examination shall carry a total maximum of 100 marks and in order to pass the examination a candidate must obtain not less than 60 marks.

10. Identity and conduct of the candidate:

(1) Every candidate for an Exchange Certificate shall be required to produce at the time of examination the authorisation issued to him for appearing in the examination.

(2) (a) Every candidate for a Manager's, Surveyor's or Foreman's Exchange Certificate shall be required to sign in a register in which his roll number has been recorded.

(b) Every candidate for a Foreman's or Mate's Certificate shall, at the time of the examination, hand over two unmounted photographs of himself (of a size approximately 5 c.m. x 6.5 c.m.) to the Secretary for the examination who after satisfying himself that each photograph is a likeness of the candidate, shall endorse each to them on the back with the name of the candidate.

(c) The Secretary of examination may take the left hand thumb impression of any candidate for the grant of Mate's Exchange Certificate.

(3) Every candidate shall conduct himself as required by the Secretary of the examination. The Rules laid down in Appendix-XII shall apply to the conduct of the written examination.

(4) (a) Any candidate who submits a false certificate or counterfeits a certificate or makes a false declaration or adopts unfair means during the examination, may be disqualified by the Board and also debarred from appearing at any subsequent examination for a specified period not exceeding three years depending upon the facts of the case.

(b) If a candidate, who has been declared successful in any examination for the grant of a certificate or who has been granted a certificate, is found to have submitted a false certificate or to have made a false declaration, the Board may cancel his result or withdraw the certificate issued to him, as the case may be.

11. Re-examination:

A candidate who fails to pass an examination shall not be eligible for re-examination for a period of three months from the date of the examination in which he failed.

12. Notwithstanding anything contained in this notification:

(i) the Board may also grant Exchange Certificate to any person otherwise found suitable:

(ii) anything done or any action taken by the Board prior to this notification shall remain valid and effective.

APPENDIX-X SYLABUS FOR THE EXAMINATION FOR THE UNRESTRICTED MATE'S EXCHANGE CERTIFICATE OF COMPETENCY.

(i) Benching and slopping of opencast workings, examination and Dressing of sides.

(ii) Method of examining hangwall, footwall, roof and sides of working places and roadways etc.

(iii) Methods of timbering, packwalling and setting support, withdrawal of supports, fencing of dangerous places.

(iv) Shotfiring, and transport use of explosives in mines.

(v) Provisions of the Metalliferous Mines Regulations and Rules made under the Mines Act, 1952,

relating to the Safety of persons employed in mines in general, and to the duties of Mates and Blasters in particular.

APPENDIX-XI

SYLLABUS FOR THE MATE'S EXCHANGE CERTIFICATE OF COMPETENCY RESTRICTED TO MINES HAVING OPENCAST WORKINGS ONLY.

(i) Benching and slopping of opencast workings, examinations and dressing of sides, fencing of opencast workings and other dangerous places.

(ii) Shotfiring, and transport use of explosives in opencast mines.

(iii) Provisions of the Metalliferous Mines Regulations and Rules made under the Mines Act, 1952, relating the Safety of persons employed in opencast mines in general, and to the duties of Mates and Blasters in particular.

APPENDIX-XII

RULES GOVERNING THE CONDUCT OF THE WRITTEN EXAMINATION

(i) No candidate shall be admitted into the examination hall until he has produced an authorization issued by the Secretary. No candidate arriving more than 30 minutes late shall be permitted to attend the examination; and no candidate arriving late shall be eligible for any extra compensatory time.

(ii) Before entering the examination hall, every candidate shall leave all books, notes and papers etc., out-side.

(iii) Every candidate shall be required to sign in a register in which his roll number would be recorded.

(iv) Paper will be supplied, and no paper other than that so supplied shall be used.

(v) Names shall not be written on the answer book. Every candidate shall write his roll number on the slip attached to the answer book and nowhere else. Any person who writes his roll number or name or initials etc., on his answer book is liable to be disqualified.

(vi) Ink will be provided. Candidate shall bring their own pens and pencils, drawing pens and drawing instruments, including protractor where required.

(vii) Slide Rules may be used. Candidates will be supplied with logarithmic tables if considered necessary by the examiner.

(viii) The calculations and other work by which a result is obtained shall be clearly shown on the left-hand side page, in immediate connection with the answer to the question under reference.

(ix) Sketches may be made to illustrate answers. When sketches are asked for, it would be understood that, unless otherwise stated, freehand sketches with dimensions are all that is necessary; and candidates need not spend time in making finished drawings.

(x) Any candidate desiring to consult the examiner or requiring any paper or other material should stand in his seat to draw attention, but should not shout or call out.

(xi) Any candidate speaking to any other candidate, or consulting any book or notes, or using paper other than that supplied by the Board, or using any other unfair means or acting in a manner considered improper by the examiner, shall be liable to be disqualified.

(xii) No candidate shall leave the examination hall before the expiry of one hour after the commencement of the examination.

(xiii) When a candidate has completed the answers to the questions or when the time allowed for answering the question has elapsed, or when a candidate has been disqualified under Rule 11 he must hand over the answer book to the Secretary of the examination and at once leave the examination hall.
