That Shri justice Jawahar Lal Gupta, Chief Justice of the Kerala High Court , who has been transferred from the Punjab and Haryana High Court , shall be entitled to receive in addition to his salary , a compensatory allowance of Rs. 3000/- (Rupees three thousand) permonth , for the period ofhis service as Chief Justice of the Kerala High Court .

किकेरल उच्च न्यायालय के मुख्य न्यायाधीश न्यायविद् श्री जवाहर लाल गुप्ता, जिन्हें पंजाब एवं हरियाणा उच्च न्यायालय से स्थानांतरित किया गया है, केरल उच्च न्यायालय के मुख्य न्यायाधीश के रूप में अपनी सेवा अवधिके दौरान अपने वेतन के अतिरिक्त 3000 रु. ( तीन हजार रुपये मात्र) प्रतिमाह की दर से प्रतिपूरक भत्ता प्राप्त करने के हकदार होंगे ।

In exercise of the powers conferredby the proviso to article 309 of the Constitution , the President hereby makes the following rules to amend the Office of the Registrar General , India and the offices of the Directorates of Census Operations in States and Union Territories (Senior Drawing Assistant) Recruitment Rules . 2000 namely :-

1. ( 1 ) These rules may be called the Office of the Registrar General , India and the offices of the Directorates of Census Operations in States and Union Territories (Senior Drawing Assistant ) Recruitment (Amendment) Rules , 2003 .

(2) They shall come into force on the date of their publication in the Official Gazette.

सा.का.नि. 41.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए भारत के महारजिस्ट्रार का कार्यालय तथा राज्यों एवं संघ राज्य क्षेत्रों में स्थित जनगणना कार्य निदेशालय ( वरिष्ठ ड्राईंग सहायक ) भर्ती नियम, 2000 में संशोधन करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्: -

सा.का.नि. 42.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए गृह मंत्रालय, राजभाषा विभाग, केन्द्रीय हिंदी प्रशिक्षण संस्थान ( लेखा अधिकारी ) भर्ती नियम, 1991 को उन बातों के सिवाय अधिक्रांत करते हुए जो ऐसे अधिक्रमण से पूर्व की गई है या करने से रह गई है , केन्द्रीय हिन्दी प्रशिक्षण संस्थान, राजभाषा विभाग , गृह मंत्रालय में लेखा अधिकारी के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्: -

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम गृह मंत्रालय , राजभाषा विभाग , केन्द्रीय हिंदी प्रशिक्षण संस्थान ( लेखा अधिकारी ) भर्ती नियम, 2003 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण और वेतनमान. उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतनमान वे होंगे, जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ 2 से स्तम्भ 4 में विर्निदिष्ट हैं ।

3. भर्ती की पद्धति, आयु सीमा और अन्य अर्हताएं आदि उक्त पद पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ 5 से स्तम्भ 14 में विनिर्दिष्ट हैं ।

4. निरर्हता.- वह व्यक्ति, -

(क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है , या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

5. शिथिल करने की शक्ति जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबन्ध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.- इन नियमों की कोई बात , ऐसे आरक्षणों, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों , अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबन्ध करना अपेक्षित है ।

परिवीक्षा की अवधि, यदि कोई हो

सीधी भर्ती किए जाने वाले व्यक्तियों के लिए अपेक्षित शैक्षिक और अन्य अर्हताएं

सेवा में जोड़े गए वर्षों का फायदा केन्द्रीय सिविल सेवा ( पेंशन ) नियमावली, 1972 के नियम 30 के अधीन अनुज्ञेय है या नहीं

सीधे भर्ती किए जाने वाले व्यक्तियों के लिए विहित आयु और शैक्षिक अर्हताएं प्रोन्नत व्यक्तियों की दशा में लागू होंगी या नहीं

भर्ती की पद्धति : भर्ती सीधे होगी या प्रोन्नति द्वारा या प्रतिनियुक्ति/आमेलन द्वारा तथा विभिन्न पद्धतियों द्वारा भरे जाने वाले पदों की प्रतिशतता

प्रतिनियुक्ति

प्रतिनियुक्ति:

( सशस्त्र बल कार्मिक के लिए ) प्रतिनियुक्ति/पुनर्नियोजन केन्द्रीय सरकार के ऐसे अधिकारी जो:-

(क) (i ) मूल काडर/ विभाग में नियमित आधार पर सदृश पद धारण किए हुए हैं; या

(ii ) मूल काडर/विभाग में 5500-9000 रु. या समतुल्य वेतनमान में नियमित आधार पर नियुक्तके पश्चात् उस श्रेणी में तीन वर्ष सेवा कर चुके हैं ; या

(ख) निम्नलिखित में से कोई अर्हता रखते हैं:

( 1 ) केन्द्रीय सरकार के किसी संगठित लेखा विभाग द्वारा संचालित अधीनस्थ लेखा सेवा या समतुल्य परीक्षा उत्तीर्ण हो

(2) सचिवालय प्रशिक्षण एवं प्रबंध संस्थान या समतुल्य में रोकड़ और लेखा-कार्य में सफलतापूर्वक प्रशिक्षण प्राप्त किया हो और रोकड़, लेखा और बजट कार्य का अनुभव हो ।

सशस्त्र बल कार्मिक के लिए-

प्रतिनियुक्ति/पुनर्नियोजन

लेफ्टीनेंट या समतुल्य पंक्ति के सशस्त्र बल कार्मिक जो एक वर्ष की अवधि के भीतर सेवानिवृत्त होने वाले हैं या रिजर्व में स्थानांतरित किए जाने वाले हैं और जिनके पास प्रतिनियुक्त व्यक्तियों के लिए विहित अर्हताएं हैं , पर भी विचार किया जाएगा । यदि चयन हो जाता है तो ऐसे अधिकारी को उस तारीख तक प्रतिनियुक्ति के निर्बंधनों पर रखा जाएगा जिस तारीख से उन्हें सशस्त्र बल से निर्मुक्त किया जाना है , तत्पश्चात् उन्हें पुनर्नियोजन पर बने रहने दिया जा सकता है । यदि ऐसे पात्र अधिकारी उक्त पद पर वास्तविक चयन से पूर्व सेवानिवृत या रिजर्व में स्थानांतरित हो चुके हैं तो उनकी नियुक्तिपुनर्नियोजन के आधार पर की जाएगी ।

(सिविल पदों के प्रतिनिर्देश से अधिवर्षिता की आयु तक पुनर्नियोजन )

(प्रतिनियुक्ति की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर- बाह्य पद पर प्रतिनियुक्ति की अवधि है , तीन वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति द्वारा नियुक्ति के लिए अधिकतम आयु सीमा , आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी । ) 207 [ भाग II - खण्ड 3( i) ]

G.S.R. 42. In exercise of the powers conferred by the proviso to article 309 of the Constitution , and in supersession of the Ministry of Home Affairs , Department of Official Language, Central Hindi Training Institute ( Accounts Officer) Recruitment Rules , 1991 , except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Accounts Officer in the Central Hindi Training Institute , Department of Official Language , Ministry of Home Affairs , namely:-

1. Short title and commencement . ( 1 ) These rules may be called the Ministry of Home Affairs . Department of Official Language, Central Hindi Training Institute (Accounts Officer), Recruitment Rules , 2003 .

(2) They shall come into force on the date oftheir publication in the Official Gazette .

2. Number of posts, classification and scale of pay . The number of said posts , its classification and scale of payattached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules .

3.Method of recruitment , age limit and qualifications etc. The method of recruitment to the said posts , age limit , qualification and other matters relating thereto shall be as specified in columns (5) to ( 14) of the said Schedule .

4. Disqualification . No person,-

(a) Who has entered into or contracted a marriage with a person having a spouse living; or

(b) who , having a spouse living, has entered into or contracted a marriage with any person ;

shall be eligible for appointment to any of the said posts ;

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and other party to the marriage and that there are other grounds for so doing , exempt any person from the operation ofthis rule.

5. Power to relax .-Where the Central Government is of the opinion that it is necessary or expedient so to do . it may by order, for reasons to be recorded in writing , and in consultation with the Union Public Service Commission , relax any of the provisions of these rules with respect to any class or category of persons .

(ii) Successful completion of training in the Cash and Accounts work in the Institute of Secretariat Training and Management or equivalent and experience in Cash , Accounts andBudget work.

For Armed Forces Personnel :

Deputation /Re - employment Armed Forces Personnel of the Rank of Lieutenant or equivalent and who are due to retire or to be transferred to reserve within a period of one year and have the qualifications prescribed for deputa-tionists shall also be considered . If selected , suchofficer will be given deputation terms upto the date on which they are due for release from the Armed Forces , thereafter , they may be continued on re- employment terms . In case such eligible officers have retired or have been transferred to reserve before the actual selection to the post is made, their appointment will be on re - employment basis ( Re -employment upto the age of superannuation with reference to civil posts . )

(Period ofdeputation including period ofdeputation inanother ex - cadre post held immediately preceeding this appointment in the same or some other organisation department of the Central Government shall ordinarily not exceed three years . The maximum age limit for appointment by deputation shall be not exceeding 56 years as on the closing date of receipt of applications).

सा.का.नि. 43.- राष्ट्रपति, संविधानं के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और वित्त मंत्रालय ( आर्थिक कार्य विभाग ) की अधिसूचना सा.का.नि. 2054 तारीख 23-11-1968 द्वारा प्रकाशित वित्त मंत्रालय , आर्थिक कार्य विभाग वर्ग-3 और वर्ग -4 पद ( बजट मुद्रणालय ) भर्ती नियम, 1968 को वहां तक अधिक्रांत करते हुए जहां तक उनका संबंध तकनीकी अधिकारी ( मशीन ) के पद से है सिवाय उन बातों के जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है ।

आर्थिक कार्य विभाग में तकनीकी अधिकारी ( मशीन ) समूह ' ख ' अराजपत्रित पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्: -

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम वित्त मंत्रालय , आर्थिक कार्य विभाग तकनीकी अधिकारी ( मशीन ) समूह ' ख ' अराजपत्रित पद भर्ती नियम , 2002 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे । 210

2. पद संख्या, वर्गीकरण और वेतनमान उक्त पद की संख्या , उसका वर्गीकरण और उसका वेतनमान वह होगा जो इससे नियमों से उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति , आयु- सीमा, अन्य अर्हताएं आदि . भर्ती की पद्धति, आयु सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्तअनुसूची के स्तंभ 5 से स्तंभ 14 में विनिर्दिष्ट हैं ।

4. निरर्हता:- वह व्यक्ति-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है , या

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

5. शिथिल करने की शक्ति जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृति. इन नियमों की कोई बात, ऐसे आरक्षणों, आयु - सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

टिप्पण: जब ऐसे कनिष्ठ व्यक्तियों के संबंध में, जिन्होंने अपनी अर्हक पात्रता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा ही वहां उनसे ज्येष्ट व्यक्तियोंके संबंध में भी विचार किया जाएगा परंतु यह तब जबकि उनके द्वारा की गई अर्हक /पात्रता सेवा, अपेक्षित अर्हक/पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कंनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक पात्रता सेवा पहले ही पूरी कर ली है , अगेली उच्चतर श्रेणी में प्रोन्नतिके लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो । 15001 /003-2 212

केन्द्र सरकार के ऐसे अधिकारीः-

( क ) ( i ) जो मूल काडर या विभाग में नियमित आधार पर सदृश पद धारण किए हुए हैं; या

( ii ) जिन्होंने मूल काडर या विभाग में 5500-9000 रु. के या समतुल्य वेतनमान में नियमित आधार पर नियुक्ति के पश्चात् उस श्रेणी में 3 वर्ष नियमित सेवा की हो, या

( iii ) जिन्होंने मूल काडर या विभाग में 5000-8000 रु. या समतुल्य वेतनमान में नियमित आधार पर नियुक्ति के पश्चात् उस श्रेणी में 6 वर्ष नियमित सेवा की हो, या

( iv ) जिन्होंने मूल काडर या विभाग में 4500-7000 रु. या समतुल्य वेतनमान में नियमित आधार पर नियुक्ति कि पश्चात् उस श्रेणी में 8 वर्ष नियमित सेवा की हो, और

(ख ) जिसके पास स्तम्भ ४ के अधीन विहित शैक्षिक अर्हताएं और अनुभव है ।

[पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में हैं , प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्तिप्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । प्रतिनियुक्ति/संविदा की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्तिसे ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति संविदा की अवधि है, साधारणतया तीन वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति पर नियुक्त ( जिसके अंतर्गत अल्पकालिक संविदा भी है ) के लिए अधिकतम आयु सीमा, आवेदन प्राप्त करने की तारीख को 56 वर्ष से अधिक नहीं होगी । ] यदि विभागीय प्रोन्नति समिति है , तो उसकी सरंचना

In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Ministry of Finance , Department of Economic Affairs , Class III and Class IV Posts (Budget Press ) Recruitment Rules , 1968 published in the Ministry of Finance ( Department of Economic Affairs ) vide No. GSR 2054 dated 23-11-1968 in so far as they relate to the post of Technical Officer ( Machine ) , except as respects things done on omitted to be done before such supersession , the President hereby inakes the following rules regulating the methoc of recruitment to the post of Technical Officer (Machine ) , Group- B , Non - Gazetted in the Department of Economic Affairs, namely :-

1. Short title and commencement . ( 1 ) These rules may be called the Ministry of Finance . Department o Economic Affairs , Group- B , Non- Gazetted Post of Technical Officer ( Machine ) Recruitment Rules .2002.

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of posts , classification and scale of pay . The number of said post , its classification and scale of pay attached thereto shall be as specified in columns 2 to 4 of the said Schedule annexed hereto .

3. Method of recruitment, age limit and other qualifications etc. The method of recruitment, age limit , qualifications and other matters relating thereto shall be as specified in columns 5 to 14 of the said Schedule .

4. Disqualification . No person,- (a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living , has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any persons from the operation of this rule .

5. Power to relax .- Where the Central Government is of the opinion that it is necessary or expedient so to do, it may by order , for reasons to be recorded in writing, and in consultation with the Union Public Service Commission , relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving . Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes and other special categories of persons in accordance with the orders issuedby the Central Government from time to time , in this regard.

1. ( 1 ) These rules.may be called the Planning Commission (Non - Secretariat post of Assistant Library and InformationOfficer ) Recruitment ( Amendment ) Rules , 2003 ,

(2) They shall come into force on the date of their publication in the Official Gazette .

2. In the Schedule to the Plannifig Commission (Non - Secretariat post of Assistant Library and Information Officer) Recruitment Rules , 2002, under column 12, below the sub - heading Deputation , for the entry :----

5. शिथिल करने की शक्ति:-जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत. आदेश द्वारा शिथिल कर सकेगी । 217

In exercise of the powers conferred by the proviso to article 309 of the Constitution the President hereby makes the following rules regulating the method of recruitment to the post of Chief Engineer ( Electrical and Mechanical) in the Ministry of Road Transport and Highways , in the Border Roads Organisation , namely :-

1. Short title and commencement . ( 1 ) These rules may be called the Border Roads Engineering Service Group 'A' [ Chief Engineer ( Electrical and Mechanical) ] Recruitment Rules, 2002.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts , classification and scale of pay. The number of the said post, its classification and the scale ofpay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications etc. The method of recruitment , to the said post , age limit , qualifications and other matters relating thereto shall be as specified in columns 5 to 14 of the said Schedule .

4. Disqualification . No person ,-

(a) Who has entered into or contracted a marriage with a person having a spouse living ; or

(b) who, having a spouse living , has entred into or contracted a marriage with any person ,

shall be eligible for appointment to the said post:

Provided that the Cennial Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule .

5. Power to relax .-Where the Central Government is of the opinion that it is necessary or expedient so to do, itmay, by order , for reasons to be recorded in writing , and in consultation with the Union Public Service Commission relax any of the provisions of these rules with respect to any class or category of persons .

6. Savings . Nothing in these rules shall affect reservations , relaxation of age limit and other concessions to be provided for the Scheduled Castes , the Scheduled Tribes , other Backward classes , Ex - serviceman and other special categories of persons in accordance with the orders issued by the Central Government from time to time , in this regard .

1. Short title and commencement,-( 1 ) These rules may be called the Border (Group ' D ' posts ) Recruitment ( Amendment ) Rules, 2002;

(2) They shall come into force on the date of their publication in the official Gazette.

2. In the schedule.-

3. पदों की संख्या , वर्गीकरण एवं वेतनमानः-उक्त पदों की संख्या, उनका वर्गीकरण और उससे जुड़े वेतनमान इन नियमों के साथ संलग्न अनुसूची के कॉलम ( 3 ) से ( 5 ) में विनिर्दिष्ट किए जाएँगे । 4. भर्ती की प्रणाली, आयु सीमा और अन्य अर्हताएँ:- उक्त पदों की भर्ती प्रणाली, आयु सीमा, अर्हताएँ और अन्य बातें उक्त अनुसूची के कॉलम ( 6 ) से ( 14 ) में विनिर्दिष्टानुसार होंगी । परंतु केंद्र सरकार द्वारा समय - समय पर जारी आदेशों के अनुसार अनुसूचित जाति, अनुसूचित जनजाति और अन्य विशिष्ट श्रेणियों के व्यक्तियों से संबंधित मामले में उक्त अनुसूची के कॉलम ( 7 ) में विनिर्दिष्ट ऊपरी आयु सीमा में छूट दी जा सकती है ।

5. अनर्हता:-ऐसा कोई भी व्यक्तिः

(क) जिसने किसी ऐसे व्यक्ति से विवाह किया हो जिसका पति/पत्नी जीवित है,

अथवा जिसने पति/पत्नी के जीवित होते हुए, किसी अन्य व्यक्ति से विवाह किया ले,

(ख)

उक्त पदों पर नियुक्ति का पात्र नहीं होगा:

परंतु केंद्र सरकार, यदि इस बात से संतुष्ट हो कि ऐस व्यक्ति या अन्य पक्ष ( पार्टी ) के लिए लागू व्यक्तिगत नियमों के अधीन इस प्रकार का विवाह स्वीव्य है और ऐसा करने के अन्य आधार हैं , तो इस नियम के लागू होने से किसी भी व्यक्ति को छूट दे सकती है ।

6. छूट देने की शक्ति: - जहाँ केंद्र सरकार का यह मत हो कि ऐसा करना आवश्यक अथवा वांछनीय है, तो यह आदेश द्वारा और लिखित मे दर्ज कारणों से किसी भी वर्ग अथवा श्रेणी के व्यक्तियों के संबंध में इन नियमों के किसी भी उपबंध में छूट दे सकती है ।

3. Number ofposts , classification and scale of pay : The number of said posts , their classification and the scale of pay attached thereto shall be specified in Columns (3 ) to ( 5) of the schedule annexed to these rules .

4. The method ofrecruitment, age- limit and other qualifications : The method of recruitment to the said posts , age- limit, qualifications and other matters shall be as specified in columns (6) to ( 14) of the said schedule :

Provided that the upper age limit specified in column (7) ofthe said Schedule may be relaxed in the case of persons belonging to the Scheduled Castes , the Scheduled Tribes and other special categories of persons in accordance with the orders issued by the Central Government from time to time.

5. Disqualification : No person :

(a) who has entered into or contracted a marriage with a person having a spouse living , or

(b) who, having a spouse living , has entered into or contracted a marriage with any person , shall be eligible for appointment to the said posts :

Provided that the Central Govemment may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule .

6. Power to relax :-Where the Central Govemment is of the opinion that it is necessary or expedient to do so , it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons .

सा.का.नि. 49.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और केन्द्रीय भूमिगत जल बोर्ड, ज्येष्ठ तकनीकी सहायक ( यांत्रिक ) भर्ती नियम, 1977 को सिवाय उन बातों के अधिक्रांत करते हुए जिन्हे ऐसे अधिक्रमण से पूर्व किया गया है या करने का लोप किया गया है, केन्द्रीय भूमिगत जल बोर्ड, जल संसाधन मंत्रालय में ज्येष्ठ तकनीकी सहायक ( यांत्रिक ) के पद पर भर्ती की पद्धति काविनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

2003है । 1. संक्षिप्त नाम और प्रारंभ.-( 1 ) इन नियमों का संक्षिप्त नाम केन्द्रीय भूमिगत जलबोर्ड, ज्येष्ठ तकनीकी सहायक ( यांत्रिक ) भर्ती नियम, (2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण और वेतनमान. उक्त पद की संख्या, उनका वर्गीकरण और उनका वेतनमान वह होगा, जो इससे नियमों से उपाबद्ध अनुसूची के स्तम्भ 2 से स्तम्भ 4 में विर्निदिष्ट हैं ।

3. भर्ती की पद्धति, आयु सीमा, अर्हताएं आदि उक्त पद पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ ( 5 ) से स्तम्भ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता. वह व्यक्ति,-

(क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है , या

( ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा:

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधिके अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके , इन नियमों के किसी उपबन्ध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.- इन नियमों की कोई बात ऐसे आरक्षणों , आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्यपिछड़े वर्गों , भूतपूर्व सैनिकों, और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबन्ध करना अपेक्षित है । [ भाग 11- खण्ड 3 (i ) ]

प्रोन्नति/प्रतिनियुक्ति/आमेलन द्वारा भर्ती की दशा में वे श्रेणियां जिनसे प्रोन्नति/ प्रतिनियुक्ति/आमेलन किया जाएगा

टिप्पण: जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में, जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है , प्रोन्नतिके लिए विचार किया जा रहा हो वहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परन्तु यह तब जब कि उनके द्वारा की गई ऐसी अर्हक/पात्रता सेवा, अपेक्षित अर्हक पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक/पात्रता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो ।

प्रतिनियुक्तिद्वारा नियुक्ति के लिए अधिकतम आय- सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी ।

In exercise of the powers conferred by the proviso to article 309 of the Constitution , and in supersession of the Central Ground Water Board , Senior Technical Assistant (Mechanical ) Recruitment Rules , 1977 , except , as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment for the post of Senior Technical Assistant ( Mechanical ) in the Central Ground Water Board , Ministry of Water Resources , namely :-

1. Short title and commencement .-( 1 ) These rules may be called the Central Ground Water Board, Senior Technical Assistant ( Mechanical ) Recruitment Rules , 2003 .

(2) They shall come into force on the date of their publication in the Official Gazette .

आदेश दिए गए हैं । टिप्पण 1 : इस अनुसूची के अधीन प्रमुख विभागाध्यक्षों की अनुशासनिक शक्तियां, समन्वयकारी विभागाध्यक्षों या वरिष्ठ प्रशासनिक ग्रेड के विभागाध्यक्षों द्वारा भी जिनके पास उत्पादन इकाइयों जैसे चित्तरंजन रेलइंजन कारखाना/चित्तरंजन, डीज़ल कलपुर्जा कारखाना/पटियाला, डीज़ल रेलइजन कारखाना/वाराणसी , सवारी डिब्बा कारखाना/पेरंबूर, पहिया एवं धुरा संयंत्र/येलहंका ( बेंगलूरु ) और रेल डिब्बा कारखाना/कपूरथला और नई जोनल रेलों यथा पूर्व तटीय रेलवे/भुवनेश्वर, पूर्व मध्य रेलवे/हाजीपुर, उत्तर मध्य रेलवे इलाहाबाद, उत्तर पश्चिम रेलवे/जयपुर, दक्षिण पश्चिम रेलवे / हुबली, पश्चिम मध्य रेलवे/ जबलपुर और दक्षिण पूर्व मध्य रेलवे/बिलासपुर में अपने संबंधित विभागों में जिनका उनके पास स्वतंत्र प्रभार है कनिष्ठ वेतनमान और समूह ' ख ' के अधिकारियों जो उनके प्रशासनिक नियंत्रण में हैं, के संबंध में प्रयोग की जाएंगी ।

टिप्पण 2 : इस अनुसूची के अधीन प्रमुख विभागध्यक्षों की अनुशासनिक शक्तियां रेल प्रशिक्षण संस्थानों के निदेशकों, यथा- निदेशक/ भारतीय रेल सिविल इंजिनियरी संस्थान, पुणे निदेशक/ भारतीय रेल बिजली इंजिनियरी संस्थान, नासिक, निदेशक/भारतीय रेल यांत्रिक एवं बिजली इजीनियर संस्थान , जमालपुर, निदेशक/ भारतीय रेल सिगनल इंजीनियर एवं दूरसंचार संस्थान, सिकंदराबाद और निदेशक/ भारतीय रेल आधुनिक अनुरक्षण प्रौद्योगिकी संस्थान , ग्वालियर द्वारा भी कनिष्ठ वेतनमान और समूह ' ख' के अधिकारियों जो उनके प्रशासनिक नियंत्रण में हैं के संबंध में प्रयोग की जाएंगी । "

G. S. R. 50. In exercise of the powers conferred by the proviso to article 309 of the Constitution , the President hereby makes the following rules further to amend the Railway Servants ( Discipline and Appeal ) Rules , 1968 , namely :-

1. ( 1 ) These rules may be called the Railway Servants (Discipline and Appeal ) First Amendment Rules , 2003.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Railway Servants ( Discipline and Appeal ) Rules , 1968, for Schedule III , the following shall be substi- tuted, namely:-

सा. का. नि. 51.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शविनयों का प्रयोग करते हुए संचार और सूचना प्रौद्योगिकी मंत्रालय, दूर संचार विभाग में सहायक महानिदेशक ( विधिक ) के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्:-

1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियपों का संक्षिप्त नाम संचार और सूचना प्रौद्योगिकी मंत्रालय , दूर संचार विभाग , सहायक महानिदेशक ( विधिक ) भर्ती नियम, 2003 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

( 2) पद संख्या, वर्गीकरण और वेतनमान: उक्त पद की संख्या , उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 तक विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु-सीमा, अर्हताएं आदि. उक्त पद पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उक्त पद से संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ ( 5 ) से स्तम्भ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता.-वह व्यक्ति,-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है , या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

5. शिथिल करने की शक्ति जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबन्ध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति . इन नियमों की कोई बात ऐसे आरक्षणों , आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों , भूतपूर्व सैनिकों, अन्य पिछड़े वर्गों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबन्ध करना अपेक्षित है । 238

1. (क) जिन्होंने मूल काडर या विभाग में नियमित आधार पर सदृश पद धारण किए हुए हैं, या

(ख) जिन्होंने मूल काडर या विभाग में 8000- 275-13500 रु . के या समतुल्य वेतनमान में नियमित आधार पर नियुक्ति के पश्चात् उस श्रेणी में पांच वर्ष नियमित सेवा की है, या

( ग ) जिन्होंने मूल काडर या विभाग में 6500- 200-10500 रु. के या समतुल्य वेतनमान में नियमित आधार पर नियुक्तिके पश्चात् उस श्रेणी में आठ वर्ष नियमित सेवा की हो, या 239

2. जिनके पास निम्नलिखित शैक्षिक अर्हताएं और अनुभव हैं,

(क) किसी मान्यताप्राप्त विश्वविद्यालय से विधि में उपाधि या समतुल्य,

(ख ) विधिक या विधायी कार्यों का तीन वर्ष का अनुभव,

वांछनीय : प्रशासनिक कार्यों काअनुभव ।

टिप्पण: प्रतिनियुक्ति या संविदा की अवधि जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/ विभाग में इस नियुक्तिसे ठीक पहले धारित किसी अन्यकांडर बाह्य पद पर प्रतिनियुक्ति या संविदा की अवधि है साधारणत्तया तीन वर्ष से अधिक नहीं होगी ।

प्रतिनियुक्तिद्वारा नियुक्तिके लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी ।

G. S. R. 51. In exercise of the powers conferred by the proviso to article 309 of the Constitution , the President hereby makes the following rules regulating the method of recruitment to the post of Assistant Director General ( Legal ) in the Department of Telecommunications , Ministry of Communications and Information Technology, namely:-

1. Short title and commencement ( 1 ) These rules may be called the Ministry of Communications and Information Technology, Department of Telecommunications ' Assistant Director General ( Legal ) Recruitment Rules, 2003.

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of posts , classification and scale of pay . The number of the said posts, its classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexedto these rules .

3. Method of recruitment , age limit and qualification etc. The method of recruitment to the said post, age limit , qualifications and other matters relating to the said post shall be as specified in columns 5 to 14 of the said Schedule .

4. Disqualification .-No person ,--

(a) who has entered into or contracted a marriage with a person having a spouse living ; or (b) who, having a spouse living, has entered into or contracted a marriage with any person , shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule .

5. Power to relax .-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may by order , for reasons to be recorded in writing, and in consultation with the Union Public Service Commission relax any of the provisions of the rules with respect of any class or category of persons .

6. Saving . Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , the Ex- Servicemen , the Other Backward Classes , and other special categories of persons in accordance with the orders issued by the Central Government from time to time, in this regard.

(i) खंड ( क) के अंत में आने वाले ' और ' शब्द का लोप किया जायेगा;

1. (1 ) These rules may be called the Allotment of Government Residences ( General Pool in Delhi) Amend- ment Rules , 2003 .

(2) They shall come into force on the date of their publication in the Official Gazette .
