सा. का. नि. 139.- राष्ट्रपति, संविधान के अनुच्छेद 299 के खंड ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, यह निदेश देते हैं कि भारत सरकार के तत्कालीन विधि मंत्रालय ( विधि कार्य विभाग ) की अधिसूचना सं. सा.का.नि. 585 तारीख 1 फरवरी , 1966 में निम्नलिखित और संशोधन किए जाएंगे , अर्थात्: -

उक्त अधिसूचना के " संचार मंत्रालय की दशा में " शीर्षक से संबंधित भाग 23 में, पैरा 3 और उससे संबंधित प्रविष्टियों के पश्चात् निम्नलिखित पैरा और प्रविष्टियां अंतःस्थापित की जाएंगी , अर्थात्: -

" उक. सार्वभौमिक सेवा बाध्यता निधि प्रशासन के मामले में :

संपूर्ण भारत सरकार के शुद्ध उच्च लागत ग्रामीण क्षेत्रों/ दूरस्थ क्षेत्रों में सार्वजनिक उपयोग और व्यष्टिक घरेलू टेलीफोन के लिए, ग्रामीण सार्वजनिक टेलीफोन या सामुदायिक टेलीफोन और अन्य दूरसंचार प्रसुविधाओं को स्थापित करने , उनके रखरखाव और कार्यकरण के लिए साहाय्यकी की मंजूरी से संबंधित सभी संविदाएं और अन्य लिखतें; प्रशासक ( सार्वभौमिक सेवा निधि ) ; संयुक्त प्रशासक ( प्रशासनिक सेवा निधि ) उपप्रशासक (सार्वभौमिक सेवा निधि) द्वारा । "

G. S. R. 139. In exercise of the powers conferred by clause (1 ) of article 299 of the Constitution, the President hereby directs that the following further amendments shall be made in the notification of the Government of India in the then Ministry of Law ( Department of Legal Affairs ) , number G.S.R. 585 , dated the 1st February , 1966 , namely:-

In the said notification , in Part XXIII relating to the heading " IN THE CASE OF DEPARTMENT OF COMMUNICATIONS" , after para3 and the entries relating thereto, the following para and entries shall be inserted , namely :-

" 3A. In the case of Universal Service Obligation Fund Administration :

All contracts and instruments relating to the grant of subsidy for establishing , maintaining and working of the village public telephones or community telephones and other telecommunication facilities for public use and individual household telephones in the net high cost rural/ remote areas throughout India shall be executed , by The Administrator ( Universal Service Fund) ; Joint Administrator ( Universal Service Fund ) ; Deputy Administrator ( Universal Service Fund) ."

सा.का.नि. 142.- अखिल भारतीय सेवाएं अधिनियम, 1951 ( 1951 का 61 ) की धारा 3 की उप धारा ( i ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय सरकार, एतद्वारा भारतीय प्रशासनिक सेवा ( भर्ती ) नियमावली , 1954 में आगे और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्:

1. ( 1 ) इन नियमों का नाम भारतीय प्रशासनिक सेवा ( भर्ती ) संशोधन नियमावली, 2003 है ।

(2 ) ये नियम पहली मई, 2002 से लागू हुए समझे जाएंगे ।

2. भारतीय प्रशासनिक सेवा ( भर्ती ) नियमावली , 1954 के नियम 9 के उप नियम ( 2 ) में " 30 अप्रैल , 2002 " के स्थान पर " 30अप्रैल , 2007 " प्रतिस्थापित किया जाएगा ।

व्याख्यात्मक ज्ञापन

दिनांक 31-12-1997 की अधिसूचना संख्या 14015/51 /96 -अ.भा.से . ( 1 ) क द्वारा , भारतीय प्रशासनिक सेवा के जम्मू तथा कश्मीर संवर्ग के संबंध में राज्य की संगत संवर्ग अनुसूची में वरिष्ठ ड्यूटी पदों, केन्द्रीय प्रतिनियुक्ति रिजर्व, राज्य प्रतिनियुक्ति रिजर्व और प्रशिक्षण रिजर्व के 50 % पदोन्नति कोटे को 30 अप्रैल, 2002 तक बढ़ा दिया गया था । इस वितरण व्यवस्था को पहली मई, 2002 से और आगे 5 वर्ष के लिए विस्तारित किए जाने का प्रस्ताव है । यह प्रमाणित किया जाता है कि उक्त व्यवस्था भूतलक्षी प्रभाव से लागू किए जाने से किसी भी अधिकारी पर कोई प्रतिकूल प्रभाव नहीं पड़ेगा ।

G. S. R. 142. In exercise of the powers conferred by sub - section ( i) of Section 3 of the All India Services Act , 1951 (61 of 1951 ) , the Central Government hereby makes the following Rules further to amend the Indian Administrative Service( Recruitment) Rules, 1954 , namely :-

1. (1 ) These rules may be called the Indian Administrative Service (Recruitment) Amendment Rules , 2003 .

(2) They shall be deemed to have come into force on the first day of May , 2002 .

2. In the Indian Administrative Service ( Recruitment) Rules , 1954, in Rule 9 , sub - rule (2 ), the date " 30th April , 2002 " shall be substituted by the date " 30th April , 2007" .

Explanatory Memorandum

By the notification No. 14015/ 51 / 96 -AIS ( I ) -A, dated 31-12-1997 , the promotion quota in respect of the Jammu and Kashmir Cadre of the 1AS at 50 % of the Senior Duty posts , Central Deputation Reserve , State Deputation Reserve and the Training Reserve of the relevant Cadre Schedule was extended for the period upto 30th April , 2002. The same dispen- sation is proposed to be extended for a further period of 5 years beginning 1st May, 2002. It is certified that giving retrospective effect to the said dispensation would not adversely affect any officer .

सा. का. नि. 143.- अखिल भारतीय सेवाएं अधिनियम, 1951 ( 1951 का 61 ) की धारा 3 की उप धारा ( 1 ) द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए, केन्द्रीय सरकार, एतद्वारा भारतीय पुलिस सेवा ( भर्ती ) नियमावली, 1954 में आगे और संशोधन करने के लिए निम्नलिखित नियम बनाती हैं , अर्थात्: -

1. ( 1 ) इन नियमों का नाम भारतीय पुलिस सेवा ( भर्ती ) संशोधन नियमावली , 2003 है ।

(2) ये नियम पहली मई, 2002 से लागू हुए समझे जाएंगे ।

2. भारतीय पुलिस सेवा ( भर्ती ) नियमावली, 1954 के नियम 9 के उप नियम ( 3 ) में 30 अप्रैल, 2002 " के स्थान पर " 30 अप्रैल, 2007" प्रतिस्थापित किया जाएगा ।

व्याख्यात्मक ज्ञापन

दिनांक 31-12-1997 की अधिसूचना संख्या 14015/ 51 /96- अ.भा.से. ( 1 ) -ख द्वारा , भारतीय पुलिस सेवा के जम्मूतथा कश्मीर संवर्ग के संबंध में राज्य की संगत संवर्ग अनुसूची में वरिष्ठ ड्यूटी पदों, केन्द्रीय प्रतिनियुक्ति रिजर्व, राज्य प्रतिनियुक्ति रिजर्व और प्रशिक्षण रिजर्व के 50 % पदोन्नति कोटे को 30 अप्रैल, 2002 तक बढ़ा दिया गया था । इस वितरण व्यवस्था को पहली मई, 2002 से और आगे 5 वर्ष के लिए विस्तारित किए जाने का प्रस्ताव है । यह प्रमाणित किया जाता है कि उक्त व्यवस्था को भूतलक्षी प्रभाव से लागू किए जाने से किसी भी अधिकारी पर कोई प्रतिकूल प्रभाव नहींपड़ेगा ।

G.S.R. 143- In exercise of the powers conferred by sub - section ( 1 ) of Section 3 of the All India Services Act , 1951 (61 of 1951 ) , the Central Government hereby makes the following Rules further to amend the Indian Police Service (Recruitment) Rules , 1954, namely :---

1. (1 ) These rules may be called the Indian Police Service (Recruitment) Amendment Rules , 2003.

(2) They shall be deemed to have come into force on the first day of May , 2002.

2. In the Indian Police Service ( Recruitment ) Rules , 1954, in Rule 9 , sub -rule (3 ) , the date " 30th April , 2002 " shall be substituted by the date " 30th April , 2007 " .

Explanatory Memorandum

Bythe notification No. 14015 / 51 /96 - AIS ( I ) -B, dated 31-12-1997 , the promotion quota in respect of the Jammu & Kashmir Cadre of the IPS at 50 % of the Senior Duty posts . Central Deputation Reserve , State Deputation Reserve and the Training Reserve of the relevant Cadre Schedule was extended for the period upto 30th April, 2002. The same dispensation is proposed to be extended for a further period of 5 years beginning 1st May , 2002. It is certified that giving retrospective effect to the said dispensation would not adversely affect any officer .

सा.का.नि. 145.-- राष्ट्रपति संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए योजना आयोग ( सलाहकार ) भर्ती नियम, 2003 का संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम योजना आयोग ( सलाहकार ) भर्ती ( संशोधन ) नियम, 2003 है। (2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. योजना आयोग ( सलाहकार ) भर्ती नियम, 2000 की अनुसूची में-

(क) स्तंभ 5 में विद्यमान शीर्षक के स्थान पर ' चयन या अपचयन पद ' शीर्षक रखा जाएगा ,

(ख ) स्तंभ 13 , में विद्यमान प्रविष्टि के स्थान पर निम्नलिखित प्रविष्टि रखी जाएगी,

" 1. चयन समिति का गठन ( नियुक्ति करने के लिए) :

1. योजना आयोग में संबंधित विषय का भारसाधक सदस्य

अध्यक्ष

2. सचिव या सदस्य- सचिव, योजना आयोग

3. निम्नलिखित में से योजना आयोग से बाहर के तीन विशेषज्ञ होंगे :

(क) संबंधित सेक्टर के मंत्रालय/विभाग का सचिव ।

(ख) किसी मंत्रालय/विभाग/लोक उपक्रम से सचिव, भारत सरकार की समान प्रास्थिति का व्यक्ति ।

(ग ) उपाध्यक्ष योजना आयोग द्वारा नामनिर्दिष्ट संबंधित संस्थाओं में विशेष योग्यता का आचार्य ।

G. S. R. 145. In exercise of the powers conferred by the proviso to article 309 of the Constitution , the President hereby makes the following rules to amend the Planning Commission (Adviser) Recruitment Rules , 2000, namely:-

1. ( 1 ) These Rules may be called the Planning Commission ( Adviser) Recruitment (Amendment ) Rules , 2003 .

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Schedule to the Planning Commission (Adviser) Recruitment Rules , 2000, -

(a) in Column 5 , for the existing heading , the heading " Whether selection or non- selection post " shall be substituted;

(b) in Column 13 , for the existing entry, the following entry shall be substituted, namely: -

" 1 . Composition of Selection Committee ( for making appointments) :

1. Member - in -charge of concerned subject in the Planning Commission ---Chairman

2. Secretary or Member - Secretary, Planning Commission -Member

3. Three experts from outside the Planning Commission from among: ---Members

(a) Secretary of Ministry/ Department dealing with the sector .

(b) Persons equal in status to Secretary to the Government of India from any Ministry/Department/ Public Undertakings .

(c) Professors of distinction in the relevant institutions , to be nominated by the Deputy Chairman , Planning Commission .

NOTE : After selection , the approval of Deputy Chairman , Planning Commission and the Appointments Committee of the Cabinet shall be obtained .

सा.का.नि. 146.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, सड़क परिवहन और राजमार्ग मंत्रालय के सीमा सड़क संगठन में अधीक्षक, भंडार तथा अधीक्षक, गैर तकनीकी समूह " ख " ( अराजपत्रित ) पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्: -

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम सड़क परिवहन और राजमार्ग मंत्रालय, साधारण रिजर्व इंजीनियर बल (अधीक्षक, भंडार और अधीक्षक, गैर तकनीकी ) भर्ती नियम , 2003 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद- संख्या, वर्गीकरण और वेतनमान. उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं । उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतनमान वे होंगे , जो इन नियमों से 3. भर्ती की पद्धति, आयु- सीमा, अर्हताएं आदि. उक्त पदों पर भर्ती की पद्धति, आयु- सीमा अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ 5 से स्तंभ 14 में विनिर्दिष्ट हैं ।

4. निरर्हता.-वह व्यक्ति-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदिकेन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधिके अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय हैं कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति. इन नियमों की कोई बात, ऐसे आरक्षणों, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़ी जातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

टिप्पण: - जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो वहां उनके ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जब कि उसके द्वारा की गई ऐसी अर्हक/पात्रता सेवा, अपेक्षित अर्हक/पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित उनकी उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली है, जिन्होंने ऐसी अर्हक/पात्रता सेवा पहले ही पूरी कर ली है ।

(ख) प्रशासन, लेखा या भंडार संभालने का तीन वर्ष का अनुभव रखते होः टिप्प्ण: पोषक प्रवर्ग के ऐसे विभागीय अधिकारी, जो प्रोन्नति की सीधी पंक्ति में है, प्रतिनियुक्ति पर नियुक्तिकेलिए विचार किए जाने के पात्र नहीं होंगे। इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । प्रतिनियुक्ति की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रति- नियुक्तिकी अवधि है साधारणतया 3 वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति द्वारा नियुक्तिकेलिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी ।

In exercise of the powers conferred by the proviso to article 309 of the Constitution , the President hereby makes the following rules regulating the method of recruitment to the posts of Superintendent Stores and Superintendent Non - Technical of Group ' B' (Non -Gazetted ) in the Ministry of Road Transport and Highways , in the Border Roads Organisation , namely :-

1. Short title and commencement.- ( 1 ) These rules may be called the Ministry of Road Transport and Highways, General Reserve Engineer Force (Superintendent Stores and Superintendent Non - Technical ) Recruitment Rules , 2003 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of posts , classification and scale of pay . The number of the said posts , its classification and the scale ofpay attached thereto shall be as specified in columns (2 ) to (4) of the Schedule annexed to these rules .

3.Method of recruitment , age limit, qualifications ete. The method ofrecruitment, to the said post, age limit , qualification and other matters relating thereto shall be as specified in columns (5 ) to ( 14 ) of the said schedule .

4. Disqualification. No person ,

(a) who has entered into or contracted a marriage with a person having a spouse living ; or

(b) who having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that , such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax . Where the Central Government is of the opinion that it is necessary to expedient so to do , it may, by order, for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons .

6. Savings. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions to be provided for the Scheduled Castes , the Scheduled Tribes , Other Backward Classes , Ex - servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

सा. का. नि. 147.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए इंदिरा गांधी राष्ट्रीय वन अकादमी, देहरादून में पुस्तकालय-सह - सूचना सहायक के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ.-( 1 ) इन नियमों का संक्षिप्त नाम इंदिरा गांधी राष्ट्रीय वन अकादमी, देहरादून में पुस्तकालय - सह- सूचना सहायक भर्ती नियम , 2003 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद-संख्या, वर्गीकरण और वेतनमान -उक्त पद की संख्या, उसका वर्गीकरण और उनका वेतनमान वह होंगे, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु- सीमा अन्य अर्हताएं आदि- उक्त पद पर भर्ती की पद्धति, आयु- सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता.- वह व्यक्ति,-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तुयदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. व्यावृत्ति.-इन नियमों की कोई बात, ऐसे आरक्षणों, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़ों वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

G.S.R. 147. In exercise of the powers conferred by the proviso to article 309 of the constitution , the President hereby makes the following rules regulating the method of recruitment to the post of Library- cum Information Assistant in the Indira Gandhi National Forest Academy, Dehradun , namely :--

1. Short title and Commencement.-( 1 ) These rules may be called the Indira Gandhi National Forest Academy, DehradunLibrary - cum Information Assistant Recruitment Rules , 2003 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2.Number of posts , classification and scale of pay . The number ofthe said post, its classification and the scale ofpay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules .

3.Method of recruitment , age limit, qualification , etc. The method of recruitment, age limit , qualifications and other matters relating to the said posts shall be as specified in columns 5 to 14 of the said Schedule.

4.Disqualification . No person ,-

( a) who has entered into or contracted a marriage with a person having a spouse living; or

(b ) who having a spouse living , has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule .

5. Power to relax .-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order , for reasons to be recorded in writing relax any of the provisions of these rules respect of any class or category of persons .

6. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Caste, Scheduled Tribes , Other Backward Classes , Ex- servicemen and other special categories or persons in accordance with the orders issued by the Central Government from time to time in this regard .

G.S.R. 148. In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the India Meterological Department (Group C Hindi Translator Grade I and Grade II posts) Recruitment Rules, 1987 , in so far as they relate to the post of Hindi Translator Grade II , except as things done or omitted to be done before such supersession , the President hereby makes the following rules , regulating the method of recruitment to Group 'C' posts of Junior Translator (erstwhile Hindi Translator Grade - II ) in the India Meterological Department , Ministry of Science and Technology, namely :-

1. Short title and commencement. ( 1 ) These rules may be called the Ministry of Science and Technology , ( India Meteorological Department) Group ' C ' posts of Junior Translator Recruitment Rules , 2002.

( 2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of posts , classification and scale of pay . The number of posts , its classification and the scale ofpay attached thereto shall be as specified in columns (2) to (4 ) of the said Schedule .

3. Method of recruitment, age limit and other qualification.---The method of recruitment to the said posts, age limit , qualifications and other matters relating thereto shall be as specified in columns (5 ) to ( 14 ) of the aforesaid Schedule.

4. Disqualification. No person ,-

(a)who has entered into or contracted a marriage with a person having a spouse living; or

(b) who having a spouse living , has entered into or contracted a marriage with any person , shall be eligible for appointment to any of the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule .

5. Power to relax . Where the Central Governrnent, is of the opinion that it is necessary or expedient so to do, it may , by order , for reasons to be recorded in writing relax any of the provisions of these rules with respect to any class or category of persons .

6. Savings . Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , Scheduled Tribes , Ex - servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard. सा.का.नि. 149 राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और फरक्का बैराज परियोजना उच्चतर माध्यमिक स्कूल और अस्पताल ( समूह ग पद ) नियम, 1976 और फरक्का बैराज परियोजना ( समूह ग पद ) भर्ती नियम, 2001 कोजहां तक उनका संबंध स्टाफ नर्स/पुरुष नर्स से है , उन बातों के सिवाय आंशिक रूप से अधिक्रांत करते हुए जिन्हें ऐसे आंशिक अधिक्रमण से पहले किया गया है या करने का लोप किया गया है , केन्द्रीय जल संसाधन मंत्रालय के अधीन फरक्का बैराज परियोजना में स्टाफ नर्स/पुरुष नर्स पद पर भर्ती कीपद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ.-( 1 ) इन नियमों का संक्षिप्त नाम फरक्का बैराज परियोजना अस्पताल ( समूह " ग " ) भर्ती नियम 2003 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे । 2. पद संख्या, वर्गीकरण और वेतनमान. उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ 2 से 4 में विर्निदिष्ट हैं ।

3. भर्ती की पद्धति, आयु- सीमा , अर्हताएं आदि भर्ती की पद्धति, आयु- सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्तअनुसूची के स्तम्भ 5 से स्तम्भ 14 में विनिर्दिष्ट हैं । 4. निरर्हता. वह व्यक्ति,-

(क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्तिका पात्र नहीं होगा:

परन्तुयदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति.- इन नियमों की कोई बात, ऐसे आरक्षणों, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

लोक सेवा आयोग के विवेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती है जब चयन के किसी प्रक्रम पर संघ लोक सेवा आयोग की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध होने की संभावना नहीं है ।

G.S.R. 150. In exercise of the powers conferred by the proviso to article 309 of the Constitution , and in spersession of the Central Water Commission , Editor ( Hindi - Bhagirath ) Recruitment Rules , 1984, except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the posts of Editor ( Hindi- Bhagirath ) in the Central Water Commission , namely :-

1. Short title and commencement . ( 1 ) These rules may be called the Central Water Commission, Editor (Hindi- Bhagirath ) Recruitment Rules , 2003 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of posts , classification and scale of pay. The number of posts , their classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the said Schedule annexed to these rules .

7 3. Method of recruitment, age limit , and other qualifications . The method of recruitment , to the said post age limit , qualifications and the other matters relating there to shall be as specified in columns 5 to 14 of the said Schedule .

4. Disqualification .- No person ,

(a) who has entered into or contracted a marriage with a person having a spouse living , or

(b) who; having a spouse living , has entered into or contracted a marriage with any person , shall be eligible for appointment to the said post :

5. Power to relax .- Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission , relax any of the provisions of these rules with respect to any class or category of persons .

6. Savings. Nothing in these rules shall affect reservations relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Other Backward Classes , Ex- serviceman and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard .
