सा. का. नि. 242.-केन्द्रीय सरकार , केन्द्रीय रिजर्व पुलिस बल अधिनियम, 1949 ( 1949 का 66 ) की धारा 18 की उपधारा ( 2 ) के खंड ( ख ) के साथ पठित उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, विशेष सेवा ब्यूरो में सहायक कमांडेंट समूह ' क ' ( साधारण ड्यूटी ) पदों के लिए पद पर भर्ती की पद्धति को विनियमित करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्: -

1. संक्षिप्त नाम और प्रारम्भ:-( 1 ) इन नियमों का संक्षिप्त नाम विशेष सेवा ब्यूरो सहायक कमांडेंट समूह ' क' ( साधाराण ड्यूटी ) 'पद भर्ती नियम , 2003 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. लागूहोना:- इन नियमों से उपाबद्ध सूची के स्तंभ 1 में विनिर्दिष्ट पद को लागू होंगे ।

3. परिभाषाएं:-इन नियमों में जब तक कि संदर्भ से अन्यथा अपेक्षित न हो:-

(क) " सरकार " से भारत सरकार अभिप्रेत है ;

(ख) " श्रेणी " से काडर की श्रेणी अभिप्रेत है;

(ग ) " अनुसूचित जाति " और " अनुसूचित जनजाति " का वही अर्थ है जो संविधान के अनुच्छेद 366 के खंड ( 24 )और (25) में क्रमशः उनके हैं ;

(घ) उन शब्दोंऔर पदों के, जो इसमें प्रयुक्त हैं और परिभाषित नहीं है किन्तु विद्यमान रिजर्व पुलिस बल अधिनियम, 1949 (1949का 66 ) में परिभाषित किए गए हैं वही अर्थ होंगे जो उक्त अधिनियम के अधीन उनके हैं । 4. संख्या, वर्गीकरण और वेतनमान: उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतनमान वे होंगे जो इससे उपाबद्ध अनुसूची केस्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं ।

5. भर्ती की पद्धति, आयु सीमा, अर्हता आदि-उक्त पद पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होगी जो पूर्वोक्त अनुसूची के स्तंभ 5 से 14 में विनिर्दिष्ट हैं ।

6. आरंभिक गठन:-( 1 ) नियमित आधार पर इन नियमों के प्रारंभ से ठीक पूर्व साधारण ड्‌यूटी अधिकारी कैडर में सहायक कमांडेंट का पद धारण करने वाले अधिकारी के विषय में यह समझा जाएगा कि वे इन नियमों के उपबंधों के अनुसार नियुक्त किए गए । (2) इन नियमों के प्रारंभ से ठीक पूर्व संबंधित श्रेणियों में उपनियम ( 1 ) में निर्दिष्ट अधिकारियों की नियमित निरंतर सेवा , सेवा में परिवीक्षा अवधि, प्रोन्नति के लिए अर्हक सेवा, पुष्टि और पेंशन की गणना के प्रयोजन के लिए संगणित की जाएगी ।

7. अनुरक्षण:-नियम 6 के उपबंधों के अधीन रहते हुए ऐसा प्रत्येक पद जो इन नियमों के प्रारंभ की तारीख को रिक्त रहता है और ऐसी प्रत्येक रिक्ति जो उसके पश्चात् उत्पन्न होती है इन नियमों से उपाबद्ध अनुसूची में यथा अंतर्विष्ट उपबंधों के अनुसार भरी जाएंगी । 8. ज्येष्ठता:-( 1 ) उच्यतर रैंक धारण करने वाले सभी अधिकारी, निम्नतर रैंक धारण करने वाले अधिकारियों से ज्येष्ठ होंगे । ( 2 ) किसी विशिष्ट रैंक में किसी पद पर नियुक्त अधिकारियों की ज्येष्ठता उस पद पर नियुक्ति के लिए चयन के क्रम के अनुसार अवधारित की जाएगी ।

(3) उपनियम ( 2 ) के उपबंधों के अधीन रहते हुए समान रैंक धारण करने वाले अधिकारियों की परस्पर ज्येष्ठता निम्नलिखित रूपं में होगी:-

(i ) एक ही दिन प्रोन्नति किए गए अधिकारियों की ज्येष्ठता उस क्रम में अवधारित की जाएगी जिसमें उस रैंक में प्रोन्नति के लिए उनका चयन किया गया है ।

(ii) सीधे भर्ती किए गए व्यक्तियों की परस्पर ज्येष्ठता भर्ती परीक्षण , आधारिक पाठ्यक्रम और आधारी वृत्तिक पाठ्यक्रम में उनके द्वारा अभिप्राप्त अंकों को 50 10:40 के अनुपात में एक साथ जोड़कर अवधारित की जाएगी ।

( iii ) खंड ( i ) और ( ii ) के उपबंधों के अधीन रहते हुए अस्थायी अधिकारियों की ज्येष्ठता उनके चयन के समय उनकी योग्यता के क्रम के आधार पर अवधारित की जाएगी और किसी पूर्वतर समूह ( बैच ) में चुने अधिकारी पश्चात्वर्ती समूह में चुने गए अधिकारियों सेज्येष्ठ होंगे । [PART II- SEC. 3 ( i ) ] THE GAZETTE OF INDIA : JUNE 28 , 2003 /ASADHA 7, 1925

(iv) खंड ( i ) ( ii ) और ( iii ) के उपबंधों के अधीन रहते हुए अधिकारियों की ज्येष्ठता उस रैंक में उनकी सतत् नियुक्ति की तारीख के अनुसार अवधारित की जाएगी ।

(v ) किसी विशिष्ट रैंक में पुनर्नियोजित अधिकरियों की ज्येष्ठता उस रैंक में उनके पुनर्नियोजन की तारीख से अवधारित की जाएगी । (vi ) कोई सेवारत सैनिक अधिकारी किसी विशिष्ट रैंक के भीतर अपने और अन्य सैनिक अधिकारियों के बीच और भारतीय पुलिस सेवा का सेवारत अधिकारी किसी विशिष्ट रैंक के भीतर अपने तथा भारतीय पुलिस सेवा के अन्य अधिकारियों के बीच अपनी ज्येष्ठता बनाए रखेगा ।

9. नियुक्ति:-ऐसे अधिकारियों पर ही, जिन्होंने इन नियमों से उपाबद्ध अनुसूची में यथा अंतर्विष्ट उनकी अर्हक पात्रता सेवा पूरी कर ली है, श्रेणी ( यों ) में नियुक्ति के लिए विचार किया जाएगा:

परंतु वे अधिकारी जो चिकित्सीय प्रवर्ग शेप 1 में हैं 55 वर्ष की आयु प्राप्त करंने तक प्रोन्नति, प्रतिनियुक्ति या पुनर्नियोजन के लिए नियुक्ति केलिए पात्र होंगे । 55 वर्ष से अधिक आयु के अधिकारी एस 1 एच 2 ए 2 पी 2 ई 3 से नीचे नहीं होंगे ।

स्पष्टीकरण:

संकेत अक्षर शेप निम्नलिखित का प्रतिनिधित्व करते हैं- एस-मनोवैज्ञानिक एच- श्रवण शक्ति ए- संलग्नक पी-शरीरिक क्षमता

ई- दृष्टि

प्रत्येक कारक के अधीन कार्य करने की क्षमता प्रत्येक संकेत अक्षर के सामने संख्यांक एक से पांच तक के द्वारा सूचित की जाएगी जो समय - समय पर महानिदेशक विशेष सेवा ब्यूरो द्वारा अधिकथित मार्गदर्शक सिद्धातों के अनुसार गिरती हुई कार्य करने की क्षमता को उपदर्शित करेगा ।

शेप-1 से " शेप " वर्गीकरण के अधीन कारकों में सं. 1 ( एक) द्वारा सूचित बल के किसी सदस्य का चिकित्सीय प्रवर्ग अभिप्रेत है;

शेप-2 से बल के किसी ऐसे सदस्य का चिकित्सीय प्रवर्ग अभिप्रेत है, जिसकी कार्य करने की क्षमता, " शेप " वर्गीकरण के अधीन किसी एक या विभिन्न कारकों में सं 1 ( एक ) और उससे ऊपर गिरते हुए द्योदित की गई है , किन्तु यह गिरना एस 1 एच 2 ए 2 पी 2 ई 3 से नीचे नहीं होना चाहिए;

शेप-3 से बल के किसी ऐसे सदस्य का चिकित्सीय प्रवर्ग अभिप्रेत है जिसकी कार्य करने की क्षमता " शेप " वर्गीकरण के अधीन किसी एक या विभिन्न कारकों में सं 1 ( एक ) और उससे ऊपर गिरते हुए धोदित की गई है, किन्तु यह गिरना एस 1 एच 3 ए 3 ( एल ) पी2 ई 3 से नीचे नहीं होना चाहिए ।

1 (2 ) अधिकारी जो युद्ध के दौरान या शत्रुओं, लड़ाकुओं, घुसपैठियों, सशस्त्र विद्रोहियों के विरुद्ध लड़ते समय या लड़ाकुओं या तोड़‌फोड़ करने वालों के किसी कार्य के कारण या युद्ध के दौरान गोलाबारी, सांयोगिक गोलाबारी के दौरान, सुरंग या अन्य विस्फोटक युक्तियों के विस्फोट के कारण और भारत में तथा विदेश में सक्रिय ड्यूटी पर दुर्घटनाओं के कारण आहत/ क्षतिग्रस्त हो जाते हैं और जिन्हें ऐसी क्षति के कारण निम्न चिकित्सीय प्रवर्ग ( स्थायी/अस्थायी ) के अधीन रखा जाता है, प्रोन्नति से इस शर्त के अधीन रहते हुए रोके नहीं जाएंगे कि वह अधिकारी " एस 1 एच 3 ए 3 ( एल ) पी 3 ई 3 " से नीचे नहीं है ।

10. दायित्व:-इन नियमों के अधीन पदों के किसी प्रवर्ग पर नियुक्त किसी व्यक्ति का, भारत में या विदेश में किसी भी स्थान पर सेवा करने का दायित्व होगा ।

11. सेवा की अन्यशर्तें:-केन्द्रीय रिजर्व पुलिस बल अधिनियम 1949 ( 1949 का 66 ) और उसके अधीन बनाए गए नियमों के उपबंध सेवा की उन शर्तों की बाबत जो इन नियमों में विनिर्दिष्ट रूप से उपबंधित नहीं की गई हैं इन नियमों के उपबंधों के अधीन नियुक्त व्यक्तियों को लागू होंगे । 12. निरर्हता:- वह व्यक्ति, -

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है विवाह किया है ; या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है, इन नियमों के अधीन नियुक्तिका पात्र नहींहोगा:

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधिके अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

13. अन्य देशीय की अपात्रता: ऐसा व्यक्ति जो भारत का नागरिक नहीं है , केन्द्रीय सरकार की लिखित सहमति से ही इन नियमों के अधीन नियुक्त या नियोजित किया जाएगा अन्यथा नहीं:

परंतु इन नियमों की कोई बात नेपाल , भूटान की प्रजा की इन नियमों के अधीन नियुक्ति, भर्ती या पुनः नियोजन को वर्जित नहीं करेगी । 14. अधिवर्षिता: सहायक कमांडेंट का पद धारण करने वाला अधिकारी उस मास की अंतिम तारीख के अपराह्न को सेवा से निवृत्त होगा जिसमें वह 57 वर्ष की आयु प्राप्त कर लेता है । 15. शिथिल करने की शक्ति-जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके , इन नियमों के किसी उपबंध को किसी वर्ग या श्रेणी के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 16. व्यावृत्ति:- इन नियमों की कोई बात, ऐसे आरक्षण, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

17. निर्वचन : - यदि इन नियमों के निर्वचन की बाबत कोई प्रश्न उठता है तो वह केन्द्रीय सरकार द्वारा विनिश्चित किया जाएगा । 18. शिथिल करना: - ऐसे अधिकारी जिन के लिए अनुसूची में विनिर्दिष्ट विशिष्ट रैंक का धारण अपेक्षित है और जो आज्ञापक कोर्स की अर्हता प्राप्त नहीं है इन नियमों के प्रारंभ की तारीख से दो वर्ष की अवधि के भीतर विशिष्ट रैंक के लिए विहित आज्ञापक कोर्स में अर्हक होना होगा। यह रियायत दो वर्ष की अवधि के पूर्ण हो जाने पर समाप्त समझी जाएगी ।

अभ्यर्थी को संघट्ट जानु या सपाट पैर वाला अंतस्फीत शिरावाला या दृष्टि त्रियक नहीं होना चाहिए और उनकी उच्च रंग दृष्टि होनी चाहिए । अभ्यर्थियों का इशहारा परीक्षण तथा एड्रिच- ग्रीन लेंटर्न परीक्षण द्वारा रंग दृष्टि के लिए परीक्षण किया जाएगा । उन्हें अच्छे मानसिक और शारीरिक स्वास्थ्यका होना चाहिए और उनमें कर्तव्यों के कुशल निर्वहन में रुकावट पैदा करने वाली कोई शारीरिक खराबी नहींहोनी चाहिए ।

वांछनीय:

एन.सी.सी. का ' बी' या ' सी ' प्रमाण पत्र का धारक होना चाहिए ।

(iii ) परीक्षा की योजना आदि ऐसी होगी जो सहायक कमांडेंट ( केन्द्रीय पुलिस ) बल परीक्षा के नियमों में समय- समय पर केन्द्रीय सरकार द्वारा उपबंधित की जाए । [ भाग II- खण्ड 3 (i ) ]

प्रोन्नति/प्रतिनियुक्ति/आमेलन द्वारा भर्ती की दशा में वे श्रेणियां जिनसे प्रोन्नति/ प्रतिनियुक्ति/आमेलन किया जाएगा

भर्ती की पद्धति : भर्ती सीधे होगी या प्रोन्नति द्वारा या प्रतिनियुक्ति/आमेलन द्वारा तथा विभिन्न पद्धतियों द्वारा भरे जाने वाले पदों की प्रतिशतता

प्रोन्नति द्वारा:

(i ) 50% जो सीधी भर्ती द्वारा संघ लोक सेवा आयोग द्वारा की जाएगी ।

(क) ऐसे निरीक्षक जिन्होंने श्रेणी में 3 वर्ष की नियमित सेवा की है ;

( ii ) 33 % प्रोन्नति द्वारा ।

(ख) उसने ज्येष्ठ निरीक्षक पाठ्यक्रम पूरा कर लिया है ;

(iii) 17% सीमित विभागीय प्रतियोगी परीक्षा द्वारा ।

(ग) उसे चिकित्सीय प्रवर्ग शेप -1 में का होना चाहिए;

(iv) सीमित विभागीय प्रतियोगिता परीक्षा में किसी कमी को प्रोन्नति द्वारा भरा जा सकेगा ।

(घ) अर्हक पात्रता सेवा के संबंध में शर्त ज्येष्ठ व्यक्तियों की दशा में शिथिल की गई समझी जाएगी यदि उनके कनिष्ठ व्यक्तियों ने विहित पात्रता शर्तें पूरी कर ली हैं और प्रोन्नति के लिए उन पर विचार किया जा रहा है ।

सीमित विभागीय प्रतियोगिता परीक्षा द्वारा:

4 वर्ष नियमित सेवा वाले उप- निरीक्षक ( जी.डी. ) और निरीक्षक ( जी.डी. ) दोनों सीमित विभागीय प्रतियोगिता परीक्षा में सम्मिलित होने के लिए पात्र होंगे । यदि उनके पास सीधी भर्ती के लिए यथा विहित शारीरिक और चिकित्सीय मानक और शैक्षिक अर्हता है ।

G.S.R. 242. In exercise of the powers conferred by Sub- section ( i ) read with clause (b) of Sub- section (2) of Section 18 of the Central Reserve Police Force Act, 1949 (66 of 1949) the Central Government hereby makes the following rules regulating the method of recruitment to the post of Assistant Commandant Group ' A' (General Duty) posts in the Special Service Bureau, namely :-

1. Short title and commencement :-( 1 ) These rules may be called the Special Service Bureau, Assistant CommandantGroup ' A' ( General Duty) post Recruitment Rules, 2003.

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Application :-These rules shall apply to the post specified in Column 1 of the Schedule annexed to these rules .

3. Definitions:-In these rules , unless the context otherwise requires ,

( a) "Government " means the Government of India ;

(b) "Grade" means the grade of the cadre.

(c) " Scheduled Castes " and " Scheduled Tribes" shall have the same meaning as assigned to them respectively inclauses (24) and (25 ) of article 366 of the Constitution ;

(d) words and expressions used herein and not defined but defined in the Central Reserve Police Force Act, 1949 (66 of 1949 ) shall have the same meaning as assigned to them under the said Act .

4. Number, classification and scale of pay :-The number of the said post, its classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed hereto .

5. Method of recruitment , age limit, qualifications, etc. :-The method of recruitment, age limit, qualifications and other matters relating to the said post shall be as specified in columns 5 to 14 of the Schedule aforesaid.

6. Initial constitution :-( 1 ) Officers holding the post of Assistant Commandant in the General Duty Officers cadre immediately before commencement of these rules on a regular basis shall be deemed to have been appointed in accordance with the provisions of these rules.

(2) The regular continuous service ofofficers referred in Sub -rule ( 1 ) in the respective grades immediately before the commencement of these rules shall count for the purposes of counting the probation period. qualifying service for promotion , confirmation and pension inthe service.

7. Maintenance :-Subject to the provisions of Rule 6, every post remains unfilled on the date of commencement ofthese rules and every vacancy that may arise thereafter shall be filled in accordance with the provisions as contained in the Schedule annexed to these rules .

8. Seniority :-( 1 ) All Officers holding a higher rank shall be senior to officers holding a lower rank .

(2) In a particular rank seniority of officers appointed to any post shall be determined in accordance with the order of selection for appointment to that post. ) A (3) Subject to the provisions of sub -rule (2 ) inter - se seniority amongst officers holding the same rank shall be as follows:-

(i ) Seniority of Officer promoted on the same day shall be determined in the order in which they are selected for promotion to that rank .

( ii) Inter - se seniority of direct recruits shall be determined by adding together the marks obtained by them in recruitment test, the Foundation course , and the Basic Professional Courses in the ratio of 50 : 10:40 .

( iii ) Seniority of temporary officers , subject to the provisions of clauses ( i ) and ( ii ) shall be determined on the basis of the order of merit at the time of their selection and officers selected in an earlier batch will be senior to officers selected in subsequent batches .

( iv) Seniority of officers , subject to the provisions of clauses ( i ) , ( ii ) and ( iii ) shall be determined according to the date of their continuous appointment in that rank.

(v) Seniority of re -employed officers in a particular rank shall be determined from the date of their re- employment in that rank .

(vi) A serving Army Officer shall maintain his seniority as between himself and other Army Officers within a particular rank and a serving officer of the Indian Police Service shall maintain his seniority as betweenhimself and other officer of the Indian Police Service within particular rank .

9. Appointment

( 1 ) Officers who have completed their qualifying eligibility service as contained in the schedule annexed to these rules , shall only be considered for appointment to the grade (s) .

Provided that those officers who are in the medical category SHAPE - I shall be eligible for appointment on promotion , deputation or re- employment till attaining the age of 55 years . Above 55 years of age officers shall not be below S1 H2 A2 P2 E3 .

The functional capacity under each factor will be denoted by numerals 1 to 5 against each code letter which will indicate declining functional efficiency as per guidelines laid down by the Director General , Special Service Bureau from time to time .

SHAPE-I Means medical category of a Member of Force denoted by number 1 ( one) in factors under " SHAPE " classification.

SHAPE-II Means medical category of a member of Force whose functional capacity is declined by denoting number 1 ( one ) and above in any one or in different factors under " SHAPE" classification but should not decline below S1 H2 A2 P2 E3 .

SHAPE- III Means medical category of a member of Force whose functional capacity is declined by denoting number 1 (one ) and above in any one or in different factors under " SHAPE " classification but should not decline below S1 H3 A3 (L) P3 E3 .

(2) The officers who are wounded/injured during war or while fighting against enemy ; militants ; intruders ; Armed Hostiles; Insurgents or due to act of Militants or Saboteurs or during field firing; accidental firing; explosion of mine or other explosive devices and due to accidents while on active duty in India and abroad 167562/03-2 1556

[PART II-SEC . 3 ( i ) ] and placed under low medical category ( Permanent/Temporary ) due to such injury shall not be debarred from promotion subject to condition that the officer is not below " S1 H3 A3 (L) P3 E3 " .

10. Liability :-

Any person appointed to any category of posts under these rules shall be liable to serve anywhere in India or abroad .

11. Other conditions of service :-

The provisions ofthe Central Reserve Police Force Act , 1949 (66 of 1949 ). and the rules made thereunder shall be applicable to the persons appointed under the provisions of these rules in respect of conditions of service not specifically provided for in these rules.

12. Disqualification : No person

(a) who has entered into or contracted a marriage with a person having a spouse living ; or

(b) who having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment under these rules:

Provided that the Central Govt . may if satisfied that such marriage is permissible under the personal law applicable to such person and the other grounds for so doing , exempt any person from the operation of this rule.

13. Ineligibility of aliens :-

No person who is not a citizen of India shall , except with the consent of the Central Government signified writing,be appointed or employed under these rules :

Provided that nothing contained in these rules, shall debar the appointment , enrolment or re - employment of a subject of Nepal or Bhutan under these rules.

14. Superannuation : ---

An officer holding post of Assistant Commandant shall retire from service on the afternoon of the last day of the month in which he attains the age of fifty seven years ":

Provided that an officer whose date ofbirth is the first of a month shall retire from service on the afternoon of the last day of the preceding month on attaining the age of sixty years or fifty seven years as the case maybe.

15. Power to relax :-

Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order , for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons .

16. Saving:-

Nothing in these rules shall , affect reservation , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , Scheduled Tribes , Other Backward Classes, Ex - servicemen and other special categories of persons in accordance with the order issued by the Central Government from time to time inthis regard.

17. Interpretation : --

If any question relating to the interpretation of these rules arises, it shall be decided by the Central Government .

18. Relaxation : -

Officers required to hold the particular rank specified in the Schedule who have not qualified mandatory courses , shall qualify the mandatory courses prescribed for a particular rank within a period of two years from the date of commencement of these rules . The relaxation shall be deemed as ceased on completion of two years' period .

The candidates must not have knock knee , flat foot , varicose veins or squint in the eyes and they should possess high colour vision . The candidates will be tested for colour vision by Ishahara's Test as well as Edrich-Green Lantern Test. They must be in good mental and bodily health and free from any Physical defect likely to interfere with the efficient performance of the duties .

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम फार्म मशीनरी प्रशिक्षण और परीक्षण संस्थान ( कृषि और सहकारिता विभाग ) सहायक निदेशक ( हिन्दी ) और सहायक पुस्तकालय सूचना अधिकारी समूह " ख " ( राजपत्रित ) भर्ती नियम , 2003 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. लागू होना.-ये नियम , इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 1 ) में विनिर्दिष्ट पदों को लागू होंगे ।

3. पद- संख्या , वर्गीकरण और वेतनमान. उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतनमान वे होंगे, जो उक्त अनुसूची के स्तंभ ( 2 ) से स्तंभ (4 ) में विनिर्दिष्ट हैं ।

4. भर्ती की पद्धति , आयु-सीमा और अन्य अर्हताएं आदि. उक्त पदों पर भर्ती की पद्धति, आयु- सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तम्भ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

5. निरर्हता.- वह व्यक्ति, -

(i ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

( ii ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पदों पर नियुक्ति का पात्र नहीं होगा :

परन्तुयदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधिके अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

7. व्यावृति.-इन नियमों की कोई बात, ऐसे आरक्षणों , आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

टिप्पणः जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो, वहां उनके ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जब कि उनके द्वारा की गई ऐसी अर्हक/पात्रता सेवा, अपेक्षित अर्हक/पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित उनकी उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली है , ऐसी अर्हक/ पात्रता सेवा पहले ही पूरी कर ली है ।

(iii ) किसी पुस्तकालय में दो वर्ष का वृतिक अनुभव या पुस्तकालय क्रिया कलापके कंप्यूटरीकरण का दो वर्ष का अनुभव या किसी मान्यताप्राप्त विश्वविद्यालय या समतुल्य से कंप्यूटर अनुप्रयोग में स्नातकोत्तर डिप्लोमा ।

In exercise of the powers conferred by the proviso to Article 309 of the Constitution, and in supersession FarmMachinery Training and Testing Institute (Department of Agriculture and Cooperation ) Group ' A' and ' B ' (Gazetted) posts Recruitment Rules , 1990 in so far as they relate to the post of Assistant Director (Hindi ) and Assistant Library Information Officer, except as respect things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the Group ' B ' (Gazetted) posts for the Farm Machinery Training and Testing Institute under the Ministry ofAgriculture (Department ofAgriculture and Cooperation ) namely :-

1. (1 ) Short title and commencement :--( 1 ) These rules may be called the Farm Machinery Training and Testing Institute (Department of Agriculture and Cooperation), Assistant Director (Hindi ) and Assistant Library Information Officer, Group ' B ' (Gazetted) Recruitment Rules , 2003.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application :- These rules shall apply to the posts specified in column 1 of the Schedule annexed to these rules.

3. Number of posts , classification and scale of pay : The number ofthe said posts, their classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the said Schedule annexed hereto.

4. Method of recruitment , age limit and other qualifications , etc. The method of recruitment to the said posts , age limit , qualifications and other matters relating thereto shall be as specified in columns 5 to 14 ofthe aforesaid schedule .

5. Disqualification- No person:-

Who has entered into or contracted a marriage , with a person having a spouse living, or

(ii) Who, having a spouse living , has entered into or contracted a marriage with any person, shall be eligible for appointment to the said posts :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation ofthis rule.

6. Power to relax :- Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission , relax any of the provisions of these rules with respect to any class or category of persons .

7. Saving :- Nothing in these rules shall effect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , the Ex - Servicemen and other special categories of persons, in accordance with the orders issued by the Central Government from time to time in this regard.

सा.का.नि. 245. - राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और फार्म मशीनरी प्रशिक्षण और परीक्षण संस्थान ( कृषि एवं सहकारिता विभाग ) समूह ' क ' और समूह ' ख ' ( राजपत्रित ) पद भर्ती नियम 1990, को जहां तक वे सहायक अभियन्ता ( इन्स्ट्रमेन्टेशन ) के पद से संबंधित है, उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने से लोप किया गया है, कृषि मंत्रालय ( कृषि और सहकारिता विभाग ) के अधीन फार्म मशीनरी प्रशिक्षण और परीक्षण संस्थान में समूह ' ख ' ( राजपत्रित ) पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ:-( 1 ) इन नियमों का नाम केन्द्रीय फार्म मशीनरी प्रशिक्षण और परीक्षण संस्थान, ( कृषि और सहकारिता विभाग ) , समूह ' ख ' ( राजपत्रित ) पद भर्ती नियम , 2003 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2.लागूहोना:-ये नियम इन नियमों के साथ संलग्न अनुसूची के स्तम्भ 1 में निर्दिष्ट पदों पर लागू होंगे ।

3. पदों की संख्या, वर्गीकरण और वेतनमान:-उक्त पदों की संख्या, उनका वर्गीकरण और उनका वेतनमान वह होगा, जो उक्त अनुसूची के स्तम्भ 2 से 4 में विनिर्दिष्ट हैं ।

4. भर्ती की पद्धति, आयु- सीमा और अन्य अर्हताएं आदि- उक्त पदों पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उनसे संबंधित अन्य बाते वे होंगी , जो पूर्वोक्त अनुसूची के स्तम्भ 5 से स्तम्भ 14 में विनिर्दिष्ट है ।

5. निरर्हता : वह व्यक्ति:

( 1 ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

(2 ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा ।

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. शिथिल करने की शक्ति:- जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

(ii) मूल काडर/विभाग में 5500-175-9000 रु. के अथवा समतुल्य वेतनमान में नियमित आधार पर नियुक्ति के पश्चात् उस श्रेणी में तीन वर्ष नियमित सेवा कर चुके हों; या

( iii ) मूल काडर/विभाग में 4500-7000 रु. के अथवा समतुल्य वेतनमान में नियमित आधार पर नियुक्तिके पश्चात् उस श्रेणी में आठ वर्ष नियमित सेवा कर चुके हों ; और

(ख ) स्तंभ 8 के अधीन सीधे भर्ती किए जाने वाले व्यक्तियों के लिए विहित शैक्षिक अर्हताएं और अनुभव रखते हों ।

2. ऐसे विभागीय ज्येष्ठ तकनीकी सहायक ( यंत्रीकरण ) जो अपनी श्रेणी में तीन वर्ष नियमित सेवा कर चुका हो पर भी विचार किया जाएगा और यदि उक्त पद पर नियुक्ति के लिए उसका चयन हो जाता है तो वह प्रोन्नति द्वारा भरा गया समझा जाएगा ।

(पोषक प्रवर्ग के ऐसे विभागीय अधिकारी, जो प्रोन्नति की सीधी पंक्ति में है, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे। )

In exercise of the powers conferred by the proviso to Article 309 of the Constitution and in super- session Farm Machinery Training and Testing Institute (Department of Agriculture and Cooperation) group ' A' and ' B' (Gazetted) posts Recruitment Rules, 1990 in so far as they relate to the post ofAssistant Engineer ( Instrumentation) , except as respect things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the group ' B ' ( Gazetted ) post for the Farm Machinery Training and Testing Institute under the Ministry of Agriculture (Department of Agriculture and Cooperation) namely:-

1. ( 1 ) Short title and commencement- These rules may be called the Farm Machinery Training and Testing Institute , (Departinent of Agriculture and Cooperation ) , Assistant Engineer (Instrumentation ) , Group ' B ' (Gazetted) Recruit- ment Rules, 2003 भाग II-खण्ड 3 (i) ]

(2 ) my shall come into force on the date of their publication in the official Gazette.

2. Application: --- These rules shall apply to the posts specified in column 1 of the Schedule annexed to these rules.

3. Number of posts , classification and scale of pay : --- The number of the said posts , their classification and the scale ofpay attached thereto shall be as specified in columns 2 to 4 of the said Schedule annexed hereto.

4. Method of recruitment , age limit and other qualifications, etc.':- The method of recruitment to the said posts , age limit, qualifications and other matters relating thereto shall be as specified in columns 5 to 14 of the aforesaid schedule .

5. Disqualification No person :---

(i) Who has entered into or contracted a marriage , with a person having a spouse living; or

(ii ) Who, having a spouse living , has entered into or contracted a marriage with any person , shall be eligible for appointment to the said posts:

6. Power of relax :- Where the Central Government is of the opinion that it is necessary or expedient so to do, it may. by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons .

7. Saving: Nothing in these rules shall effect reservations relaxation of age limit and other concessions required to beprovided for the Scheduled Castes, the Scheduled Tribes , the Ex - Servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard .

(b) Possessing the educational qualifications and experience prescribed for direct recruits under column 8 .

2. The Departmental Senior Technical Assistant ( Instrumen- tation) with three years ' regular service in the grade will also be considered and in case he is selected for appointment to the post, the same shall be deemed to have been filled in by promotion. The Departmental Officer in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly, deputationists shall not be eligible for consideration for appointment by promotion . ( Period of deputation including period ofdeputation in another ex-cadre post held immediately preceding this appointment in the same or some other organization/ department of the Central Govt . shall ordinarily, not to exceed three years . The maximum age limit for appointment by deputation shall be not exceeding fifty six years as on the closing date of receipt of applications) .

सा०का०नि० 246.-वायुयान ( संशोधन ) नियमावली 2002 का प्रारूप वायुयान नियम 1934 ( 1934 का 22 ) की धारा 14 की अपेक्षानुसार भारत के राजपत्र के भाग II खंड 3 , उपखंड ( i ) दिनांक 18 जनवरी 2003 में भारत सरकार के नागर विमानन मंत्रालय के दिनांक 8 जनवरी 2003 की साप्कानि० 32 के साथ प्रकाशित किया गया था जिसमें उन सभी व्यक्तियों से जिनके उससे प्रभावित होने की संभावना थी, आपत्तियां और सुझाव मांगे गएथे ;

और उक्त प्रारूप नियमों के संबंध में कोई आपत्ति और सुझाव प्राप्त नहीं हुए हैं ;

अतः अब, केन्द्रीय सरकार, उक्त अधिनियम की धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए वायुयान नियमावली 1937 में और आगे संशोधन के लिए निम्नलिखित नियम बनाती है , अर्थात्:-

1. ( 1 ) इन नियमों का संक्षिप्त नाम वायुयान ( दूसरा संशोधन ) नियम, 2003 है ।

2. वायुयान नियम, 1937 की अनुसूची 2 में, अनुभाग ड में

(i ) पैरा 1 के खंड (च ) में, उपखंड ( ii ) के स्थान पर निम्नलिखित उपखंड रखा जाएगा ; अर्थात्: -

" उसके पास बहु- इंजन वायुयान पर चालू उपकरण रेटिंग होगी";

(ii) पैरा 3 में, खंड ( घ ) के स्थान पर निम्नलिखित खंड रखा जाएगा, अर्थात्: -- " जिसके पास किसी बहु- इंजन वायुयान पर चालू उपकरण रेटिंग है । "

Whereas the draft of the Aircraft (Amendment) Rules , 2002 was published as required by Section 14 oftheAircraft Act , 1934 (22 of 1934) in the Gazette of India, Part II , Section 3 , Sub - section ( i ) dated the 18th January, 2003 with the notification of the Government of India in the Ministry of Civil Aviation GSR 32 dated the 8th January, 2003 inviting objections and suggestions from all persons likely to be affected thereby ;

And WHEREAS no objections or suggestions have been received on the said draft rules;

Now, THEREFORE , in exercise of the powers conferred by Section 5 of the said Act, the Central Government hereby makes the following rules further to amend the Aircraft Rules , 1937 , namely : -

1. ( 1) These rules may be called the Aircraft (2nd Amendment ) Rules, 2003.

(2) They shall come into force on the date of their final publication in the Official Gazette.

2. In the Aircraft Rules, 1937, in Scheduled II , in Section M,-

(i) in paragraph 1 , clause (f) , for sub-clause (ii ), the following sub -clause shall be substituted, namely :-- "He shall have a current Instrument Rating on multi -engine aircraf.";

(ii) in paragraph 3 , for clause (d), the following clause shall be substituted, namely:--

"having a current Instrument Rating on a multi -engine aircraft . "
