सा. का. नि. 75.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, असम राइफल्स महानिदेशालय में मुख्य लेखा अधिकारी और ज्येष्ठ लेखा अधिकारी के समूह " क " पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते है, अर्थात्: -

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम असम राइफल्स ग्रुप ( मुख्य लेखा अधिकारी और ज्येष्ठ लेखा अधिकारी ) भर्ती नियम, 2002 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या , वर्गीकरण और वेतनमान. उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ 2 से स्तम्भ 4 में विर्निदिष्ट हैं ।

3. भर्ती की पद्धति, आयु सीमा, अर्हताएं आदि- उक्त पद पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ 5 से स्तम्भ 14 में विनिर्दिष्ट हैं ।

4. प्रारंभिक गठन.- मुख्य लेखा अधिकारी और ज्येष्ठ लेखा अधिकारी के पदधारियों को जिन्हें इन नियमों के प्रकाशन की तारीख से पूर्व दीर्घकालिक आधार पर पदों पर नियुक्त किया गया था इन नियमों के अधीन नियुक्त किया गया समझा जाएगा और प्रकाशन की उक्त तारीख से पूर्व उक्त पदों पर उनके द्वारा की गई सेवा को अगली उउच्चतर श्रेणी में प्रोन्नति के लिए उनकी पात्रता का विनिश्चय करने के लिए गणना में लिया जाएगा ।

5. निरर्हता . वह व्यक्ति, -

(क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

( ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबन्ध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.-इन नियमों की कोई बात, ऐसे आरक्षणों, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबन्ध करना अपेक्षित है ।

टिप्पण: जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो वहां उनके ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जब कि उनके द्वारा की गई ऐसी अर्हक/पात्रता सेवा, अपेक्षित अर्हक/पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित उनकी उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली है , जिन्होंने ऐसी अर्हक/पात्रता सेवा पहले ही पूरी कर ली है ।

प्रतिनियुक्ति: केन्द्रीय सरकार/ राज्य सरकार/ संघ राज्य क्षेत्र प्रशासन सरकारों के ऐसे

अधिकारी:-

(क) ( i ) जो मूल काडर/विभाग में नियमित आधार पर सदृश पद धारण किए हुए हैं; और

(ii ) जिन्होंने मूल काडर/ विभाग में 6500-10500 रु. के या समतुल्य वेतनमान में नियमित आधार पर नियुक्तिके पश्चात् उस श्रेणी में 5 वर्ष नियमित सेवा की है; और

(ख ) जिनके पास निम्नलिखित अर्हताओं में से कोई अर्हता है: -

(i ) केन्द्रीय सरकार के किसी संगठित लेखा विभागों द्वारा संचालित अधीनस्थ लेखा सेवा या समतुल्य परीक्षा में उत्तीर्ण ।

(i ) सचिवालय प्रशिक्षण और प्रबंध संस्थान या समतुल्य संस्थान में रोकड़ और लेखा कार्य में प्रशिक्षण को सफलतापूर्वक किया हो और रोकड़ तथा लेखा और बजट कार्य में 5 वर्षका अनुभव ।

(प्रतिनियुक्ति की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति के ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है साधारणतया तीन वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति पर नियुक्तिके लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष सेअधिक नहींहोगी । )

भर्ती करने में किन परिस्थितियों में संघ लोक सेवा आयोग से परामर्श किया जाएगा

MINISTRY OF HOME AFFAIRS

New Delhi , the 5th February, 2003

G.S.R. 75. In exercise of the powers conferredby the proviso to article 309 of the Constitution , the President hereby makes the following rules , regulating the method of recruitment to the Group ' A' posts of Chief Accounts Officer and Senior Accounts Officer in the Directorate General , Assam Rifles namely :--

1. Short title and commencement . ( 1 ) These rules may be called the Assam Rifles Group ( Chief Accounts Officer and Senior Accounts Officer ) Recruitment Rules , 2002 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of posts , classification and scale of pay. The number of the said posts , their classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules .

3. Method of recruitment , age- limit , qualifications etc. The method of recruitment to the said posts , age- limit , qualifications and other matters relating thereto shall be as specified in columns 5 to 14 of the said Schedule .

4. Initial constitution.- The incumbents of the posts of Chief Accounts Officer and Senior Accounts Officer as the case may be who were appointed to the posts on a long term basis , before the publication of these rules shall be deemed to have been appointed under these rules and the service rendered by them in the said posts before the said date of publication shall be taken into account for deciding their eligibility for promotion to the next higher grade .

5. Disqualification .-No person, ---

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who , having a spouse living , has entred into or contracted a marriage with any person ,

shall be eligible for appointment to the said posts :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operaton of this rule.

6. Power to relax .-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing , and in consultation with the Union Public Service Commission , relax any of the provisions of these rules with respect to any class or category of persons .

7. Saving . Nothing in these rules shall affect reservations , relaxation of age- limit and other concessions required to be provided for the Scheduled Castes , Scheduled Tribes , Other Bakward Classes , Ex - Servicemen and other special categories of person in accordance with the orders issued by the Central Government from time to time in this regard .

(ii) with five years service in the grade rendered after appointment thereto on a regular basis in the scale of pay or Rs . 6500-10500 or equivalent in the parent cadre/ department; and

(b) possessing any of the following qualifications :-

(i) A pass in the SAS or equivalent examination conducted by any of the organized acccounts departments ofthe Central Government .

(ii) Successful completion of training in cash and accounts work in the institute of secretariat training and management or equivalent and five years experience in cash , accounts and budget work .

धारण करने वाले व्यक्ति और जो इन नियमों में अधिकथित अर्हताएं और अनुभव पूरा करते हैं तथा जिन्होंने विभागीय प्रोन्नति समिति द्वारा उपयुक्त समझा गया है तथा इस शर्त के अधीन रहते हुए कि उनके मूल विभाग को असम राइफल्स में उनके आमेलन किए जाने पर कोई आपत्ति नहीं है, अपनी-अपनी श्रेणी में आमेलन/विनियमन के लिए पात्र होंगे ।

5. निरर्हता. वह व्यक्ति-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

G. S. R. 76. in exercise of the powers conferred by the proviso to article 309 of the Constitution , the President hereby makes the following rules , regulating the method of recruitment to the Group ' B ' posts of Accounts Officer, Additional Accounts Officer, Record Officer and Civilian Gazetted Officer in the Directorate General , Assam Rifles namely:-

1. Short title and commencement .( 1 ) These rules may be called the Assam Rifles (Accounts Officer , Additional Accounts Officer, Record Officer and Civilian .Gazetted Officer) Recruitment Rules , 2002 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of posts, classification and scale of pay. The number of the said posts , their classification and the scales ofpay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules .

3. Method of recruitment, age- limit, qualification , ete . The method of recruitment to the said posts , age - limit , qualifications and other matters relating thereto shall be as specified in columns 5 to 14 of the said Schedule .

4. Initial constitution. Notwithstanding contained in these rules , the persons holding the post of Accounts Officer , Additional Accounts Officer, Record Officer or Civilian Gazetted Officer , on the date of commencement of these rules either on transfer or on deputation basis or , as the case may be , on direct recruitment basis and who fulfil the qualifications and experience laid down in these rules and who are considered suitable by the Departmental Promotion Committee shall be eligible for absorption / regularisation in the respective grade subject to the condition and their parent department does not have any objection to their being absorbed in the Assam Rifles .

5. Disqualification . No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living ; or

(b) who having a spouse living, has entred into or contracted a marriage with any person ,

shall be eligible for appointment to the said posts:

Providedthat the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operaton of this rule.

6. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may by order, for reasons to be recorded in writing , and in consultation with the Union Public Service Commission , relax any of the provisions of these rules with respect to any class or category of persons .

7. Saving -Nothing in these rules shall affect reservations , relaxation of age - limit and other concessions required to be provided for the Scheduled Castes , Scheduled Tribes , Other Bakward Classes , Ex - Servicemen and other special categories of person in accordance with the orders issued by the Central Government from time to time in this regard.

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम असम राइफल्स , असम राइफल्स प्रशिक्षण केन्द्र और विद्यालय (ज्येष्ठ लेखा अधिकारी ) भर्ती नियम, 2002 है ।

(2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण और वेतनमान.-उक्त पदों की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ 2 से स्तम्भ 4 में विर्निदिष्ट हैं ।

3. भर्ती की पद्धति, आयु-सीमा, अर्हताएं आदि.-उक्त पद पर भर्ती की पद्धति, आयु सीमा, अर्हत्ताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ 5 से स्तम्भ 14 में विनिर्दिष्ट हैं ।

4. प्रारंभिक गठन: -असम राइफल्स प्रशिक्षण केन्द्र और विद्यालय , असम राइफल्स में ज्येष्ठ लेखा अधिकारी के पद के पदधारियों को , इन नियमोंके अधीन नियुक्त किया गया समझा जाएगा और उक्त प्रशिक्षण की तारीख से पूर्व उक्त पद पर उसके द्वारा की गई सेवा को, अगली उच्चतर श्रेणी में प्रोन्नतिके लिए उसकी पात्रता का विनिश्चय करने के लिए गणना में लिया जाएगा ।

5. निरर्हता. वह व्यक्ति-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तुयदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधिके अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जोकारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबन्ध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

7. व्यावृत्ति.- इन नियमों की कोई बात , ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबन्ध करना अपेक्षित है ।

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्यपक्षकार को लागूस्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हेंलेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबन्ध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल करसकेगी ।

1. Short title and commencement .( 1 ) These rules maybe called the Assam Rifles , Range Headquarters (Junior Accounts Officer) Recruitment Rules , 2002.

(2) They shall come into force on the date of their publication in the Official Gazette .

[PART II-SEC . 3 (i) ) 2. Number of posts , classification and scale of pay. The number ofthe said posts , their classification and the scales ofpay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules .

3. Method of recruitment , age limit, qualifications etc. The method of recruitment to the said posts , agė limit , qualifications and other matters relating thereto shall be as specified in columns 5 to 14 of the said Schedule .

4. Initial constitution.- Notwithstanding contained in these rules , the persons holding the post of Accounts Officer , Additional Accounts Officer , Record Officer or Civilian Gazetted Officer , on the date of commencement of these rules either on transfer or on deputation basis or, as the case may be , on direct recruitment basis and who fulfil the qualifications and experience laid down in these rules and who are considered suitable by the Departmental Promotion Committee shallbe eligible for absorption/regularization in the respective grade subject to the condition and their parent department does not have any objection to their being absorbed in the Assam Rifles .

5. Disqualification . No person,--

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who , having a spouse living , has entered into or contracted a marriage with any person ,

shall be eligible for appointment to the said posts ;

6. Power to relax. Where the Central Government is of opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing , and in consultation with the Union Public Service Commission , relax any of the provisions of these rules with respect to any class or category of persons .

7. Saving . Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , Scheduled Tribes , Other Backward Classes , Ex -Servicemen and other special categories of person in accordance with the orders issued by the Central Government from time to time in this regard.

3. भर्ती की पद्धति, आयु-सीमा, अर्हताएं आदि- उक्त पद पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ 5 से स्तम्भ 14 में विनिर्दिष्ट हैं ।

4. प्रारंभिक गठन.- इन नियमों में किसी बात के होते हुए भी , ऐसे व्यक्ति जो इन नियमों के प्रारंभ की तारीख को लेखाधिकारी, अपर लेखा अधिकारी , अभिलेख अधिकारी या सिविलियन राजपत्रित अधिकारी के यथास्थिति, स्थानांतरण या प्रतिनियुक्ति पर या सीधी भर्ती पर पद धारण किए हुए हैं, और जो इन नियमों में अधिकथित शैक्षिक और अनुभव पूरा करते हैं तथा जिन्होंने अपनी-अपनी श्रेणी में आमेलन/विनियमन के लिए विभागीय प्रोन्नति समिति द्वारा इस शर्त के अधीन रहते हुए उपयुक्त पाया गया है कि उनके मूल विभाग को असम राइफल्स में उनके आमेलन किए जाने पर कोई आपत्ति नहीं है । 5. निरर्हता. वह व्यक्ति-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

G. S. R. 80.-In exercise of the powers conferred by the proviso to article 309 of the Constitution , the President hereby makes the following rules to amend the Office of the Registrar General , India, Data Processing Assistant Grade ' A ' Recruitment Rules, 2000, namely:---

1. ( 1 ) These rules may be called the Office of the Registrar General , India , Data Processing Assistant Grade ' A ' Recruitment (Amendment) Rules , 2003.

(2) They shall come into force on the date oftheir publication in the Official Gazette .

2. In the Schedule to the Office of the Registrar General , India , Data Processing Assistant Grade ' A ' Recruitment Rules , 2000 , in column ( 12) , for the existing entries , the following entries shall be substituted, namely:-

"Deputation (including short - term contract ) /Absorption .

Officers under Central / State Governments /Union Territories/ Universities /Recognised Research Institutions/ Public Sector Undertakings/ Semi Government/Autonomous or Statutory Organisation :

(a) ( i ) holding analogous posts on regular basis ; or

(ii) with three years ' regular service in posts in the scale ofRs . 5000-8000 or equivalent ; or

(iii) with six years ' regular service in posts in the scale of Rs . 4500-7000 or equivalent; and

(b) possessing the educational qualifications and experience prescribed for direct recruits under column (8). Note: Only persons belonging to Central /State Government/ Union Territories are eligible for absorption .

[Period of deputation/contract including period of deputation/contract in another ex - cadre post held immediately proceeding this appointment in the same or sorne other organisation /department of the Central Government shall ordinarily not exceed three years . सा. का. नि. 81.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए भारत के नियंत्रक- महालेखा परीक्षक के परामर्श से, भारत के राजपत्र, भाग II , खंड 3, उप- खण्ड (i ) में व्यय विभाग , वित्त मंत्रालय की अधिसूचना सं. 1010 तारीख 20 दिसम्बर, 1988 द्वारा प्रकाशित भारतीय लेखा तथा लेखापरीक्षा विभाग ( वरिष्ठ निजी सहायक ) भर्ती नियमावली , 1988 को अधिक्रांत करते हुए भारतीय लेखापरीक्षा और लेरता विभाग के कार्यालयों में निजी सचिव के पद/पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त नाम भारतीय लेखापरीक्षा और लेखा विभाग ( निजी सचिव ) भर्ती नियम, 2003है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

लागू होना : ये नियम इससे उपाबद्ध अनुसूची के स्तम्भ में विनिर्दिष्ट पद/ पदों को लागू होंगे ।

2. पद संख्या, वर्गीकरण और वेतनमान. उक्त पद/पदों की संख्या, उसका उनका वर्गीकरण और उसका उनके वेतनमान वह होगा वे होंगे, जो इससे इन नियमों से उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु- सीमा और अन्य अर्हताएं आदि उक्त पद/पदों पर भर्ती की पद्धति, आयु-सीमा और अन्य अर्हताएं और उससे उनसे संबंधित अन्य बातें वे होंगी जो पूर्वोक्त/उक्त अनुसूची के स्तम्भ 5 से स्तम्भ 14 में विनिर्दिष्ट हैं ।

4. निरर्हता. वह व्यक्ति,-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा:

परन्तु यदि भारत के नियत्रंक महालेखा परीक्षक का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागूस्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 5. शिथिल करने की शक्ति. जहां भारत के नियत्रंक महालेखा परीक्षक की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबन्ध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति. इन नियमों की कोई बात ऐसे आरक्षण, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, और अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबन्ध करना अपेक्षित है ।

जहां कनिष्ठों ने अपनी अर्हता सेवा या पात्रता सेवा पूरी कर ली हो वहां पदोन्नति के लिए उन पर विचार किया जा रहा है । उनके वरिष्ठों पर भी इस बारे में विचार किया जाएगा बशर्ते उनकी अपेक्षित अर्हता या पात्रता सेवा अवधि के आधे से ज्यादा या दो वर्ष, इनमें से जो भी कम हो , की अवधि से कम न हो तथा उन्होंने अपने कनिष्ठों, जिन्होंने उक्त अर्हता या पात्रता पहले ही पूरी कर ली है, के साथ उन्होंने अगले उच्चतर ग्रेड में पदोन्नति हेतु परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो ।

प्रतिनियुक्ति:- केन्द्रीय सरकार के ऐसे अधिकारी: -

(i ) जो मूल कॉडर या विभाग में नियमित आधार पर सदृश पद धारण किए हुए हैं , या

(ii ) जिन्होंने मूल कॉडर या विभाग में 5500-9000 रु. के या समतुल्य वेतनमान में ऐसे आशुलिपिक श्रेणी- । के रूप में तीन वर्ष सेवा की है , और

(ख ) जिनके पास आशुलिपिक अंग्रेजी/हिन्दी में 100 शब्द प्रति मिनट की गति है ।

[पोषक प्रवर्ग के ऐसे विभागीय अधिकारी, जो प्रोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्तिके लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्तिके लिए विचार किए जाने के पात्र नहीं होंगे । ( प्रतिनियुक्ति/संविदा कीअवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्तिसे ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति संविदा की अवधि है , साधारणतया 3 वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति पर नियुक्ति ( जिसके अंतर्गत अल्पकालिक संविदा भी है ) के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी । ] [भाग II- खण्ड 3 ( i ) ]

G.S.R. 81.-In exercise ofthe powers conferred by clause (5) of article 148 of the Constitution and after consultation with the Comptroller and Auditor- General of India and in supersession of the Indian Audit and Accounts Department (Senior Personal Assistant) Recruitment Rules , 1988 notified in the Gazette of India, Part II , Section 3 , Sub- section ( i ) , in the Ministry of Finance , Department of Expenditure vide GSR 1010 dated 20th December , 1988, the President hereby makes the following rules to regulate the method of recruitment to the post of Private Secretary in the offices of the Indian Audit and Accounts Department , namely:-

1. Short title and commencement .-( 1 ) These rules may be called the Indian Audit and Accounts Department (PrivateSecretary) Recruitment Rules, 2003.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification and scale of pay. The number of said post, its classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed hereto .

3. Method of recruitment, age limit and qualificationsetc. The method of recruitment , age limit , qualifications and other matters relating to the said post, shall be as specified in columns 5 to 14 of the said Schedule .

4. Disqualification : No person ,-

(a) who has entered into or contracted a marriage with a person having a spouse living , or

(b ) who, having a spouse living , has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Comptroller and Auditor - General of India may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation ofthis rule.

5. Power to relax. Where the Comptroller and Auditor - General of India is of the opinion that it is necessary or expedient so to do , he may, by order and for reasons to be recorded in writing and in consultation with the Union Public Service Commission , relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving. Nothing in these rules shall affect reservations , relaxation ofage limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Other Backward Classes , Ex - servicemen and other special categories of persons in accordance with the orders issued by the Government of India from time to time in this regard.

प्रारूप नियम

1. संक्षिप्त नाम और लागूहोना:-

(i ) इन नियमों का संक्षिप्त नाम आम की खटाई और अमचूर श्रेणीकरण और चिह्नांकन नियम, 2003 है;

( ii ) ये आम की खटाई और अमचूर को लागू होंगे;

( iii ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. परिभाषाएं:-

इन नियमों में जब तक कि संदर्भ से अन्यथा अपेक्षित न हो :-

( i ) " कृषि विपणन सलाहकार " से भारत सरकार का कृषि विपणन सलाहकार अभिप्रेत है;

( ii ) " प्राधिकृत पैकर " से ऐसा व्यक्ति या व्यक्तियों का निकाय अभिप्रेत है , जिसे इन नियमों में विनिर्दिष्ट श्रेणी मानक और प्रक्रिया के अनुसार आम की खटाई और अमचूर का श्रेणीकरण और चिह्नांकन करने के लिए प्राधिकार प्रमाणपत्र अनुदत्त किया गया है ;

(iii ) " प्राधिकृत प्रमाण- पत्र" से साधारण श्रेणीकरण और चिह्नांकन नियम 1988 के उपबंधों के अधीन श्रेणी जारी किया गया प्रमाणपत्र अभिप्रेत है, जो किसी व्यक्ति या व्यक्तियों के निकाय को अभिधान चिह्न से आम की खटाई और अमचूर का श्रेणीकरण और चिह्नांकन करने के लिए किसी व्यक्ति या व्यक्तियों के निकाय को प्राधिकृत करता है ;

( iv ) " साधारण श्रेणीकरण और चिह्नांकन नियम " से कृषि उत्पाद ( श्रेणीकरण और चिन्हांकन ) अधिनियम, 1937 ( 1937 का 1 ) की धारा 3 के अधीन बनाए गए साधारण श्रेणीकरण और चिह्नांकन नियम, 1988 ( समय - समय पर यथासंशोधित ) अभिप्रेत है;

(v) " अनुमोदित रसायनज्ञ " से आम की फांकों और अमचूर आदि का एगमार्क श्रेणीकरण , परीक्षण करने के लिए सक्षम प्राधिकारी द्वारा अनुमोदित रसायनज्ञ अभिप्रेत है;

(vi ) " अनुमोदित प्रयोगशाला " से एगमार्क श्रेणीकरण के लिए कच्चे आम की फांकों और अमचूर के परीक्षण के लिए सक्षम प्राधिकारी द्वारा अनुमोदित प्रयोगशाला अभिप्रेत है;

(vii ) " श्रेणी अभिधान चिह्न " से नियम 5 में निर्दिष्ट एगमार्क अधिकार चिह्न अभिप्रेत है ;

(viii) " अनुसूची " से इन नियमों से संलग्न अनुसूची अभिप्रेत है ।

3. श्रेणी अभिधान:-

आम की खटाई और अमचूर की क्वालिटी उपदर्शित करने के लिए श्रेणी अभिधान वह होगा जो अनुसूची 2 और अनुसूची 3 के स्तम्भ 1 मेंदिया गया है ।

4. क्वालिटी की परिभाषा:-

ऐसे श्रेणी अभिधान और साधारण लक्षणों द्वारा उपदर्शित क्वालिटी अनुसूची 2 के स्तंभ 2 से स्तंभ 9 और अनुसूची 3 के स्तंभ 2 से स्तंभ 7 तक में प्रत्येक श्रेणी अभिधान के सामने उपवर्णित प्रकार की होगी ।

5. श्रेणी अभिधान चिह्नः-

श्रेणी अभिधान चिह्न में " एगमार्क अधि चिह्न " होगा जो अनुसूची 1 में दिए गए डिजाइन के सदृश होगा जिसमें प्राधिकरण प्रमाणपत्र संख्यांक, शब्द" एगमार्क ", वस्तु का नाम और श्रेणी अभिधान समाविष्ट होंगे ।

6. पैकिंग की रीति :-

( i ) श्रेणीकृत वस्तु मजबूत , स्वच्छ और सूखे आधानों में पैक की जाएगी जो कागज, कपड़े पोलीपाउचों, जूट के थैलों 200 गेज के उच्च घनत्व वाली पालिथिलीन अस्तरों वाली टिन प्लेटों, कांच की बोतल, प्लास्टिक आधान , पॉलीवोवन या किसी अन्य पैकिंग सामग्री के बने हों, जो क्रेता द्वारा अपेक्षित हो और कृषि विपणन सलाहकार या इस निमित उसके द्वारा प्राधिकृत किसी अन्य अधिकारी द्वारा साधारण श्रेणीकरण चिह्नांकन नियम 1988 के नियम 11 के अनुसार अनुमोदित हों, परंतु यह तब जबकि पैकिंग सामग्री खाद्य अपमिश्रण निवारण नियम, 1955 के अधीन यथा अनुज्ञात खाद्य श्रेणी क्वालिटी की बनी हों;

( ii ) आधान कीटग्रसन, फफूंदी संसूषण और किसी अवांछनीय गंध से मुक्त होगा;

(iii ) एक ही श्रेणी अभिधान और एक ही लाट/बैच की श्रेणीकृत सामग्री वाले उपभोक्ता पैकेटों को उपयुक्त संख्या में एक बड़े आधान में जैसे लकड़ी के मंजुषों, गत्तों के डिब्बों आदि में पैक किया जाएगा;

( iv ) प्रत्येक आधान को, कृषि विपणन सलाहकार द्वारा अनुमोदित रीति से सुरक्षित रूप से बंद किया जाएगा और यथोचित रूप से सीलबंद किया जाएगा;

(v ) आम की खटाई या अमचूर ऐसे आधामों में पैक किया जाएगा जो उत्पाद की स्वास्थ्यकर , पौष्टिक , प्रौद्योगिकीय और इंद्रियग्राह्य , क्वालिटी की सुरक्षा करेंगे;

(vi ) प्रत्येक पैकेज में केवल एक ही श्रेणी अभिधान की आम की खटाई या अमचूर होगा;

(vii ) आम की खटाई या अमचूर समय - समय पर कृषि विपणन सलाहकार द्वारा जारी अनुदेशों के अनुसार पैक आकारों में पैक किए जाएंगे ।

7. चिह्नांकन की पद्धति:-

(i ) श्रेणी अभिधान चिन्ह कृषि विपणन सलाहकार या उसके द्वारा इस 'निमित्त प्राधिकृत किसी अधिकारी द्वारा साधाख्ण श्रेणीकरण और चिन्हांकन नियम 1988 के नियम11 के अनुसारअनुमोदित रीप्ति में सुरक्षित रूप से आम की खटाई और अमचूर के प्रत्येक आधान पर चिपकाया जाएगा या स्पष्ट रूप से और अमिद रूप से मुद्रिप्त 'किया जाएगा।

(ii ) श्रेणी अभिधान चिन्ह के अतिरिक्त प्रत्येक आधान पर निम्नलिखित विशिष्टियां स्पष्ट और अमिट रूप से चिन्हांकित की जाएंगी;

(क ) प्राधिकृत पैकर का नाम और पता;

(ख) पैकिंग का स्थान;

(ग ) पैकिंग की तारीख;

(घ) लॉट/बैच संख्यांक;

(ङ) शुद्ध वजन;

(च) कीमत (सभी करों सहित ) ;

वर्ष से पूर्व सर्वोतम;

(छ) मास

(ज ) खाद्य अपमिश्रण निवारण नियम , 1955 या बाट और माम मानक ( पैक की हुई वस्तु) नियम, 1977 के अधीन कोई अन्य अपेक्षाएं ।

(iii) यह सुनिश्चित करने के लिए उचित सावधानी बरती जाएगी कि चिन्हांकन के लिए प्रयुक्त स्याही उत्पाद को संदूषित न करें ;

(iv ) प्राधिकृत पैकर कृषि विपणन सलाहकार या उसके द्वारा इस मिमिप्त सम्यक् रूप से प्राधिकृत किसी अन्य अधिकारी से पूर्व अनुमोदन अभिप्राप्त करने के पश्चात् , साधारण श्रेणीकरण और चिन्हांकन नियम 1988 के नियम 11 के अनुसार श्रेणीकृत पैकेजों पर अपना प्राइवेट व्यापार चिन्ह या व्यापार ब्रांड लेबल चिपकाएगा , परंतु इससे श्रेणीकृत पैकेजों पर चिपकाए गए श्रेणी अभिधान चिह्न सेभिन्न वस्तुकी क्वालिटी या श्रेणी उपदर्शित नही हो।

8. प्राधिकरण प्रमाण पत्र अनुदत करने के लिए विशेष शर्तें:-

साधारण श्रेणीकरण और चिन्हांकन नियम , 1988 के नियम 3 के उपनियम ( 8 ) में विनिर्दिष्ट साधारण शर्तों के अतिरिक्त आम की खटाई और अमचूर के श्रेणीकरण और चिन्हांकन के लिए प्राधिकरण प्रमाण पत्र अनुदत्त करने के लिए निम्नलिखित अतिरिक्त शर्तें होंगी :-

( i ) प्राधिकृत पैकर आम की खटाई और अमचूर की क्वालिटी के परीक्षण के लिए कृषि विपणन सलाहकार द्वारा या उसके द्वारा प्राधिकृत किसी अधिकारी द्वारा अनुमोदित अर्हित रसायनज्ञ द्वारा साधारण श्रेणीकरण और चिन्हांकन नियम, 1988 के नियम 9 के - अनुसार चलाई जाने वाली अपनी प्रयोगशाला स्थापित करेगा या राज्य श्रेणीकरण प्रयोगशाला में या इस प्रयोजन के लिए अनुमोदित प्राइवेट वाणिज्यिक प्रयोगशाला में पहुँच रखेगा;

( ii ) प्रसंस्करण , प्रेषण और पैकिंग के लिए परिसर को पूर्णतया स्वास्थ्यप्रद , स्वच्छ दशाओं में उश्वित्त हवादार और सही प्रकाशमय व्यवस्थाके साथ रखेगा;

(iii ) इन संक्रियाओं में लगे कार्मिकों का अच्छा स्वास्थ्य होगा और वे किसी संक्रामक, संचारी और सांसर्गिक रोगों से मुक्त होंगे;

( iv ) नमूने लेने, अन्वेषण करने, सीलबंद करने, पैकेजों पर चिन्हांकन करने, अभिलेख का रखरखाव और विवरणी आदि को प्रस्तुत करने की पद्धति से संबंधित ऐसे सभी अनुदेशों का जो कृषि विपणन सलाहकार या उसके द्वारा सम्यक् रूप से प्राधिकृत किसी अन्य अधिकारी द्वारा समय- समय पर जारी किए जाएं, प्राधिकृत पैकर और अनुमोदित रसायनज्ञ द्वारा कठोरता से अनुपालन किया जाएगा ;

( v ) परिसर में पक्के फर्श के साथ पर्याप्त भंडारण सुविधाएं होंगी और वे कृन्तक और कीटग्रसन से मुक्त होंगे । 438

( 1 ) बाह्य पदार्थ:-

( i ) अकार्बनिक बाह्य पदार्थ में धात्विक टुकड़े, बालू, मिट्टी कण , धूल , पत्थर, मिट्टी के कण , चिकनी मिट्टी और कीचड़ समाविष्ट होगा ।

(ii ) कार्बनिक बाह्य पदार्थ जैसे भूसी, डंठल और तिनका ।

(2) 15 मि.मी. से कम लंबी फांक:-15 मि.मी. से कम लंबी फांकों को फांक के एक कोने से दूसरे कोने तक मापा जाएगा । (3 ) बीज आवरण- बीज आवरण बीज का बाहरी आवरण होगा ।

साधारण लक्षण

आम की खटाई

(1) बाहरी छिलके के साथ या उसके बिना कच्चे आम के फल को पूर्ण रूप से या उसके खाद्य भाग को सुखाया जाएगा।

( 2) उचित रूप से सुखाया जाएगा, फफूंदी, कीट ग्रसन , कृन्तक संदूषण , जीवित या मृत कीटों, मिलाए गए रंजक पदार्थों, वासक द्रष्यों, क्षयकारी पदार्थों और ऐसे नुकसानदायक पदार्थ से मुक्त होगा जो स्वास्थ्य के लिए हानिकारक है ।

( 3) इसमें खाद्य सामान्य नमक, जिसे शुष्क रूप में भार के अनुसार 5 प्रतिशत की सीमा तक मिलाया जा सकेगा , के सिवाय कोई परिरक्षी नहींहोगा ।

(4) स्वाद तथा वासक लक्षणों से युक्त होगी ।

(5) यह विषैली धातुओं ( नियम -57 ) प्राकृतिक रूप से होने वाले विषैले पदार्थों ( नियम 57 - ख ) कीटनाशी /नाशक जीव मार अवशिष्ट (नियम- 65 ) की सीमा और ऐसी किन्ही अन्य अपेक्षाओं के , जो समय - समय पर यथासंशोधित खाद्य अपमिश्रण निवारण नियम 1955 के आदेशात्मक उपबंधों के अधीन अधिकथित की जाएं, अनुरूप होगा ।

(6) 30 माइक्रोग्राम प्रति किलोग्राम से अधिक अफलाटॉक्सिन नहीं होगा ।

धूप में सुखाए गए कच्चे आम का चूर्ण ( अमचूर) :

(1) कच्चे आभ की स्वच्छ और शुष्क फांकों के पोषण द्वारा अभिप्राप्त चूर्ण होगा जो स्वाद और वासक के लक्षणों से युक्त होगा । (2) बासी गंध अरुचिकर वासक, कृन्तक संदूषण, फफूंदी और कीट ग्रसन, बाह्य पदार्थ और मिलाए गए रंजक और वासक पदार्थ से मुक्तहोगा ।

( 3) मिलाए गए स्टार्च , क्षयकारी पदार्थों तथा ऐसे किसी अन्य नुकसानदायक पदार्थ से मुक्त होगा जो स्वास्थ्यके लिए हानिकारक है । 351 G1/2003-5 440

(4 ) स्थूल कणों से मुक्त होगा और सामग्री का 97 प्रतिशत 500 आई ०एस ० माइक्रोन छलनी से निकाला जाएगा ।

( 5 ) इसमें खाद्य सामान्य नमक जिसे शुष्क रूप में भार के अनुसार 5 प्रतिशत की सीमा तक मिलाया जा सकेगा, के सिवाय कोई परिरक्षी नहीं होगा ।

G.S.R. 82. The following draft of Sundried Raw Mango Slices and Powder Grading and Marking Rules , 2003 which the Central Government proposes to make , in exercise of the powers conferred by Section 3 of the Agricultural Produce ( Grading and Marking) Act, 1937 (4 of 1937 ) and in supersession of Sundried Raw Mango Slices and PowderGrading and Marking Rules , 1981 , except as respects ofthings done or omitted to be done before such supersession , are hereby published , as required by the said Section , for information of all persons likely to be affected thereby and notice is hereby given that said draft rules shall be taken into consideration after the expiry of a period of forty - five days from the date on which the copies of the Gazette of India containing this notification are made available to the public;

Any person desirous of making any suggestion or objection in respect of the said draft rules may forward the same for consideration of the Central Government within the period so specified to the Agriculture Marketing Adviser to the Government of India , Directorate of Marketing and Inspection , Head Office , New C.G.O. Building , N.H. IV , Faridabad - 121001 (Haryana ) .

DRAFT RULES

1. Short title and application :

(i ) These rules may be called Sundried Raw Mango Slices and Powder Grading and Marking Rules , 2003 ;

(ii ) They shall apply to Sundried Raw Mango Slices and Powder;

(iii) They shall come into force on the date of their final publication in the Official Gazette .

2. Definitions :

In these rules , unless the context otherwise requires :-

(i) " Agricultural Marketing Adviser " means the Agricultural Marketing Adviser to the Government of India;

(ii) " Authorised packer " ineans a person or a body of persons who has been granted a certificate of authorisation to grade and mark the Sundried Raw Mango Slices and Powder in accordance with the grade standards and procedure specified in these rules ;

(iii) " Certificate of Authorisation " means a certificate issued under the provisions of the General Grading and Marking Rules , 1988 authorising a person or a body of persons to grade and mark Sundried Raw Mango Slices and Powder with the grade designations mark;

(iv) " General Grading and Marking Rules" means the General Grading and Marking Rules , 1988 (as amended from time totime) made under Section 3 of the Agriculture Produce (Grading and Marking) Act, 1937 ( 1 of 1937);

(v) "Approved Chemist" means chemist approved by the competent authority to undertake Agmark grading, testing of the Mango Slices and Powder etc .;

(vi) "Approved Laboratory " means laboratory approved by the competent authority for testing of Raw Mango Slices and Powder for Agmark grading;

(vii ) " Grade designation mark " means the Agmark insignia referred to in Rule-5;

(viii ) " Schedule " means schedules appended to these rules.

3. Grade designation :

The grade designation to indicate the quality of Sundried Raw Mango Slices and Powder shall be as setout in Column 1 of Schedule II and III .

4. Definition of Quality :

The quality indicated by such grade designations and general characteristics shall be as set out against each grade designation in column 2 to 9 of Schedule II and 2 to 7 of the Schedule III .

5. Gradedesignation mark:-

The grade designation marks shall consist of " AGMARK INSIGNIA " consisting of the design incorporating the certificate of authorisation number , the word " AGMARK " , name of the commodity and grade designation resembling the design as setout in Schedule 1 .

6.Method ofpacking :

(i ) The graded article shall be packed in sound , clean and dry containers made of paper, Cloth , poly pouches , jutebags, tin plates with inner lining of 200 guage high density polyethylene , glass bottle, plastic container , ploywovenor any other packing material as may be required by the buyer and approved by the Agricultural Marketing Adviser or any officer authorised by him in this behalf as per rule 11 of the General Grading and Marking Rules , 1988 provided that the packing material is made of food grade quality as permitted under Prevention of Food Adulteration Rules , 1955;

(ii) The container shall be free from any insect infestation , fungus contamination and free from any undesirable smell ;

(iii) Suitable number of consumer packets containing graded material of the same grade designation and from the same lot/batch may be packed in a master container such as wooden cases, card board cartons etc .;

(iv) Each container shall be securely closed and suitably sealed in the manner approved by the Agricultural Marketing Adviser ;

(v) Sundried Raw Mango slices or Powder shall be packed in containers which will safeguard the hygienic , nutritional , technological and organoleptic qualities of the product .

(vi ) Each package shall contain raw mango slices or powder of one grade designation only .

(vii) The Sundried Raw Mango Slices or Powder shall be packed in the pack sizes as per instructions of Agricultural Marketing Adviser issued from time to tiine .

7. Method of Marking:

(i ) A grade designation mark shall be securely affixed to or clearly and indelibly printed on each container , Sundrei draw Mango Slices and Powder , in a manner approved by the Agricultural Marketing Adviser or an officer authorised by him in this behalf in accordance with rule 11 of the General Grading and warking Rules, 1988;

(ii) In addition to the grade designation mark , the following particulars shall also be clearly and indelibly marked on each container:-

(a) Name and address of the authorised packer ,

(b) Place ofpacking,

(e) Net weight ,

(f) Price ( inclusive ofall taxes) ,

(g) Best before within -month and year,

(h) Any other requirements given under the Prevention of Food Adulteration Rules , 1955 or the Standards of Weight and Measures (Packaged Commodities ) Rules , 1977.

(iii) Proper care shall be taken to ensure that the ink used for marking does not contaminate the product;

( iv) The authorised packer may, after obtaining prior approval of the Agricultural Marketing Adviser or any other officer duly authorised by him in this behalf, in accordance with rule 11 of the General Grading and Marking Rules , 1988, affix his private trade - mark or trade brand label on the graded package , provided that the same does not indicate quality or grade of the commodity different from the grade designation mark affixed to the graded packages .

8. Special conditions for grant of Certificate of Authorisation:-

In addition to the general conditions specified in sub-rule (8) of rule 3 of the General Grading and Marking Rules, 1988 the following shall be additional conditions for grant of certificate of authorisation for Grading and Marking of Sundried Raw Mango Slices and Powder: --

(i) The authorised packer shall either set up their own laboratory manned by a qualified chemist approved by the Agricultural Marketing Adviser or any officer authorised by him in this behalf in accordance with rule 9 of the General Grading and Marking Rules , 1988 for testing the quality of Sundried Raw Mango Slices and Powder or have access to the State Grading Laboratory or private commercial laboratory approved for the purpose .

(ii) The premises for processing , grinding and packing shall be maintained in perfect hygienic , sanitary conditions with proper ventilation and well - lighted arrangement .

(iii) The personnel engaged in these operations shall be in sound health and free from any infectious , communicable and contagious diseases .

(iv) All instructions regarding the method of sampling , analysis , sealing , marking of packages , maintenance of records and submission of returnsetc. Which may be issued from time to time by the Agricultural Marketing Adviser or any other officer duly authorised by him , shall be strictly observed by the authorised packer and the approved chemist .

(v) The premises shall have adequate storage facilities with Pucca floor and free froin rodent and insect infestation.

Explanation:-

(1) Extraneous matter-

(1) Inorganic Extraneous matter consisting of metallic pieces , sand , gravel dirt , stone , lumps ofearth, clay and mud.

(ii) Organic extraneous matter such as chaff, stem and straw.

(2) Slices below 15 mm-Slices below 15mm in length shall be measured from one end to the other end of the slice.

(3) Seed coating-Seed coating shall be exterior covering of the seed.

(4) Damaged and dicoloured slice- means the slices that are eaten by weevils or other insects and including slices internally damaged by fungus , moisture or heating.

General Characteristics

Sundried rawMango Slices (Khatai ) shall-

(1) Be dried wholesome , edible part of raw mango fruit with or without the outer skin ,

(2) Be reasonably dried, free from fungus , insect infestation, rodent contamination , living and dead insects , added colouring matter , flavouring matter deleterious substance and any other harmful substance which are injurious to health,

(3) Not contain any preservative except edible common salt which may be added to the extent of5 % by weight on dry basis ,

Have characteristic taste and flavour, (4)

Conform to the limit for poisonous metals ( rule - 57 ) naturally occuring toxic substances (rule 57 -B ) insecticides/ pesticides reside (rule -65 ), and any other requirements as laid down under the mandatory provisions ofthe Prevention (5) ofFood Adulteration Rules, 1955 as amended from time to time,

General Characteristics

Sundried raw Mango powder ( Amchur) Shall;

( 1 ) Be the powder obtained by grinding clean and dried raw mango slices having characteristics taste & flavour.

(2) Be free from musty odour , objectionable flavour , rodent , contamination, fungus & insect infestation , extraneous matter , added colouring and flavouring matter .

(3 ) Be free from added starch , deleterious substance and any other harmful substance which are injurious to health.

(4) Be free from coarse particles and 97 per cent of the material shall pass through 500IS Micron sieve.

(5) Not contain any preservative except edible common salt which maybe added to the extent of 5 % by weight on dry basis.

(6) Not have aflatoxin more than 30 microgram/kg .

(7) Conform to the limit for Poisonous metals ( rule - 57 ), Pesticides and Insectisides residue ( rule-65 ) , naturally occuring toxic substances ( rule- 57 - B ) and any other requirements as laid down under the mandatory provisions of the Prevention ofFood Adulteration Rules , 1955 as amended from time to time .

सा. का. नि. 83.-गेहूं श्रेणीकरण और चिष्मांकन नियम, 2003 का निम्नलिखित प्रारूप, जिसे केन्द्रीय सरकार , कृषि उपज ( श्रेणीकरण और चिह्नांकन ) अधिनियम, 1937 ( 1937 का 1 ) की धारा 3 द्वारा प्रदत्त शक्लियों का प्रयोग करते हुए, अनाज श्रेणीकरण नियम, 1966 को उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने से लोप किया गया है , बनाना चाहती है, उक्त धारा की अपेक्षानुसार ऐसे सभी व्यक्तियों की जानकारी के लिए, जिनके उससे प्रभावित्त होने की संभावना है, प्रकाशित किया जाता हैं और यह सूचना दी जाती है कि उक्त प्रारूप नियमों पर उस तारीख से जिसको उस राजपत्र, जिसमें यह अधिसूचना अंतर्विष्ट है, की प्रतियां जनता को उपलब्ध करा दी जाती हैं, पैंतालीस दिन की अवधि की समाप्ति के पश्चात् विचार किया जाएगा;

ऐसा कोई व्यक्ति , जो उक्त प्रारूपः नियमों के संबंध में कोई सुझाव देना चाहता है, उन्हें वह ऐसी विनिर्दिष्ट अवधि के भीतर कृषिविपणन सलाहकार, भारत सरकार, विपणन और निरीक्षण निदेशालय , नई दिल्ली , सी.जी.ओ. काम्पलेक्स, एनएच-IV, फरीदाबाद, हरियाणा 121007 को विचार करने के लिए भेज सकेगा ।

प्रारूपनियम

1. संक्षिप्त नाम, लागू होना और प्रारम्भ. ( i ) इन नियमों का संक्षिप्त नाम गेहूं श्रेणीकरण और चिह्नांकन नियम, 2003 है । ( ii ) ये गेहूं (ट्रिटीकम वल्गारे विल और ट्रिटीकम डूरम डेस्फ ) को लागू होंगे ।

( iii ) ये राजपत्र में इसके प्रकाशन की तारीख से प्रवृत्त होंगे ।

2. परिभाषाएं. इन नियमों में जब तक कि संदर्भ से अन्यथा अपेक्षित न हो,-

(i ) " कृषि विपणन सलाहकार " से भारत सरकार का कृषिः विपणन सलाहकार अभिप्रेत है;

(ii) " प्राधिकृत पैकर " से ऐसा व्यधित या व्यक्तियों का निधाय अभिप्रेत हैं जिसे इन नियमों में विहित श्रेणी मानकों और प्रक्रिया के अनुसार गेहूं का श्रेणीकरण और उन्हें विश्नांकन करने के लिए प्राधिकार प्रमाणपत्र अनुदत्त किया गया है;

( iii ) " प्राधिकार प्रमाणपत्र" से किसी व्यषित या व्यक्तियों के विस्सी निवमय को, गेहूं का श्रेणीकरण करने और उस पर श्रेणी अभिधान चिह्न लगाने के लिए प्राधिकृत करते हुए साधारण श्रेणीकरण और चिल्लांकन नियम , 1988 के उपबंधों के अधीन जारी किया गया कोई प्रमाणपत्र अभिप्रेत हैं;

( iv) " साधारण श्रेणीकरण और चिह्नांकन नियम " से कृषि उपज ( श्रेणीकरण और चिश्नांकन ) अधिनियम, 1937 (1937 का 1 ) की धारा 3 के अधीन बनाए गए साधारण श्रेणीकारण और चिह्नांकन नियम, 1988 अभिप्रेत है;

(v) " श्रेणी अभिधान चिह्न " से नियम 5 में निर्दिष्ट एगमार्क अधिकार चिह्न अभिप्रेत है;

(vi ) " अनुसूची" से इन नियमों से संलग्न अनुसूची अभिप्रेत है;

(vii ) " विजातीय पदार्थ ( कार्बनिक ) " से शल्क, तना, तृण , जहरीले और अन्य बीज तथा अन्य कार्बनिक अशुद्धियां अभिप्रेत हैं;

(viii ) " विजातीय पदार्थ ( अकार्बनिक ) " से धूल , पत्थर, मिट्टी के ढेले , धातु के टुकड़े , बालू, कंकड़, गंदगी, चिकनी मिट्टी और पंक, पशु मल और अन्य अकार्बनिक उद्भूत अशुद्धियां अभिप्रेत हैं;

(ix ) " अन्य खाद्यान्न " से गेहूं से भिन्न खाद्यान्न अभिप्रेत है;

(x) " क्षतिग्रस्त दाने " से ऐसे दाने अभिप्रेत हैं जो अंकुरित हो गए हैं या गर्मी, जीवाणु, आर्द्रता या मौसम के परिणामस्वरूप आन्तरिक रूप से क्षतिग्रस्त हो गए हैं जिनके अंतर्गत अर्गट प्रभावित दाने और भीगी कृष्णिका युक्त दाने या क्वालिटी को प्रभावित करने वाले रंगहीन पदार्थ;

(xi) " अपरिपक्व सिकुड़े हुए और टूटे हुए दाने " से वे दाने, जो समुचित रूप से विकसित नहीं हुए हैं या साबुत दानों के सिकुड़े अभिप्रेत है;

(xii ) " घुने हुए दाने " से ऐसे दाने अभिप्रेत हैं जो घुन या अन्य कीटों द्वारा आंशिक रूप से या पूर्ण रूप से छिद्रित कर दिए गए हैं या खाए गए हैं ;

(xiii ) " अन्य गेहूं" से गेहूं की अन्य मिश्रित प्रजाति अभिप्रेत है । 446

[PART 11-SEC . 3 (i ) ] 3. श्रेणी अभिधान.-इन नियमों के प्रयोजन के लिए श्रेणी अभिधान उन श्रेणियों के नाम होंगे जो अनुसूची 2 के स्तम्भ 1 के अधीन दी गई गेहूं की क्वालिटी को उपदर्शित करते हैं ।

4. क्वालिटी की परिभाषा.-इन नियमों के प्रयोजन के लिए, क्वालिटी की परिभाषा वह होगी जो अनुसूची 2 के स्तम्भ 2 से 11 में प्रत्येक श्रेणी अभिधान के सामने दी गई है ।

5. श्रेणी अभिधान चिह्न. श्रेणी अभिधान चिह्न " एगमार्क प्रतीक " से बनेगा जिसमें प्राधिकार प्रमाण- पत्र संख्या " एगमार्क " शब्द, वस्तुका नाम और श्रेणी अभिधान सहित डिजाइन होगी और जो अनुसूची 1 में उपवर्णित चिह्न के सदृश होगा।

6. पैक करने का ढंग.-( i ) गेहूं को ऐसे पटसन के बैगों, पोलि - युतित बैगों, पोलिथिलीन से निर्मित बैगों, पोलि पाउचों या अन्य उपयुक्त ऐसी पैकेजों में, जो स्वच्छ, मजबूत , कीटों/फफूंदी के आकीर्णन से मुक्त हों या अन्य खाद्य श्रेणी की प्लास्टिक/पैकिंग सामग्रियों में पैक किया जाएगा ;

( ii ) पैकेज में गेहूं का कुल भार, समय - समय पर संशोधित बाट और माप मानक (पैक वस्तुएं ) नियम, 1977 के उपबंधों के अनुसार होगा;

( iii ) प्रत्येक पैकेज में एक ही किस्म की और एक ही श्रेणी अभिधान के गेहूं होंगे ;

( iv ) प्रत्येक पैकेज सुरक्षित रूप से बंद और उपयुक्त रूप से मुहरबंद किया जाएगा ;

(v ) उपर्युक्त गेहूं के अतिरिक्त निम्नलिखित होंगे-

( i ) ट्रिटीकम वल्गर प्रजाति निम्नलिखित तीन रंग के समूहों में पैक की जाएंगी , अर्थात्: -

(क) सफेद

(ख) अम्बर

(ग) लाल ।

( ii ) ट्रिटीकम डूरम प्रजाति निम्नलिखित दो रंग के समूहों में पैक की जाएंगी, अर्थात्:-

(क) अम्बर

(ख) लाल।

7. चिह्नांकन का ढंग.-( i ) श्रेणी अभिधान चिह्न प्रत्येक पैकेज पर कृषि विपणन सलाहकार या इस निमित्त उसके द्वारा प्राधिकृत किसी अधिकारी द्वारा अनुमोदित रीति में साधारण श्रेणीकरण और चिह्नांकन नियम, 1988 के नियम 11 के अनुसार सुरक्षित रूप से चिपकाया जाएगा या मुद्रित किया जाएगा;

( ii ) श्रेणी अभिधान चिह्न के अतिरिक्त प्रत्येक लेबल या पैकेज पर निम्नलिखित विशिष्टियां स्पष्टतः और अमिट रूप में चिह्नांकित की जाएंगी:-

(क) उत्पादक देश का नाम;

(ख) विनिर्माता/प्राधिकृत पैकर का नाम और पता;

(ग) पैक किए जाने का स्थान;

( घ ) पैक किए जाने की तारीख; *

(ङ) मास वर्ष से पूर्व उत्कृष्ट;

( च) लाट/बैच संख्या;

(छ) कुल वजन;

(ज) श्रेणी;

( झ ) अधिकतम खुदरा कीमत, सभी करों सहित ( केवल घरेलू विपणन के लिए ) ;

*पैक करने की तारीख वह तारीख होगी जिसको नमूनों का विश्लेषण पूरा होता है ।

( iii ) पैकेजों पर चिह्ननांकन के लिए प्रयुक्त स्याही ऐसी क्वालिटी की होगी जो उत्पाद को संदूषित न करे;

(iv ) प्राधिकृत पैकर, कृषि विपणन सलाहकार या इस निमित्त उसके द्वारा प्राधिकृत किसी अधिकारी का पूर्व अनुमोदन अभिप्राप्त करने के पश्चात्, श्रेणीकृत पैकेजों पर अपना निजी व्यापार चिह्न या व्यापार ब्रांड चिह्नांकित करेगा । परन्तु वह इन नियमों के अनुसार पैकजों परलगाए गए श्रेणी अभिधान चिह्न द्वारा उपदर्शित से भिन्न क्वालिटी या श्रेणी उपदर्शित न करता हो ।

8. प्राधिकार प्रमाणपत्र अनुदत्त करने के लिए विशेष शर्तें. साधारण श्रेणीकरण और चिह्नांकन नियम, 1988 के नियम 3 के उपनियम (8 ) मेंविनिर्दिष्ट शर्तों के अतिरिक्त निम्नलिखित शर्तें इन नियमों के अधीन गेहूंके श्रेणीकरण और चिह्नांकन के लिए प्राधिकार प्रमाणपत्र अनुदत्त करने की अतिरिक्त शर्तें होंगी, अर्थात्: -

(i ) प्राधिकृत पैकर, गेहूं की क्वालिटी के परीक्षण के लिए कृषि विपणन सलाहकार अथवा उसके द्वारा इस निमित्त प्राधिकृत किसी अधिकारी द्वारा अनुमोदित किसी अर्हित रसायनज्ञ द्वारा साक्षित या तो स्वयं की प्रयोगशाला की स्थापना करेगा या इस प्रयोजन के लिए अनुमोदित किसी प्रयोगशाला तक पहुंच रखेगा;

( ii ) परिसर पूर्ण स्वास्थ्य कारक और स्वच्छता की दशाओं में होंगे और इन संक्रियाओं में लगे कार्मिकों का अच्छा स्वास्थ्यहोगा और वे किसी संक्रामक या संचारी रोग से मुक्त होंगे;

( iii ) प्राधिकृत पैकर और अनुमोदित रसायनज्ञ परीक्षण, श्रेणीकरण, पैकिंग , चिह्नांकन , मुद्रांकन और अभिलेखों के अनुरक्षण केके संबंध में ऐसे सभी अनुदेशों का पालन करेगा जो समय- समय पर कृषि विपणन सलाहकार इस निमित्त भारत सरकार द्वारा जारी किएजाएं ।

सामान्य अपेक्षाएं

गेहूं:-

(क) ट्रिटीकम वल्गारे विल और ट्रिटीकम डूरम डेस्फ के सूखे और परिपक्व बीज होंगे ।

(ख ) दुरुस्त आकार , बनावट, रंग में एक से और ठोस विपण्य स्थिति में होंगे ।

(ग ) मीठे , साफ, दुरुस्त और मल, कृन्तक चिकुर और उत्सर्ग , फफूंदी, जीवित कीटों, हानिकारक जीवाणुओं, फफूंदी, वेब, पैरासाइट्स, दुर्गन्ध, बदरंग और अन्य सभी अशुद्धियों से उस सीमा के सिवाय मुक्त होंगे , जैसा कि अनुसूची में वर्णित है ।

(घ) मिलाई गई रंग सामग्री से मुक्त होंगे ।

(ङ) मूत्राम्ल प्रतिकिलोग्राम 100 मिलीग्राम से अधिक नहीं होगा ।

(च) एफलाटोक्सिन प्रतिकिलोग्राम 30 माइक्रोग्राम से अधिक नहीं होगा ।

(छ) विषाक्त या अनिष्ठ कर बीजों की मात्रा जो मानव स्वास्थ्य को क्षति पहुंचाने वाली हों, जैसे कि क्रोटोलेरिया ( क्रोटोलेरिया स्प. ) , दाना घोघा ( एग्रोस्टेमो गिथागो एल. ) एरण्ड फली ( रिसिनस कम्यूनिस एल. ) धतूरा ( धतूरा स्प. ) , अकरा ( विसिआ प्रजाति ) और ऐसे अन्य बीजों से, जिन्हें सामान्यतः स्वास्थ्य के लिए हानिकर रूप में मान्यता दी जाती है, मुक्त होंगे ।

(ज) भीगी कृष्णिकायुक्त दाने अर्गट प्रभावित दाने जो भार में क्रमशः 3.0 प्रतिशत और 0.05 प्रतिशत से अधिक नहीं होंगे । (झ) डिआक्सीनीवालियोन ( डीओएन ) प्रतिकिलोग्राम 1000 माइक्रोग्राम से अधिक नहीं होगा ।

(ञ) प्राकृतिक रूप से आने वाले विषैले पदार्थों ( नियम 57 - ख ) , जहरीली धातुओं ( नियम 57 ) , कीटनाशी और नाशक जीमार अवशिष्ट (नियम 65 ) के संबंध में समय - समय पर यथासंशोधित अपमिश्रण निवारण नियम , 1955 के अधीन यथा अधिकथित निर्बंधनों का पालन करेंगे ।

कुल विजातीय पदार्थ, अन्य खाद्यान्न और क्षतिग्रस्त दाने भार के 12 प्रतिशत से अधिक नहीं होंगे ।

G. S. R. 83. The following draft of the Wheat Grading and Marking Rules , 2003 which the Central Government proposes to make , in exercise of the powers conferred by Section 3 of the Agricultural Produce ( Grading and Marking ) Act , 1937 ( 1 of 1937 ) , in supersession of Cereals Grading Rules , 1966 except as things done or omitted to have been done , is hereby published as required by the said section for information of all persons likely to be affected thereby, and notice is hereby given that the said draft rules shall be taken into consideration after expiry of forty five days from the date on which the copies of the Gazette containing this notification are made available to the public;

Any person desirous of making any suggestion or objection in respect of the said draft rules , may forward the same within the period so specified to the Agricultural Marketing Adviser to the Government of India , Directorate of Marketing and Inspection , New C.G.O. Complex , N.H. IV, Faridabad, ( Haryana)- 121001 for consideration.

DRAFT RULES

1. Short title, application and Commencement.-

(i ) These rules may be called the Wheat Grading and Marking Rules , 2003 .

(ii) They shalll apply to Wheat ( Triticum vulgare will and Triticum durum Desf. )

(iii) They shall come into force from the date of their publication in the Official Gazette .

2. Definitions.- In these rules , unless , the context otherwise requires: -

(i ) " Agicultural Marketing Adviser " means the Agricultural Marketing Adviser to the Government of India;

(ii) " Authorised Packer " means a person or a body of persons who has been granted a certificate of authorisation to grade and mark Wheat in accordance with the grade standards and procedure prescribed under these rules ;

(iii) "Certificate of Authorisation " means a certificate issued under the provisions of the General Grading and Marking Rules , 1988 authorising a person or a body of persons to grade and mark Wheat with grade designation marks;

(iv) "General Grading and Marking Rules " mean the General Grading and Marking Rules , 1988 made under Section 3 ofthe Agricultural Produce ( Grading and Marking ) Act, 1937 (1 of 1937) ;

(v) "Grade designation mark " means the Agmark insignia as referred to in rule 5;

(vi) "Schedule " means a Schedule appended to these rules;

(vii ) " Foreign matter (Organic ) " means chaff, stem , straw , poisonous and other seeds and other impurities of organic origin ;

(viii) "Foreign matter ( inorganic ) " means dust , stones , lumps of earth , metallic pieces , sand , gravel , dirt , clay and mud , animal filth and other impurities of inorganic origin ;

( ix) "Other edible grains " mean edible grains other than Wheat ;

(x) "Damaged grains " mean grains that are sprouted or internally damaged as a result of heat , microbe, moisture or weather including ergot affected grains and karnal bunt grains or discoloured materially affecting the quality; (xi) " Immature , shrivelled and broken grains " mean grains which are not properly developed or are pieces of whole grains;

(xii) "Weevilled grains " mean grains that are partially or wholly bored or eaten by weevil or other grain insects ; xiii) " Other Wheat " means mixture of other species ofwheat .

( 3. Grade designations :- For the purpose of these rules the grade designations shall be the names of the grades which indicate the quality of wheat as given under Column 1 of Schedule - II .

4. Definition of quality :-For the purpose of these rules the definition of quality shall be such as given against each grade designation from Columns 2 to 11 of Schedule - II .

5. Grade designation mark:-The grade designation mark shall consist of " AGMARK insignia " consisting of a design incorporating the number of certificate of authorisation , the word " AGMARK " , name of the Cominodity and grade designation , resembling the design as set out in Schedule- 1 .

6. Method of packing :-

(i) Wheat shall be packed in jute bags, polywoven bags , perforated polyethlene bags , poly pouches or other suitable packages which shall be clean , sound and free from insect / fungal infection and in other food grade plastic/packaging materials ;

(ii) The net weight of wheat in a package shall be as per provisions of the Standards of Weights and Measures (Packaged Commodities ) Rules , 1977 as amended from time to time;

(iii) Each package shall contain wheat of the same type and of the same grade:

(iv) Each package shall be securely closed and suitably sealed;

(v) In addition to the above the wheat :-

(i) Triticum vulgare species shall be packed under three colour groups, namely:

7.Method ofMarking:-

(i) The grade designation mark shall be securely affixed to or printed on each package in a manner approvedby the Agricultural Marketing Adviser or an officer authorised by him in this behalf in accordance with rule 1l ofthe General Grading and Marking Rules , 1988 .

e (ii) In addition to the grade designation mark , following particulars shall be clearly and indelibly marked on each label or package:-

( a) Name of the producing country :

(b) Name and address of manufacturer/authorised packer;

( d) Date of packing ; *

( e) Bestbefore

upto month and year ;

( f) Lot/batch number;

(g) Net weight;

(h ) Grade;

(i ) Maximum retail price inclusive of all taxes (only for domestic market ) ; *Date of packing shall be the date of completion of analysis of the samples .

(iii) The ink used for marking shall be of such quality which may not contaminate the product ;

(iv) An authorised packer may , after obtaining prior approval of the Agricultural Marketing Adviser or an officer authorised by him in this behalf, mark his private trade mark or trade brand on the graded packages provided that the same does not indicate quality or grade other than that indicated by the grade designation mark affixed to the graded packages in accordance with these rules .

8. Special conditions for grant of Certificate of Authorisation :-In addition to the conditions specified in Sub- rule ( 8) of Rule 3 of the General Grading and Marking Rules , 1988 , the following shall be the additional conditions for grant of certificate of authorisation for grading and Marking Wheat under these rules , namely :---

(i) The authorised packer shall either set up his own laboratory manned by a qualified chemist, approved by the Agricultural Marketing Adviser or an officer authorised by him in this behalf for testing the quality of Wheat or has an access to any approved laboratory for the purpose :

(ii) The premises shall be maintained in clean and hygienic conditions and all the operatives shall be in sound health and free from any contagious or communicable disease :

( iii) The authorised packer and approved chemist shall observe all instructions regarding testing , grading . packing, marking , sealing and maintenance of recards which may be issued by the Agricultural Marketing Adviserto the Government of India from time to time .

(h) Karnal bunt affected grains and ergot affected grains shall not exceed 3.0 per cent and 0.05 per cent by weight , respectively .

(i) Deoxynivalenol ( DON) shall not exceed 1000 micrograms per kg.

(j ) Shall comply with the restrictions in regards to naturally occuring toxis substances ( Rule 57- B ) , Poisonous metals ( Rule 57) , Insecticides and Pesticides residue ( Rule 65) as laid down under Prevention of Food Adulternation Rules , 1955 as amended from time to time .

Total of foregin matter , other edible grains and damaged grains shall not exceed 12 per cent by weight.

सा. का. नि. 84.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और केन्द्रीय मत्स्य नौचालन एवं इंजीनियरी प्रशिक्षण संस्थान ( स्किपर ) भर्ती नियम, 1987 को, सिवाय उन बातों के जो ऐसे अधिक्रमण से पूर्व की गई हैं या करने से रह गई हैं , अधिक्रांत करते हुए केन्द्रीय मत्स्य नौचालन एवं इंजीनियरी प्रशिक्षण संस्थान, कोचीन , पशु पालन और दुग्ध उद्योग विभाग में स्किपर के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्: -

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम केन्द्रीय मत्स्य नौचालन एवं इंजीनियरी प्रशिक्षण संस्थान , कोचीन स्किपर ( समूह ' ख ' पद ) भर्ती नियम, 2003 है ।

(2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण और वेतनमान - उक्त पद की संख्या, उसका वर्गीकरण और उसके वेतनमान वे होगें, जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ (2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु- सीमा और अन्य अर्हताएं आदि . उक्त पद पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता.- वह व्यक्ति, -

(i ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित हैं, विवाह किया है , या

( ii ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधिके अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति.- इन नियमों की कोई बात, ऐसे आरक्षणों , आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

( क ) ( i ) मूल/काडर विभाग में नियमित आधार पर सदृश पद धारण किए हुए हैं ; या

(ii ) मूल/काडर विभाग में 8000-13500 रु. अथवा समतुल्य वेतनमान में नियमित आधार पर नुियक्ति के पश्चात् उस श्रेणी में पांच वर्ष सेवा कर चुके हों ; या

(iii ) मूल/काडर विभाग में 7450-11500 रु. अथवा समतुल्य वेतनमान में नियमित आधार पर नियुक्ति के पश्चात् उस श्रेणी में सात वर्ष सेवा कर चुके हों; और

(ख ) निम्नलिखित शैक्षिक अर्हताएं और अनुभव रखते हों:-

आवश्यक अर्हताएं:

(i ) वाणिज्यिक समुद्री विभाग द्वारा मत्स्यन जलयानों के लिए स्किपर श्रेणी.- 1 के रूप में क्षमता प्रमाणपत्र या समतुल्य

(ii ) माध्यमिक विद्यालय प्रमाणपत्र या समतुल्य और केन्द्रीय मत्स्य नौचालन एवं इंजीनियरी प्रशिक्षण संस्थान में मेट मत्स्यन जलयान पर संस्थागत प्रशिक्षण सफलतापूर्वक पूर्ण किया हो ।

( iii ) मेट मत्स्यन जलयानं प्रमाणपत्र प्राप्त करने के पश्चात् बोर्ड मत्स्यन जलयान पर पांच वर्ष का व्यवहारिक अनुभव ।

टिप्पण: ऐसे विभागीय मेट जो उस श्रेणी में सात वर्ष नियमित सेवा कर चुके हों और उपर्युक्त अर्हताएं पूर्ण करते हों पर भी प्रतिनियुक्ति पर नियुक्ति के लिए आवेदकों के साथ विचार किया जाएगा और यदि उसका चयन हो जाता है तो वह पद प्रोन्नति द्वारा भरा गया समझा जाएगा ।

पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में हैं , प्रतिनियुक्तिपर नियुक्ति के लिए विचार किए जाने के पात्र नही होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नुियक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । ( प्रतिनियुक्ति की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है , साधारणतया 3 वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी ) । 454

G. S. R. 84.-In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Central Institute of Fisheries Nautical and Engineering Training (Skipper ) Recruitment Rules , 1987 , except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules , regulating the method of recruitment to the post of Skipper in the , Central Institute of Fisheries , Nautical and Engineering Training , Cochin , Department of Animal Husbandry and Dairying , namely:-

1. Short title and commencement . ( i ) These rules may be called the Central Institute of Fisheries , Nautical and Engineering Training , Cochin , Skipper , ( Group ' B ' post ) Recruitment Rules , 2003.

(ii ) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post , classification and scale of pay. The number of post, its classification and scale of pay attached thereto shall be specified in columns 2 to 4 of the schedule annexed to these rules .

3. Method of recruitment, age limit and other qualification etc. The method of recruitment to the post , age limit, qualifications and other matters relating thereto shall be as specified in columns 5 to 14 of the said Schedule.

4. Disqualification .-No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who , having a spouse living, has entered into or contracted a marriage with any person ,

shall be eligible for appointmentto the said post:

Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule .

5. Power to relax .---Where the Central Governinent is of the opinion that it is necessary or expedient so to do , it may by order , for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving . Nothing in these rules shall affect reservations , relaxation or age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes, the Ex- Servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time , in this regard .

1. लघु शीर्षक और प्रारंभ ( 1 ) इन नियमों को आशुलिपिक श्रेणी II क्षेत्र संकार्य प्रभाग , राष्ट्रीय प्रतिदर्श सर्वेक्षण संगठन भर्ती नियमान्नली, 2002 कहा जाएगा ।

( 2) ये सरकारी राजपत्र में इनके प्रकाशन की तारीख से लागू होंगे ।

G. S. R. 85. In exercise of the powers conferred by the proviso to article 309 of the Constitution and in superses- sion of the Field Operations Division , National Sample Survey Organisation , Stenographer Grade II Recruitment Rules , 1984 the President hereby makes the following rules regulating the method of recruitment to the post of Stenographer Grade II in the Field Operations Division , National Sample Survey Organisation , under the Ministry of Statistics and Programme Implementation, namely :---

1. Short title and commencement. ( 1 ) These rules may be called the Stenographer Grade II , Field Operations Division , National Sample Survey Organisation , Recruitment Rules , 2003 .

(2) They shall come into force on the date of their publication in the Official Gazette.

3. Number of posts , classification and scale of pay . The number ofthe said post, its classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the said schedule annexed to hereto .

4. Method of recruitment , age limit and qualification etc. The method of recruitment , age limit, qualifications and other matters relating to the said post shall be as specified in columns 5 to 14 of the said Schedule .

5. Disqualification .-No person, -

(a) who has entered into or contracted a marriage with a person having a spouse living ; or 、

(b) who , having a spouse living , has entred into or contracted a marriage with any person,

shall be eligible for appointment to the said posts:

Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule .

6. Power to relax . Where the Central Government is of the opinion that it is necessary or expedient so to do , it may by order , and for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons .

7. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Ex- Servicemen , Other Backward Classes and other special categories of persons , in accordance with the orders issued by the Central Government from time to time , in this regard .
