| चे की न् यूनतम ऊँ चाई (अिभप्रेरित/उ4 च $ा%ट भों के लिए) - भे की क्षमता 30,000 हजार .ट प्रतिदिन से कम - भे की क्षमता 30,000 हजार .ट प्रतिदिन के बराबर या उससे अधिक ि टिप् पिणयां: टप् प टिप् प टिप् प िणयां: सभी नये .ट भों को .ट निर्माण की के वल जिगजैग या लंबवत विधि की 1. अनुमति दी जाएगी और उन् हें इस अधिसूचना में निर्धारित नये मानकों का पालन करना होगा। विद्यमान .ट भे, जो .ट निर्माण की जिगजैग या लंबवत विधि का पालन नह> 2. कर रहे हैं, उन् हें जिगजैग या लंबवत विधि अपनाने के लिए अनुपालन सुनि@ित न करने वाले शहरों के निकट अवस्थित भों के मामले मे एक वर्ष की अवधि के भीतर और अन्य दोनों भों के मामले मे दो वर्ष के भीतर परिवEर्तत करना होगा। इसके अतीरिक्त ऐसे मामलों मे, जहां सी पी सी बी / एस पी सी बी / पी सी सी द्वारा परिवर्तन किए जाने के लिए समय सीमा अलग से निर्धारित की गयी है, ऐसे आदेश अभिभावी होंगे। 3. नये .ट भों को नये मानकों का पालन करने और धूल कण (पीएम) के मापदंडों का अनुपालन करने के लिए एक वर्ष के भीतर चे की ऊँ चाइयों को उपयुक् त बनाना होगा। सभी .ट भे के वल अनुमोदित इMधन जैसे कोयला, जलावन लकड़ी और/या कृ िष 4. अवशिष् टों का प्रयोग करेगें। .ट भों में पेटकोक का उपयोग करने की अनुमति नह> दी जाएगी। 5. विद्यमान .ट भों को अ4 छे इMधन से युक् त करने / प्रचालन के तरीकों को अपनाकर धूलकणों के लिए नये मानकों का पालन करने के लिए एक वर्ष की मध् यवर्ती अवधि की अनुमति दी जाएगी। 6. .ट भे उज् सर्जनों की निगरानी के लिए सीपीसीबी द्वारा निर्धारित मानदंडों/डिजाइन के अनुरूप स् थायी सुविधा (पोर्टहोल और प् लेटफोर्म) का निर्माण करेंगे। 7. उत् सर्जन के नमूनें .धन चाVजMग और नॉन-चाVजMग दोनों ही दशाओं का प्रतिनिधित् व करेंगे। 8. धूल कण (पीएम) के परिणामों को 4% CO पर निम् न प्रकार से सामान् यकृ त किया जाएगा; 9. पीएम (सामान् यीकृ त) = PM (मापा गया) x 4% / मापी गयी CO,% में चे की ऊ ँ चाई (मीटरों में) का आकलन सूत्र H=14Q" के द्वारा भी किया जाएगा। | 2 4 मी. 27 मी. | ||
| (जहां Q, किा/घंटे में SO2 की उत् सर्जन दर है) और इन दोनों में जो अधिकतम है वह लागू होगा। 10. यदि .ट भा न् यूनतम 50 मिमी. वाटर गॉज $ा%ट के साथ प्रचालित होने वाले प ंखे से युक् त है, तो उसे अभिप्रेरित/उ4 च $ा%ट भा माना जाएगा। 11. .ट भों को बसावट और फल उद्यानों से न् यूनतम 0.8 किमी. की दूरी पर स् थापित किया जाएगा। राज् य बोर्ड बसावट/जनसंख् या, घनत् व, जल निकायों, स ंवेदनशील संाहकों इत् यादि से निकटता को ध् यान में रखते `ए स् थान संबंधी मानदंडों को कड़ा बना सकते हैं। 12. किसी क्षेत्र में भों का समूहन न होने देने के लिए .ट भों को विद्यमान नियत चिमनी भे से न् यूनतम एक किलोमीटर की दूरी पर स् थापित किया जाना चािहए। 13. .ट भे संबंधित एसपीसीबी/पीसीसी द्वारा निर्धारित प्रdिया उत् सर्जन नियंत्रण दिशानिदेशों का पालन करेंगे। 14. .ट भों में उत् पन् न राख का उपयोग पूरी तरह भों में .ट बनाने के लिए किया जाएगा। 15. .ट भे में .ट निर्माण के लिए उपयोग में लाई जाने वाली ऊपरी मृदा के निष् कर्षण के लिए, संबe राज् य/संघ राज् यक्षेत्र के खनन विभाग सहित, संबe प्राधिकरणों से सभी आवश् यक स् वीकृ ितयां प्राप् त की जाएग>। 16. .ट भों के स् वामी यह सुनि@ित करेंगे कि क4 ची सामयिों/.टों के परिवहन के लिए उपयोग में लाई जाने वाली सड़क पक् की हो और धूल रिहत हो। 17. क4 ची सामी/.टों के परिवहन के दौरान ट्रकों को ढककर रखा जाएगा। 18. विद्यमान भे, यदि इन नये मानकों का अनुपालन करने के लिए अपेक्षित हो, तो एक वर्ष के भीतर चे की ऊँ चाई को बढ़ायेंगे। " |

NOTIFICATION
New Delhi, the 15th March, 2018
G.S.R.233.(E).—The following draft rules, which the Central Government proposes to issue in exercise of the powers conferred by sections 6 and 25 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986 is hereby published, for the information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules will be taken into consideration by the Central Government on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to the public.
Any person interested in making any objections or suggestions on the proposals contained in the draft notification may forward the same in writing, for consideration of the Central Government within the period specified above to the Secretary, Ministry of Environment, Forest and Climate Change, Indira Paryavaran Bhawan, Jor Bagh, Road, New Delhi-110003, or send it to Member Secretary, CPCB and Scientist 'D' Ministry at the e-mail address i.e. [email protected] and [email protected].

1. (1) These rules may be called the Environment (Protection) Amendment Rules, 2018.
(2) They shall come intoforce on the date of their final publication in the Official Gazette.
2. In the Environment (Protection) Rules, 1986, in Schedule-I, for entry 74 the following entry shall be
substituted, namely:-

| Notes: 1 . All new brick kilns shall be allowed only with zig-zag or vertical method of brick making and shall comply to the new standards as stipulated in this notification. 2. The existing brick kilns which are not following zig zag or vertical method of brick making shall be converted so as to adopt zig zag or vertical method within a period of one year in case of kilns located near non-attainment cities and two year for other both kilns. Further, in cases where CPCB/SPCB/PPC has separately laid down timelines for conversion, such orders shall prevail. 3. The new brick kilns shall have appropriate stack heights to meet the new standards and comply with the norms for Particulate Matter (PM) within one year. 4. All brick kilns shall use only approved fuel such as coal, fire wood and/or agricultural residues. Use of pet coke shall not be allowed in brick kilns. 5. In the intervening period of one year allowed to the existing brick kilns to complywith these new standards for Particulate Matter by adopting good fuel charging/operation practices. 6. Brick kilns shall construct permanent facility (port hole and platform) as per the norms/design laid down by the CPCB for monitoring of Emissions. 7. Emission sample shall represent both fuel charging and non-charging conditions. 8. Particulate Matter (PM) results shall be normalized at 4% CO, as below: 9. PM (normalized) = PM (measured) x 4% / measured CO, in% Stack height (in metre) shall also be calculated by formula H=l4Q'' (where Q is SO2 emission rate in kg/hr), and the maximum of two shall apply. 10. A brick kilns will be considered an Induced/High draft kiln if it has a fan operating with minimum 50mm water gauge draught. 11. Brick kilns should be established at a minimum distance of 0.8 km from habitation and fruit orchards. State Boards may make siting criteria stringent considering proximity to habitation, population density, water bodies, sensitive receptors, etc. 12. Brick kilns should be established at a minimum distance of 1 km from an existing fixed chimney kiln to avoid clustering of kilns in an area. 13. Brick kilns shall follow process emission control guidelines as prescribed by concerned SPCBs/PCCs. 14. The ash generated in the brick kilns shall be fully utilized in-house in brick making. 15. All necessary approvals from the concerned authorities including mining department of the concerned State/UT shall be obtained for extracting the top soil to be used for brick making in the brick kiln. The brick kiln owners shall ensure that the road utilized for transporting raw materials/bricks shall be metaled roads 16. and is dust free. 17. Trucks shall be covered during transportation of raw material/bricks. 18. The existing kilns shall increase stack height, if required, to meet these new standards within 1 year". |
