सा.का.नि. 125.-राष्ट्रपति, संविधान के अनुच्छेद 309 के पैरन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए सरकारी आयुर्विज्ञान महाविद्यालय और अस्पताल, चंडीगढ़ में ज्येष्ठ प्राध्यापक ( त्वचा रोग विज्ञान और रतिं रोग विज्ञान ) , उपाचार्य ( त्वचा रोग विज्ञान और रति रोग विज्ञान ) और आचार्य ( त्वचा रोग विज्ञान और रति रोग विज्ञान ) के पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम सरकारी आयुर्विज्ञान महाविद्यालय और अस्पताल, चंडीगढ़, ज्येष्ठ प्राध्यापक ( त्वचा रोग विज्ञान और रति रोग विज्ञान ) , उपाचार्य ( त्वचा रोगें विज्ञान और रंति रोग विज्ञान ) और आचार्य ( त्वचा रोग विज्ञान और रति रोग विज्ञान ) भर्ती नियम , 2002 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद- संख्या, वर्गीकरण और वेतनमान उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु- सीमा और अन्य अर्हताएं आछि उक्त पदं परं भर्ती की पेद्धति, आयु सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता: - वह व्यक्ति,-

(क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा:

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधिके अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके और संघ लोक सेवा आयोग से परामर्श करने के पश्चात् इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति . इन नियमों की कोई बात , ऐसे आरक्षण, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनको केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

(ii) किसी मान्यताप्राप्त विश्वविद्यालय /संस्था से एम. डी. ( त्वचा रोग बिज्ञान और रतिरोग विज्ञान ) /एम.डी. ( त्वचा रोग विज्ञान और रति रोग विज्ञान और कुष्ठ रोग)/एम.डी. ( त्वचा रोग विज्ञान )/एम. डी. ( त्वचा रोग विज्ञान जिसमें रति रोग विज्ञान सम्मिलित है )/एस. डी. ( त्वचा रोग विज्ञान जिसमें रति रोग विज्ञान कुष्ठ रोग सम्मिलित है ) डी बी डी या डी डी सहित एम . डी. (आयुर्विज्ञान ) या समतुल्य ।

(iii) स्नातकोत्तर अर्हता प्राप्त करने के पश्चात् वृत्ति में 10 वर्ष का अनुभव जिसमें 4 वर्ष का अनुभव किसी मान्यताप्राप्त आयुर्विज्ञान महाविद्यालय/शिक्षण संस्था में उपाचार्य/सहयुक्त आचार्य के रूप में होना चाहिए ।

टिप्पण 1 :-अर्हताएं, अन्यथा सुअर्हित अभ्यर्थियों की दशा में संघ लोक सेवा आयोग के विवेकानुसार शिथिल की जा सकती है ।

टिप्प्ण ? :-अनुभव संबंधी अर्हता ( अर्हताएं ) संघ लोक सेवा आयोग के विबेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती हैं जब चयन के किसी प्रक्रम पर संघ लोक सेवा आयोग की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध होने की संभावना नहीं है ।

वांछनीय:- इन्डैक्स मैडिक्स/राष्ट्रीय पत्रिकाओं में अनुक्रमांकित कम से कम चार अनुसंधान प्रकाशन और अंतर्राष्ट्रीय पत्रिकाओं में एक अनुसंधान प्रकाशन हो ।

भर्ती की पद्धति: भर्ती सीधे होगी या प्रोन्नति द्वारा या प्रतिनियुक्ति/आमेलन द्वारा तथा विभिन्न पद्धतियों द्वास भरे जाने वाले पदों की प्रतिशतता

प्रतिनियुक्ति/आमेलन द्वारा भर्ती की दशा में वे श्रेणियां जिनसे प्रोन्नति/प्रतिनियुक्ति/आमेलन किया जाएगा

प्रोन्नति/प्रतिनियुक्तिजिसके अतंर्गत अल्पकालिक संविदा भीहै :

प्रोन्नति/प्रतिनियुक्ति ( जिसके अतंर्गत अल्पकालिक संविदा भी है ) जिसके न हो सकने पर सीधी भर्ती द्वारा ।

I. केन्द्रीय सरकार/राज्य सरकारों/संघ राज्य क्षेत्रों/कानूनी निकायों/ स्वशासी संगठनों/अनुसंधान संस्थाओं के अधीन ऐसे अधिकारी:-

(क) ( i ) जो नियमित आधार पर सदृश पद धारण किए हुए हैं;

या

(ii ) जिन्होंने 16400-20000 रु. के या समतुल्य वेतनमान वाले पदों पर 2 वर्ष नियमित सेवा की है ; और

(ख) जिनके पास स्तंभ ( 8 ) के अधीन सीधे भर्ती किए जाने वाले व्यक्तियोंके लिए विहित शैक्षिक और अन्य अर्हताएं हैं ।

II . उपाचार्य ( त्वचा रोग विज्ञान , रति रोग विज्ञान , कुष्ठ रोग विज्ञान की श्रेणी में ऐसे विभागीय अधिकारी पर भी जिन्होंने उस श्रेणी 648

में दो वर्ष नियमित सेवा की है , बाह्य व्यक्तियों के साथ विचार किया जाएगा और यदि उसका पद पर नियुक्तिके लिए चयन हो जाता है तो उसे प्रोन्नति द्वारा भरा गया समझा जाएगा;

पोषक प्रवर्ग के ऐसे विभागीय अधिकारी, जो प्रोन्नति की सीधी पंक्तिमें हैं, प्रतिनियुक्तिपर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्तिके लिए विचार किए जाने के पात्र नहींहोंगे ।

(प्रतिनियुक्ति की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है , साधारणतया 3 वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति पर नियुक्ति ( जिसके अतंर्गत अल्पकालिक संविदा भी है ) के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहींहोगी। ) यदिविभागीय प्रोन्नति समिति है , तो उसकी संरचना

( त्वचा रोग विज्ञान जिसमें रति रोग विज्ञान सम्मिलित है ) एम. डी. ( त्वचा रोग विज्ञान जिसमें रति रोग विज्ञान और कुष्ठ रोग सम्मिलित है ) /डी वी डी या डी डी सहित एम. डी. ( आयुर्विज्ञान ) या समतुल्य ।

(iii) स्नातकोत्तर अर्हता प्राप्त करने के पश्चात्संबंधित विशेषज्ञता में किसी मान्यताप्राप्त आयुर्विज्ञान महाविद्यालय/शिक्षण संस्था में सहायक आचार्य/ज्येष्ठ प्राध्यापक/ प्राध्यापक के रूप में 5 वर्ष का शिक्षण अनुभव ।

टिप्पण 1 :-अर्हताएं, अन्यथा सुअर्थित अभ्यर्थियों की दशा में संघ लोक सेवा आयोग के विवेकानुसार शिथिल की जा सकती हैं ।

L केन्द्रीय सरकार/राज्य सरकारों/संघ राज्य क्षेत्रों/कानूनी निकायों/ स्वशासी संगठनों/अनुसंधान संस्थाओं के अधीन ऐसे अधिकारी:-

(क) ( i ) जो नियमित आधार पर सदृश पद धारण किए हुए हैं ; या (ii ) जिन्होंने 14300-18300 रु. के या समतुल्य वेतनमान वाले पदों पर 2 वर्ष नियमित सेवा की है ; और

(ख) जिनके पास स्तंभ ( 8 ) के अधीन सीधे भर्ती किए जाने वाले व्यक्तियों के लिए विहित शैक्षिक और अन्य अर्हताएं हैं ।

Π. ज्येष्ठ प्राध्यापक ( त्वचा रोग विज्ञान, रति रोग विज्ञान, कुष्ठ रोग ) की श्रेणी में ऐसे विभागीय अधिकारियों पर भी जिन्होंने उस श्रेणी में दो वर्ष नियमित सेवा की है , बाह्य व्यक्तियों के साथ विचार किया जाएगा और यदि उसका पद पर नियुक्ति के लिए चयन हो जाता है तो उसे प्रोन्नति द्वारा भरा गया समझा जाएगा ।

पोषक प्रवर्ग के ऐसे विभागीय अधिकारी, जो प्रोन्नति की सीधी पंक्तिमें हैं, प्रतिनियुक्तिपर नियुक्तिके लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

टिप्पण 1 : -अर्हताएं, अन्यथा सुअर्थित अभ्यर्थियों की दशा में संघ लोक सेवा आयोग के विवेकानुसार शिथिल की जा सकती हैं ।

G.S.R. 125. In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules regulating the method of recruitment to the posts of Senior Lecturers (Dermatology and Venereology) , Reader (Dermatology and Venereology) , and Professor (Dermatology and Venereology ) , in the Government Medical College and Hospital , Chandigarh , namely :-

1. Short title and commencement . ( 1 ) These rules may be called the Government Medical College and Hospital, Chandigarh, Senior Lecturers ( Dermatology and Venereology ) , Reader (Dermatology and Venereology ) and Professors (Dermatology and Venereology ) , Recruitment Rules , 2003 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Numher of posts , classification and scale of pay. The number of the said posts , their classification and the scale of pay attached thereto shall be as specified in columns (2) to (4) of the said Schedule .

3. Method of recruitment , age limit , qualifications etc.-The method of recruitment, age limit, qualifications and other matters relating to the said posts shall be as specified in columns (5 ) to ( 14) of the said Schedule .

4. Disqualification .-No person, -

(a) who has entered into or contracted a marriage with a person having a spouse living ; or

(b) who having a spouse living, has entred into or contracted a marriage with any person,

shall be eligible for appointment to the said posts :

Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other partyto the marriage and that there are other grounds for so doing , exempt any person from the operative of this rule .

5. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order, for reasons to be recorded in writing , and in consultation with the Union Public Service Commission relax any of the provisions of these rules with respect to any class or category of persons .

6. Savings. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Other Backward Classes , Ex- servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time, in this regard.

2. पद -संख्या, वर्गीकरण और वेतनमान: उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ (4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति , आयु- सीमा और अन्य अर्हताएं आदि-उक्त पद पर भर्ती की पद्धति , आयु- सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

5. शिथिल करने की शक्ति: जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके और संघ लोक सेवा आयोग से परामर्श करने के पश्चात् इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति:-इन नियमों की कोई बात , ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।.

II. उपाचार्य ( सामान्य शल्य चिकित्सा ) की श्रेणी में ऐसे विभागीय अधिकारी पर भी जिन्होंने उस श्रेणी में दो वर्ष नियमित सेवा की है, बाह्य व्यक्तियों के साथ विचार किया जाएगा और यदि उसका पद पर नियुक्तिके लिए चयन हो जाता है तो उसे प्रोन्नति द्वारा भरा गया समझा जाएगा ।

G.S.R. 126. In exercise of the powers conferred by the proviso to article 309 of the Constitution , the President hereby makes the following rules regulating the method of recruitment to the post of Senior Lecturers (General Surgery) . Reader (General Surgery ) , and Professors ( General Surgery ) , in the Government Medical College and Hospital , Chandigarh, namely : -

1. Short title and commencement . ( 1 ) These rules may be called the Government Medical College and Hospital , Chandigarh, Senior Lecturers ( General Surgery ) , Reader ( General Surgery) and Professors (General Surgery ), Rules, 2003 .

(2) They shall come into force as the date of their publication in the Official Gazette.

2. Number of posts , classification and scale of pay. The number of the said post , its classification and the scale of pay attached thereto shall be as specified in column ( 2 ) to (4) of the said Schedule .

4. Disqualification .-No person, ---

(a) who has entered into or contracted a marriage with a person having a spouse living ; or

(b) who, having a spouse living , has entred into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

Provided that the Central Govemment may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the inarriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.-Where the Central Govemment is of the opinion that it is necessary or expedient so to do, it may, by order , for reasons to be recorded in writing and in consultation with the Union Public Service Commission , relax any of the provisions of these rules with respect to any class or category of persons .

6. Savings . Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Other Backward Classes , Ex - servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

सा.का.नि. 127. - राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए सरकारी आयुर्विज्ञान महाविद्यालय और अस्पताल, चंडीगढ़ में ज्येष्ठ प्राध्यापक ( सामान्य आयुर्विज्ञान ) , उपाचार्य ( सामान्य आयुर्विज्ञान ) और आचार्य ( सामान्य आयुर्विज्ञान ) के पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्: -

1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम सरकारी आयुर्विज्ञान महाविद्यालय और अस्पताल , चंडीगढ़ , ज्येष्ठ प्राध्यापक ( सामान्य आयुर्विज्ञान ) , उपाचार्य ( सामान्य आयुर्विज्ञान ) और आचार्य ( सामान्य आयुर्विज्ञान ) भर्ती नियम , 2002 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद -संख्या, वर्गीकरण और वेतनमान:- उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु- सीमा और अन्यअर्हताएं आदि:- उक्त पद पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता:-वह व्यक्ति-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. व्यावृत्ति:- इन नियमों की कोई बात , ऐसे आरक्षण, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

भर्ती की पद्धति: भर्ती सीधे होगी या प्रोन्नति द्वारा या प्रतिनियुक्ति/ आमेलन द्वारा तथा विभिन्न पद्धतियों द्वारा भरे जाने वाले पदों की प्रतिशतता

प्रोन्नति/प्रतिनियुक्ति( जिसके अतंर्गत अल्पकालिक संविदा भी है ) जिसके न हो सकने पर सीधी भर्ती द्वारा ।

(ख ) जिनके पास स्तंभ ( 8 ) के अधीन सीधे भर्ती किए जाने वाले व्यक्तियों के लिए विहित शैक्षिक और अन्य अर्हताएं हैं ।

Π . उपाचार्य ( सामान्य आयुर्विज्ञान ) की श्रेणी में ऐसे विभागीय अधिकारी पर भी जिन्होंने उस श्रेणी में दो वर्ष नियमित सेवा की है, बाह्य व्यक्तियों के साथ विचार किया जाएगा और यदि उसका पद पर नियुक्ति के लिए चयन हो जाता है तो उसे प्रोन्नति द्वारा भरा गया समझा जाएगा ।

पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्तिमें है, प्रतिनियुक्तिपर नियुक्तिके लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे।

(ii) किसी मान्यताप्राप्त विश्वविद्यालय/संस्था से एम.डी. ( आयुर्विज्ञान ) /एम.डी. (सामान्य आयुर्विज्ञान ) या समतुल्य।

(iii) स्नातकोत्तर अर्हता प्राप्त करने के पश्चात् संबंधित विशेषज्ञता में किसी मान्यताप्राप्त सरकारी आयुर्विज्ञान महाविद्यालय/शिक्षण संस्था में प्राध्यापक/रजिस्ट्रार/सीनियर रेजिडेंट/परिदर्शक/ ट्यूटर के रूप में 3 वर्ष का शिक्षण अनुभव ।

टिप्पण 1 :-अर्हताएं, अन्यथा सुअर्थित अभ्यर्थियों की दशा में संघ लोक सेवा आयोग के विवेकानुसार शिथिल की जा सकती है ।

टिप्पण 2:-अनुभव संबंधी अर्हता ( अर्हताएं ) संघ लोक सेवा आयोग के विवेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती हैं जब चयन के किसी प्रक्रम पर संघ लोक सेवा आयोग की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध होने की संभावना नहींहै ।

G.S.R. 127. In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules regulating the method of recruitment to the posts of Senior Lecturers ( General Medicine), Reader(General Medicine), and Professors ( General Medicine), in the Government Medical College and Hospital, Chandigarh, namely :-

1. Short title and commencement . ( 1 ) These rules may be called the Government Medical College and Hospital , Chandigarh , Senior Lecturers ( General Medicine ) , Reader ( General Medicine ) and Professors (General Medicine ) , Rules, 2003.

(2)They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts , classification and scale of pay. The number of the said posts , its classification and the scale ofpay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules .

3. Method of recruitment, age limit , qualifications , etc. The method of recruitment, age limit, qualifications and other matters relating to the said posts shall be as specified in columns ( 5) to ( 14) of the said Schedule.

4. Disqualification .- No person, -

(a) who has entered into or contracted a marriage with a person having a spouse living; or

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule .

5. Power to relax. Where the Central Government is of the opinion that it is necessary or expedient sơ to do , it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission , relax any of the provisions of these rules in respect to any class or category of persons .

6. Savings . Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes , Other Backward Classes , Ex - servicemen and other special categories ofpersons in accordance with the orders issued by the Central Government from time to time in this regard.

1. संक्षिप्त नाम और प्रारंभ-( 1 ) इन नियमों का संक्षिप्त नाम सरकारी आयुर्विज्ञान महाविद्यालय और अस्पताल , चंडीगढ़ , ज्येष्ठ प्राध्यापक ( न्याय आयुर्विज्ञान ) , उपाचार्य ( न्याय आयुर्विज्ञान ) और आचार्य ( न्याय आयुर्विज्ञान ) भर्ती नियम, 2002 है ।

2. पद-संख्या, वर्गीकरण और वेतनमान: उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु- सीमा और अन्य अर्हताएं आदि:-उक्त पद पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता:-वह व्यक्ति, -

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

6. व्यावृत्ति: -इन नियमों की कोई बात, ऐसे आरक्षण, आयु - सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

उपाचार्य (न्याय आयुर्विज्ञान ) की श्रेणी में ऐसे विभागीय अधिकारी पर भी जिन्होंने उस श्रेणी में दो वर्ष नियमित सेवा की है, बाह्य व्यक्तियों के साथ विचार किया जाएगा और यदि Π. उसका पद पर नियुक्तिके लिए चयन हो जाता है तो उसे प्रोन्नति द्वारा भरा गया समझा जाएगा ।

G.S.R. 128. In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules regulating the method of recruitment to the post of Senior Lecturers (Forensic Medicine) , Reader ( Forensic Medicine ) , and Professor (Forensic Medicine) , in the Government Medical College and Hospital , Chandigarh, namely :-

1. Short title and commencement . ( 1 ) These rules may be called the Government Medical College and Hospital, Chandigarh, Senior Lecturers (Forensic Medicine) , Reader (Forensic Medicine) and Professors (Forensic Medicine ) , Rules, 2003 .

(2) They shall come into force as the date of their publication in the Official Gazette .

2. Number of posts , classification and scale of pay.-The number of the said posts, their classification and the scale of pay attached thereto shall be as specified in columns (2) to (4 ) of the said Schedule annexed to these rules .

3. Method of recruitment , age limit , qualificationsetc. The method of recruitment, age limit, qualifications and other matters relating to the said posts shall be as specified in coluthns ( 5 ) to ( 14) of the said Schedule .

4. Disqualification . No person ,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who , having a spouse living , has entred into or contracted a marriage with any person ,

shall be eligible for appointment to the said posts:

Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operative of the rule.

5. Power to relax . Where the Central Government is of the opinion that it is necessary or expedient so to do , it may by order , for reasons to be recorded in writing, and in consultation with the Union Public Service Commission relax any of the provisions of these rules in respect to any class or category of persons.

6. Savings . Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Other Backward Classes , Ex - servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time , in this regard.

सा.का.नि. 129.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए सरकारी आयुर्विज्ञान महाविद्यालय और अस्पताल, चंडीगढ़ में ज्येष्ठ प्राध्यापक ( कान , नाक, गला ) , उपाचार्य ( कान , नाक, गला ) और आचार्य ( कान , नाक, गला ) के पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ-( 1 ) इन नियमों का संक्षिप्त नाम सरकारी आयुर्विज्ञान महाविद्यालय और अस्पताल, चंडीगढ़ , ज्येष्ठ प्राध्यापक ( कान, नाक, गला ) , उपाचार्य ( कान , नाक, गला) और आचार्य ( कान , नाक, गला ) भर्ती नियम, 2002 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद-संख्या , वर्गीकरण और वेतनमान:- उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ (4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु- सीमा और अन्य अर्हताएं आदि उक्त पद पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता:-वह व्यक्ति,-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेंगी ।

5. शिथिल करने की शक्ति:-जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके और संघ लोक सेवा आयोग से परामर्श करने के पश्चात् इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति:- इन नियमों की कोई बात, ऐसे आरक्षण, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों , अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

लिएएक वर्ष । आवश्यक: (i ) भारतीय आयुर्विज्ञान परिषद् अधिनियम, 1956 ( 1956 का 102 ) की अनुसूची में सम्मिलित कोई एक मूल विश्वविद्यालय या समतुल्य अर्हता और किसी राज्य आयुर्विज्ञान रजिस्टर यों भारतीय आयुर्विज्ञान रजिस्टर में रजिस्ट्रीकृत होना चाहिए ।

(ii ) किसी मान्यताप्राप्त विश्वविद्यालय/संस्था से एम. एस. ( कर्ण , नासा, कंठ ) या समतुल्य ।

(iii) स्नातकोत्तर अर्हता प्राप्त करने के पश्चात् वृक्ति में 10 वर्ष का अनुभव जिसमें 4 वर्ष का अनुभव किसी मान्यताप्राप्त आयुर्विज्ञान महाविद्यालय/शिक्षण संस्था में उपाचार्य/सहयुक्त आचार्य के रूप में होना चाहिएं ।

टिप्पण 1 :-अर्हताएं, अन्यथा सुअर्थित अभ्यर्थियों की दशा में संघ लौक सेवा आयोग के विवेकानुसार शिथिल की जा सकती है ।

टिप्प्ण 2 :- अनुभव संबंधी अर्हता ( अर्हताएं ) संघ लौक सेवा आयोग के विवेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती हैं जब चयन के किसी प्रक्रम पर संघ लोक सेवा आयोग की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध होने की संभावना नहीं है ।

प्रोन्नति/प्रतिनियुक्ति/आमेलन द्वारा भर्ती की दशा में वे श्रेणियां जिनसे प्रोन्नति/प्रतिनियुक्ति/आमेलन किया जाएगा भर्ती की पद्धति : भर्ती सीधे होगी या प्रोन्नति द्वारा या प्रतिनियुक्ति/ अमिलन द्वारा तथा विभिन्न पद्धतियों द्वारा भरे जाने वाले पदों की प्रतिशतता

प्रोन्नति/प्रतिनियुक्ति ( जिसकें अतर्गत अल्पकालिक संविदा भीहै ) :

प्रोन्नति/प्रतिनियुक्ति ( जिसके अतंर्गत अल्पकालिक संविदा भी है) जिसके न हो सकने पर सीधी भर्ती द्वारा ।

1. केंन्द्रीय सरकार/राज्य सरकारों/संघ राज्य क्षेत्रों/कानूनी निकायों/स्वशासी संगठनों/अनुसंधान संस्थाओं के अधीन ऐसे अधिकारी:-

(क ) ( i ) जो नियमित आधार पर सदृश पद धारण किए हुए हैं ; या

(ख ) जिनके पास स्तंभ ( 8 ) के अधीन सीधे भर्ती किए जाने वाले व्यक्तियों के लिए विहित शैक्षिक और अन्य अर्हताएं है ।

उपाचार्य ( कान, नाक, गला ) की श्रेणी में ऐसे विभागीय अधिकारी पर भी जिन्होंने उस श्रेणी में दो वयं नियमित सेवा की है , बाह्य व्यक्तियों के साथ विचार किया जाएगा और यदि Π. उसका पद पर नियुक्ति के लिए चयन हो जाता है तो उसे प्रोन्नति द्वारा भरा गया समझा जाएगा ।

पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्तिपर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने केपात्र नहींहोंगे ।

Π. उपाचार्य ( कान, नाक, गला ) की श्रेणी में ऐसे विभागीय अधिकारी पर भी जिन्होंने उस श्रेणी में दो वर्ष नियमित सेवा की है, बाह्य व्यक्तियों के साथ विचार किया जाएगा और यदि उसका पद पर नियुक्ति के लिए चयन हो जाता है तो उसे प्रोन्नति द्वारा भरा गया समझा जाएगा ।

पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहींहोंगे ।

New Delhi , the 4th March , 2003

G.S.R. 129.-In exercise of the powers conferred by the proviso to article 309 of the Constitution , the President hereby makes the following rules regulating the method of recruitment to the posts of Senior Lecturers (E.N.T. ) , Reader (E.N.T. ) , and Professors (E.N.T. ) , in theGovernment Medical College and Hospital , Chandigarh , namely :-

1. Short title and commencement .-( 1 ) These rules may be called the Government Medical College and Hospital, Chandigarh, Senior Lecturers (E.N.T. ) , Reader (E.N.T. ) and Professors (E.N.T. ), Rules , 2003 .

(2) They shall come into force as the date of their publication in the Official Gazette .

2. Number of post, classification and scale of pay. The number of said post, its classification and the scale of pay attached thereto shall be as specified in columns (2) to (4 ) of the Schedule annexed to these rules .

3. Method of recruitment , age limit , qualificationsetc. The method of recruitment , age limit, qualifications and other matters relating to the said posts shall be as specified in columns (5) to ( 14) of the said Schedule .

4. Disqualification .-No person,-

(a) who has entered into or contracted a marriage with person having a spouse living ; or

(b) who having a spouse living , has entred into or contracted a marriage with any person, shall be eligible for appointment to the said posts :

Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operative of the rule .

5. Power to relax.- Where the Central Govemment is of the opinion that it is necessary or expedient so to do , it may, by order , for reasons to be recorded in writing, and in consultation with the Union Public Service Commission , relax any of the provisions of these rules with respect to any class or category of persons .

6. Savings . Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Other Backward Classes , Ex - servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time, in this regard.

सा.का.नि. 130.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और केन्द्रीय जल और विद्युत आयोग ( जल स्कंध ) श्रेणी दो और तीन अराजपत्रित ( वैज्ञानिक ) पद की भर्ती नियम , 1971 को जहां तक उनका संबंध अनुसंधान सहायक ( रसायन विज्ञान ) और अनुसंधान सहायक ( भौतिक विज्ञान ) पद से है, और केन्द्रीय जल आयोग ( अलिपिक वर्गीय समूह " ग " पद ) भर्ती नियम, 1982 को जहां तक उनका संबंध अनुसंधान सहायक ( गणित ) पद से है; उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने से लोप किया गया है , केन्द्रीय जल आयोग में अनुसंधान सहायक पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्: -

है। 1. संक्षिप्त नाम और प्रारंभः-( 1 ) इन नियमों का संक्षिप्त नाम केन्द्रीय जल आयोग , समूह " ग " ( वैज्ञानिक पद ) भर्ती नियम, 2003 (2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण और वेतनमान:- उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु- सीमा और अन्य अर्हताएं आदि:- उक्त पद पर भर्ती की पद्धति, आयु सीमा, और अन्य अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ 5 से स्तंभ 14 में विनिर्दिष्ट हैं ।

4. निरर्हता:-वह व्यक्ति, -

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है , या

उक्त पद पर नियुक्ति का पात्र नहीं होगा:

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति: जहाँ केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहाँ वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृति:- इन नियमों की कोई बात ऐसे आरक्षण, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिसका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।
