सा.का.नि. 14(अ).—संविधान के अनुच्छेद 309 के प्रावधान द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, और इस मंत्रालय के डिस्पैच राइडर समूह 'ग' पद भर्ती नियम, 2012 के अधिक्रमण में, ऐसे मामलों को छोड़कर जो ऐसे अधिक्रमण से पहले किए गए या किए जाने के लिए छोड़े गए थे, राष्ट्रपति महिला एवं बाल विकास मंत्रालय में डिस्पैच राइडर के पदों पर भर्ती की पद्धति को विनियमित करते हुए निम्नलिखित नियम बनाते हैं, अर्थात्:-
1. संक्षिप्त नाम और प्रारंभ- (1) इन नियमों का संक्षिप्त नाम महिला एवं बाल विकास मंत्रालय, डिस्पैच राइडर समूह 'ग' पद भर्ती नियमावली, 2022 है।
(2) वे सरकारी राजपत्र में उनके प्रकाशन की तारीख से लागू होंगे।
2. पदों की संख्या, वर्गीकरण और वेतन स्तर- उक्त पदों की संख्या, उनका वर्गीकरण, वेतन स्तर संलग्न अनुसूची के कॉलम (2) से (4) में निदिष्ट अनुसार होगा।
3. भर्ती की पद्धति, आयु सीमा, योग्यता आदि- उक्त पदों पर भर्ती की पद्धति, आयु सीमा, अर्हताएं तथा अन्य मामले उक्त अनुसूची के कालम (5) से (14) में विनिदिष्ट अनुसार होंगे।
4. निरर्हता - कोई व्यक्ति उक्त पदों पर नियुक्ति के लिए पात्र नहीं होगा:
(i) जिसने ऐसे व्यक्ति से विवाह या विवाह का अनुबंध किया है जिसका पति या पत्नी जीवित है; या
(ii) जिसने अपने पति या पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह या विवाह का अनुबंध किया हो, 161 GI/2023
(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] बशर्ते कि कें द्र सरकार, यदि संतुष्ट हो कि ऐसे व्यक्ति और विवाह के दूसरे पक्षकार पर लागू व्यक्तिगत कानून के तहत ऐसा विवाह स्वीकार्य है और ऐसा करने के लिए अन्य आधार हैं, तो किसी भी व्यक्ति को इस नियम के पालन से छू ट दे सकती है।
5. शिथिल करने की शक्ति - जहां कें द्र सरकार की यह राय है कि ऐसा करना आवश्यक और समीचीन है, वह आदेश द्वारा और कारणों को लिखित रूप में अभिलिखित करते हुए इन नियमों के किन्हीं उपबंधों में से किसी वर्ग या व्यक्तियों के वर्ग के संबंध में छू ट दे सकती है।
6. अपवाद- इन नियमों की कोई भी बात अनुसूचित जाति, अनुसूचित जनजाति, अन्य पिछड़ा वर्ग, भूतपूर्व सैनिकों और अन्य विशेष श्रेणी के व्यक्तियों के लिए इस संबंध में कें द्र सरकार द्वारा समय-समय पर जारी किए गए आदेशों के अनुसार आरक्षण, आयु-सीमा में छू ट और अन्य रियायतों को प्रभावित नहीं करेगी।

पुन:सेवायोजन पर जारी रखा जाएगा।
(इस या अन्य संगठन/विभाग में इस नियुक्ति से ठीक
पहले धारित किसी अन्य संवर्ग-बाह्य पद पर
प्रतिनियुक्ति सहित प्रतिनियुक्ति की अवधि सामान्य

NOTIFICATION
New Delhi, the 19th October, 2022
G.S.R. 14(E).—In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of this Ministry's Despatch Rider Group 'C' post Recruitment Rules, 2012, except as respects things done or omitted to be done before such supersession, the President hereby make the following rules, regulating the method of recruitment to the posts of Despatch Rider in the Ministry of Women and Child Development, namely:-
1. Short title and commencement.- (1) These rules may be called the Ministry of Women and Child Development, Despatch Rider Group 'C' post Recruitment Rules, 2022.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Number of posts, classification and pay level.- The number of said posts, their classification, pay level attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed hereto.
3. Method of recruitment, age limit, qualification, etc.- The method of recruitment, age limit, qualifications and other matters relating to the said posts shall be as specified in columns (5) to (14) of the said Schedule.
4. Disqualification.- No person,-
(i) who has entered into or contracted a marriage with a person having a spouse living; or
(ii) who, having a spouse living, has entered into or contracted a marriage with any person,
shall be eligible for appointment to the said posts:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
5. Power to relax.- Where the Central Government is of the opinion that it is necessary and expedient so to do, it may, by order and for reasons to be recorded in writing relax any of the provisions of these rules with respect to any class or category of persons.
6. Saving.- Nothing in these rules shall affect reservations, relaxation of age-limit and other concessions required to be provided to the Scheduled Castes, the Scheduled Tribes, the other Backward Classes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
