का.आ. 231(अ).—कें द्रीय सरकार, ठेका श्रम (विनियमन और उत्सादन) अधिनियम, 1970 (1970 का 37) की धारा 31 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, कें द्रीय सलाहकार ठेका श्रम बोर्ड के साथ परामर्श करके , स्नातकोत्तर चिकित्सा शिक्षा और अनुसंधान संस्थान (पीजीआईएमईआर) चंडीगढ़ में दाखिल रोगियों के लिए,
(i) स्वच्छता सेवा (सफाई, झाड़ने और कू ड़ाकरकट हटाने);
(ii) सुरक्षा सेवाएं (संस्थान की निगरानी और सेवा); और
(iii) खानपान सेवा, संक्रर्मों में लगे हुए ठेका श्रम के नियोजन के संबंध में,
भारत सरकार, श्रम और रोजगार मंत्रालय की अधिसूचना संख्यांक का.आ. 3161(अ), तारीख 12 दिसंबर, 2014, जो भारत के राजपत्र, असाधारण, भाग II, खंड 3, उपखंड (ii) को प्रकाशित की गई थी, के राजपत्र में इस अधिसूचना के प्रकाशन की तारीख से एक और वर्ष की अवधि के लिए स्नातकोत्तर चिकित्सा शिक्षा और अनुसंधान संस्थान (पीजीआईएमईआर) चंडीगढ़ को लागू होने से निम्नलिखित शर्तों के अधीन रहते हुए छू ट प्रदान करती है, अर्थात् :– 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (क) अस्पताल प्रबंधन यह सुनिश्चित करेगा कि ठेका कर्मकार ठेका श्रम (विनियमन और उत्सादन) नियम, 1971 के नियम 25 के उपनियम (2) के खंड (v) के उपखंड (क) के निबंधनों के अनुसार किसी स्थापन में एक समान कार्य निष्पादित करने वाले न्यूनतम संदत्त नियमित कर्मकार के समान मजदूरी और अन्य सुविधाएं संदत्त की जाती हैं; और
(ख) बोर्ड को यह सुनिश्चित करने और जांच करने के लिए स्थापन निरीक्षण का अधिकार होगा कि क्या ऐसी मजदूरी और फायदे स्थापन द्वारा प्रदान किए जाते हैं और पूर्वोक्त शर्त स्थापन द्वारा कार्यान्वित की जाती है।

NOTIFICATION
New Delhi, the 13th January, 2023
S.O. 231(E).— In exercise of the powers conferred by section 31 of the Contract Labour (Regulation and Abolition) Act, 1970 (37 of 1970), the Central Government, after consultation with the Central Advisory Contract Labour Board, hereby exempts the Post-Graduate Institute of Medical Education and Research (PGIMER), Chandigarh from the applicability of notification of the Government of India in the Ministry of Labour and Employment number S.O. 3161(E), dated the 12th December, 2014, published in the Gazette of India, Extraordinary, Part II, Section 3, sub-section (ii), dated the 12th December, 2014, in respect of employment of contract labour involved in the works of-
(i) sanitation services (cleaning, sweeping and dusting);
(ii) security services (Watch and ward of the institute); and
(iii) catering services to admitted patients,
in the Post-Graduate Institute of Medical Education and Research (PGIMER), Chandigarh, for a further period of one year with effect from the date of publication of this notification in the Official Gazette subject to the following conditions, namely:-
(a) the hospital management shall ensure that the contract workers are paid wages and provided other facilities equal to the lowest paid regular worker performing similar work in the establishment in terms of sub-clause (a) of clause (v) of sub-rule (2) of rule 25 of the Contract Labour (Regulation and Abolition) Rules, 1971; and
(b) the Board will have the right to inspect the establishment to ensure and check whether such wages and benefits are given and whether the above said conditions are implemented by the establishment.
